One of North Sydney's best-known commercial buildings could become hundreds of new homes, with insurance giant Zurich Australia lodging a State Significant Development Application (SSDA) to transform 5 Blue Street into a mixed-use residential development above North Sydney Station.

Rather than demolishing the existing building and starting again, Zurich is proposing an adaptive reuse project that would convert the landmark office building into a 15-level residential development delivering 62 apartments, 86 affordable co-living dwellings, activated retail and significant upgrades to the Blue Street Plaza.

The proposal reflects a growing trend of commercial property owners repositioning ageing office assets into residential housing as Sydney grapples with housing supply shortages and changing workplace demand.

Located directly above North Sydney Metro and train station, the 3,051 sqm site occupies one of the most strategically positioned parcels of land on Sydney's Lower North Shore.

Designed by fjcstudio, the proposal seeks to retain and adapt much of the existing structure while creating a contemporary residential address that better connects with the public domain surrounding North Sydney Station.

The application proposes two basement levels, ground floor retail, affordable co-living accommodation across the podium levels, and apartments above, while preserving and enhancing the publicly accessible Blue Street Plaza.

Rather than pursuing maximum apartment numbers, Zurich has opted for a housing mix heavily weighted towards larger owner-occupier residences.

The proposal includes 62 build-to-sell apartments comprising 12 one-bedroom, 19 two-bedroom, 29 three-bedroom apartments and two premium penthouses. It also incorporates 86 affordable co-living dwellings, which would be managed in perpetuity by a Community Housing Provider.

That balance between traditional apartments and affordable housing reflects the NSW Government's push to increase housing diversity around major transport infrastructure.

The proposal has been lodged concurrently with a rezoning application, with Zurich arguing the site is ideally positioned to support additional housing given its immediate proximity to public transport, employment and services.

"The proposal aims to respond to the housing challenges facing Sydney through the delivery of diverse housing types in a highly accessible location," the design report by fjcstudio states. It also seeks to improve pedestrian amenity through upgrades to Blue Street Plaza while creating a high-performing residential building that responds to the surrounding context.

Rather than replacing the commercial building, fjcstudio has developed a design that works with the existing structural framework above the rail corridor, an approach that significantly reduces demolition while allowing the site to be repositioned as a mixed-use residential precinct.

The existing structural constraints have informed much of the building's design, including its relationship with Blue Street and surrounding public spaces.

The building has been designed as a slender tower rising above a clearly defined podium, with vertically expressed façades intended to reduce the perceived bulk while reinforcing North Sydney's emerging skyline.

According to fjcstudio, the architectural language responds directly to the surrounding commercial towers while maintaining a finer grain expression more closely aligned with the neighbouring Lavender Bay streetscape.

The tower incorporates articulated façade elements, landscaped podium edges and recessed upper levels to soften its appearance and improve pedestrian amenity below.

A significant component of the proposal is the revitalisation of Blue Street Plaza.

The existing public space has long served as one of the primary pedestrian connections between North Sydney Station, Greenwood Plaza and Blue Street, yet its role is expected to become even more important following the opening of Sydney Metro.

Zurich's proposal seeks to strengthen that role by improving landscaping, introducing new retail frontages, enhancing pedestrian permeability and creating more active edges throughout the day and evening.

Ground floor retail would wrap the plaza, while separate residential and co-living entries have been designed to improve wayfinding without reducing street activation.

Landscape design has been integrated throughout the podium and public realm, softening what is currently one of the most heavily urbanised parts of North Sydney.

The project forms part of the continuing transformation of North Sydney from a predominantly commercial CBD into a genuine mixed-use city centre.

Since the completion of Victoria Cross Metro Station, developers have increasingly shifted their attention towards residential projects capable of leveraging the area's unparalleled transport connectivity.

Busy developer Aqualand Prestige has formally taken the next step in its expansion across Sydney's Lower North Shore, lodging a State Significant Development Application (SSDA) for its long-held Archer Street site in Chatswood.

The application covers <a href="https://www.apartments.com.au/new-apartments/51-55-archer-street-chatswood-nsw-2067">51-55 Archer Street</a>, a 1,767 sqm amalgamated site on the eastern edge of the Chatswood CBD, where the developer is seeking approval for a 45-level mixed-use tower delivering 114 apartments, including a significant affordable housing component, alongside retail, commercial space and six basement levels of parking.

The SSDA marks the latest milestone for a project Aqualand has been quietly progressing over the past two years. The developer first secured the site for its Aqualand Prestige platform before undertaking an alternative design excellence process with PTW Architects, ultimately avoiding a formal design competition through the Housing Delivery Authority pathway.

The proposal has evolved considerably from Aqualand's original concept. The revised scheme has been designed around larger owner-occupier product, with an unusually high proportion of three and four-bedroom apartments, targeting the more affluent buyer profile, and downsizer, emerging across the North Shore.

The 114-apartment mix comprises six studios, 27 one-bedroom apartments, 18 two-bedroom apartments, 50 three-bedroom residences and 13 four-bedroom homes. A quarter of the building will be dedicated to affordable housing, well above the mandated 15 per cent&nbsp;

PTW has structured the building vertically, with affordable housing across levels one to six, premium apartments through levels seven to 31, duplex skyhomes on klevels 32 to 43, a penthouse on level 44, and a rooftop plant level above. Six basement levels will provide resident parking and servicing.

The tower is proposed to reach approximately 154 metres, placing it among a growing collection of residential high-rises transforming Chatswood's skyline.

Rather than competing purely on height, PTW says the design has been driven by creating a slimmer tower capable of delivering significantly larger apartments.

"The primary objective of this project was to create a distinctive building that stands out from the recently approved or built structures in the Chatswood area," the design report states, noting the structural efficiency allows greater investment into apartment quality and resident amenity.

Residents would have access to more than 450 sqm of communal open space including landscaped gardens, swimming pool, rooftop entertaining areas, fitness spaces, community gardens, children's play areas and barbecue facilities.

A major focus of the design has been the public domain.

The ground plane has been opened up through landscaped terraces inspired by Willoughby's sandstone ridges, with native planting, public seating, artwork, retail activation and a series of gathering spaces intended to soften what has traditionally been a hard commercial streetscape.

The landscape strategy references Blue Gum forests once common throughout the area, while incorporating Indigenous storytelling, public art and lighting installations to strengthen the connection to Country.

Chatswood has been one of Sydney's busiest apartment markets over the past 12 months, with a steady pipeline of both new project launches and fresh development applications.

Hyecorp recently launched Celine, a 122-apartment development just along Archer Street, while Changfa and Huirong Group are progressing The Anderson, an 84-apartment project on Anderson Street.

Develotek recently secured approval for a 101-apartment tower on Pacific Highway, while Tian An LFD received the green light for Hammond Greens, its apartment development on the edge of the Chatswood Bowling Club.

Commercial property developer FiveX is also making its move into the residential market. Last month it lodged plans for a 61-storey tower with 490 apartments, which, if approved, would become one of the tallest residential buildings in Chatswood.

Aqualand is also expanding its development pipeline following the launch of its luxury residential brand, Aqualand Prestige. The developer has delivered a string of high-end apartment projects across Sydney's affluent suburbs over the past decade, most recently AURA by Aqualand on Walker Street in North Sydney.

Mass timber is becoming an increasingly popular construction material in apartment developments, but Adelaide developer <a href="https://www.apartments.com.au/developers/otello">Otello</a> is taking the approach a step further.

At its new <a href="https://www.apartments.com.au/new-apartments/flowe-bowden-18-gibson-street-bowden-sa-5007">Flowe Bowden</a> development, the exposed cross-laminated timber (CLT) structure isn't just about reducing the building's environmental footprint. It also forms the foundation of a broader wellness strategy, influencing everything from indoor air quality and natural materials to the way residents move through and experience the building.

The 115-apartment mixed-use development, designed by Melbourne-based architecture practice Fieldwork, will occupy a prominent island site opposite Bowden Village Reserve, combining one, two and three-bedroom apartments with retail and a dedicated wellness destination.

Wellness isn't confined to a gym or shared resident facility at Flowe. Instead, Fieldwork embedded the concept into the building itself.

Inca Property Group has lodged a State Significant Development Application (SSDA) for Dawn, a 53-apartment oceanfront development overlooking Mona Vale Beach.

The proposal, at 35-39 Darley Street East, would replace an existing 18-apartment strata building with a new owner-occupier-focused development comprising 53 two and three-bedroom apartments, including nine affordable built-to-rent residences delivered under the State's infill affordable housing scheme.

Positioned on a 2,679 sqm elevated site around 280 metres from Mona Vale Beach, the development has been designed to maximise panoramic ocean views while responding to the site's sloping topography.

<a href="https://www.apartments.com.au/developers/inca-property-group">Inca Property Group</a> Managing Director Josh Thompson said the State Significant pathway provided greater certainty for projects of this scale.

"This State Significant pathway gives the team real certainty to progress <a href="https://www.apartments.com.au/new-apartments/dawn-35-39-darley-street-east-mona-vale-nsw-2103">Dawn</a> through to completion," Thompson said.

"It allows us to acquire a one-off site, design it carefully and deliver the right offering for the suburb, assessed by the NSW Government's planning department."

The project is one of the first developments in the area to be assessed under the NSW Government's Low and Mid-Rise Housing policy, with the site sitting on the edge of the policy's designated inner area.

The proposal includes three basement levels providing 124 car spaces, alongside a range of resident amenities including a swimming pool, gym, sauna, wellness facilities and private plunge pools for selected ground-floor and penthouse apartments.

Located within walking distance of Mona Vale Beach, the town centre, Mona Vale Golf Club and the Royal Motor Yacht Club, Dawn represents Inca's first Northern Beaches project following the sell-out of Tara on Park in Waitara and Ellis Residences, currently under construction in St Ives.

Construction will be undertaken by Inca's in-house construction arm, GOP Constructions.

Dawn is the latest major apartment proposal for Mona Vale, with the suburb emerging as one of the key beneficiaries of the NSW Government's new Low and Mid-Rise Housing policy.

New developer One Living, led by industry veteran Joseph Scuderi, recently secured a site on Mona Vale Road, on the border of Mona Vale and Pymble, where it is planning around 140 apartments.

First look: Inca eyes Mona Vale with State Significant DA for Dawn apartments

A range of new laws regarding home building will be introduced in New South Wales this week.
From 15 January, owner-builders will only require a permit for works valued over $10,000, not $5,000. The required threshold for owner-builder courses will also be lifted. Currently, owner-builders must complete an approved course for projects valued over $12,000. After 15 January, the course will only be required for projects costing $20,000 or more.
Owner-builders will also need to name all other owners of the land on owner-builder permit applications. According to the NSW government, the new regulation is intended to prevent owner-occupiers from using the application permit to carry out unlicensed commercial building work.
Those named in an owner-builder permit won't be able to apply for another owner-builder permit for five years, potentially affecting any nomadic owner-occupiers who renovate, redevelop and flip their homes frequently.
Owner-occupiers will also be unable to get permits for dual occupancy projects, barring "special circumstances". From 15 January, they will not be able to get statutory insurance (though their contractors will still require it), and will have to disclose that there is no statutory insurance on the property in any sale contract if the property sells within the warranty period.
It's not just owner-builders who will see changes to their regulatory environment.
From Thursday, there will be changes to builder licence requirements to combat phoenix schemes, where collapsed and indebted companies restart with different names.
Simultaneously, licensing rules will be loosened so builders only legally require a license for works valued over $5,000. Currently, builders must have a license for any work that costs $1,000 or more, including labour and materials. Although the threshold for most builders has increased, tradespeople doing specialist jobs like plumbing or electrical work will require a licence.
For standalone jobs like painting or repairs to water features or tennis courts, builders will no longer need a licence.
NSW Fair Trading Minister Matthew Mason-Cox will also introduce changes to the Home Warranty Insurance Scheme, which will be renamed the "Home Building Compensation Fund".
To claim compensation from the government for building faults, a defect must be deemed "major". Until now, a six year warranty was available for any "structural" defects to homes made by builders or developers. A major defect is defined by the NSW government as those that cause "the inability to inhabit or use the building (or part of the building) for its intended purpose," or "the destruction of the building or any part of the building" or "a threat of collapse" of the building or any of its parts.
Some claim the terminology change will <a href="/expert-insights/investing/nsw-home-owners-dodgy-construction-claims-curbed-by-government">degrade consumer rights</a> but the NSW government claims <a href="/expert-insights/finance/home-owner-rights-still-strong-despite-building-reforms-nsw-fair-trading">home owners won't lose protections</a>, with "general defects" still covered under the standard two year warranty.
Homeowners hoping to wash their hands of any dodgy builders may run into trouble with the government requiring tribunals and courts to "consider rectification as the preferred outcome". Owners cannot "reasonably refuse" access to builders who want to fix their defective work, and Fair Trading Inspectors will be able to "oblige" owners to pay builders money owed under their contract.
Builders will remain responsible for warranties for all work completed on a home, but subcontractors will be responsible for their own statutory warranties. If an owner engages an independent professional who gives written specialist advice to a builder, that builder will now also have a legal defence if the advice contributes to a building defect.
After Thursday, strata buildings will also be considered complete with the issue of an occupation certificate.

Changes to NSW home building laws coming this week

Sydney's strong property market has triggered a windfall in stamp duty for the state government.
The NSW government's half-yearly budget review indicated stamp-duty revenue was 40% higher in 2013-14, allowing the Treasurer Andrew Constance to say the NSW budget was the "envy" of the nation.
The state government also expects $744 million more stamp duty in 2014-15 than it forecast in the May budget.
Stamp duty revenue was now expected to be up by 12% during the current financial year.
Much of the gain was through commercial and industrial property sales.
But softer revenue than expected in payroll tax and mining royalties was noted along with the jobless rate expected to be higher than the prior 5.5% forecast.
After predicting a $283 million deficit for 2014/15 mid-year, the review revealed a likely surplus of $272 million.
The $555 million turnaround was mostly attributed to property stamp duty.
"Higher-than-expected property transfer duties are the significant driver of the 2014/15 surplus forecast," Treasurer Andrew Constance said.

A suite of new laws will be introduced in mid-January next year to protect home buyers, renovators and home builders, according to NSW Minister for Fair Trading Matthew Mason-Cox.
To be introduced on 15 January 2015, the new laws will protect consumers against incomplete or subpar work on their homes and will look to ensure builders and tradespeople are properly regulated, said Mason-Cox.
"The decision to commence the new laws on 15 January followed extensive consultation with industry and consumer groups,” he said.
"The changes are part of the NSW government's plan to ensure NSW’s important building sector remains healthy and continues to grow, while making sure consumers remain appropriately protected.’’
The cornerstone of the home building reforms is a new definition of ‘major defect’. This changes include fire safety and waterproofing issues being redefined as major elements in a building’s structure for the first time.
“By including fire safety systems and waterproofing as major elements of the building, the new definition broadens the scope of what may be considered a ‘major defect’, and provides access to the six year warranty period, offering consumers greater protection in these two very important areas,” Mason-Cox said.
“The new laws clearly define statutory warranties to avoid costly litigation over defective work. The warranty period for major defects continues to be six years and two years for all other defects.’’
Illegal phoenixing, whereby a building company collapses and then is reborn under a new name to avoid their debts, will be come under Fair Trading's microscope.
“Changes to the licensing system will allow NSW Fair Trading to refuse a licence application or revoke a licence if a builder has a history or involvement in a failed company or an unreasonable number of complaints or disciplinary matters against them,” he said.
Home building contract requirements are also being amended to maximum cap deposits on work over $20,000 to 10%, from 5%, to assist with cash flow for builders.
“To ensure consumers are protected, the new laws also require builders to include a progress payment schedule in the contract which accurately reflects the work that has been done,” he said.
“This will help ensure that consumers do not end up paying the builder more than the work that has been completed."

The Raith House residential development site at Bradbury has been sold for $2.41 million.
Capital Developments bought the 2.2 hectare offering from Government Property NSW.
It was offered through John Macree and Dylan McEvoy at JLL.
It comes with the heritage listed home, <a href="https://www.realcommercial.com.au/property-land+development-nsw-bradbury-501368135" target="_blank">Raith House at 74 Fern Avenue</a>, offered after fire damage and ongoing vandalism.
The Indian bungalow-style house was built for H.J.M. Merewether and his bride, Wilhelmina Gore, daughter of Campbelltown bank Manager, A.J. Gore. 
The building was designed by Wardell &amp; Denning in 1903 and built by D. McIntyre and Sons of Sydney at a cost of 3000 pounds. 
Raith Lark Hill Hostel was established by the Child Welfare Department in 1964 to serve the Campbelltown district.

A cash retention trust scheme is scheduled to protect New South Wales sub-contractors in the event of a large construction company collapses in response to the Collins Inquiry.
The NSW Fair Trading Minister, Matthew Mason-Cox announced the retention trust proposal as the first of its kind in Australia.
"NSW will become the first state to protect payments for subcontractors by requiring construction companies to hold retention money in a trust fund," Mason-Cox said.
“Head contractors will be responsible for holding retention money in their own accounts, and NSW Fair Trading will be checking audit reports that require head contractors to show they are keeping trust accounts as required.
“This will end the widespread industry practice of using subcontractors’ trust money for the head contractor’s working capital purposes."
NSW Fair Trading has released a draft regulation and regulatory impact statement, which is now open for public consultation.
The scheme will initially apply to head contractors and their direct subcontractors for projects valued of $20 million plus.
The NSW government would commence a full review of the Security of Payment Act in 2015, which would be an opportunity for a comprehensive revision of security of payment laws.
The $40 billion construction industry in NSW was a major contributor to employment and growth in this state, Mason-Cox said.

NSW subcontractors cash retention trust scheme proposed for construction company collapses

The New South Wales government's recently released 'A Plan for Growing Sydney' and it has been welcomed by Housing Industry Association's (HIA) executive director NSW David Bare.
“HIA has been calling for housing supply targets that actually reflect true underlying and future demand. A Plan for Growing Sydney delivers on this aspect because the entire strategic plan is based on meeting the future needs of Sydney’s growing population,” he said.
The plan includes a goal to deliver more property supply through a number of initiatives, including accelerating supply with priority precincts, increasing urban renewal by placing homes near to jobs and transport hubs, increasing housing choice and delivering greenfield precincts.
“The focus on urban renewal and infill in a planned fashion is long overdue in housing delivery in Sydney” said Bare.
“Increasing the opportunities for housing type diversity and enabling subdivision of existing homes for higher density outcomes is also welcomed.”
To accelerate housing supply, the plan aims to work with councils and the development sector to introduce flexible planning controls.
It notes that for infill and urban renewal., large lots within the existing urban area and close to centres on the rail, light rail and rapid bus systems are most suitable.
It appears the 10 priority precincts will remain on the radar with North Ryde Station, Epping Town Centre, Wentworth Point, Carter Street Lidcombe, Herring Road Macquarie Park, Showground Station, Bella Vista Station, Kellyville Station, Banksia and Arncliffe all mentioned.

NSW planning focus on infill long overdue: HIA

At present, the New South Wales government allows two storey houses to be put through a 10 day planning approvals under the current housing code.
However, Urban Taskforce’s CEO Chris Johnson says that this quicker approval code should be extended to more developments to assist with Sydney’s supply problems.
While he acknowledges that taller towers will be crucial in this mix, he says that unsurprisingly they do take longer to be assessed.
For mid-rise apartments, of six to eight storeys, he suggests that a 30 day approval could be brought in.
“With Sydney’s projected population growth requiring a doubling of the number of homes over the next 50 years, we must encourage more mid-rise apartments as a major component of housing such large growth,” he said.
“We cannot rely only on two storey houses so a mid-rise apartment code with 30 day approvals will be needed.”
They have created a two page Complying Code that could be introduced for mid-rise apartments.
The requirements in the code include specific rules for setbacks, heights, landscaping, parking, apartment size and so on, and also requires architects to design the development.
“The planning system does not need vast volumes of complex rules. Our code respects the context and the amenity of neighbours as well as requiring an expert to deliver a quality result,” he said.
“Mid-rise apartments represent a third way to deliver housing between two storey houses and high-rise apartment towers. At a height of six to eight storeys these apartments are family friendly with parents able to keep an eye on children playing in a common garden. They also blend into the landscape well as the Australian gum tree grows to height similar to an eight storey building."
He also suggested that large areas featuring 1960s walk up flats could be renewed under the new code.
“The proposed mid-rise apartment code would be a strong signal from the government that it supports this building type as a preferred way to house the growing future population,” he said.

Is 30-day approval for mid-rise apartments the solution for Sydney’s supply?

Strong demand is behind Byron Bay’s resurgence following a problematic post-GFC environment, according to McGrath Byron Bay’s Nick Dunn.
High demand and tight supply are fuelling price growth in the area, with Dunn noting that the enquiry level from buyers has risen “dramatically” and spells good things for the property market’s future.
“We are seeing multiple prospective buyers interested in a property, which in turn is driving the marketplace,” he said.
Dunn notes that both local buyers and sea changers from Melbourne, Brisbane and Sydney are driving the demand.
The average days on market has dropped to 40 to 45 days, as opposed to 90 to 120 days just a few years prior. Rental returns of up to 5.5% gross yield are available, which may see investors turn to the area soon.
“Property in this market can be neutrally to positively geared, so it can be a set and forget scenario which works well for investors,” Dunn said.
The market may be driven by retirees, as well as by new development – with Unison Projects’ Seacliffs being the recent first residential subdivision in almost 15 years, bring 33 new lots to the market from $485,000.

Is the Byron Bay market rebounding?

If the Real Estate Institute of New South Wales (REINSW) can't achieve their goals by lobbying political parties, they have an alternative strategy in place: become one.
According to REINSW president Malcolm Gunning, the group is considering the formation of a political party to change legislation regarding the real estate industry.
It is now too late for the industry group to form a political party to run in the March 2015 New South Wales election. However, Gunning tells Property Observer the REINSW has already made connections with the head of one party, which he declines to name.
"We've been approached now by another industry based single party to support them, which we'll consider," Gunning says.
"If we get co-operation by state government, we'll review it. But if we don't, if again we're pushed off, there's the framework in place."
He likens the potential real estate focused party to the Shooters and Fishers party, which holds two seats in the New South Wales Upper House. As a result of their government deals, hunters are now allowed onto public land in New South Wales.
"It's really about putting pressure on both sides of government to make sure property practice and agency practice is in line with public expectations."
The REINSW's potential political ambitions come after their sister organisation, the Real Estate Institute of Victoria, was <a href="/expert-insights/investing/tweet-of-the-day-reivs-anti-liberal-campaign-reckless">criticised by some</a> for running an <a href="/news/vic/reiv-locked-in-dispute-with-small-business-body-over-victorian-election-advertising">anti-Liberals campaign</a> ahead of last week's Victorian state election. 
Gunning claims any REINSW affiliated political party won't be campaigning on behalf of any major party.
"We're apolitical, we're policy driven," Gunning says.
"From an REINSW point of view, we prefer to argue policies in both sides of government, and not necessarily back any particular party."
Their main concern, he explains, is the <a href="/news/real-estate-agent-education-in-a-dire-state-reinsw">standard of real estate professionals</a> in the state.
"We've been lobbying state government and various ministers, and the Office of Fair Trading, for some time about improving the educational standards for entry into our industry," he says.
"And it's been really falling on deaf ears."
Gunning says despite the existence many qualified and long-practicing real estate agents in New South Wales, lax educational standards have allowed unqualified or unprofessional agents to practice, particularly in migrant populations.
"Through our international chapter, they're saying there's a sub-market taking place within Melbourne and Sydney's immigrant groups, and it's slipping under the radar of Fair Trading.
"A lot of the immigrants won't report real estate agents, and don't understand the legislation," claims Gunning.
He says the state's poor agent standards extend beyond selling agents, to property managers.
"A profile of a current property manager is a 26 year old female, maybe with a week of training," he explains.
"If that's the case, that young woman, or that person, has got to be mindful of swimming pool legislation in New South Wales, fire place safety, or people hanging themselves with blind cords.
"So you've got people who are assumed to be taking on responsibilities which they aren't equipped for."
He claims the increasing educational requirements for new agents will not negatively impact competition in the industry, with agents previously required to train for 12 months and then have two years of probation.
"So when it came to opening their own business, they were pretty well prepared," says Gunning.
Land tax and stamp duties would be another area a REINSW party would hope to reform after addressing their industry standard concerns.
"There are about 70% of Australians who have some interest in property.
"If you own a bit of real estate, you hope to have a voice in government," says Gunning.

Will the REINSW make the leap from lobby group to political party?

The latest NSW 2014 edition of the Contract for Sale and Purchase of Land features a number of changes to the 2005 edition, including new clauses on electronic conveyancing.
The new 2014 edition of the Contract for Sale and Purchase of Land was issued by the Joint Copyright Holders, Law Society of New South Wales and the Real Estate Institute of New South Wales, last month.
While the 2005 edition of the contract was issued in both paper and electronic formats, the new contract has been released in an electronic format only, <a href="https://www.cbp.com.au/People/Gary-Newton?utm_source=Mondaq&amp;utm_medium=syndication&amp;utm_campaign=author-bio-link">CBP Lawyers</a> has advised.
Although the contract is largely the same as the 2005 edition, it contains a few changes:
<ul>
<li>The contract has been renamed, from "Contract for Sale of Land" to "Contract for Sale and Purchase of Land". </li>
<li>The front page of the contract has a few changes, including the addition of buyer's agent as well as storage spaces as an improvement and solar panels as a possible inclusion. </li>
<li>There are a few new boxes to tick, including the vendor agreeing to accept a deposit bond and the parties electing to use the new electronic conveyancing for completing the purchase. </li>
<li>One change that was badly needed was the removal of references to "vendor's duty". Although it was still relevant at the time the 2005 edition was being prepared, shortly after release the vendor's duty was scrapped. </li>
<li>A new clause on "breach by the vendor" has been added. This new clause 8.2 is important because in the previous drafts of the contract there had been extensive clauses in relation to termination for default by the purchaser, but there was no corresponding clause in relation to default by the vendor. This lack of mutual breach clauses could be seen as being an unfair contract term. The new clause restores the balance. </li>
<li>There is a new clause 30 on electronic conveyancing. Given the rollout of electronic conveyancing over the last year and the fact that it is expected that the first settlements of transfers in NSW will occur using the new electronic system at the time of publication of this article, the joint copyright holders thought it would be a good idea to put in an extensive clause that dealt with all of the key steps and processes required in order to complete a matter using the new electronic conveyancing.</li>
</ul>
Gary Newton, a partner at CBP Lawyers<a href="https://www.cbp.com.au/People/Gary-Newton?utm_source=Mondaq&amp;utm_medium=syndication&amp;utm_campaign=author-bio-link"></a>, says the new clause 30 on electronic conveyancing sets out a mechanism for the party's representatives to confirm if it is proposed that the matter will proceed using electronic conveyancing and a mechanism for a party's representative to notify the other party that the matter will need to default to the paper environment, as well as the payment of fees and costs associated with that change.
The electronic conveyancing clause sets out:
<ul>
<li>How to go about creating the work space </li>
<li>How to populate the work space with data </li>
<li>How to send certain invitations to join the work space </li>
<li>Subsequent communications between the parties as they prepare for settlement </li>
<li>Time frames for the supply of adjustment figures, completion of a financial settlement schedule and digital signings of all things necessary for each settlement</li>
</ul>
Newton, who is the author of the new book Real Property Law (4th edition, 2014) and is the co-author and co-editor of a new book titled Annotated Conveyancing of Real Property Legislation in NSW, noted the new clause 30 on electronic conveyancing provides a default mechanism for the provision of settlement documents outside the work space if not otherwise agreed by the parties and sets out the consequences of the computer systems of the land registry, the Reserve Bank of Australia or the electronic platform being inoperative at the completion time.
"Finally, the electronic conveyancing clause provides for amendment of other clauses of the contract as necessary, for example clause 16 is amended such that the place for settlement becomes the work space," he advised.
