One of North Sydney's best-known commercial buildings could become hundreds of new homes, with insurance giant Zurich Australia lodging a State Significant Development Application (SSDA) to transform 5 Blue Street into a mixed-use residential development above North Sydney Station.

Rather than demolishing the existing building and starting again, Zurich is proposing an adaptive reuse project that would convert the landmark office building into a 15-level residential development delivering 62 apartments, 86 affordable co-living dwellings, activated retail and significant upgrades to the Blue Street Plaza.

The proposal reflects a growing trend of commercial property owners repositioning ageing office assets into residential housing as Sydney grapples with housing supply shortages and changing workplace demand.

Located directly above North Sydney Metro and train station, the 3,051 sqm site occupies one of the most strategically positioned parcels of land on Sydney's Lower North Shore.

Designed by fjcstudio, the proposal seeks to retain and adapt much of the existing structure while creating a contemporary residential address that better connects with the public domain surrounding North Sydney Station.

The application proposes two basement levels, ground floor retail, affordable co-living accommodation across the podium levels, and apartments above, while preserving and enhancing the publicly accessible Blue Street Plaza.

Rather than pursuing maximum apartment numbers, Zurich has opted for a housing mix heavily weighted towards larger owner-occupier residences.

The proposal includes 62 build-to-sell apartments comprising 12 one-bedroom, 19 two-bedroom, 29 three-bedroom apartments and two premium penthouses. It also incorporates 86 affordable co-living dwellings, which would be managed in perpetuity by a Community Housing Provider.

That balance between traditional apartments and affordable housing reflects the NSW Government's push to increase housing diversity around major transport infrastructure.

The proposal has been lodged concurrently with a rezoning application, with Zurich arguing the site is ideally positioned to support additional housing given its immediate proximity to public transport, employment and services.

"The proposal aims to respond to the housing challenges facing Sydney through the delivery of diverse housing types in a highly accessible location," the design report by fjcstudio states. It also seeks to improve pedestrian amenity through upgrades to Blue Street Plaza while creating a high-performing residential building that responds to the surrounding context.

Rather than replacing the commercial building, fjcstudio has developed a design that works with the existing structural framework above the rail corridor, an approach that significantly reduces demolition while allowing the site to be repositioned as a mixed-use residential precinct.

The existing structural constraints have informed much of the building's design, including its relationship with Blue Street and surrounding public spaces.

The building has been designed as a slender tower rising above a clearly defined podium, with vertically expressed façades intended to reduce the perceived bulk while reinforcing North Sydney's emerging skyline.

According to fjcstudio, the architectural language responds directly to the surrounding commercial towers while maintaining a finer grain expression more closely aligned with the neighbouring Lavender Bay streetscape.

The tower incorporates articulated façade elements, landscaped podium edges and recessed upper levels to soften its appearance and improve pedestrian amenity below.

A significant component of the proposal is the revitalisation of Blue Street Plaza.

The existing public space has long served as one of the primary pedestrian connections between North Sydney Station, Greenwood Plaza and Blue Street, yet its role is expected to become even more important following the opening of Sydney Metro.

Zurich's proposal seeks to strengthen that role by improving landscaping, introducing new retail frontages, enhancing pedestrian permeability and creating more active edges throughout the day and evening.

Ground floor retail would wrap the plaza, while separate residential and co-living entries have been designed to improve wayfinding without reducing street activation.

Landscape design has been integrated throughout the podium and public realm, softening what is currently one of the most heavily urbanised parts of North Sydney.

fjcstudio has carefully oriented apartments towards Sydney Harbour and the CBD while using privacy blades and articulated façades to minimise overlooking between neighbouring buildings.

Large framed openings along the western elevation maximise harbour outlooks, while the eastern apartments have been angled towards the south-east to improve privacy from neighbouring development.

The project forms part of the continuing transformation of North Sydney from a predominantly commercial CBD into a genuine mixed-use city centre.

Since the completion of Victoria Cross Metro Station, developers have increasingly shifted their attention towards residential projects capable of leveraging the area's unparalleled transport connectivity.

FiveX recently lodged plans for a 61-storey, 490-apartment tower that would become one of the tallest residential buildings in North Sydney if approved.

Aqualand continues to expand its Lower North Shore presence following the completion of AURA on Walker Street and its recent St Leonards and Roseville proposals.

Developers are also progressing projects throughout Walker Street, Miller Street and the Victoria Cross precinct as demand for well-located owner-occupier apartments continues to strengthen.

First look: Zurich targets North Sydney office conversion with 148-unit proposal above Metro station

Busy developer Aqualand Prestige has formally taken the next step in its expansion across Sydney's Lower North Shore, lodging a State Significant Development Application (SSDA) for its long-held Archer Street site in Chatswood.

The application covers <a href="https://www.apartments.com.au/new-apartments/51-55-archer-street-chatswood-nsw-2067">51-55 Archer Street</a>, a 1,767 sqm amalgamated site on the eastern edge of the Chatswood CBD, where the developer is seeking approval for a 45-level mixed-use tower delivering 114 apartments, including a significant affordable housing component, alongside retail, commercial space and six basement levels of parking.

The SSDA marks the latest milestone for a project Aqualand has been quietly progressing over the past two years. The developer first secured the site for its Aqualand Prestige platform before undertaking an alternative design excellence process with PTW Architects, ultimately avoiding a formal design competition through the Housing Delivery Authority pathway.

The proposal has evolved considerably from Aqualand's original concept. The revised scheme has been designed around larger owner-occupier product, with an unusually high proportion of three and four-bedroom apartments, targeting the more affluent buyer profile, and downsizer, emerging across the North Shore.

The 114-apartment mix comprises six studios, 27 one-bedroom apartments, 18 two-bedroom apartments, 50 three-bedroom residences and 13 four-bedroom homes. A quarter of the building will be dedicated to affordable housing, well above the mandated 15 per cent&nbsp;

PTW has structured the building vertically, with affordable housing across levels one to six, premium apartments through levels seven to 31, duplex skyhomes on klevels 32 to 43, a penthouse on level 44, and a rooftop plant level above. Six basement levels will provide resident parking and servicing.

The tower is proposed to reach approximately 154 metres, placing it among a growing collection of residential high-rises transforming Chatswood's skyline.

Rather than competing purely on height, PTW says the design has been driven by creating a slimmer tower capable of delivering significantly larger apartments.

"The primary objective of this project was to create a distinctive building that stands out from the recently approved or built structures in the Chatswood area," the design report states, noting the structural efficiency allows greater investment into apartment quality and resident amenity.

Residents would have access to more than 450 sqm of communal open space including landscaped gardens, swimming pool, rooftop entertaining areas, fitness spaces, community gardens, children's play areas and barbecue facilities.

A major focus of the design has been the public domain.

The ground plane has been opened up through landscaped terraces inspired by Willoughby's sandstone ridges, with native planting, public seating, artwork, retail activation and a series of gathering spaces intended to soften what has traditionally been a hard commercial streetscape.

The landscape strategy references Blue Gum forests once common throughout the area, while incorporating Indigenous storytelling, public art and lighting installations to strengthen the connection to Country.

Chatswood has been one of Sydney's busiest apartment markets over the past 12 months, with a steady pipeline of both new project launches and fresh development applications.

Hyecorp recently launched Celine, a 122-apartment development just along Archer Street, while Changfa and Huirong Group are progressing The Anderson, an 84-apartment project on Anderson Street.

Develotek recently secured approval for a 101-apartment tower on Pacific Highway, while Tian An LFD received the green light for Hammond Greens, its apartment development on the edge of the Chatswood Bowling Club.

Commercial property developer FiveX is also making its move into the residential market. Last month it lodged plans for a 61-storey tower with 490 apartments, which, if approved, would become one of the tallest residential buildings in Chatswood.

Aqualand is also expanding its development pipeline following the launch of its luxury residential brand, Aqualand Prestige. The developer has delivered a string of high-end apartment projects across Sydney's affluent suburbs over the past decade, most recently AURA by Aqualand on Walker Street in North Sydney.

It has since quietly assembled its next wave of projects.

Earlier this year Aqualand launched Boronia in Roseville, a boutique 111-apartment development on Larkin Street. Mass timber is becoming an increasingly popular construction material in apartment developments, but Adelaide developer <a href="https://www.apartments.com.au/developers/otello">Otello</a> is taking the approach a step further.

At its new <a href="https://www.apartments.com.au/new-apartments/flowe-bowden-18-gibson-street-bowden-sa-5007">Flowe Bowden</a> development, the exposed cross-laminated timber (CLT) structure isn't just about reducing the building's environmental footprint. It also forms the foundation of a broader wellness strategy, influencing everything from indoor air quality and natural materials to the way residents move through and experience the building.

The 115-apartment mixed-use development, designed by Melbourne-based architecture practice Fieldwork, will occupy a prominent island site opposite Bowden Village Reserve, combining one, two and three-bedroom apartments with retail and a dedicated wellness destination.

Wellness isn't confined to a gym or shared resident facility at Flowe. Instead, Fieldwork embedded the concept into the building itself.

The building's architecture also reflects Bowden's industrial heritage. The lower podium references the area's historic brick and sandstone buildings, while the upper levels transition to exposed CLT, allowing the timber structure to become a defining feature throughout the apartments and shared spaces.

The use of mass timber sits alongside a range of sustainability initiatives, including a fully electric, gas-free design, rooftop solar and a targeted 5 Star Green Star rating.

Swimming pools, gyms, rooftop terraces and residents' lounges have long featured on buyers' wishlists, but as the way Australians live has changed, so too have the features that make apartment living more convenient.

Inca Property Group has lodged a State Significant Development Application (SSDA) for Dawn, a 53-apartment oceanfront development overlooking Mona Vale Beach.

The proposal, at 35-39 Darley Street East, would replace an existing 18-apartment strata building with a new owner-occupier-focused development comprising 53 two and three-bedroom apartments, including nine affordable built-to-rent residences delivered under the State's infill affordable housing scheme.

Positioned on a 2,679 sqm elevated site around 280 metres from Mona Vale Beach, the development has been designed to maximise panoramic ocean views while responding to the site's sloping topography.

<a href="https://www.apartments.com.au/developers/inca-property-group">Inca Property Group</a> Managing Director Josh Thompson said the State Significant pathway provided greater certainty for projects of this scale.

"This State Significant pathway gives the team real certainty to progress <a href="https://www.apartments.com.au/new-apartments/dawn-35-39-darley-street-east-mona-vale-nsw-2103">Dawn</a> through to completion," Thompson said.

"It allows us to acquire a one-off site, design it carefully and deliver the right offering for the suburb, assessed by the NSW Government's planning department."

The project is one of the first developments in the area to be assessed under the NSW Government's Low and Mid-Rise Housing policy, with the site sitting on the edge of the policy's designated inner area.

The proposal includes three basement levels providing 124 car spaces, alongside a range of resident amenities including a swimming pool, gym, sauna, wellness facilities and private plunge pools for selected ground-floor and penthouse apartments.

Located within walking distance of Mona Vale Beach, the town centre, Mona Vale Golf Club and the Royal Motor Yacht Club, Dawn represents Inca's first Northern Beaches project following the sell-out of Tara on Park in Waitara and Ellis Residences, currently under construction in St Ives.

Construction will be undertaken by Inca's in-house construction arm, GOP Constructions.

Dawn is the latest major apartment proposal for Mona Vale, with the suburb emerging as one of the key beneficiaries of the NSW Government's new Low and Mid-Rise Housing policy.

New developer One Living, led by industry veteran Joseph Scuderi, recently secured a site on Mona Vale Road, on the border of Mona Vale and Pymble, where it is planning around 140 apartments.

In the case of the Baird government strategy the proceeds from the sale of state ownership of the electricity network would be directed to the generation of pivotal capital works projects and not state debt reduction.
A 2013 report on the Electricity Network Regulation the Productivity Commission announced that electricity prices had risen 70% in real terms over the previous five years with structural problems most apparent in NSW. The Productivity Commission went on to say: “There are strong arguments for privatisation of those businesses. There is no evidence that the productivity, reliability, quality or cost performance of private – sector electricity network businesses is worse than their public sector equivalents. To the contrary, the evidence in Australia and internationally suggests that such private sector enterprises are more efficient.”

A recent report commissioned by the Property Council of NSW has found that Sydney is facing a housing crisis with an additional 190,000 homes needed to be constructed over the next 10 years. The report identified that since 2005 an average of just 17,002 homes had been approved by Sydney’s 43 councils each year. From a business perspective you’re not going to attract new housing projects unless you are rolling out massive new infrastructure community platforms.

Privatisation should not be a dirty word rather the dirty word clearly is lack of infrastructure spending by past NSW governments.
Sydney must absorb Newcastle, Wollongong and western Sydney into its business model by creating a world class metropolis. Given what’s been achieved in other countries there is no excuse why Sydney does not have a very fast train that connects all the cities.
Given that investors today are getting next to no return given the record low cash rate – investors can purchase syndicates that would allow them to invest in infrastructure projects <a href="https://www.businessspectator.com.au/article/2015/2/25/infrastructure/neat-fix-politics-infrastructure-funding" target="_blank" title="a neat fix to the politics of infrastructure funding.">a neat fix to the politics of infrastructure funding.</a>
Given that the self-managed superannuation funds are driving investment property in NSW due to a lack of choice such a proposal to attract these funds with infrastructure investment is a brilliant and a long overdue alternative. Naturally the big superannuation funds want as much of this pie as they can get so the state governments must offer allocations to ensure that everyone has equal investment opportunities.
From an investment perspective NSW can easily offer thousands and thousands of critical infrastructure investment funds for investors to diversify as against relying solely on the real estate markets.
Of course nothing can happen if we have a change in government given the alternative is simply too scary to contemplate. If NSW had previously had a strong infrastructure platform property prices would be nowhere near as high as they are today.
If the Baird government is successful at next month’s election and they stick to their infrastructure platforms there is a strong possibility they could become the most successful government in NSW history.

Although 'fad' and 'trend' are considered synonyms, in practice they have very different meanings.
A fad implies something fleeting and of little value that will pass soon without importance.
Trends, however, while they might be equally temporary, can provide us with valuable insight about where something is heading.
It's therefore worthwhile for any Australian property investor to have a closer look at some of the trends and hot topics which are defining the current market.
We found one of the most noticeable trends is the amount of investment activity in real estate at the moment.
Investors are becoming key drivers of growth and purchasers of new stock, which was the domain of first home buyers.
Investors have a natural advantage over first time buyers, due to their access to a greater amount of equity and income, and the fact that the expenses involved are tax deductible.
As a result, virgin buyers are finding it increasingly hard to compete with them.
A segment of the investor market which is becoming particularly more prominent is that of self-managed super fund (SMSF) investors.
The number of SMSFs in Australia is growing - 29% over the last five years, according to the Australian Taxation Office - and with it are the number of SMSF holders considering property as an investment.
Part of the appeal lies in the fact that investors can leverage their superannuation monies to fund themselves through retirement without relying solely on accumulation-based savings.
Also additional purchases are becoming increasingly common.
It's becoming almost a sport.
While buyers were previously happy to buy a single investment property and stick with it, more and more people are thinking in terms of multiple properties or portfolios.
When it comes to the most popular topics in the world of investment over the last three months, one of these was the record demand for high yield assets like dual income properties, duplexes or high rent properties.
While buyers were desperately looking for properties with yields of 7% or upwards, he warned that the search may not be so easy.
That market has been quite exploited, so it's really down to who you know as opposed to tripping over them now.
Land needed for a dual-income property - 450 square metres or greater in New South Wales - is getting tighter.
Because of a shortage of land, most of the lots released fall short of this number and unfortunately, legislation hasn't changed to fit this new state of affairs.
It seems that while investors are finding it ever more advantageous to enter the property market, getting the ideal investment property is still no piece of cake.

The Koonawarra estate, some 24 acres of private established gardens in the Blue Mountains, has been listed as a rental estate.
It's located at Mount Wilson, a popular weekend destination for more than a century. It would make a wonderful winter retreat just two hours from Sydney, then staying on for spring.
I am happy to take Cherry Cottage, the one loft bedroom cottage for guests. It was all originally part of Dennarque.
Charles Moore, the first director of the Botanical Gardens, also designed nearby Yengo that features an exquisite walled garden, embellished with 16th-century Catalan wrought-iron work.
I'd really like to see snow too, and stay for spring to do all the walks - Waterfall Reserve, the rainforest pocket in Davies Lane, the Cathderal of Ferns, Pheasants Cave, Chinamans Hat and perhaps even the track to the Wollangambe River.

Koonawarra Cottage is the charming single storey three bedroom cottage with a large front verandah which looks out over the expansive parklike gardens.
Every window has garden views, as you'd expect. 
I have always throught Mount Wilson was best placed for autumn viewing. Especially this year to escape the prevailing humidity of Sydney.
This property also has a tennis court so imagine the sunny exercise you'd get before the chill sets in, and the days are spent in front of the fireplace.
I seem to recall it was formerly the home of Mr. and Mrs. J. R. Armitage in the 1960s, but I could chase all that up with a bit more study on the chilly nights.
I once read that the walk from one end of Mount Wilson to the other along avenues of beeches, plane trees, oaks, liquidambers and cherry trees can move even strong men to poetry.
Let's see.

Which season for Koonawarra, Mount Wilson rental estate?

With all the talk on the impact of the mining slow down, let's not forget the other strong Hunter industries that are quietly achieving and employing the locals: tourism, business conferences and wine production.
Property Bloom has been project managing property developments in the Hunter region for over 14 years now and my research began with a study on the local wine and tourism area and their contribution to the local economy. There's nothing like sipping on a chilled glass of Hunter Valley Semillon whilst studying economics!
As reported by the Hunter Valley Wine and Tourism Association: "The Hunter Valley is the oldest and most iconic wine region in Australia with a heritage of over 180 years. It is the most visited region in NSW after Sydney attracting 2.2 million overnight visitors per annum. The Hunter Valley is one of the key pillars of the NSW visitor economy. The total impact of the local tourism and wine industry is worth $520.6 million, generating over 2800 jobs."
Tourism in the Hunter Valley is benefiting from the massive industry of holding concerts in the vineyards. There's been an impressive array of high-profile performers that have played in the Hunter Valley over the past 10 years: Elton John, Lionel Ritchie, Burt Bacharach, Blondie, Neil Diamond, Crowded House, the Beach Boys, Leonard Cohen, Alicia Keys, Tom Jones and Fleetwood Mac.  If you want a bit of the action get up there to see legendary Swedish pop-rockers ROXETTE on the 28th of February, their special guests include Eurogliders, Dragan and Boom Crash Opera. These bands are straight out of my youth and Joyride was one of my first albums (I'm showing my age)!
When Elton John performed at two shows at the Hope Estate in 2011, it was one of the busiest weekends the region had seen. Thirty-two thousand people attended over the Saturday and Sunday.
A BA Market Surveys report, commissioned by Cessnock City Council and Hunter Valley Wine Country Tourism, showed accommodation over the Elton John weekend was at 99% capacity.
The average daily case sales from cellar doors rose from 41 to 122 across all wineries on that weekend.  The recently signed Chinese-Australian free-trade agreement is likely to boost the Hunter economy and wine exporters will benefit from reduced tariffs.
A separate BA Market Surveys report showed the 2009 Fleetwood Mac concert contributed $13.28 million to the local economy, not including ticket sales. Hope estimates the figure for the 2011 Elton John concerts at around $20 million.
The benefits flow through to other industries as a result of the concerts like the oyster farm in Port Stephens (also part of the Hunter Region) who provided four hundred dozen fresh oysters for picnic baskets. Supermarkets and other retailers in Cessnock see sales boosted by weekenders stocking up on their way to the vineyards.
While concert-goers lead to spikes in cellar door sales and accommodation bookings, so does the strong business tourism and large midweek conference industry. There is also the wedding and in-bound tourism markets that bring a lot of money into the region.
A new $6 million conference and event centre has just opened at the Crown Plaza and General Manager Robert Coates said: “The new Conference and Events Centre will position the Hunter Valley as a leading Australian conference and events destination. Offering guests the latest technology and a light-filled design in a state-of-the-art venue with a combined 2,000 square metres of pre-function, meeting and exhibition space coupled with a unique wine country destination. We have already received large scale group bookings for 2015 resulting in 20 percent growth in business events and many in the pipeline for 2016 – it looks set to be a very busy year for us.”
All these tourists need good roads to drive on and so the New South Wales government has just announced $16.7 million in 'Resources for Regions' funding to upgrade roads in the Hunter's wine country region.
The project, to upgrade Hermitage and Broke Roads, will see more than 12 kilometres of roadway rebuilt, improvements at intersections, new tourist signage and lighting.
The money will also fund construction of a new on-road cycleway connecting the Hunter Expressway and New England Highway with Broke Road.  Infrastructure upgrades such as road works brings contractors to town and they need to rent properties.  We've noticed an increase in demand for our granny flats and villas as single contractors (usually men) want small, low maintenance properties to rent. We have just completed a duplex which was leased immediately to tenants working in the tourism industry.
Understanding the current and future industries in the locations you choose to invest in property is very important.  Finding locations with industries that not only endure but recreate themselves is like finding gold.  The property market’s long-term performance is very closely tied to industry and employment opportunities and the more diverse the local economy the better.

There's a lot more to the Hunter Valley's economy than mining: Jo Chivers

Sweetwater, a world class winery located in the rolling hills of the Hunter Valley, has been listed for sale.
<a href="https://jurds.com.au/listings/rural_sale-319321-pokolbin/" target="_blank">The 48 hectare Pokolbin property</a> is being marketed by Jurds Real Estate as the most significant country vineyard estate in Australia.
Inspired by southern European vineyard estates, in it is a planned hamlet with a series of interlocking properties of differing eras.
Producing Cabernet Sauvignon and Shiraz on 16 hectares, there is also a cellar door.

There is private owners and guest wing accommodations, entertaining loggia and plunge pool. There is also an olive grove.
Sweetwater Wines, part of the Hardie Holdings group, purchased the land in 1997 in Belford from Belford Pastoral Company, which was originally granted to the pioneering Richard Jones, a merchant and pastoralist.
In 1829 Jones had received 10,000 acres at Singleton in the Hunter Valley from where he established one of his finest vineyards in the Patrick Plains Shore at Sweetwater Creek off Old North Road. 
In 1844 from Jones’s first plantings, his vineyard produced a total of 2,000 gallons of wine.

When Sweetwater Wines purchased the property, there was clear evidence of several vineyards, which at that stage consisted of rows of mainly dead, but in some cases struggling vines with huge old knarled bases and the odd spindly vine struggling to survive. These were being grazed by cattle, and on advice from our viticulturist, dozed and burnt, as a precaution against plant disease.
Sweetwater Wines had Brian McGuigan give early advice on the layout and planting, having worked on the vineyard when he was about 18 years old.
Alan Jurd at Jurds Real Estate has Sweetwater for sale with $30 million plus expectations. "The enquiry levels of 2007 have started to return given the current exchange rate," he said.

Australia's most easterly home - by only a few metres - set beneath the towering Byron Bay lighthouse, has been listed for 1 April auction.
Rod Smart of Ray White Burleigh Waters is quoting $4 million plus.

The home at <a href="https://raywhiteburleighwaters.com.au/nsw/byron-bay/1263433/" target="_blank">9 Brownell Drive</a>, Byron Bay, is a split-level four-bedroom home, 100 metres' walk from Wategos Beach, and above the walking track, but under the Cape Byron Lighthouse on Australia's most easterly headland.
Its peak season nightly rental rate has been $1,429.

Byron Bay is 800 kilometres north of Sydney and 170 kilometres south of Brisbane.
It's a prestige trophy home street. Social commentator Craig McGregor and his wife, Jane, sold their Wategos Beach property on the street for $4,475,000 in 2009. Their four-bedroom Brownell Drive house was Ian McKay's first Byron Bay architectural commission. It had been their retreat for 30 years and their permanent home since they sold in Bondi Junction in 2000. It came with a Terry Dorrough-designed addition. It was on the market for six months before Gold Coast orthopaedic surgeon Dr Stephen Rackemann bought it through First National agent Chris Hanley.
At 17 Brownell Drive architect Christine Vadasz designed a distinctive house high above Wategos Beach in 1995.
The street's most recent sale was $5.9 million in May last year when the <a href="/news/wing-house-the-peter-stutchbury-designed-byron-bay-trophy-house-sold">Peter Stutchbury-designed Wing house</a> was sold.

Australia's eastern most home at Byron Bay listed for Easter eve auction

Bilpin former art gallery offering with tourist potential

Recent claims from the Owners Corporation Network that the changes to the Home Building Act will lessen protection for apartment owners in relation to defective work are false, according to the Urban Taskforce.
Urban Taskforce CEO Chris Johnson said that the definition of what a ‘major defect’ is in the amendments is clear and includes defects that prevent a part of the building being used for its intended purpose. This includes fire safety or waterproofing, he said.
“I can’t see how the Owners Corporation Network (OCN) interprets this to mean a lowering of importance for waterproofing or fire safety system defects,” he said.
“The government’s own website on the changes to the Act clarifies that a faulty waterproofing membrane that caused water to leak into only one room would be a major defect.”
He said that they had worked with consumer groups to lessen funds spent on legal battles over defects.
“The industry and OCN agreed to a package of changes that ensure quality builders and developers will not be continually fighting claims that have dubious evidence. This included a new definition of major defect which we thought was a fair benchmark for all concerned,” he said.
“It is concerning to now see the state opposition quoting OCN claims that says 85% of apartments since 2000 have defects. These assertions are actually based on a survey by the City Futures unit at the University of NSW and is based on less than 300 respondents of which half said they had no problem getting the defects fixed.”
He said that, in fact, there were 600,000 strata units in New South Wales during the time of the survey so the 300 respondents were a small figure to base the study on.
“With a growing interest in apartment living it is important that quality buildings are constructed and that any defects are quickly rectified. The changes to the Home Building Act would seem to be contributing to a better process for ensuring quality and for managing defects where they occur,” he said.

Apartment owners not less protected under Home Building Act changes: Urban Taskforce

New South Wales Fair Trading Minister Matthew Mason-Cox claims changes to home building laws will increase protections for consumers.
The <a href="/news/nsw/changes-to-nsw-home-building-laws-coming-this-week">new laws</a>, which will be enforced from today, include changes to licensing for builders – both professionals and owner-builders – and changes to the eligibility of building defects for compensation.
Mason-Cox said the changes were intended to modernise industry practices.
"From today, builders and traders face up to 12 months in prison if they are repeat offenders of unlicensed contracting work or don't have the required insurance," he said.
Licensing changes also take aim at illegal phoenix schemes, where an indebted business shuts down and resumes operations under a new name.
"At its core, these new home building laws are about ensuring NSW consumers are appropriately protected without creating unnecessary red tape and regulation that will stifle industry growth and investment," said Mason-Cox.
However, some claim the changes will <a href="/expert-insights/investing/nsw-home-owners-dodgy-construction-claims-curbed-by-government">degrade consumer rights</a> and property research and investment firm Aviate has warned that the new laws mean investors must now be more vigilant when purchasing properties.
One of the major aspects of the Home Building Amendment Act includes a change to the warranty period a builder must provide for new works.
A six-year warranty now only applies for "major" defects, which means there is a threat of collapse or the building is uninhabitable, while there is now no legal distinction between structural and non-structural defects.
All non-major defects will only be covered under the standard two-year warranty, even if they are structural defects.
Aviate Group's Neil Smoli says buyers must now take greater care.
"Investing in property is typically seen as low risk but it's only low risk if you take all the necessary precautions and undertake the proper due diligence prior to investing," said Smoli.
"Limiting the ability of purchasers to take action against builders for defects means the need to work only with builders and developers with a proven track record is vital. The company responsible for delivering a project must take pride in their work and be able to demonstrate that their other projects have been an enduring success."
He urges consumers to research builders before engaging their services.
