High-profile apartment defect cases have changed the way many NSW buyers approach purchasing, putting greater scrutiny on building quality, strata records and the parties behind a development before a contract is signed.

The industry buyers are assessing today, however, is also different from the one in which cases such as Opal Tower and Mascot Towers emerged.

NSW has introduced a series of regulatory measures aimed at strengthening oversight of apartment construction, including Building Commission NSW, the Residential Apartment Buildings Act 2020 and the Strata Building Bond and Inspections Scheme. Under the latter, developers are required to lodge a bond, with independent inspections forming part of the process for identifying defects in new strata developments.

Those changes provide another layer of protection, but they haven't removed the importance of buyer due diligence.

For purchasers considering an apartment, that means looking beyond the residence itself. Building and strata history, strata reports, the track record of the builder and developer, the condition of common property and any known or planned expenditure by the owners corporation can all form part of assessing a building before purchase.

Whether the development is already complete can also materially change what can be assessed.

An off-the-plan purchaser is necessarily buying before the finished product exists. A completed apartment, by comparison, can be walked through before contracts are signed, allowing the purchaser to see the finishes, common areas and broader building as they have actually been delivered rather than relying solely on plans and renders.

It also removes exposure to some of the uncertainties that exist between an off-the-plan purchase and completion, including construction delays, cost pressures and builder insolvency during the delivery period.

<a href="https://www.apartments.com.au/project-marketer/equitifund-group">Projects by Equitifund</a> National Sales Director Ben Hamblett said that greater focus on tangible evidence is increasingly evident among apartment purchasers.

“The biggest shift we're seeing is buyers wanting proof, not promises,” Hamblett said.

“That's exactly why we deal in completed stock - you can inspect the building before you commit - and why we've backed every purchase with a cash bond against special levies.”

At <a href="https://www.apartments.com.au/buildings/the-lennox-parramatta-12-phillip-street-parramatta-nsw-2150">The Lennox</a> in Parramatta, that emphasis on a completed, inspectable product is already in place.

The 413-apartment, 46-level tower at 12 Phillip Street is being marketed by Projects by Equitifund, allowing prospective purchasers to inspect the residences, common areas and resident facilities before committing.

The Lennox also introduces another layer to the due-diligence conversation through Strata Surety.

The vendor-funded arrangement provides purchasers with a cash-backed bond held in their own solicitor's trust account from settlement. According to Equitifund, the bond covers any special levy raised during the applicable cover period and is provided at no cost to the purchaser.

Special levies can create an unexpected cost for apartment owners where an owners corporation needs funding beyond its existing strata contributions. Under NSW strata law, a special levy requires approval by owners at a general meeting.

Equitifund Executive Chairman Greg Huxley said Strata Surety was designed to provide something more concrete than reassurance about that potential exposure.

“Buyers have every right to ask hard questions about strata risk - the industry has given them plenty of reasons to,” Huxley said.

“Our answer isn't a reassurance, it's a bond. Strata Surety puts real money behind that confidence, held by the buyer's own solicitor, not by us.”

For The Lennox, its completed status also means purchasers can assess not only the apartment itself, but a building that has already been occupied and operating for several years.

Completed in 2021, the $300 million development, designed by <a href="https://www.apartments.com.au/architects/marchese-partners">Marchese Partners</a>, comprises one, two, three and four-bedroom apartments, with open-plan living areas extending to private balconies. Interiors incorporate engineered timber flooring, stone benchtops and integrated appliances, while many upper-level residences have views across the river and surrounding district.

Its established amenity can similarly be inspected in operation. Resident facilities include the Watermark precinct with a 20-metre pool, outdoor terrace, barbecue areas, gym, fitness studio and conference room, while ground-floor retail addresses the river walk and surrounding public space.

The Lennox is also home to the Southern Hemisphere's first fully robotic residential car park, which has now operated for several years. Its nine-level basement combines three conventional parking levels with six automated levels, accommodating 327 vehicles using technology from German firm Lödige Industries.

The remaining apartments form part of a limited release secured by Equitifund, following the sale of the majority of residences before and shortly after completion.

The regulatory environment around NSW apartment construction has changed considerably since the defect cases that reshaped public discussion around the sector. For purchasers, however, regulation is only one part of the equation. The ability to investigate a building's history, review its strata position and, where possible, inspect what has actually been delivered remains central to making an informed apartment purchase.

At The Lennox, its completed status provides that opportunity before contracts are signed, while Strata Surety adds a financial backstop against special levies beyond the protections already provided under NSW strata law.

Buying with confidence: What NSW apartment buyers should check beyond the defect headlines

Too often, heritage buildings become the podium for a contemporary tower. At <a href="https://www.apartments.com.au/new-apartments/623-collins-607-623-collins-street-melbourne-vic-3000">623 Collins</a>, <a>Sterling Global</a> challenged its design team to reverse that process.

The brief to <a href="https://www.apartments.com.au/architects/plus-studio">Plus Studio</a> was deliberately simple: "Don't design around the heritage. Design from it." It became the philosophy behind a project that draws inspiration not only from two landmark heritage buildings, but from Collins Street itself, a street layered with architectural history and civic significance.

That philosophy has shaped one of <a href="https://www.apartments.com.au/developments/melbourne-vic-3000">Melbourne</a> CBD's most considered residential projects, where the 1924 State Savings Bank and neighbouring Batman's Hill Hotel have become the architectural foundation for 623 Collins rather than remnants preserved beneath a new development.

Rather than approaching the site as a blank canvas, <a href="https://www.apartments.com.au/developers/sterling-global">Sterling Global</a> saw the existing buildings as the beginning of the story.

"Sites like this rarely become available," the developer said.

"623 Collins wasn't simply an opportunity to develop a prominent CBD site. It was an opportunity to restore and reimagine one of Melbourne's important heritage landmarks while contributing to the continued evolution of Collins Street. For us, the existing buildings weren't constraints. They were the beginning of the story."

Instead of mimicking the ornate heritage architecture, Plus Studio studied the proportions, rhythm and craftsmanship of the original buildings before translating those characteristics into a contemporary 42-storey tower.

"The brief challenged us to create a contemporary landmark that respected Melbourne's architectural history without becoming nostalgic," Plus Studio said.

"Rather than mimicking heritage, we sought to understand its proportions, rhythm and material language before translating those qualities into a distinctly contemporary architectural expression."

The practice says the State Savings Bank and Batman's Hill Hotel became the project's primary source of inspiration, allowing the heritage buildings and contemporary architecture to exist "in conversation rather than contrast." Generous planted terraces further soften the transition between old and new, creating elevated green spaces while reinforcing the dialogue between the restored podium and the contemporary tower.

That dialogue continues throughout the interiors, where Melbourne designer Fiona Lynch developed a material palette inspired by the idea of alchemy, balancing contrasting materials that reference both the Neo-Grec detailing of the original bank and contemporary urban living. The result is a series of spaces that feel timeless rather than trend-driven.

The project will deliver 316 residences across four collections, Heirloom, Signature, Reserve and the Penthouse Collection, with each responding differently to its position within the building, from the restored heritage podium through to the upper levels of the tower. The Heirloom Residences retain defining heritage elements including original heritage windows, generous proportions and high ceilings, while the tower introduces contemporary homes with expansive layouts and elevated views.

Amenities have likewise been designed to support long-term city living rather than short-stay convenience. Residents will have access to concierge services, wellness facilities including a pool, cold plunge, sauna, steam room and gym, alongside private lounges, entertaining spaces and dedicated resident clubs.

Sterling Global says that approach is resonating with buyers seeking permanence rather than novelty.

The Silo is planned as a mixed-use development incorporating apartments alongside a bar and centre activities including food and drink outlets, indoor sport and recreation, office and retail uses.

Architecturally, Bureau Proberts has conceived the building as a collection of vertically expressed, stepping forms rather than a single uniform tower. The composition rises from an articulated podium before being broken by a triple-height landscaped recreation level, with the upper section becoming more compact before terminating in a landscaped rooftop garden.

The project's name and architectural language draw directly from Newstead's industrial history. Patterned off-form concrete is proposed as the principal façade material, complemented by slender metal rod balustrades and extensive planting. The cylindrical and vertically ribbed elements give the building its silo-like expression, while curved balconies and planted edges introduce a softer subtropical layer.

“The Silo reinterprets its robust forms, scale and materiality through a contemporary subtropical architectural expression, creating a building that acknowledges its industrial legacy, while responding to the way the precinct is occupied today,” Bureau^Proberts said.

The recreation level is one of the defining breaks in the tower. Plans include a lap pool, mature subtropical planting and shared resident facilities within an elevated communal garden. Landscaping continues through the podium and onto the rooftop, where a further garden forms what the architects describe as a “subtropical crown” to the building.

Renders in the design report show the proposed “Silo Lane” as a substantial opening through the podium, framed by cylindrical concrete forms with cascading planting above.

Released a year ago, the app has already had more than 100,000 downloads, with 5,000 keen Australia users jumping on board.
The app’s founder and chief executive, Raul Moreno, told SmartCompany investors were already making money from its use.
“If you look at the reviews on the app store, you can see people are making money, they are very happy with it,” says Moreno.
Moreno says the app’s usefulness can be quantified by the iBillionaire index, which showed a wealth increase for users.
“People following the app have seen an 8% increase in their assets from November,” he says.
Moreno says iBillionaire will soon add several top Australian money men to the app for its Australian users, including investment manager Kerr Neilson and British-Australian businessman Michael Hintze.
He says Australian users would benefit from keeping an eye on the rapidly moving local retail sector.
Ecuadorian-born Moreno had the idea for the app while he was working in the finance industry, after his own Apple stocks fluctuated greatly while he was on vacation.
“Not having that information at the time was very painful,” he says.
“I think it’s critical to have access to this sort of information all the time.  And knowing what billionaires know, because they have more insight, is very useful.”

It’s unclear what effect the changes will have on Queensland’s real estate market.

…WITH SOME CAVEATS According to Attorney General and Minister for Justice Jarrod Bleijie, buyers won’t be complete in the dark when it comes to property values. If a seller consents, agents can also provide “market information about a property”.  “However, the bill allows an agent, with a seller’s written consent, to give any person,which includes, for example, a buyer or a property journalist, with market information about a property through the form of a comparative market analysis. There are also numerous online sources that provide market information about properties," said Bleijie. "This information provides objective, not speculative, data to assist a buyer to work out what a property may be worth to them. This information will also assist property journalists and writers to prepare real estate profiles and editorial pieces without the need for real estate agents or auctioneers to breach provisions preventing disclosure of price guides for auction properties. "Prohibiting agents from giving a price guide indication for auction properties, or properties for sale without a price, also creates a level playing field for the industry.” It’s unclear at this stage what “market information” entails.

COMMISSIONS Price guides aren’t the only form of disclosure to go in Queensland. Agents are now able to charge commissions even when they have a beneficial interest in a property, and will no longer have to disclose that commission to buyers. There is no cap on the commissions received, an issue which some believe may have an inflationary impact on prices. Labor MP Desley Scott said that: “It is preposterous to suggest that the commission being paid by the seller to the agent will have no impact on the buyer. It has the potential to make a significant difference in the contract price of a property. Where the contract price is distorted by a highly inflated commission, the buyer has no way of knowing what the real value of the property is. Transparency is paramount.”

CHANGES TO LICENSES The new legislation removes the requirement for property developers and their employees to be licensed. Until now, property developers in Queensland were the only in the country who were required to hold a license. Bleijie claims that this move will reduce red tape in the industry, removing barriers to entry to the property developer market and stimulate the economy. As the Property Agents and Motor Dealers Act has now been split, those who auction real estate will carry a different license to those selling other forms of property. The changes mean that anyone who auctions real estate and other asserts will have to hold two licenses.

USE OF LAND DISCLOSURE Under the Property Agents and Motor Dealers Act, agents had to notify a buyer if the land they were considering could not be used for residential development. That provision has been removed, meaning that sellers and agents are not required to tell a buyer, pre-contract, that the piece of land they are about to purchase cannot lawfully be developed for residential purposes. That means it's up to buyers who are considering residential development to investigate council requirements themselves before signing their contract.

After Property Observer published a<a href="/expert-insights/investing/seven-ways-to-detect-if-your-investment-property-is-being-used-as-a-drug-lab"> list of ways to check whether or not your tenant is turning your property into a drug den</a>, some industry members and property owners wrote in.
Smart Property Adviser’s Kevin Lee was among these readers, describing clients of his who had been taken for a ride after accidentally leasing their Adelaide investment property to drug dealers.
They had felt let down by property managers in the past, and took it upon themselves to self-manage – finding a couple with great references.
Lee explains that it was “happy days” for the investors at first, the tenant paying their deposit and bond completely in cash. In fact, he said, they appeared to be “such perfect tenants” that the investors were tempted not to renew their landlord’s insurance policy.
The tenants paid their rent on time and in cash. They also installed a new, powered, remote-controlled double car garage roller door at their own expense of $2,200, after the investors’ approval.
“The owners occasionally drove past the property, and it always appeared 'lived in', and when they conducted a routine inspection in early November 2013 nothing seemed suspicious,” explains Lee.
Fast forward six weeks, and the Adelaide police raided the properties, arrested the tenants, and revealed that the property was a hydroponic drug farm. The tenants had used false names, identification, referees and references, and resulted in more than 100 man hours worth of effort from the investors to resolve the problem, deal with police and the insurance company.
Despite this, they remain $2,000 out of pocket, Lee explains. Their landlord’s insurance policy covered them for $12,000 in costs to clean and re-wire the property and compensate for loss of rent.
Kevin Lee recommends the following:

<li>Do not accept cash payments – ask for payments via internet banking, such as BPAY or DEFT.

Investor stories: My house was turned into a hydroponic drug farm

The current NSW ICAC hearings which appears to link clandestine property developer payments to the NSW Liberal Party ought trigger the strategic delay, though not the death knell, of key NSW state government's planning reform initiatives.
Can the freshly installed Baird government ministry now be seen to handsomely reward the property development industry with long-desired legislation against the backdrop of alleged corrupt influence over their parliamentary colleagues and hangers on? Ditto the NSW opposition.
The controversial planning and strata legislation were already looking like courageous endeavours with an apprehensive public, but with the ICAC hearings to resume again in August and the March 28, 2015 election looming, both the NSW planning and strata reforms may possibly not deserve to be high on the agenda before the state Parliament rises in late November this year.
It's not to deny that the majority are cleanskins in the government, opposition and property development industry, but the pall over them all just doesn't sit well.
The new Planning Minister Pru Goward certainly doesn't shy away from doing the tough policy implementation - as her public housing housing tenant reforms showed - but already she has acknowledged her planning bill quandary. She understands the community concern over the derailed planning legislation going too far, even without the troubling backdrop that it now sits within.
''She understands there is community concern about getting the planning reforms right and she'll be very keen to listen to the views of everyone involved and work towards getting the balance right,'' her spokesman said on her appointment last month.
Then a few days later after assuming the ministry Pru Goward acknowledged the public perception.
"Development is a very expensive and highly-invested sector, and there will be plenty of people who want me to do what they want to make money for them, and every community in NSW will want me to listen to them," she told News Ltd papers.
Touted as the biggest shake-up in urban planning for three decades, the overhaul has effectively been in limbo since late 2013 when the Labor opposition and the minor upper house parties forced major changes, with 51 amendments. The government's plan to fast track the approval process for code-complying developments in high growth areas within a 25 day period was struck out in the upper house along with the intention to have the economic significance of mining projects deemed a principal consideration in the approval process.
The other key reform, and gift to urban renewal property developers, is the so-called "collective sales and renewals" initiative which will allow developers to evict strata home owners from their apartments. The renewals policy will actually force elderly owner occupiers out of their homes by developers. 
Currently 100% of strata lot owners have to agree to any replacement and redevelopment.
The property development industry has successfully lobbied the state government to reduce that to a 75% threshold with conciliation and mediation to encourage consensus.
The 75% threshold is a very generous threshold especially as each lot will have one vote, the decision will not be based on the more worthy unit entitlement. It is extraordinary that on such an important issue the lawmakers would seek to have the penthouse owner's voting entitlement the same as the viewless studio down near the laundry in the basement.
Yes it will start slowly with select blocks mostly with water views, but I think there will be an outcry once the electorate understands the disruptive compulsory eviction outcome, let alone The Castle movie-like denial of rights to ownership.
Of course the government has done the talk to the stakeholders routine, but once it filters down to the property ownership constituency there will be no tolerance of the 'Making NSW No.1 Again: Shaping Future Communities' spin. 
Hardly an initiative I'd suggest that reflects the moniker of the NSW Fair Trading department, but rather a scheme that developers have won from lobbying Macquarie Street.
One legislative clause apparently gives all lot owners and mortgagees just 60 days to consider the proposal and to seek independent advice. Hardly fair if you've been resident for many decades, and betcha the wishful stay-put strata owners get their letters early December, just before the lengthy Christmas summer holidays.
Compulsory acquisition by local council and state and national governments has been around in some form for ever for development purposes when they consider this to be in the best interest of the community - and leaves a sour aftermath, but this legislation is handing private nest eggs over to a ambitious private developer. It will involve resumptions eventually on a scale perhaps not seen since farmers lost land for the 1940s postwar soldiers settlements. Milder metropolitan dispossessions subsequently took place on the Macquarie University construction at North Ryde, the Eastern Suburbs railway line, and the Gore Hill freeway, all for the community benefit by government.
This time the supposed net public benefit is going to be harder to cop, especially in the face of big profits for developers. The proposed legislation is really just making life easier, and cheaper, for the developer who view the task of getting 100% as taking too much time and profit.
I don't see why the legislation can't have a graded threshold of say 95% where the building is less than 15 years old and 85% if the building is more than 15 years old. As we already occasionally see amalgamations can happen, and did so recently along the Cronulla beachfront when the Sunland Group consolidated a 2,398 square metre Prince Street site - from nine separate sellers - and then got approval for 12 luxury apartments.
There have now been three Fair Trading ministers with carriage of the task over the past seven months.
Anthony Roberts, the then Fair Trading Minister, told the Strata Community Australia (NSW) last November that the government’s commitment to change has been responding to the community’s calls to modernise the state’s strata laws.
NSW was the first jurisdiction in the world to introduce strata title laws, back in 1961, so there is no doubting they need modernisation, and the economic boost that will come from infill housing, rather than greenfields development. Some 30% of residential strata schemes in the Sydney metropolitan area were registered more than 30 years ago.
Only 826 strata schemes have been terminated since 1961, out of over 72,000 schemes in New South Wales.
Almost all of these terminations have been made following an application to the Registrar General unanimously signed by the lot owners, with only five schemes being terminated by Supreme Court orders.
It is estimated that more than 30% of the State’s population live or work in strata and within two decades around half of NSW’s population will be living or working in strata.
Roberts said the government was undertaking a landmark reconsideration of the strata and community schemes legislation, which will lead to important reforms in the sector in 2014. Termination of a strata scheme without the unanimous support of all apartment owners occurs in countries including Singapore, New Zealand and the United States.
It was Robert's aim of the bill being introduced to Parliament early this year and to commence the new laws by the middle of this year.
Then Fair Trading Minister Stuart Ayres drafted legislation for cabinet approval this month, with hopes to table it in Parliament this month too.
Yesterday MLC Matthew Mason-Cox was appointed the latest Fair Trading minister.
He might reconsider the specifics of the drafts.
It's not just the Liberals who've found the going tough.
Previous Labor governments have averted the emotional legislative debate about property rights with developers expressing their frustrations since the days of the NSW premier Bob Carr.
Then in 2007 the Planning Minister, Frank Sartor, had plans for the Morris Iemma cabinet to drop the threshold to less than 100%, but a decision was made at the last minute to retain the status quo.
The Keneally government envisaged similar legislation in 2010. 
Stand by to watch the potential evictees heading off to the High Court with the Magna Carta of 1215 and the more recent Mabo judgment.
The drama of dozens of Daryl Kerrigans, mimicking the lines from the film The Castle, will be a news feast since compulsory acquisition is almost un-Australian.

Corrupt influence backdrop ought stall overly generous NSW strata and planning initiatives

Westfield Group has succumbed to shareholder pressure and announced it will be improving the terms of its proposed merger for Westfield Trust unit holders by $300 million.
Under the adjusted proposal, Westfield will reduce the net debt contributed by the group's Scentre Group - made up of the Australian and New Zealand businesses- by $300 million to $6.8 billion.
As a result, Scentre Group’s pro forma net assets, at 31 December 2013, will increase from $14,980 million ($2.82 per security) to $15,280 million ($2.88 per security).
Pro forma gearing will reduce to 37.3%. Slightly above Scentre's targeted range of between 30-35%.
Last December, Westfield proposed splitting up its $70 billion empire to create an international entity to be known as Westfield Corporation.  The rest of the business would be known as Scentre Group - to be made up of its local and New Zealand operations, along with the Westfield Retail Trust (WRT).
A number of WRT unit holders had reportedly expressed concerns about the price of the merger deal and the consensus was that proposal would be voted down at the extraordinary meeting in late May.  
Westfield Group chairman Mr Frank Lowy AC said: “We have met with key investors in both WDC and WRT, the overwhelming majority of whom support WDC’s strategy of restructuring along geographic lines and merging the Australia/NZ business with WRT". " In response to some concerns raised and in consultation with the independent directors of WRT, WDC has decided to improve the merger terms for WRT security holders.”
“The change improves the terms on which WRT security holders are gaining their ownership interest in WDC’s industry leading operating platform." At the same time, he said, the adjusted terms improved the financial position of Scentre Group by reducing its gearing ratio and enhancing its Funds from Operations (FFO).
The transaction is now expected to deliver a 6.6% accretion to WRT’s forecast 2014 FFO.

Westfield Group improves trust merger terms

One of the country's biggest office landlords has said "positive indicators" were emerging from Australia's office market in 2014.
In a March quarter operational update, GPT chief executive Michael Cameron said GPT was experiencing "good momentum" with 37,000 square metres of office lease signed or at heads of agreement.
He made a point of saying that GPT had seen "positive indicators in 2014, with levels of enquiry continuing to improve and vacancy across its portfolio reducing to 8.9% at 31 March 2014".
Highlighting the point, GPT noted its announcement this week that top law firm King &amp; Wood Mallesons had signed a new 11,980 square metre lease at its Governor Phillip tower in the Sydney CBD.
His comments were part of a broader update on the trust's performance.
Comparable moving annual turnover (MAT) in the quarter grew 1.5%, while specialty sales growth rose 4.4%.
Mr Cameron said it was please with the positive momentum of nine consecutive months of specialty sales growth at its centres, "however we remain conservative on the broader retail market with our medium term outlook for shopping centre sales, and rents remaining unchanged."
It is anticipating moderate growth. 
Management also noted that its logistics development pipeline continued to expand and that its $7.2 billion funds management platform remained a solid performer, and was poised to "substantially grow throughout 2014".

"Positive indicators" emerging in office market: GPT's Michael Cameron

A commercial building with a long-term tenant in Brisbane’s Strathpine has fetched $2 million.
A private investor picked up the 2,200 square metre property, at 3/104 Gympie Road, Strathpine.
The sale reflected a yield of 8.5%.
Handling the sale was Dillon Murphy and Trevor Nelson-Jones of Ray White Brisbane Northside.
The building is leased to Inside Sportz, with a returning rental income of more than $170,000 per annum. The lease is in place until 2017, with a five year option.
“The sports centre is situated on approximately 3,382 square metre of land and features indoor cricket, netball, soccer and beach volleyball facilities", said Mr Murphy.

A Camberwell shop and dwelling in Melbourne has sold under the hammer for $1.1 million.
The property was offered with vacant possession and purchased by a local investor, who has plans to refurbish and re-lease the property.
It sits on a land area of about 177 square metres at 931 Bourke Road, and features a two-level building of about 200 square metres with ground floor retail plus first floor residence.
Fitzroys agents Michael Ryan and David Bourke negotiated the sale. The vendor was  a local family, who had owned the property for more than 30 years.

Camberwell shop sells for $1.1 million under the hammer

The Caloundra Suncourt motel on the Sunshine Coast has been sold for $1.4 million. 
The prominent motel with redevelopment potential is located at 133 Bulcock Street and was sold to a local investor.
Len Greedy and Alan Gray of Ray White Commercial Caloundra handled the transaction.
Constructed on a 1,518 square metre block of land, the motel comprises 12 rooms split over two levels and includes a three bedroom manager’s accommodation.
Gray said redevelopment options for the property were varied and could include a mix of retail, office, medical and also residential units with water views.
He added that the purchaser had leased the motel operation to an experienced motelier for a limited period while he worked through the redevelopment potential for the site with an architect and town planner.
