<a href="https://www.apartments.com.au/developers/sunland-group">Sunland Group</a> has officially lodged plans for its first Gold Coast apartment project since the departure of the Abedian family from the company three years ago, unveiling a new high-rise proposal for a prominent Broadbeach corner site on Old Burleigh Road.

The application was submitted by an entity directed by Tom Jamieson, stepson of longtime Sunland leader Soheil Abedian, and Riaz Rezvanipour, brother-in-law of Sahba Abedian, Soheil’s son.

Sunland acquired the 1,283 sqm site on the corner of Old Burleigh Road and Armrick Avenue for $9.5 million late last year and is now seeking approval for a <a href="https://www.apartments.com.au/new-apartments/99-101-old-burleigh-road-broadbeach-qld-4218">42-storey tower with 81 apartments</a>.

Designed by <a href="https://www.apartments.com.au/architects/contreras-earl-architecture">Contreras Earl Architecture</a>, the proposed tower at 99-101 Old Burleigh Road would deliver a predominantly larger-format apartment mix aimed at the owner-occupier market. Plans include 17 two-bedroom apartments, 55 three-bedroom apartments, and nine four-bedroom residences across 35 residential levels.

The development also incorporates three basement levels, four podium parking levels, two levels of communal recreation facilities, and rooftop plant and equipment. A total of 189 car spaces are proposed, significantly exceeding the 90 spaces required under the planning scheme.

The architecture adopts a sculpted, curvilinear form, with deep wraparound balconies and integrated landscaping intended to soften the tower’s vertical expression. The planning report states the building’s “slender footprint/form provides a complimentary yet varied built form within the local streetscape” and contributes to “a varied, yet ordered skyline.”

Contreras Earl noted in its Architectural Statement that from the early stages, the project addressed a fundamental challenge: how to accommodate the required residential yield while avoiding the conventional model of a tower sitting on a rigid, fully resolved parking podium.

“The most direct response would have been to consolidate parking into a singular, flat podium and extrude a repetitive tower above,” the statement said. “While efficient, this approach would result in a consolidated built form with limited engagement with the surrounding landscape and public realm.”

Instead, the conventional podium model was “deliberately rejected”. The architects described the base of the building as “a landscaped architectural condition where structure, planting and circulation are integrated”.

“Rather than presenting a continuous built mass, the base of the building is articulated through a series of concrete planter elements that organise the podium into a fragmented system,” the statement said. “This approach reduces the perceived bulk of the lower levels while establishing a more permeable interface with the streetscape and adjacent open space.”

The site sits within the High Density Residential Zone and inside the City of Gold Coast’s unrestricted “HX” building height area, where the planning framework anticipates intensified residential development tied to the expanding light rail corridor. The planning report notes the area is undergoing “transition toward more intense development forms” given its proximity to Broadbeach, Surfers Paradise, and high-frequency public transport infrastructure.

Positioned directly opposite Broadbeach Park and within walking distance of Florida Gardens light rail station, the development would sit among a rapidly evolving stretch of Old Burleigh Road that has become one of the Gold Coast’s most active apartment development corridors.

The application joins a growing pipeline of luxury residential projects reshaping Broadbeach, including nearby developments by 5Point Projects, Polycell, and Graya.

The planning report argues the project contributes toward the Gold Coast’s long-term housing targets under the South East Queensland Regional Plan, which forecasts the need for more than 100,000 additional high-rise dwellings across the city by 2046.

The Minns Labor Government has established the new Bays West Delivery Authority to lead the development&nbsp;of the Bays West Precinct and Blackwattle Bay Precinct.&nbsp;

The Authority is charged with creating Sydney’s newest precinct, a thriving, connected, sustainable hub with White Bay Power Station as its cultural heart. Its vision is to build on the area’s natural, cultural and industrial history to shape a vibrant new neighbourhood.

The precinct will deliver up to 8,500 well-located homes, including a minimum of 10 per cent affordable and essential worker homes. Combine new housing with public open space, opening public access to the waterfront for the first time in more than 100 years, while retaining important deep-water facilities to support Sydney’s working harbour.

Located just minutes from the Sydney CBD and connected to a world-class metro, ferry, walking and cycling links, the Bays West precinct will rebalance housing growth towards well-serviced inner-city locations and help tackle the state’s housing crisis.

The Bays West Delivery Authority,&nbsp;an agency of the Department of Planning, Housing and Infrastructure, will report to the NSW Minister for Lands and Property who already has oversight of major precinct renewal projects including at Blackwattle Bay and Barangaroo.

As part of the broader Bays West transformation, the Minns Government recently announced that a proposal from Lendlease to redevelop part of the Bays West Precinct has progressed to Stage 2 of the NSW Government’s unsolicited proposals process.

The Minns Labor Government has also confirmed the Bays West precinct will have a new suburb name. This will be the first major suburb built in close proximity to Sydney’s CBD in decades and will encompass the area currently being referred to as Bays West, including Glebe Island and the White Bay Power Station. Served by a new Metro station just five minutes from the CBD, it will become one of the most populous suburbs in the Inner West and one of Sydney’s premier cultural destinations.

An early works program is taking shape, which&nbsp;includes the first stages of an international design competition.&nbsp;

The aim of the Bays West&nbsp;International&nbsp;Design Competition is to&nbsp;ensure design excellence is embedded in the project from the start. The competition will deliver an&nbsp;urban framework that defines the character, ambition and long-term identity of&nbsp;this&nbsp;former industrial precinct as it transitions to a vibrant, inclusive and sustainable residential&nbsp;neighbourhood.

The competition will be led by the Bays West Delivery Authority in partnership with Government Architect NSW.&nbsp;

It will launch with an invitation for a global Expressions of Interest, before moving to an invitation-only stage that will be assessed by a panel that&nbsp;will provide advice to Cabinet who will select a winner.

Premier of NSW, Chris Minns said the establishment of the new Authority is the first step in transforming the Bays West precinct into a vibrant, livable suburb minutes from the Sydney CBD and two stops from Hunter St Station on the Metro West line.

“The Authority will deliver well-located homes close to the heart of the city and integrate the new precinct with Blackwattle Bay and the new Sydney Fish Market.

“This is a generational opportunity to build a new suburb on the city’s edge and open the harbour foreshore to the public for the first time in a century.”&nbsp;

Minister for Lands and Property Steve Kamper said the new Bays West Delivery Authority established by the Minns Government will turbocharge the development of Sydney’s newest suburb.

“The Authority is working at a record pace to deliver an international design competition, planning pathways and a financial model so that this development benefits Sydney with well-designed homes in a central location, close to public transport, jobs, entertainment and essential services.

“If we want Sydney to stay liveable and affordable, we need to be bold about using underutilised government-owned land to deliver homes for the future while making sure essential working harbour functions can be accommodated.”

Bays West Delivery Authority established to "turbocharge" Sydney’s newest suburb

Around 400 additional homes could be built at Southwark Grounds on Port Road, lifting total site capacity from 1300 to around 1700 dwellings.

A recently approved code amendment would allow apartment towers of up to 14 storeys in some areas of Renewal SA’s redevelopment of the former West End Brewery.

Renewal SA Acting Chief Executive Shane Wingard said he welcomed the code amendment, with the increase in heights and homes making a positive impact on the supply of high-quality, well-connected housing close to the city.

“By going higher across some parts of Southwark Grounds, we are adding a substantial number of very well-located homes with little impact on project delivery time or planned open space,” Mr Wingard said.

Since the project officially launched in 2025, Mr Wingard said more than 12,000 enquiries had been received about living at Southwark Grounds.

“The very strong early interest we’ve seen since homes were first released in the precinct reinforces our plans to create more housing opportunities,” he said.

The Southwark Grounds code amendment was launched in December last year, with community engagement undertaken over five weeks from January.

It proposed increasing maximum building heights from eight to 14 storeys on the eastern section of Southwark Grounds, and to 12 storeys across the remainder of the site, with minimum building heights ranging from two to four storeys.

The code amendment was implemented through an Early Commencement policy in late January, allowing developers to quickly explore the viability of increased height and housing yield while other planning processes continue.

One of the first developers delivering apartment sites have already finalised redesigns to increase the number of apartments following the code amendment.

Samaras’ development adjacent to the future Colonel Light Park is now planning to deliver 125 apartments across 11 storeys, significantly greater than original plans of around 50 apartments across four storeys.

The developer is also exploring the potential for additional affordable housing outcomes.

Most of the apartments at Southwark Grounds will be delivered within a master-planned precinct on a large parcel of land on the eastern portion of the site, covering around two-thirds of its 8.4 hectares.

Wingard said detailed precinct planning over the coming months may identify further opportunities to increase yield further that could see total apartment numbers at Southwark Grounds, exceed this number.

Affordable homes at Southwark Grounds will also see a net increase, with Renewal SA maintaining its commitment to a minimum of 20 per cent affordable housing across the development.

Civil works have begun across the site, with construction under way on the first new roads surrounding a townhouse precinct in the south‑west corner of Southwark Grounds. This includes Renewal SA’s 17 Founder’s Row homes, which are on track for completion by Christmas.

“We expect to have people living at Southwark Grounds by the end of the year, so delivering roads and public spaces for those residents is among our highest priorities.”

Construction of 40 townhouses off Anderson Street, known as West Village and being delivered by Contour, is forecast to begin in mid‑2026. Kolabb’s Anderson Lane development will follow shortly after, delivering a further 26 townhouses.

Southwark Grounds is a state government‑led urban renewal project now set to deliver around 1,700 homes over the next decade.

Homes will be supported by a supermarket, a range of retail and hospitality offerings anchored by a revitalised Walkerville Brew Tower, a childcare centre, car parking and well‑connected public spaces.

400 new homes planned for Adelaide's former West End Brewery site

Brisbane developer&nbsp;<a href="https://www.apartments.com.au/developers/cavcorp">Cavcorp</a> has lodged plans for a new mixed-use residential development at <a href="https://www.apartments.com.au/new-apartments/55-wyandra-street-teneriffe-qld-4005">55 Wyandra Street</a>, Teneriffe, anchored by an 85-metre public laneway designed to reconnect the suburb’s riverfront with the Gasworks precinct.

The buildings, known as Teneriffe House and Teneriffe Lane, would replace the existing Queensland Cotton head office site with a 15-storey residential tower transitioning to eight storeys toward Helen Street. The project has been designed by Plazibat Architects and lodged as a code assessable development application for 93 apartments across a 3,401 sqm mixed-use site within the Newstead and Teneriffe Waterfront neighbourhood plan.

Central to the scheme is the transformation of an existing service easement into a publicly accessible cross-block connection linking Wyandra and Helen Streets. Cavcorp says the new laneway will act as both a pedestrian shortcut and a landscaped civic space between the Teneriffe Riverwalk, ferry terminal, and Gasworks precinct.

“The revised proposal delivers a legacy public-realm cross-block link, permanently secured for community use, transforming an existing private easement into a safe, high-quality pedestrian connection between the Teneriffe heritage riverwalk and the Gasworks–Long Island precinct,” the planning report states.

The laneway will sit beneath a large subtropical loggia integrated into the podium levels of the development. The design incorporates deep landscaping, water gardens, lobby spaces, business lounges, and ground-floor apartments to create what Cavcorp describes as a climate-responsive “urban verandah.”

The tower itself has been designed as a slender form with recessed floorplates and curved translucent corners inspired by contemporary Japanese architecture. The building height aligns with the Commercial Road precinct controls, which permit towers up to 15 storeys within proximity to Longland Street.

The project will comprise a mix of larger-format apartments aimed at owner-occupiers, downsizers, and families. The proposed apartment mix includes 11 loggia apartments across the lower levels, 50 four-bedroom Sky-Terrace apartments from levels three to seven, and 32 Sky-Pool Homes occupying the upper tower levels. The Sky-Pool Homes will feature private thermal plunge pools integrated into oversized balconies.

According to the application, the apartments are intended to reinterpret the scale and character of Teneriffe’s woolstore conversions and Queensland homes within a vertical residential format.

“The sky-pool homes build on Cavcorp’s previous projects and introduce a distinct apartment typology to Teneriffe, informed by both local and international precedent and responding to an identified market demand for enhanced safety, space and amenity,” the planning submission notes.

A major focus of the proposal is its five-level wellness and lifestyle offering, extending from the basement through to the rooftop.

Amenities proposed include a rooftop Swim &amp; Racquet Club with a 25-metre Olympic lap pool and tennis court, coworking spaces and libraries, golf simulators, wine storage, concierge facilities, business lounges, pet wash areas, and rooftop longevity-focused wellness spaces with spas, outdoor fitness zones, and landscaped terraces.

All parking will be concealed within basement levels accessed from Wyandra and Helen Streets. Cavcorp says the deep-basement engineering approach allows the entire ground plane to prioritise landscaping, pedestrian movement, and active frontage rather than vehicle infrastructure.

The development continues Cavcorp’s concentration in Newstead and Teneriffe, where the Brisbane developer has delivered a number of apartment projects including Lucent, Le Bain, and Luminare, as well as the Long Island Wellness Precinct nearby. Several of those projects have received national design and architecture awards, including recognition under Brisbane’s “Buildings that Breathe” program.

Cavcorp unveils wellness-focused Teneriffe House and Teneriffe Lane apartment buildings

Focus Group Investments has lodged plans for a new apartment development at <a href="https://www.apartments.com.au/new-apartments/64-70-hanover-street-fitzroy-vic-3065">64–70 Hanover Street</a> in Fitzroy, seeking to utilise the Victorian Government’s recently introduced Great Design Fast Track pathway to accelerate approvals for the project.

The proposal is among the latest developments to emerge through the state-led initiative, which was established to fast-track well-designed residential projects in activity centres and transport-connected inner-city locations. The pathway allows qualifying developments that meet elevated design and housing benchmarks to bypass traditional council planning timeframes and instead be assessed directly by the Department of Transport and Planning.

Designed by SJB, the development will comprise a mix of apartments above activated lower levels, with a strong focus on architectural articulation, landscaping, and communal amenity. The design response seeks to balance the industrial character of Richmond’s former warehouse precincts with a more contemporary residential form.

Proposed are 63 new dwellings, a wide ranging mix of studio, one-, two-, and three-bedroom apartments, and townhouses and duplexes. They will be spread across a part-three, part-eight storey building.

The Planning and Urban Context Report by Tract says the development is of an "exemplary architectural standard" and has been carefully crafted by SJB Architects.

"Dwellings&nbsp;will benefit from excellent access to natural light, cross-ventilation opportunities and extensive communal space," the report noted.

The architectural material highlights the project’s integration of landscaped elements and communal spaces throughout the building. The proposal also incorporates sustainability initiatives aligned with the Victorian Government’s push for higher-performing apartment developments under the fast-track program.

The Great Design Fast Track was unveiled by the Victorian Government in 2024 as part of a broader housing supply strategy aimed at accelerating the delivery of new homes. Projects assessed through the pathway must demonstrate high-quality architecture, sustainability outcomes, and housing diversity while being located close to public transport and existing infrastructure.

Focus Group, founder and led by Paul De Lutiis, is increasingly active across Melbourne’s inner suburbs, targeting well-connected urban renewal locations suited to medium and higher-density residential development. The Fitzroy proposal continues that strategy, leveraging the area’s strong transport links, established retail amenity, and proximity to the CBD.

Fitzroy has been one of the most popular spots for developers and buyers in recent years. The likes of PACE Development Group, SMA Projects, Crema Group and Chapter Group, currently selling projects in the suburb.

National Australia Bank (NAB) has brought forward the timing of the first RBA cash rate cut by three months.

NAB is now expecting a cut in February, in line with ANZ and Westpac, having initially thought a cut wouldn't come until May.

Commonwealth Bank, the nation's largest lender, still thinks the first cut will come in December.

NAB changed its call following the August monthly inflation figures that were released at the end of September, showing it had dropped to 2.7 per cent.

"The risk has been skewed to a first cut earlier in 2025, and today’s change acknowledges the balance of risks has likely shifted sufficiently for the RBA to feel comfortable cutting a little sooner than we earlier expected," NAB noted in its latest update.

They added that the cadence of the cuts may be faster than its central profile.

"Domestic inflation pressures are cooling, but only gradually, and we continue to expect the conditions for a cut will not be in place this year.

NAB believes the easing cycle will end at 3.1 per cent by early 2026, which is five cuts from the current 4.35 per cent cash rate.&nbsp;

CBA also thinks 3.1 per cent will mark the end of the cutting cycle, while Westpac is forecasting 3.35 per cent, and ANZ is the most pessimistic at 3.6 per cent, which would be just three interest rate cuts.

Canstar Data Insights Director, Sally Tindall, says if core inflation continues to track in the right direction, or unemployment starts to accelerate significantly, we could well see a cash rate cut as early as February of next year.

“All four big banks now believe the RBA will be ready to cut the cash rate in just over four months’ time, if not before, in the case of CBA.

“However, the outlook for both inflation and unemployment is still highly uncertain. A couple of wobbly sets of inflation data could see the RBA holding for longer, particularly if unemployment remains relatively steady."

The consensus among economists is for at least one more rate cut in 2012 following yesterday’s unsurprising decision by the RBA to leave the cash rate unchanged at 3.5%.
Post-decision analysis focused on RBA concerns about China and the global economy while also noting comments from RBA governor Glenn Stevens that in Australia, “most indicators available for this meeting suggest growth has been running close to trend” while mortgage rates remain encouraging for borrowers, running currently “a little below their medium-term averages”.
Westpac chief economist Bill Evans is tipping a 25-basis-point rate cut at the RBA's November board meeting, but also expects a further rate cut in December.
“Broadly speaking the assessment of the global economy appears to be more downbeat, while there is little evidence of any change in the view on the domestic economy,” says Evans.
Evans highlights that “the outlook for China is more uncertain and that the terms of trade have declined significantly”.
“We expect that accumulating evidence that the domestic economy is losing momentum; the labour market is genuinely weakening; financial conditions are tightening due to the divergent behaviour of the terms of trade and the Australian dollar; and the global growth environment remains uncertain will ensure that a convincing case for a further monetary ease is apparent by that November meeting.
“The bank is clearly keeping its options open despite the fact that we assess that it is markedly closer to a rate cut stance than it was a month ago. However, the evidence on the domestic economy will need to make a stronger case for a rate cut than has been the case over the last few months.”
Commonwealth Bank economist John Peters says the bank has retained its view of a 25-basis-point rate cut in the fourth quarter, with the main pressure for lower rates comes from global downside risks.
“If anything the RBA now sees the international growth outlook as a little more subdued as was the case a few months ago. Probably the most crucial line in the RBA’s statement accompanying today’s decision is some recent (international) indicators have been weaker, which has added to uncertainty about near-term growth,” says Peters.
Australian Financial Review economics editor Alan Mitchell says the big concern is the Australian dollar, which he says is not playing its role in cushioning the economy by falling with the terms of trade.
“A weaker dollar would be good for marginal mining projects and for the manufacturers and trade-exposed services,” Mitchell says.
“Currency experts are predicting that the dollar will adjust to the new and more sombre Chinese economic reality, but if it doesn’t, the Reserve Bank will have to weigh in with a reduction in the official cash rate.”
Fairfax columnist Malcolm Maiden says the RBA’s inclination to cut rates “has grown” since the last statement, with the focus on global growth being “no more than average pace” but with the added phrase that the outlook is “still on the downside”.
Maiden says RBA commentary on China’s growth has also become more cautious than a month ago.
He says the cash rate could be cut as early as October if local economic signals and overseas signals don’t improve.
HSBC Australia and New Zealand chief economist Paul Bloxham describes yesterday’s statement by governor Glenn Stevens as “more hawkish then expected” with “concerns about the 'death' of the mining boom were nowhere to be seen”.
“Having gotten rates down ahead of the recent weaker data from China and Europe, and the fall commodity prices, they clearly felt they have time on their side. Getting 'ahead of the game' early has this pay-off."
Bloxham adds that the statement also repeated an earlier mantra – heard at the RBA's recent parliamentary testimony – that is too early to judge the full impact of the rate cuts that have already been made.
Bloxham is tipping another 25-basis-point cut before year-end, but believes that the 100 basis points of easing priced in over the next year is overdone.
CommSec economist Savanth Sebastian says it is clear the RBA is happy to remain on the interest rate sidelines – “at least for the time being”.
"Policymakers seem comfortable with domestic economic conditions but continue to watch the global situation carefully. Europe, the US and Asia have slowed and the central bank seems particularly focused on the slowdown in China, given its importance to Australia’s growth profile."
He says the variable housing rate is applying modest stimulus to the economy, at present at 6.85% below the 15-year average of 7.20%.
ANZ economists Ivan Colhoun and Justin Fabo describe the decision as “widely expected”, with much of the governor’s statement “very similar to recent public pronouncements”.
“Overall, our views on the Australian policy outlook and economy are largely unchanged. “We continue to expect the RBA to end up changing its mind about interest rates, probably by November."
Colhoun and Fabo say the disappointing response of the sharemarket yesterday was likely a reaction that suggests the RBA “continues to read the economy in a slightly too optimistic way and evolve its view slower than the underlying economy”.
“The current trend to reduced resource investment (albeit more an issue for growth in 2014 and beyond) and the continuing downward trend for job advertising (the ANZ job ads series has now fallen for five months in a row) suggest at least one easing before the end of 2012 and further easing over 2013, perhaps more than our currently factored 50 basis points in total."
The next RBA board meeting is on October 2.

At least one more RBA rate cut tipped by economists for the year, with focus on China and exchange rate

As the housing market emerges from the traditionally quieter winter period and with dwelling prices generally flat at present, the RBA’s decision to leave interest rates unchanged  was the right move.
Despite figures from Deloitte this week perhaps surprisingly showing better than expected retail sales for the first half of the year, there is little doubt that a steady interest rate environment is essential for the ongoing health of the economy in general and the housing market specifically.
There is still a degree of caution among consumers, and sentiment remains subdued in most discretionary categories.
This caution extends to the housing market, and as such the decision to leave rates unchanged is an important platform for confidence to improve going forward.
Having said this, it is encouraging to see activity appearing to improve with the onset of spring. Traditionally the strongest selling period of the year, this spring takes on extra importance given the subdued transactional activity in the year to date.
The good news is clearance rates in the Sydney market have improved in recent weeks, and genuine buyers are emerging with a greater determination to secure their desired property.
Vendors who have waited for spring to go to market can expect well presented, realistically priced properties to be the subject of stiff competition.
The more affordable markets are attracting substantial interest from owner-occupiers as well as investors seeking to capitalise on the low interest rate environment, while the prestige market appears to have stabilised in recent times.
Current market conditions appeal to a broad range of buyers.
Despite the banks continuing to apply tight lending criteria, for those with the financial capacity the current market presents some compelling opportunities.
Investors are increasingly recognising the positive fundamentals, while first-home buyers’ incentives are still applicable for certain properties. In particular, those looking to upgrade have a significant opportunity to capitalise on the closing price differential between the middle and top-end markets, with prestige prices stabilising.

The RBA's decision to leave rates on hold will improve housing market confidence

RBA governor Glenn Stevens has released a statement today regarding today's RBA decision to leave the official cash rate on hold at 3.5%. 
"At its meeting today, the board decided to leave the cash rate unchanged at 3.5%," Stevens says.
"Having picked up in the early months of 2012, growth in the world economy has since softened. Current assessments are that global GDP will grow at no more than average pace in 2012, with risks to the outlook still on the downside. Economic activity in Europe is contracting, while growth in the United States is only modest. Growth in China remained reasonably robust in the first half of this year, albeit well below the exceptional pace seen in recent years. Some recent indicators have been weaker, which has added to uncertainty about near-term growth. Around Asia generally, growth is being dampened by the more moderate Chinese expansion and the weakness in Europe.
"Markets for key natural resources are adjusting accordingly. Some commodity prices of importance to Australia have fallen sharply in recent weeks. The terms of trade peaked a year ago and have declined significantly since then, though they remain historically high," Stevens says.
"Financial markets have responded positively over the past couple of months to signs of progress in addressing Europe's financial problems, but expectations for further progress are high. Low appetite for risk has seen long-term interest rates faced by highly rated sovereigns, including Australia, remain at exceptionally low levels. Nonetheless, capital markets remain open to corporations and well-rated banks, and Australian banks have had no difficulty accessing funding, including on an unsecured basis. Share markets have generally risen over the past couple of months, on very light volumes.
"In Australia, most indicators available for this meeting suggest growth has been running close to trend, led by very large increases in capital spending in the resources sector. Consumption growth was also quite firm in the first half of the year, though some of that strength was temporary. Labour market data have shown moderate employment growth, even with job shedding in some industries, and the rate of unemployment has thus far remained low.
"Inflation remains low, with underlying measures near 2% over the year to June, and headline CPI inflation lower than that. The introduction of the carbon price is starting to affect consumer prices in the current quarter, and this will continue over the next couple of quarters. The bank's assessment is that inflation will be consistent with the target over the next one to two years. Maintaining low inflation will, however, require growth in domestic costs to remain contained as the effects of the earlier exchange rate appreciation wane.
"As a result of the sequence of earlier decisions, interest rates for borrowers are a little below their medium-term averages. The impact of those changes is still working its way through the economy, but dwelling prices have firmed a little and business credit has picked up this year. The exchange rate has declined over the past month or two, though it has remained higher than might have been expected, given the observed decline in export prices and the weaker global outlook.
"At today's meeting, the board judged that, with inflation expected to be consistent with the target and growth close to trend, but with a more subdued international outlook than was the case a few months ago, the stance of monetary policy remained appropriate," Stevens wrote.

Dwelling prices have firmed a little: RBA governor's September 2012 meeting statement

The Reserve Bank of Australia has kept the official cash rate on hold at 3.5% today at its September meeting saying, as a result of the sequence of earlier decisions, interest rates for borrowers are a little below their medium-term averages.
Its the third consecutive meeting with no adjustment.
"The impact of those changes is still working its way through the economy, but dwelling prices have firmed a little," the bank said.
The last time the RBA adjusted its cash rate setting was in June, when it reduced the cash rate by 25 basis points from 3.75% to 3.5%.
In mid-August NAB changed its outlook on interest rates and is now the second lender forecasting interest rates to rise by mid-2013.
Before today's meeting, Westpac chief economist Bill Evans said "additional interest rate relief will be required to ensure robust growth of the Australian economy during 2013".
Tim Lawless, the RP Data national research director said from a housing market perspective, the RBA’s decision to keep rates on hold comes as no real surprise.
Based on the RP Data-Rismark Home Value Index we have now seen capital city property values remain in the black over three consecutive months with a 1% increase over June, 0.6% in July and no change in August.
"The improved market conditions over winter are a decent indication that conditions across the Australian housing market, at least from a macro perspective, is starting to stabilise. 
"While a further rate cut would be a welcome development from the industry, the RBA would be conscious of not overstimulating the housing market, in fact, stable home values are probably exactly what they are hoping for with the current interest rate setting.
"We may start to see the current interest rate setting start to flow through to other areas of the housing sector; dwelling approvals remain very low and we are yet to see a sustained improvement in transaction numbers despite the improvement to housing affordability," Mr Lawless said.

Twelve of the lowest mortgage rates, fixed and variable, from 5.62%

The AFG mortgage broking group processed more home loans in August than any month since March 2009.
The company processed $3,071 million worth of mortgages in August – an increase of 10% on July figures and 7.4% on August 2011.
AFG has 10% of the total national mortgage market.
The lending data showed that the proportion of new borrowers choosing fixed interest rates rose from 16.8% in July to 19.9%, as one in five new mortgage holders chooses to lock in rates.
August is  traditionally a strong month for mortgages, according to Mark Hewitt, AFG general manager.
"What’s different about this year is that borrowers have remained relatively active during the winter months – July was also a very strong month for us.
"There is a sense that conditions for property buyers are quite positive in terms of pricing and affordability.
"And a lot of existing borrowers are also taking advantage of heavy competition amongst banks on fixed rates," he notes.
The level of mortgages processed for investors was highest in New South Wales, at 44.7% of all new home loans  in August.
August's next strongest state for investors was Queensland, on 36.6%, then Victoria on 35.2%, South Australia on 29.5% and WA on 29.1%.
WA was the strongest state for first-home buyers, where 20.7% of new home loans were arranged for them, compared with 17.7% in Victoria, 13.4% in South Australia, 13.1% in New South Wales and 13% in Queensland.
The relative market share of major vs non major lenders held steady, with majors accounting for 77.8% of all new home loans and non majors 22.2%.

Property investors dominate NSW August mortgage activity, with first-home buyer strongest in WA: AFG

Over the next few weeks a lot of readers will be receiving tax refund cheques. According to the ATO, the average refund issued between 1 July 2012 and 20 August 2012 was $2,217 – not a small amount.
What should you do with it?
First job/tertiary student: If your credit card balance is getting close to the max, a tax refund should be applied to it. If your credit card is looking OK, you should make this money earn more money, without locking it away for the six months or a year of most bank term deposits. There are high-interest savings accounts that allow you to take out the money when you want, but check the fine print: many of these high-interest rates drop once your money has been in there for four to six months.
House savers: If you are saving a deposit for a house, a tax refund is best placed in your high-interest savings account, so long as you don’t have significant credit card debt or a high-interest car loan. For example, if you are paying 15% for your cards, and only getting 5% in your savings, perhaps use the tax refund to control your debt.
Mortgage payers: In most variable-rate mortgage accounts, once you’ve been paying it for 18 months or more, you are starting to pay down principal. Paying lump sums into the mortgage at this stage can noticeably accelerate the pay-out. Be warned: there’s no point doing this in most fixed-rate mortgages, and many variable-rate home loans won’t allow you to put in lump sums. So check your mortgage first.
Mortgage payers with kids: People with mortgage and kids have so many competing priorities for a windfall that there could be 20 places to put a tax refund cheque. My advice is to not absorb it into the general bank account: tag the money and make it work for you. And if you’re stressed and overworked, consider putting that tax refund into a holiday.
Business owner: Business owners can reinvest a tax refund straight back into the business or use it to pay down personal debt, depending on where the refund accrues. Either way, a tax refund shouldn’t be squandered.
Pre-retirees: People in their 50s are still working and paying mortgages, but also preparing for retirement. Look at topping up your superannuation, having first checked with an adviser about the benefits and latest rules. A tax cheque could also be placed into a high interest bearing account, or could buy high-yielding shares (that deliver dividends). A tax refund cheque into the mortgage is a good bet.
Retiree: In retirement investors looking for very stable, high-yield places to put their money. If you’re lucky enough to have a tax refund look at a high-interest account. There’s no point in banking this cheque in your bank transaction account – you’ll be receiving either a zero interest, or an interest rate so low that the monthly account fees wipe it out.

What mortgage holders should do with their tax refunds: Mark Bouris

Federal Housing and Homelessness Minister Brendan O'Connor has ruled out changes to negative gearing for property owners.
O'Connor said more needed to be done fast to promote housing affordability, speaking on Friday after meeting with state counterparts at a COAG meeting on housing and homelessness.
He said removing tax incentives for investors was not an option.
"Some people say [negative gearing has] attracted capital to the housing sector, which has increased housing stock," O'Connor said.
"Others talk about the lack of capacity for people to enter the housing market.
"But we've ruled out reviewing negative gearing (because) we believe it has been effective in some ways."
O'Connor said there were now better opportunities for owner-occupiers to enter the market with lower interest rates, low inflation and cooling house prices.
But it did not detract from the need to build more affordable housing for those on lower incomes.
"Eighteen per cent of people who use homeless services are under the age of 10," he said.
"We have too many women and children sleeping in cars."
Releasing more land was key to the supply of affordable housing, a states' responsibility, he said.

A mortgage broker in Nelson Bay, the most mortgage delinquent suburb in Australia, agrees the blame on its unenviable record rests with impulsive holidaymakers.
A recent report by Fitch Ratings found<a target="_blank" href="/news"> the NSW Hunter region town has a delinquency rate of 7.8% for mortgages more than 30 days in arrears</a> – five times the national average of 1.6%.
Local broker Ben Eick of Hunter Home Loans Solutions in Nelson Bay says the local residents aren’t to blame for the rate,<a target="_parent" href="/news"> echoing comments by local agents to Property Observer last week.</a>
 “My understanding is that the properties are bought basically from people coming up here on holiday, liking the area, seeing an apartment or unit that looks fantastic,” he told Australian Broker Online.
 He says holidaymakers bought a slew of properties in 2005 and 2006 gambling on prices going up.
 “[They thought] these places would keep appreciating … and of course what they’ve done since then is depreciate. And that’s where they’ve come unstuck.”
 Eick says changes in the rental market have made it harder for investors to rent the property out for most of the year.
 “The rental market up here isn’t especially strong, as opposed to other areas that are driven by the mining industry further up the valley.”
 “It can have a direct effect on whether they can pay their mortgage,” he says.
Local agents say the problem is due to people out of town letting their mortgage slip. They say the rate has also been driven up by a series of unit developments which have gone into receivership.
“There are a number of developments throughout the area which were highly geared and commenced or completed construction too late to benefit from the last boom, and the loan value is so high that the borrowers have experienced higher-than-average days on market to achieve a suitable sale,” agent Daniel O'Meara says.
The Fitch report blamed the high delinquency rate on “stagnation in the local housing market, which led to an accumulation of arrears in the 90+ day bucket”.
“The stagnation in the local housing market has increased the time required for foreclosed properties to sell, leading to an accumulation of arrears in the 90+ day bucket (4.57% as of March 2012).
“Furthermore, properties that are in arrears tend to be high-value properties, where the mortgage balance is on average almost three times the average loan balance in Nelson Bay,” says Fitch.

Over the last three years of negotiating with the ATO to achieve an ATO-approved product ruling for our Property Investor Trust ® (PIT®) we have learned a few things that we thought was interesting to share.
Firstly some background information:
The use of privately held trusts in Australia has had a long history dating back many decades. Over the years many taxpayers inadvertently began using trusts incorrectly and in some cases exceeded the boundaries beyond what was acceptable in the eyes of the ATO.
This national exposure led four years ago to the ATO reviewing their position with a specific focus on hybrid trusts. As a result in March 2009 a tax determination was issued TD 2009/17.
Unfortunately the 2009 determination TD 2009/17 created significant confusion and lack of certainty regarding eligible interest tax deductibility in the marketplace at a client, advisor and accounting professional level.
In short it stated that the uncommercial use of trusts could lead to the denial of full interest deductibility on borrowed funds.
Many well-meaning and respected commentators, including accountants, interpreted that to mean that all hybrid trusts were illegal, and many practitioners ceased using hybrid trusts. This was compounded by the fact that many banks also ceased lending to hybrid trusts.
Commerciality means that there must be a motive to make a profit. Some trust deeds were written where they would never make a profit and thus never need to pay tax.
For example, when the property went from negative gearing to positive gearing and tax was due to be paid, some trust deeds allowed an event to occur such that the positive rental was driven else where and no tax was ever payable.
While many hybrid trust deeds did not do this, the ATO took a blanket view and the tax determination in 2009 created sufficient confusion that most people ceased using hybrid trusts. This was a great way for the ATO to win the war without the battle.
While our legal advice, backed up by Queens Counsel was that a properly constructed hybrid trusts was fine and certainly our Property Investor Trust® fell into that category, the tax determination created sufficient confusion that many accountants and commentators argued among themselves. We were divided into two camps: Those for hybrid trusts and those vehemently against hybrid trusts.
In the meantime Andrew Forrest (Twiggy) of Fortesque fame took the ATO to court on a similar matter in respect to his hybrid trust.
Three High Court judges ruled in Forrest’s favour, ruling that interest was fully deductible for monies borrowed to buy income units in his hybrid yrust. However, the ATO argued that apportionment (which was not in its draft ruling issued at the time) was not considered in the Forrest case and retained its position in the final tax determination TD2009/17.
Apportionment is when interest deduction is not fully allowable and maybe restricted to the net rental received by the taxpayer where the unit holder was not entitled to both income and capital.
A tax determination is not law, and it’s simply the judges’ view.
Of all the thousands of cases that end up in court it’s been reported that the ATO only wins approximately 50%. That excludes the thousands of cases where the taxpayer had simply conceded without a fight even though they may have been legally correct but did not have the financial means to see it through the courts.
 However the tax determination created enough confusion that those who were conservative in nature simply followed the tax determination and the ATO would have succeeded in stopping something that would have taken years to pass through Parliament.
Tax determinations, whether they are legally correct or not, is a cost-effective and practical tool for the ATO to achieve its means.
The ATO product ruling granted to the Chan &amp; Naylor Property Investor Trust® brings certainty to the community and opens the way for others to pursue this course if they believe that holding a property in a trust is for them.
This will have also opened the door for many banks to once again begin lending to hybrid trusts. Certainly the banks are lending to our PIT®, with the evidence of an ATO approved product ruling behind it.
This will have huge positive ramifications for property investors in Australia.
Is a “product ruling” the same as a “private ruling?”
A “product ruling” is NOT the same as a “private ruling”. While some have been able to achieve a private ruling for themselves this is not automatically transferable to another taxpayer. Relying on someone else’s private ruling in the hope that the ATO will also see your situation in the same light and the same facts is not recommended.
A private ruling is specific to the individual taxpayer and may not be relied upon by another taxpayer.
A product ruling such as the Chan &amp; Naylor product ruling on the Property Investor Trust® is an approval on the product itself and is applicable for all who own a Property Investor Trust Deed® as long as the ATO conditions are followed strictly.
Our negotiations with the ATO have reviewed some major points (among many smaller ones) they wanted to see in one’s trust deed:
<ol>
<li>There needed to be a fixed entitlement to both income and capital. Many trust deeds were not clear and left open the ability for the trustee to distribute income and capital at their discretion.</li>
<li>The income units needed to have some capital/market value attached to it</li>
<li>The ATO would apportion the interest deduction if there was not a definitive fixed entitlement to both income and capital, meaning they would not allow interest deductions in full and maybe restrict it to the net rental income of the property.</li>
<li>There must be commerciality in your dealings, meaning there must be an intent to make a profit, albeit it could be at a later date. </li>
</ol>
In summary, the ATO will apportion the interest deduction if someone other than the taxpayer can or will benefit from the transaction.
We hope this article helps you understand the background to the ATO’s challenge to hybrid trusts and in so doing assist you in structuring your affairs correctly.
