Apartment buyers in New South Wales are set to gain a decade of insurance-backed protection against major building defects, after the NSW Parliament passed the Fair Trading and Building Legislation Amendment Bill 2026.&nbsp;

The Bill establishes decennial defect insurance, known in the market as Latent Defects Insurance (LDI), as an alternative to the existing two-year strata building bond. It cleared the Legislative Council with amendments on Tuesday evening (August 4, 2026), with the Legislative Assembly agreeing to those amendments shortly after.

Under the reform, eligible developers can satisfy their statutory bond obligation by taking out an approved decennial-style policy that gives owners 10 years of cover for major structural defects from completion, claimable directly, without first having to pursue developers or builders through costly legal action.&nbsp;

The change forms the final tranche of amendments arising from the 2021 statutory review of the Strata Schemes Management Act 2015 and related legislation.

Resilience Insurance, which originated the cover in Australia and has delivered it in NSW since 2022, welcomed the passage and credited the NSW Government for delivering it.

“This is protection apartment buyers have needed for a long time, and the credit for delivering it belongs to the NSW Government,”&nbsp;said Corey Nugent, CEO of Resilience Insurance.

“Minister Chanthivong and his team have shown real leadership in replacing an outdated two-year bond with cover that matches the lifespan of the buildings people are buying into. Reform like this is what good, evidence-based regulation looks like.”

Resilience has delivered LDI in NSW since 2022, protecting thousands of apartments, giving the State, and now the country, real-world evidence of how decade-long, no-fault protection works in practice.

The reform also places NSW within a wider national shift.

NSW is the third jurisdiction to put decennial cover into law. The ACT legislated for it in 2024, with the scheme taking effect in late 2025, and Victoria passed its own framework on 17 June. Between them, the three cover the majority of Australia's apartment market.

The reform commences once the legislation is proclaimed, which is expected in the coming weeks. From that point, developers of Class 2 residential apartment buildings can meet their statutory obligation with an approved decennial policy in place of the bond.

Buyers who purchased into projects that took out the cover early are among the first in the country to take keys to apartments carrying decade-long structural protection.

“With the legislation passed, the focus now turns to making it work for buyers,”&nbsp;Nugent said.

“There are already thousands of apartments in NSW covered by this insurance, bought by developers who moved early. The question every buyer should be asking in a display suite is a simple one: does this building come with 10-year defect cover, and who stands behind it?&nbsp;

“We look forward to working with the Government and the Building Commission in coming weeks as the framework moves to implementation, and to sharing what we have learned over the past four years so the protection reaches owners as smoothly and quickly as possible.”

Other states are working through their own reform programs. Western Australia has indicated that decennial cover is within consideration a later stage of its reform sequence, and Queensland has been examining the settings as it looks at the development pipeline ahead of the 2032 Olympics.

Resilience Insurance acknowledges the NSW Government’s continued focus on strengthening consumer protection while supporting housing delivery across the State.

NSW parliament passes 10-year defect insurance laws for new apartment buyers

Builder-developer <a href="https://www.apartments.com.au/developers/mcnab-developments">McNab</a> has wasted little time reshaping one of South Brisbane's most significant undeveloped apartment sites after acquiring the property earlier this year.&nbsp;

McNab has lodged plans to scrap an existing approval for two 30-storey towers and instead deliver a single 28-storey residential building, preserving part of the site for a future development opportunity.

The proposal, lodged over <a href="https://www.apartments.com.au/new-apartments/64-peel-street-south-brisbane-qld-4101">64 Peel Street and 9 Cordelia Street</a>, is for a residential-led mixed-use development comprising 124 apartments above a landscaped podium, alongside a boundary realignment that preserves part of the land for a future residential project.

Designed by <a href="https://www.apartments.com.au/architects/hayball">Hayball</a>, the development will deliver 119 two-bedroom and five three-bedroom apartments across 23 residential levels. A five-level podium will accommodate 135 car spaces, while the ground floor will include a 66 sqm commercial tenancy, an activated residential lobby with work-from-home spaces, and a publicly accessible landscaped plaza linking Cordelia and Peel streets.&nbsp;

Communal amenities will span Level 6 and the rooftop, including indoor and outdoor recreation spaces, a swimming pool, barbecue facilities, kitchen and dining areas, lawn space, sauna, steam room and yoga facilities.

The application also proposes a boundary realignment to create a standalone 1,290 sqm development lot while retaining an adjacent parcel for future redevelopment, allowing the balance of the site to contribute additional housing over time.

Hayball said the architecture has been shaped by the site's elevated corner position at the intersection of Peel and Cordelia streets and Brisbane's subtropical climate.

The design incorporates generous landscaped setbacks, a masonry podium wrapped with planting, large north-facing balconies, and a slender tower profile intended to maximise natural light, cross ventilation and long-range views. The rooftop has been conceived as a wellness-focused retreat overlooking Brisbane, with amenities positioned to capture views towards Mount Coot-tha and the CBD.

The planning submission positions the proposal as a response to both changing market conditions and Brisbane's Kurilpa Sustainable Growth Precinct planning reforms.

McNab acquired the site after the previous approval was granted, with the existing scheme no longer reflecting current residential market demands, economic conditions, construction challenges, construction efficiencies or the quality of development outcome now being pursued, the planning report noted.

McNab continues to expand its residential development pipeline across Brisbane and the Gold Coast. The developer recently launched The Tannery in West End, securing more than 60 per cent of apartments before the project's public release. It is also delivering Elements Budds Beach in Surfers Paradise and Lucia Highgate Hill, an eight-apartment boutique development overlooking the Brisbane River.

A steeply sloping Bellevue Hill site is set to accommodate a new mid-rise apartment development, with plans lodged for 20 homes that respond to the site's dramatic topography.

The proposal for the consolidated land at <a href="https://www.apartments.com.au/new-apartments/138a-140-bellevue-road-bellevue-hill-nsw-2023">138A-140 Bellevue Road</a> has been designed by Sydney architecture practice Common Office, which has used the site’s substantial fall to distribute the building’s scale and unlock 20 apartments without presenting the full height to the street.&nbsp;

“The unique design strategy leverages the site’s substantial topographical fall to facilitate increased density, presenting a seven-storey profile to Bellevue Road while rising to 10 storeys at the rear,” Common Office said in its architectural design report.

The apartment mix spans one, two, three- and four-bedroom residences. Four two-bedroom apartments are designated as affordable housing, while the plans also include two adaptable dwellings. The mix is majority three-beds, with the typical three-bed apartment offering around 144 sqm internally, with balconies of around 15 sqm.

The affordable housing component represents 15 per cent of the residential floor area and allows the project to access additional height and floor space under the NSW Government’s in-fill affordable housing provisions. The site also falls within the inner area of the Low and Mid-Rise Housing Policy because it is within 400 metres walking distance of Double Bay Town Centre.

Common Office has arranged the building around a masonry podium and a lighter upper volume, drawing on two recurring elements of Bellevue Hill’s established architecture: sandstone bases and the vertical proportions of local Inter-war Art Deco apartment buildings.

“The proposal is governed by a holistic design language that reconciles the solid horizontal masonry of the neighbourhood’s podiums with the elegant verticality of its Art Deco heritage,” the architect said.

“The building maintains a consistent rhythmic logic utilising deep recesses and a sophisticated material transition to break down the 10-storey scale into a series of articulated, human-scale volumes.”

Large-format sandstone tiles will define the lower levels, establishing a robust base that negotiates the change in elevation from Bellevue Road. Above, red-tinted precast concrete frames, recessed balconies, anodised aluminium screens and expanded metal details will create a more vertically expressed façade. Integrated planter beds will introduce greenery across balcony edges and recessed sections of the building.

The elongated northern façade has been divided into three recessed vertical masses to reduce its perceived length. Triangular window elements and metal privacy screens reference the geometry of nearby Art Deco buildings while controlling overlooking toward surrounding homes. The southern elevation will incorporate further privacy screening, landscaped edges and deep balconies to maintain light and ventilation.

Private and communal landscaping is distributed throughout the development. A landscaped garden apartment is positioned within the lower portion of the site, while a communal terrace on Level 5 will include a central timber deck, barbecue facilities, resident planting plots and areas for outdoor dining and informal gatherings.

Common Office described the terrace as an elevated sanctuary designed to capture district views and sunlight. Its planting strategy incorporates endemic species associated with the Eastern Suburbs Banksia Scrub, extending the landscape vertically through the building and providing habitat for local flora and fauna.

A second communal outdoor area is proposed at roof level, with built-in seating, paved gathering areas and perimeter planting.

The podium has also been designed as an architectural feature rather than a conventional parking structure, with cascading planting, screening and natural-toned materials softening its appearance. Resident parking is elevated above ground level to address the site's flood constraints, while habitable apartments sit above flood planning levels. Upper-level communal facilities are designed to accommodate shelter-in-place arrangements during major flood events.

The site sits within one of Brisbane's fastest-changing inner-city precincts, less than two kilometres from the CBD and within easy reach of South Bank, West End, the Queensland Cultural Centre and extensive public transport connections. The Kurilpa Sustainable Growth Precinct planning framework is encouraging higher-density residential development to help meet Brisbane's housing supply targets while supporting walkable, transit-oriented neighbourhoods.

1800 Removals, and Super Vape Store, have snapped up two separate leases in the Brisbane suburb of Hemmant, at 9/227 Fleming Road, and 10/227 Fleming Road respectively.
With a total building area of 1,128 square metres, shed nine came with a 1,044 square metres warehouse and 84 square metres of office space.

Both properties were leased by Ray White Commercial TradeCoast’s Jared Doyle and Jack Gwyn. 
Mr Doyle said he was pleased to deliver two excellent results for the owners following an agent function, given they had not originally been appointed for the site. 
“We weren’t the banner marketing agents for this site but decided to go along to an agent function held on site a few months ago,” Mr Doyle said. 
“Here, we received information about the site and have since introduced quality tenants sealing these two deals, to the delight of both lessors and lessees. 
Mr Gwyn said 1800 Removals had been struggling to find the right property and thought they had until circumstances quickly changed.

The asset, Unit 12/15 Rawlins Circuit, came with a 454 square metre building area. 
It was leased to a high-profile tenant who occupied a majority of the development, with a significant infrastructure investment to come. 
The property was marketed and sold by Ray White Commercial Noosa and Sunshine Coast North Property Consultants Matt Marenko and Louisa Blennerhassett. 
Mr Marenko said the team received five offers on the property and it sold within five days of hitting the market. 
“The tenant was Unique Health Products who had occupied the property since 2012 and have a very successful business distributing products in the health food sector,” he said. 
“The investment market continues to strengthen thanks to interest rates remaining at an all-time low.”
Mr Marenko said investors were pulling their money out of the banks and buying property to take advantage of the stronger yields 
“We have four buyers from this property who missed out, and a long list ready, but we need more properties to sell,” he said. 
It is 7.5 km, or 10 minutes by car, from the Sunshine Coast’s CBD.

Sunshine Coast Kunda Park commercial property sells for almost $1 million

Real estate consumers would be better informed if media could let go of its obsession with median price movements and auction outcomes in the two biggest cities as the barometer of all things real estate.
The state of the nation, in terms of housing markets, is too often seen through the prism of the property price indexes and clearance rates for Sydney and Melbourne.
Not only does this ignore the different scenarios occurring in other important markets, but it tells us very little that’s useful.
Investors essentially want to know where prices are going to move before they move. A report telling consumers how much prices moved in the recent past simply tells consumers where they should  have bought a year ago.
Equally a report that Sydney’s clearance rate is regularly topping 70% doesn’t tell us where in Sydney people should be buying and it’s useless information if you’re interested in some other part of the country.
There are much more useful barometers that actually provide clues about where prices might rise before they do so. Sales volumes often provide evidence about where prices are likely to move, up or down, and that’s why I put so much time and effort into publishing my Price Predictor Index every quarter.
Trends in the rental market are also a useful indicator of what might happen with prices. There’s ample research that shows that rents often rise for a period before prices start to react. And rents rise because vacancies are low. We saw that scenario play out in Sydney (before the recent correction) and also in Hobart where prices remain strong, with vacancies the lowest in capital city Australia.
I note that Simon Pressley of Propertyology, a researcher whose work deserves respect and attention, has recently reported on the importance of vacancy rates as an indicator of future price trends. I certainly agree with Pressley that low vacancies and strong rentals can be a precursor to a period of price growth.
With that in mind, I’m always interested in precincts where vacancies are super tight, particularly when those places have other solid credentials.
And you have look beyond the generalised figures published in mainstream media. Sydney might have a vacancy rate around 3.5%, but there are local precincts with tight rental markets. Postcode 2168 in the Liverpool LGA has a vacancy rate of just 1.8% and includes a range of suburbs where affordable (by Sydney standards) suburbs are attracting first-home buyers and others. 
Melbourne, where markets are on the boil again, has many local precincts where rental markets are very tight. In the Moreland LGA, most postcodes have vacancy rates well under 2%. The Brunswick West postcode is currently 1.2%, according to SQM Research, while the postcode covering Coburg and Coburg North is 1.3%.
These are real estate locations with good bones and it’s worth noting that during the recent period when Melbourne prices generally were falling, many of the apartment markets throughout the Moreland LGA continued to achieve growth in their median prices – and the tight rental market has kept yields in the 4% to 4.5% range, which is above average for Melbourne.
Rental markets are even tighter in nearby Darebin – most postcodes have vacancy rates below 1.5%. The Northcote postcode is 1% and the Thornbury postcode is 0.9%. In Preston, the vacancy rate is 1.3%, the median price for apartments has risen in the past year, and the median rental yield is 4.6%.
As Melbourne generally recovers from the post-boom correction, locations like these are going to be strong performers.
One reason that Ballarat has been delivering such strong price growth in recent years is the strength of its rental market. Vacancies have been under 3% for the past five years and currently average around 1.5%. Many suburbs have had double-digit growth in their median house prices in the past 12 months.
The revival of many regional Queensland markets has been heralded by big improvements in their rental markets. Mackay provides a striking example. When the resources investment boom evaporated, vacancies rose in Mackay and prices inevitably fell. But now vacancies are around 1.5%, rental yields of 5.5%, 6% and higher are available, and prices are now responding.
There are numerous examples across the nation – but you’re not going to find out about them by reading our metropolitan newspapers.

Investors in North Sydney remain predominately offshore, with cross-border purchasers accounting for more than two thirds of total investments this year to date, according to the latest report from CI Australia on the North Sydney market.
They found that of the $1.53B invested into commercial assets in the North Sydney CBD last year, Canadian funds represented the largest portion of investment by dollar volume, followed closely by investors in Hong Kong and Singapore.
An influx of coworking spaces can be observed in North Sydney over the last few months, with the expansion of companies such as WeWork &amp; Regus, an additional 7,000 sqm has entered the market, bringing the total up to 23,700 sqm.
The introduction of coworking would likely have the largest impact on the smaller end of the market, with vacancy of secondary suites already rising over the last few months. In the long run, these spaces may even assist in fostering healthy competition, leading to increased flexibility and shorter terms for tech tenants.
CI said, "boosted by the low-interest rate environment, prime yields on commercial real estate in North Sydney are currently at an all time low."
"Recent transactions have seen fully-leased yields in the low 4% range - levels on par with those observed in the Sydney CBD."
"Following substantial growth in rents over the last 3 year, rental levels are now tending towards stability and will continue to increase with the rates applicable to annual review," they noted

North Sydney office market yields are at all time lows: CI Australia

Quincy, the designer shoe store in Woollahra, is leaving its Woollahra Queen Street premises after nearly a decade.
They've been located at <a href="https://www.propertyobserver.com.au/%20https:/www.realcommercial.com.au/for-lease/property-76-queen-street-woollahra-nsw-2025-503386746" target="_blank">76 Queen Street</a> since 2010.
At the time, Quincy owner Kate McDiven told the Sydney Morning Herald that the street appealed because of its beauty and friendliness.

Quincy to vacate Woollahra's Queen Street after a decade

Investment giant Moelis have entered in to an exclusivity agreement to buy The Beach Hotel in Byron Bay.
They're set to pay just over $100 million.
Moelis Australia, headed by the Sydney Swans chairman Andrew Pridham, will establish a single asset fund following the agreement, with investors to be given the opportunity to invest in the business.
If the transaction proceeds, the Beach Hotel will be managed by Moelis Australia Hotel Management, with the intention to retain the majority of the existing management operations and venue staff.
Moelis Australia Hotel Management CEO Dan Brady called The Beach Hotel Byron Bay an "iconic Australian establishment located on irreplaceable real estate."
"The acquisition of both freehold and operating interests will enable the required capital investment to further enhance what has made the hotel iconic - that is, a great community gathering place with a fun, sociable, friendly and safe hospitality offering delivered by an engage and passionate team of local hospitality professionals," Brady said.
Moelis already own several hotels, but The Beach Hotel Byron Bay will be operated separately. 
Moelis manages ASX listed Redcape Hotel Group and a single asset fund which owns the Grand Hotel in Rockdale.
It was just the second time The ‘Beachie’, as it is often referred to, was offered to the market since it was built in the 1990s by long-time local John 'Strop' Cornell.

The business was sold by the Melbourne-based Impact Investment Group, a joint venture between the Liberman and van Haandel families.
The oceanside pub was sold by Impact Investment Group, which owned the freehold, and Melbourne restaurateurs and hospitality figures John and Lisa van Haandel, who owned the business side.
Melbourne restauranteurs and hospitality figures John and Lisa van Haandel have operated the property since 2007. 
It was offloaded by Cornell for $44 million. It last traded for $68.2 million just last year.
Located with over 100 metres frontage overlooking Byron’s Main Beach, the hotel spans a 4,585 sqm area and includes 25 newly-appointed luxury boutique hotel rooms and swimming pool.
It also features a large pub with extensive beer gardens, restaurant, function spaces and bottle shop.
JLL’s national director John Musca, boutique accommodation specialist Tom Gibson secured the sale and JLL's Queensland Vice-President Tom Gleeson secured the sale.

Moelis buys Byron Bay's The Beach Hotel for just over $100 million

Equinix, a global interconnection and data centre company, has announced the opening of its eighth International Business Exchange data centre in Sydney. The complex will be named SY5. 
With an initial investment of US$160 million (A$224 million), the South Sydney facility will be the largest to date for the company in Australia.

“Equinix is committed to continuously evolving our services to interconnect our customers at the digital edge, a critical part of digital transformation efforts of many enterprises, cloud providers and network providers,” said the President of Equinix Asia-Pacific, Jeremy Deutsch. 
A recent report commissioned by CSIRO’s Data61, the data and digital specialist data sciences arm of Australia’s national science agency, reveals digital transformation is forecast to be worth A$315 billion for the Australian economy throughout the next decade.

SY5 is the eighth data centre for Equinix in Sydney, and the sixteenth in Australia (with other sites in Melbourne, Perth, Canberra, Adelaide and Brisbane).
