High-profile apartment defect cases have changed the way many NSW buyers approach purchasing, putting greater scrutiny on building quality, strata records and the parties behind a development before a contract is signed.

The industry buyers are assessing today, however, is also different from the one in which cases such as Opal Tower and Mascot Towers emerged.

NSW has introduced a series of regulatory measures aimed at strengthening oversight of apartment construction, including Building Commission NSW, the Residential Apartment Buildings Act 2020 and the Strata Building Bond and Inspections Scheme. Under the latter, developers are required to lodge a bond, with independent inspections forming part of the process for identifying defects in new strata developments.

Those changes provide another layer of protection, but they haven't removed the importance of buyer due diligence.

For purchasers considering an apartment, that means looking beyond the residence itself. Building and strata history, strata reports, the track record of the builder and developer, the condition of common property and any known or planned expenditure by the owners corporation can all form part of assessing a building before purchase.

Whether the development is already complete can also materially change what can be assessed.

An off-the-plan purchaser is necessarily buying before the finished product exists. A completed apartment, by comparison, can be walked through before contracts are signed, allowing the purchaser to see the finishes, common areas and broader building as they have actually been delivered rather than relying solely on plans and renders.

It also removes exposure to some of the uncertainties that exist between an off-the-plan purchase and completion, including construction delays, cost pressures and builder insolvency during the delivery period.

<a href="https://www.apartments.com.au/project-marketer/equitifund-group">Projects by Equitifund</a> National Sales Director Ben Hamblett said that greater focus on tangible evidence is increasingly evident among apartment purchasers.

“The biggest shift we're seeing is buyers wanting proof, not promises,” Hamblett said.

“That's exactly why we deal in completed stock - you can inspect the building before you commit - and why we've backed every purchase with a cash bond against special levies.”

At <a href="https://www.apartments.com.au/buildings/the-lennox-parramatta-12-phillip-street-parramatta-nsw-2150">The Lennox</a> in Parramatta, that emphasis on a completed, inspectable product is already in place.

The 413-apartment, 46-level tower at 12 Phillip Street is being marketed by Projects by Equitifund, allowing prospective purchasers to inspect the residences, common areas and resident facilities before committing.

The Lennox also introduces another layer to the due-diligence conversation through Strata Surety.

The vendor-funded arrangement provides purchasers with a cash-backed bond held in their own solicitor's trust account from settlement. According to Equitifund, the bond covers any special levy raised during the applicable cover period and is provided at no cost to the purchaser.

Special levies can create an unexpected cost for apartment owners where an owners corporation needs funding beyond its existing strata contributions. Under NSW strata law, a special levy requires approval by owners at a general meeting.

Equitifund Executive Chairman Greg Huxley said Strata Surety was designed to provide something more concrete than reassurance about that potential exposure.

“Buyers have every right to ask hard questions about strata risk - the industry has given them plenty of reasons to,” Huxley said.

“Our answer isn't a reassurance, it's a bond. Strata Surety puts real money behind that confidence, held by the buyer's own solicitor, not by us.”

For The Lennox, its completed status also means purchasers can assess not only the apartment itself, but a building that has already been occupied and operating for several years.

Completed in 2021, the $300 million development, designed by <a href="https://www.apartments.com.au/architects/marchese-partners">Marchese Partners</a>, comprises one, two, three and four-bedroom apartments, with open-plan living areas extending to private balconies. The Lennox is also home to the Southern Hemisphere's first fully robotic residential car park, which has now operated for several years. The ability to investigate a building's history, review its strata position and, where possible, inspect what has actually been delivered remains central to making an informed apartment purchase.

The brief to <a href="https://www.apartments.com.au/architects/plus-studio">Plus Studio</a> was deliberately simple: "Don't design around the heritage. Design from it." It became the philosophy behind a project that draws inspiration not only from two landmark heritage buildings, but from Collins Street itself, a street layered with architectural history and civic significance.

That philosophy has shaped one of <a href="https://www.apartments.com.au/developments/melbourne-vic-3000">Melbourne</a> CBD's most considered residential projects, where the 1924 State Savings Bank and neighbouring Batman's Hill Hotel have become the architectural foundation for 623 Collins rather than remnants preserved beneath a new development.

Rather than approaching the site as a blank canvas, <a href="https://www.apartments.com.au/developers/sterling-global">Sterling Global</a> saw the existing buildings as the beginning of the story.

"Sites like this rarely become available," the developer said.

"623 Collins wasn't simply an opportunity to develop a prominent CBD site. It was an opportunity to restore and reimagine one of Melbourne's important heritage landmarks while contributing to the continued evolution of Collins Street. Instead of mimicking the ornate heritage architecture, Plus Studio studied the proportions, rhythm and craftsmanship of the original buildings before translating those characteristics into a contemporary 42-storey tower.

"The brief challenged us to create a contemporary landmark that respected Melbourne's architectural history without becoming nostalgic," Plus Studio said.

The practice says the State Savings Bank and Batman's Hill Hotel became the project's primary source of inspiration, allowing the heritage buildings and contemporary architecture to exist "in conversation rather than contrast." Generous planted terraces further soften the transition between old and new, creating elevated green spaces while reinforcing the dialogue between the restored podium and the contemporary tower.

That dialogue continues throughout the interiors, where Melbourne designer Fiona Lynch developed a material palette inspired by the idea of alchemy, balancing contrasting materials that reference both the Neo-Grec detailing of the original bank and contemporary urban living. The result is a series of spaces that feel timeless rather than trend-driven.

The project will deliver 316 residences across four collections, Heirloom, Signature, Reserve and the Penthouse Collection, with each responding differently to its position within the building, from the restored heritage podium through to the upper levels of the tower. The Heirloom Residences retain defining heritage elements including original heritage windows, generous proportions and high ceilings, while the tower introduces contemporary homes with expansive layouts and elevated views.

Amenities have likewise been designed to support long-term city living rather than short-stay convenience. “A new cobblestone laneway and landscaped connection between James Street and Gasworks unlock a missing pedestrian link, improving walkability and stitching together two of Brisbane’s significant urban destinations,” Bureau Proberts said in its Urban Design Report.

Architecturally, Bureau Proberts has conceived the building as a collection of vertically expressed, stepping forms rather than a single uniform tower. The composition rises from an articulated podium before being broken by a triple-height landscaped recreation level, with the upper section becoming more compact before terminating in a landscaped rooftop garden.

The project's name and architectural language draw directly from Newstead's industrial history. Patterned off-form concrete is proposed as the principal façade material, complemented by slender metal rod balustrades and extensive planting. The cylindrical and vertically ribbed elements give the building its silo-like expression, while curved balconies and planted edges introduce a softer subtropical layer.

“The Silo reinterprets its robust forms, scale and materiality through a contemporary subtropical architectural expression, creating a building that acknowledges its industrial legacy, while responding to the way the precinct is occupied today,” Bureau^Proberts said.

The recreation level is one of the defining breaks in the tower. Plans include a lap pool, mature subtropical planting and shared resident facilities within an elevated communal garden. Landscaping continues through the podium and onto the rooftop, where a further garden forms what the architects describe as a “subtropical crown” to the building.

Sydney’s property market is known for high prices, competitive bidding, and mounting pressure on first home buyers. But change is on the horizon.

From late 2025, eligible first home buyers in New South Wales will have access to a new federal government initiative aimed at addressing affordability: the Help to Buy Scheme.&nbsp;

<h2>What is the Help to Buy Scheme?</h2>

The program introduces a shared equity model intended to reduce the upfront cost of entering the property market, particularly in high-demand urban areas such as Sydney.

The scheme operates under a shared ownership structure in which the federal government takes an equity stake of up to 40 per cent for new homes, or 30 per cent for existing dwellings. This arrangement allows eligible buyers to significantly reduce their loan size and avoid the added cost of Lenders Mortgage Insurance (LMI).

Under this model, purchasers can enter the property market with as little as a two per cent deposit, well below the traditional 10 to 20 per cent usually required. The government’s contribution is not a loan but a co-ownership stake in the property. As such, there is no interest or rent charged on its portion.

Because the government’s equity combined with the buyer’s deposit typically meets or exceeds the 20 per cent threshold, LMI does not apply. The remaining balance, generally between 60 and 70 per cent of the property’s value, is financed through a standard home loan with a participating lender.

The government's equity in the property remains in place until the buyer chooses to repay it voluntarily or until the property is sold. Buyers can buy back the government’s share over time, in increments of at least five per cent, depending on their financial situation.

There is no fixed repayment timeline, but the amount to be repaid will be based on the property's market value at the time of repayment, not the original purchase price.

<h2>How do you qualify for the&nbsp;Help to Buy Scheme?</h2>

To qualify for the Help to Buy Scheme, applicants must meet the following conditions:

For most Australians, buying an apartment is one of the biggest financial decisions they'll ever make

The location, floorplan and price are often the first considerations, but in recent years another question has become increasingly important: who is actually delivering the project?

A series of high-profile builder collapses, construction delays and defect concerns have fundamentally changed how many Victorians approach buying off the plan. The collapse of Porter Davis in 2023, which reportedly left around 1,700 homes unfinished, became one of the most visible examples of the risks that can emerge when a construction company fails. <a href="https://www.equifax.com.au/sites/default/files/lpassets/pdf/Final-Business-Market-Pulse-June-Sector-Deep-Dive-Report-2.pdf">Similar challenges across the broader construction sector</a> have left buyers asking more questions before signing a contract.

As Victoria continues encouraging higher-density housing to address supply shortages, transparency is becoming just as important as location or price.

One tool increasingly entering the conversation is the <a href="https://icirt.com/">Independent Construction Industry Rating Tool (iCIRT)</a>, an independent assessment framework designed to help buyers better understand the developer or builder behind a project. Originally developed by Equifax in consultation with government and industry as part of NSW's Construct NSW reforms, the system has since expanded nationally.

<h2 data-end="1519" data-section-id="7nmx3" data-start="1492">What is an iCIRT rating?</h2>

Most Australians are familiar with independent ratings in everyday life.

We compare ANCAP safety ratings before buying a car. We look at Health Star Ratings in supermarkets. Banks rely on credit assessments when lending money.

Until recently, however, there has been very little independent information available to help apartment buyers assess the business responsible for delivering a residential project.

That gap is what iCIRT was designed to address.

Builders, developers and other construction professionals with an iCIRT rating have demonstrated high-trust characteristics through an independent, evidence-based assessment across six criteria: Character, Capability, Conduct, Capacity, Capital and Counterparties. This involves a rigorous review of financial health, past project track record, and ethical conduct. Crucially, an iCIRT rating could help provide property buyers with confidence that they are working with a professional who has demonstrated the capability, capacity, and willingness to return and rectify issues.

Importantly, iCIRT is not a recommendation to purchase a particular property, nor is it a traditional credit rating. It is an independent assessment framework designed to provide objective information about a construction business using a <a href="https://icirt.com/sites/default/files/2025-08/iCIRT-Methodology-Issue1-May-2021.pdf">published methodology</a>.

The system has been widely adopted in New South Wales, where more than one-third of medium and large residential builders and developers now hold an iCIRT rating, representing over two-thirds of the state's residential building market by value as of 2025/26.

<h2 data-end="3126" data-section-id="h6ohtj" data-start="3084">Why buyers are doing more due diligence</h2>

For many buyers, particularly those purchasing off the plan, the biggest risk isn't whether they'll like the kitchen finishes.

It's whether the project will be delivered on time, to the expected quality, and by a company capable of completing the development.

<a href="https://icirt.com/sites/default/files/2026-07/iCIRT%202025%20Consumer%20Survey%20Report%20v05.pdf">Consumer research commissioned by iCIRT</a> found more than half of respondents believed current protections do not adequately safeguard buyers from builder insolvencies or defective projects. Other research found 88 per cent of prospective buyers would seek independent ratings or due diligence before purchasing, while 90 per cent said trust in construction professionals is essential.

That doesn't mean buyers should rely on a single rating alone.

Independent legal advice, understanding the contract, and seeking financial advice all remain important parts of the due diligence process.

However, an independent assessment can provide another source of information alongside those traditional checks.

<h2 data-end="4138" data-section-id="pquzxc" data-start="4094">Trust is becoming a competitive advantage</h2>

The conversation isn't only changing for buyers.

Developers are also recognising that trust has become an increasingly important part of the sales process.

Five years ago, purchasers typically asked about floorplans, finishes and settlement dates.

Today, sales teams are increasingly being asked about the developer's experience, financial stability, previous projects and construction partners.

For companies with strong governance and established delivery records, an independent iCIRT rating provides another way to demonstrate those credentials before buyers even visit a display suite.

According to Equifax, the assessment can also help businesses drive sales and <a href="https://icirt.com/resources-for-business/icirt-rating-helps-scion-secure-high-value-projects">secure high-value projects</a>, as well as identify operational improvements and <a href="https://icirt.com/resources-for-business/mirvac-reinforces-brand-trust-and-quality-independent-icirt-rating">attract top talent</a>.

<h2 data-end="4962" data-section-id="1j54ng5" data-start="4912">Beyond buyers: lenders are paying attention too</h2>

The influence of independent construction ratings is also extending beyond consumers.

According to Stamford Capital's Real Estate Debt Capital Markets Survey, an increasing number of lenders now incorporate iCIRT ratings into their due diligence processes when assessing residential development finance applications.

The survey found lender adoption has continued to rise, with many respondents saying independent assessments provide additional insight into governance, counterparties and delivery capability beyond traditional financial analysis. Some lenders also reported declining funding applications where businesses had poor or no ratings.

As construction costs remain elevated and access to development finance becomes more selective, demonstrating credibility is becoming increasingly valuable.

<h2 data-end="5801" data-section-id="1qazuxs" data-start="5772">What it means for Victoria</h2>

Victoria's apartment market is entering a new phase.

The state is seeking to accelerate higher-density housing while simultaneously introducing reforms aimed at improving confidence in residential construction.

For buyers, that means there are more tools available than ever before to research the businesses behind a project.

For developers, it signals that transparency is becoming another point of differentiation in an increasingly competitive market.

Buyers are asking more questions than ever before and increasingly expecting independent information, not just marketing material, before making one of the biggest financial commitments of their lives.

Buying off-the-plan in Melbourne? How independent iCIRT ratings are set to change Victorian property

Development takes advantage of South West Rail Link

A new report has revealed that upward momentum in detached housing construction can still be expected over 2013/14, according to the Housing Industry Association (HIA) and RP Data.
The most recent HIA-RP Data Residential Land Report saw strong growth of 18.2% over the June 2013 quarter, reaching a level of 17,170.
"This is the highest quarterly volume achieved since the March quarter of 2010," said HIA chief economist, Harley Dale.
"The recovery in residential land sales is impressive, but from a very low base."
Dale said that there is a close, but slightly lagged, relationship between the land sales noted in this report and the number of detached housing starts.
This points to the prospect of further growth in house starts following a modest lift of 3.7% over 2012/2013.
"The level of sales in 2012/13 was 56,782. Sales are therefore now back to a level equivalent to the GFC trough but no higher - the level is still 21 per cent below the historical average. Obviously it will be important to see further strong momentum in land sales for some time to come. For that to occur there needs to be a keener policy focus on ensuring adequate and affordable shovel-ready land is available," Dale said.
Residential land price growth has, however, been generally modest.
"A flat June 2013 quarter for the weighted median residential land value saw an increase of only 1.7 per cent over the year, less than general inflation," he said.
Meanwhile, RP Data’s research director, Tim Lawless, said that improvements in market conditions are in line with improvements across the broader housing market.
"The housing market has been back in growth since mid-2012 with both the rate of capital gains and transaction volumes gathering some momentum during 2013. It should come as no surprise that the Sydney housing market, which remains well undersupplied relative to the rate of population growth and is recording the highest rate of capital gain currently, is one of the primary drivers behind the lift in national vacant land sales,” said Lawless.

Housing construction to continue climbing: HIA-RP Data

The recent Grattan Institute’s report Renovating Housing Policy had many in the property crowd talking. While the Real Estate Institute of Australia (REIA) agreed with the report, they said that negative gearing must remain.
REIA president, Peter Bushby, said that the report’s recommendations were generally strongly agreed with.
“We strongly agree with the report’s recommendations to eliminate stamp duties, however it’s essential negative gearing be retained in its current form for the purpose of property investment,” said Bushby.
He said that negative gearing actually helps support the provision of rental accommodation, and for this reason should be left alone as part of the government’s Housing Affordability Fund to help address rental supply.
“It is far too short sighted to link investor interest in housing to negative gearing alone. Negative gearing is only one of a range of factors that contribute to the level of investment in property. Other factors include interest rates, availability and accessibility of finance, share market performance, the unemployment rate, housing supply and consumer confidence,” he said.
“The myth that negative gearing is a plaything of the wealthy also needs to dispelled. The majority of taxpayers with a negatively geared property earn less than $80,000 a year.”

We're regularly told to "buy near infrastructure" but what does this really mean? And isn't it already priced in?
Firstly, let's divide up our expectations. There's infrastructure that already exists in the area, such as the train line, and there's infrastructure that may be coming your way sometime soon. It's this latter part that tends to get investors excited, and it's the former part that owner occupiers and, more prominently, renters, tend to base much of their area selections around.
Clearly, if the train line is already there, some of that growth has already been "priced in".
Current infrastructure
Specifically looking at infrastructure that currently exists in the area - what should you be keeping an eye out for?
Observer Cameron McEvoy previously wrote for us this <a href="/news">'vital' and 'desirable' checklist</a> that you can tick off when looking at your chosen area.
WalkScore can be great for this purpose. Figuring out what infrastructure and amenities already exist in a neighbourhood.

Infrastructure projects upcoming
Why are upcoming infrastructure projects often of so much interest to investors? The answer is simple. Here, observer Terry Ryder discusses <a href="https://www.propertyobserver.com.au/queensland/infrastructure-creates-jobs-and-capital-growth-terry-ryder/2013031859926" target="_blank">infrastructure and how it correlates to growth</a>.
Infrastructure, particularly when on a large scale, regularly boosts employment in an area. This, in turn, boosts demand, which can put pressure on the existing supply, which can possibly lead to value growth.
You might notice nothing definitive in that list. The words 'possibly' and 'regularly' are there for a reason. Not every infrastructure project will lead to capital growth. A 200-person mine in a boom town might not actually increase the pressure within an area substantially. A developer could also build in there, just as you buy, offsetting some of the supply/demand pressure that we discussed yesterday. A bypass might actually just make the next town on more amenable, and may make you start looking in that area instead.
Nothing is a dead set certain in this game of property.
In saying that, it's rare that new infrastructure doesn't also bring a wave of positivity and excitement to an area. If it's a new hospital, you can be sure that it will drive employment. If it's a new train station, it may increase the area's amenity. It might also increase crime and noise in the local vicinity to the station hub. You'll want to bear in mind that while the effect of infrastructure can be a significant positive for the overall area, when you look again at the micro, it may work against you.

A bit of a warning
When buying due to upcoming infrastructure, such as a suggested airport location or similar, be aware that it is not necessarily set in concrete. Plans can, and do, change. Unless there is significant reason to believe that the project will see the light of day, it is worth ensuring that the area stacks up without it.
Investors will also want to ensure that the area they’re buying into is ‘proactive’ not ‘reactive’ – that is, according to wHeregroup’s Todd Hunter, the area is building infrastructure in prediction of future growth, rather than as a result of growth that has already occurred. Sometimes it can be hard to tell which this is.

Housing affordability is at its best in 10 years, but first home buyer activity is low.
The relatively low level of buying by first timers has enabled some to claim that there is a lack of affordability, never mind the official data.
So often in real estate, observers add one and one together and come up with seven. People with a bee in their bonnet about an issue seldom dig any deeper than the surface to find what really lies beneath.
So the industry is resplendent with simplistic analysis in which myths – such as elections cause markets to stall (the pre-election rise of markets around Australia this year suggests otherwise), interest rates dictate market movements (there’s no historic basis for that), we have a housing shortage crisis  (the REIA’s city average vacancy rate of 3% and the lack of rental growth suggests we don’t) and young people can’t afford to buy – become accepted as facts.
Many surveys have been conducted on the activity or otherwise of potential first home buyers. A recent survey by RAMS showed most thought this was a very good time to buy - but most did not intend to buy.
Therein lies the clue as to why first home buyers are not exploiting strong buying conditions. It’s all about attitudes and priorities.
Many younger Australians say they have priorities other than home ownership. They want to travel, own expensive gadgets and have a nice lifestyle in their location of choice, in preference to taking on a mortgage in a less desirable location.
Others do want to own a home but they want their dream home in a premium location as a first purchase. That’s never has been achievable and probably never will be.
First home ownership demands sacrifice and compromise and the new generations are less willing to do that.
Buying a first home has never been easy, but in many ways it’s easier today than before. When I bought my first home, there were no government grants or concessions, you needed a 20% deposit and the only borrowing option was the institution you’d saved with for several years.
That first home was a shack in a downmarket suburb 90 minutes from the CBD. It was all about compromise to get on the lowest rung of the ladder. But ugly real estate grows in value, often faster than luxury property, and two years later I was able to sell the shack for a healthy gain and buy something better, much closer to my inner-city job.
I achieved something approaching my dream home on my sixth purchase.
Those who want the dream home as a first purchase are kidding themselves.
Some newspaper articles are declaring that we have a “generation rent”, people doomed to a lifetime of renting. That’s only true for those unwilling to prioritise home ownership and make the necessary compromises. It seems many young Australians prefer to rent and have the lifestyle they prefer. That’s fine, if that’s their choice, but stop telling us you can’t afford to buy.
For those willing to stop complaining and start acting, there is so much in your favour – a high level of affordability, attractive loan options from competing lenders, a leg up from government and rising markets to create equity in the future.

Have a good look at the closing costs, understand your obligations and the purpose of the property in the first place, and ensure you’re making the choice for future gain rather than for a quick fix solution.
Ensure you know how long it will take you to recoup any of the costs associated with refinancing so you can factor this into the equation. If you’re planning to, or may be likely to need to sell the property soon then refinancing may not be the answer.

What's happening in the area you specialise in?
The retail investment market is particularly aggressive at the moment. The combination of pent-up frustration of capital trying to find a home, coupled with historically higher yields and very competitive financing rates / increased bank funding competition, has led to very strong purchaser appetite. The issue now is that stock levels are now significantly lower with owners sensing an upswing in pricing.  
Describe the most interesting property you have sold?
The most interesting property I have sold was back in my days working in the City of London. It was a large prime office building close to St Pauls Cathedral, which was predominantly held on a freehold title but had a small/thin parcel of land running right through the middle of the built improvements held by way of 699 year sub-leasehold interest with a 700 year head lease.
The transaction hit a stumbling block as in doing their due diligence, the purchaser identified there had been breaches in both the head lease and sub-lease as development had taken place without the freeholder's consent and the freeholder of the land had disappeared from records!
It was a very interesting transaction because of the history involved;  from the perspective of having to review hand-scrolled Chaucerian style "Auld English" leasehold documents and where the purchaser ended up having to take out a very expensive insurance policy to cover them in the unlikely event the freeholder's ancestors turned up and claimed the breach of lease (the freeholders whereabouts had been lost around 200 years ago). The implications of them coming back would have been very material!    
What are the ingredients to being successful in your job?
Number one is relationships. Then it  is reacting to information. Being respectful, tenacious, organised and persistent are also pre-requisites.    
What aspects of your role do you enjoy the most?
Dealing with people and being able to get out of the office on a regular basis.    
Where would you invest a spare $750,000?
Buying existing income producing improvements in urban infill locations. Like industrial assets in Alexandria for example. Subject to planning restrictions, they are highly likely to have a higher and better use down the track.    
Which football team do you support?
Being from the UK, the football I prefer is soccer! For my sins - Newcastle United. If talking other codes; league - Roosters. AFL - Swans.    
What's your favourite app or techno gadget?
Evernote. This keeps me organised and able to access my notes wherever I am.  
How do you use social media?
We use Linkedin to advertise all of our properties and I personally use Facebook to keep up with Friends and family in the UK.

Brisbane’s commercial market is currently experiencing vacancy in secondary stock, which raises the question of what landlords should be doing to tenant this space? It’s an interesting area.
There have been a series of secondary assets within the Brisbane market that have recently undergone refurbishment in the race for tenant engagement. These landlords have focussed on the inspection journey and prioritized capital expenditure within building common areas (ground floor lobby, and on floor lobby finishes), providing quality tenant amenity and ensuring the tenancy itself presents in its best light.
If a tenancy stands out as the ‘best in class’ in the eyes of a prospective occupier, it will likely make the shortlist. That is ultimately the goal.
However, if there is simply not an appetite to expend large amounts of capital within the common areas, the use of feature carpet/tiling/alternative floor coverings, non-traditional or custom lighting and clean modern finishes throughout the specific vacancies is very important. Simply, a freshly painted tenancy will always inspect better than an old second hand fitout.
Using another approach - a number of landlords have completed speculative fitouts within vacancies that have resulted in successful outcomes. Whilst this presents some risk (we are often asked, “what if the tenant doesn’t like the fitout and wants it removed altogether”) the construction of a speculative fitout, particularly in those tenancies with quirky attributes, can often hide the negative aspects of a space with a fresh new presentation.
‘Speed to market’ can also be leveraged when a fitout is immediately available. Quite often smaller groups do not think about their accommodation needs until three to six months out from lease expiry, leaving little time to find the right tenancy and construct a fitout. Recently the Seymour Group built a good quality speculative fitout within a 210 square metre suite in 300 Queen Street. On completion of the fitout works the tenancy had been leased to a consulting business. The tenant that ultimately took the space had tight time constraints and required a space that was ready to occupy.
Flexibility and willingness to accommodate out-of-the-box tenant requirements are in my view the two most important factors in securing a prospective tenant. Some of the more recent transactions within the secondary market have incorporated access periods and delayed lease commencements to enable incoming tenants the ability to facilitate a relocation without double rent exposure. Landlords project-managing the fitout process on a tenant’s behalf (so a tenant is able to move in to a fully fitted tenancy), relocating existing furniture within the building for the incoming tenant at no cost, or even creating a bicycle cage in the basement are all things that have been recently accommodated to secure a deal.
In wrapping up, it’s clear to me that taking a stubborn view on what your building is worth without assessing the market can be detrimental. Listening to the market, understanding the drivers of each specific tenant and being nimble in your dealings are paramount aspects of any leasing campaign, particularly while demand is soft.
The speed of actioning deliverables is also critical. Once a tenant has signed a heads of agreement it does not mean the deal is absolutely final - quickly turning around formal documentation, actioning landlord works items and working with the tenant to “cross the T’s and dot the I’s” should be the immediate focus to limit any potential hiccups along the way.

What should you do about secondary stock vacancy? James Montague

In recent years, some Australians have adopted an interesting strategy of being a ‘renter-investor’. I’ve written about this previously, and it is a trend I have kept an eye on ever since.
They will actually not buy a home to begin with,  instead saving their deposit money for a property that will become an investment from day one. They will then rent for the duration of this. There are several situations or reasons why some people may opt for investment ownership instead of home ownership:
- Perhaps home ownership in the desired suburbs or areas where they most enjoy the lifestyle is too cost prohibitive to be a home owner.
- They may be a younger aspiring investor and be in a situation where they can continue to live at home with parents or relatives, rent-free, enabling them to poor their savings entirely and quickly into pure investment.
- Transient lifestyles. Those in military or international business jobs may not value home ownership much at all, as their lifestyle involves lots of travel or placement in other states and countries.
- Some investors may not see the value in home ownership in Australia. For some investors, the ongoing burden of a large mortgage may not seem to be the best use of their savings dollars.
The other option for renter-investors is to begin their investment career as a home owner, which is how I started out. Renter-investors will usually do this to qualify for any government grants, exemptions, or benefits offered to first home buyers, and then live in the property for the minimum time required. This is usually around six months. These investors will then move out of the property and into a rental property. This strategy works works well for people who:
- Cannot save enough of a deposit for the home where they want to live, but wish to invest for several years to help them eventually afford to buy a home in the area they wish to live.
- For those investors looking to maximise the initial cash-flow when first buying, via accessing government grants that are paid at time of settlement. This can enable these investors to move quicker into the purchase of investment property num,ber two.
- Those who are comfortable and flexible enough to live in a temporary home for six-12 months in an area that perhaps is not their dream area, but can view it as a necessary stepping stone to move into their desired area.
In fact, another emerging trend that goes part and parcel with the above strategy is to use home ownership as a temporary springboard into an investor life,all the while retaining a capital gain tax (CGT) exemption on one of the properties you own.
How does it work?
It goes something like this:
-          An aspiring investor will purchase their first home in whatever investment area they can afford, and through their due diligence represents solid rental return and/or capital gain potential.
-          This area probably won’t be in their desired dream suburb or where they see themselves living for a long time.
-          They then live in this property for the first six months or as long as is needed to qualify for any grants or stamp duty concessions/exemptions that are on offer by federal or state governments at the time.
-          Then, the investor will move out of their home into a rental property in the area they actually want and desire to move to, and convert their home into an investment property.
-          The investor can now continue to rent for many years and use any growth achieved in their home property as a springboard to purchase their next investment property.
-          For future CGT minimisation purposes, the investor may move back into the home property in year five or six of ownership, perhaps also doing a mild renovation whilst living there again, before moving back out again and re-renting it out.
The advantage of using this strategy, as opposed to just starting as an investor from the outset, is that the investor gets to maintain a CGT exempt ‘haven’ which will help when selling the property in the future. This is a very simplistic approach, and it gets more complex as you grow a portfolio.
It is best to consult with a professional accountant and the ATO when considering a tax-minimisation strategy across a portfolio of properties. The very general rule of thumb though, is that the ATO will only allow you to claim one residence as your principal place of residence (PPR – otherwise known as your ‘home’) for tax purposes. So as some investors grow a portfolio of multiple, even dozens, of properties, and they continue to rent elsewhere, they will usually find ways to nominate the highest-value property in their portfolio as their PPR for taxation purposes.
Renting where you want to live, whilst investing where you can afford at the time, really is a strategy that can work for young and newly-starting investors. It offers the best of both worlds; enjoying the lifestyle of the area you want to live in, whilst establishing your investment career on the property ladder, at an earlier age and time in your life. This of course is ideal, because the the earlier you can make your start on the investment property ladder, the more chance you’ll have to acquire more properties and see them grow, through to retirement age.

Buying where you can afford while renting where you want to live: Cameron McEvoy

Did you know that one in three proposed residential projects never starts in Australia?
Did you also know that two out of five new projects selling off-the-plan across Queensland did not report a sale over the past six months?
Or that one in five new approved detached homes across Australia has yet to commence construction?  And did you know that this ratio lifts to one in two for new apartments and townhouses?
So what helps get a new project started?
There are seven things that – from our experience – help make a new residential development work.
Economically sound suppliers
Often a new project doesn’t proceed because the financial capacity of the developer and builder is much less than the project actually requires.  I have seen this many times.  Sometimes a developer’s latest project is the sum of all previous outlays.
One must view a new development as a business – a new 50 apartment project is typically a $25 to $30 million venue, yet it isn’t often treated as such.  If someone was going to get involved in a $25 million business, most would do a lot of investigation before they proceed.
Sadly, for some reason, that doesn’t always apply to new housing projects –  especially infill redevelopment sites, which are owned more often than not by specialist professionals (it’s their family home or an investment property).
Lawyers and solicitors, in particular, seem quite pig-headed about such matters.  Maybe that isn’t too surprising.  I do feel a writ coming on.
Project matches the site
Maximising development yield can often be a big mistake.  Too many developers still do this.  It is a logical thought process if the intention is to sell the site.  But that often backfires too.
If an owner really wants to develop the project, then it is often best to reduce the overall density and reduce your construction costs.  Building less is, more often than not, more when it comes to new housing.
Each project also needs to have its own USP or ‘unique selling points’.  I often ask a developer, on initial meeting, to explain their project’s USP to me.  Sometimes I get told “that is what we want you to do”.
Now whilst that might sound like a lucrative business opportunity for us, our experience is that we will most likely not end up working on that project.
What’s being built needs to match the site.  It is pointless trying to build an A-grade project on a C-grade site.  Even in the same street, sites are all different.
Time and effort must be invested in order to best match the built product with the site parameters.  Sadly, this often isn’t the case.
Limited construction costs
There is a simple matrix which helps to determine, quickly, if a new project has a chance of actually going ahead – ratio of construction costs to total sales venue.  If the construction costs are half (preferably less) of the gross realisation, then that new project has a chance of actually being built.
Quite a few recently completed residential projects – especially those conceived and committed to prior to the GFC – actually made a loss.  I often chuckle when I hear how rich developers are, how much money they make and how they rip everyone off.  Many are just scraping by.
Pricing
Project success needs fast pre-sales.  This often happens, not just by spending money on sales commissions or marketing, but because the pricing is right.
New residential projects sell best if they are priced at, or just below, the prices being achieved for more established property in the same area.  Potential buyers seem comfortable with this equation.
Buyers looking at a new apartment or townhouse expect a slightly higher pricing differential – between 10-20% less than the price of the established detached housing in the area.
Developers can achieve higher price points – especially on great sites – but in the main, this general rule applies.
Local market
The dwellings being offered need to be designed to suit the first two largest local occupier groups.  These markets are going to be, firstly an investor’s tenants and secondly (and importantly) potential buyers when it comes to resale.
So, if the largest local household group is say, single person households, followed by couples with no children – and assuming the site and general location supports such density – then buying a new one or two-bedroom apartment might have merit.

Valuation support
Unless it ‘sells and settles’ nothing happens in real estate.  That is so true and the key to getting sales (and settlements) is to have bank valuation support.
One of the first questions we ask about a new development that is seeking our assistance is about valuations.  Most of the time, developers have an overall project valuation (they need such to secure finance etc.), but not what the valuation industry call a ‘current market assessment’ for a selection of the dwellings to be sold.
Getting bank valuations done is vital when it comes to off-plan selling.  New prices do not have to match the valuations – a 5% (sometimes up to 8%) variation is acceptable – but the closer they are the better.  I like the 'within $10,000' rule.
Despite the public flogging that investment sellers seem to cop these days (yes, some deserve it), the more successful agencies selling investment property will only sell new stock priced within an acceptable range of independent bank valuations.
Flexibility
Many new residential developments take years to come to fruition.  Some take over a decade.  Even smaller infill projects – given the convoluted approval process these days – can take many years from concept to settlement.
Most new residential projects will go through several stages of the property cycle, some will go through several actual cycles.
In order to meet these changing conditions, new projects also need to be flexible.  This flexibility comes in a variety of forms – product, price, incentives, marketing and timing to name just a few.
Final word
We do need to tackle one elephant in the room – what I like to call ‘survival of the unfittest’.
Sometimes it is not the better projects that get built, but the projects that look best on paper.  Too often, new developments are promoted to such a degree and at such a high cost that sales are bought, buyers often duped, but presale targets are met.
More often than not, it is the project’s location that is hyped plus the timing of the property cycle that is oversold to investors, rather than the attributes of the project itself.
Promoters, advocates and forecasters have financial incentives to under-report problems/bad news and over-estimate benefits of the location, stage in the property cycle and sometimes the project itself.
