<p>The Gold Coast economy has grown by 25 per cent since 2020/21 to surpass $55 billion, but perhaps the more significant story is what sits behind the headline number.</p>

<p>For decades, the Gold Coast has been viewed through the lens of tourism, lifestyle and population growth. The latest State of the City Report suggests that perception is increasingly out of step with reality.</p>

<p>Released by Invest Gold Coast, the report ranks the Gold Coast as Australia's largest non-capital city economy and, perhaps more notably, second nationally behind Sydney for Economic Complexity, a measure that assesses the diversity and sophistication of an economy.</p>

<p>It's a result that places the Gold Coast ahead of Melbourne, Brisbane, Perth and Adelaide, highlighting the extent to which the city's economic base has broadened beyond its traditional industries.</p>

<p>Today, the Gold Coast supports more than 350,000 jobs, is home to over 83,000 businesses and generates $19 billion in annual exports. Manufacturing now accounts for 62 per cent of international export growth, while sectors including health, education, advanced manufacturing, technology and professional services are becoming increasingly important contributors to the local economy.</p>

<p>Gold Coast Mayor Tom Tate said the report confirmed the city's evolution into one of Australia's most significant economies.</p>

<p>"As one of the most entrepreneurial, investment driven and opportunity focused economies in the country our ambition has been realised and possibilities are endless.</p>

<p>While population growth has been one of the defining stories of the past decade, the report points to a broader economic transformation taking place.</p>

<p>The city's knowledge economy now contributes $7.9 billion annually and supports around 31,000 jobs, while the health and wellbeing sector contributes $5.2 billion and employs more than 42,000 people. Together, the six priority sectors identified in the report account for almost $24 billion in economic output and more than 145,000 jobs.</p>

<p>One of the strongest examples is the Gold Coast Health and Knowledge Precinct at Southport. The 200-hectare precinct now contains more than $5 billion worth of health, education, research and innovation infrastructure and supports over 16,000 jobs.</p>

<p>The report also highlights the growing role of advanced manufacturing, particularly in aerospace, defence and modular construction.</p>

<p>Gold Coast-based Gilmour Space Technologies recently became the first Australian commercial company to attempt an orbital launch, while companies including Modscape and ModnPods are helping establish the Yatala-Stapylton corridor as one of Australia's fastest-growing advanced manufacturing hubs.</p>

<p>The city's entrepreneurial culture is also translating into business growth.</p>

<p>Since 2019/20, the number of businesses operating on the Gold Coast has increased by 22 per cent, while firms employing more than 200 people have grown by 80 per cent. The report suggests the next challenge is converting more local start-ups and medium-sized businesses into nationally significant companies.</p>

<p>Development activity remains another key indicator of confidence.</p>

<p>There are currently more than $23 billion worth of major projects underway across the Gold Coast, supported by a record 75 active cranes, a figure that now exceeds Brisbane and represents a 150 per cent increase since 2016.</p>

<p>While 93 per cent of crane activity is currently tied to housing, Invest Gold Coast argues future investment will increasingly need to focus on cultural, civic, infrastructure and industry-enabling projects that strengthen the city's long-term economic resilience.</p>

<p>Invest Gold Coast Chair Will Hodgman said the city was now benefiting from years of economic diversification.</p>

<p>"What is happening on the Gold Coast is the result of the city's economic base broadening, fuelled by industries with long-term, high-growth potential," Mr Hodgman said.</p>

Buyers rush to Homecorp's Florence Residences as Gold Coast wellness trend gains momentum

<p>The NSW Government has expanded its $1 billion Pre-sale Finance Guarantee program, broadening access for affordable housing providers and smaller residential developments as it seeks to accelerate housing delivery across the state.</p>

<p>The Minns Government says the program has already helped bring forward more than 600 homes across Sydney and regional NSW since launching in September 2025, with similar models now adopted in South Australia and Western Australia.</p>

<p>The latest changes, announced by Treasurer Daniel Mookhey and Minister for Planning and Public Spaces Paul Scully, are designed to improve access to finance for projects that have planning approval but are struggling to secure funding.</p>

<p>Among the key changes is an expansion of support for community housing providers. The program will now support up to 100 per cent affordable housing projects valued at up to $30 million when delivered by not-for-profit providers, while support for larger affordable housing developments will increase for projects worth up to $80 million.</p>

<p>The government says the changes will help accelerate the delivery of housing for low-income workers, older people, people living with disability, and those at risk of homelessness, while reducing reliance on direct grants or subsidised loans to bridge funding gaps.</p>

<p>The eligibility criteria for smaller residential developments have also been broadened. The previous $5 million minimum project value threshold has been removed and replaced with a requirement that projects deliver at least four homes.</p>

<p>Support has also increased for projects delivering fewer than 20 homes, with the guarantee now able to cover up to 75 per cent of dwellings in a development, capped at $30 million per project.</p>

<p>The changes are expected to particularly benefit smaller-scale and regional developments, which often face greater challenges meeting pre-sale requirements imposed by lenders.</p>

<p>Treasurer Daniel Mookhey said the scheme demonstrates how government can use its balance sheet to stimulate housing supply without relying solely on taxpayer-funded grants.</p>

<p>"The Pre-sale Finance Guarantee shows how this Government is using its balance sheet to reduce risk and unlock private investment, enabling new homes to move from design to construction faster," Mookhey said.</p>

<p>"This landmark reform allows us to deliver homes for working families at a lower cost to taxpayers, while also maintaining strong financial discipline."</p>

<p>Planning Minister Paul Scully said the program had already proven effective in bringing stalled projects to market.</p>

<p>"The Pre-sale Finance Guarantee has already proven it can unlock stalled projects and accelerate housing delivery by giving lenders the confidence they need to back good developments," Scully said.</p>

<p>"These changes will allow more affordable housing and smaller developments to access support so more homes can be built faster where communities need them most."</p>

<p>Housing Minister Rose Jackson said the expansion would help community housing providers overcome financing barriers that often delay projects.</p>

<p>"We know community housing providers are ready to build more homes, too often they're held back by barriers to finance," Jackson said.</p>

<p>"Expanding the Pre-sale Finance Guarantee helps remove those barriers so more affordable homes can get off the ground sooner."</p>

<p>The announcement was welcomed by the Property Council of Australia, which has long advocated for measures aimed at improving project feasibility and access to finance.</p>

<p>Property Council NSW Executive Director Katie Stevenson described the expansion as a practical intervention that addresses one of the most immediate constraints on housing delivery.</p>

<p>"This is exactly the kind of practical intervention we need right now, focused on getting projects out of the ground, not just approved," Stevenson said.</p>

<p>"It builds on a model the Property Council has worked closely with government to develop following calls for such a scheme ahead of last year's NSW Budget, so it's great to see it being expanded."</p>

<p>Stevenson said the reforms would help unlock projects that are ready to proceed but have been delayed by financing challenges. However, she noted that broader feasibility issues remain a significant barrier to increasing housing supply.</p>

<p>"The biggest challenge in NSW housing today is delivery. Too many projects have planning approval but are simply not financially viable to proceed under current settings," she said.</p>

<p>Speaking at the Property Council's NSW Housing Summit, Housing Minister Rose Jackson acknowledged that feasibility and financing pressures continue to constrain housing delivery, while reaffirming the government's commitment to work with industry on solutions.</p>

<p>Stevenson said the government's recognition of those challenges was encouraging ahead of next week's state budget.</p>

<p>"It's positive to see the government clearly recognising that feasibility pressures are now a binding constraint on supply," she said.</p>

<p>"With the Budget just days away, the focus must be on backing delivery, making sure projects stack up, finance can flow, and more homes can move from approval to construction."</p>

<p>Sydney’s property market is known for high prices, competitive bidding, and mounting pressure on first home buyers. But change is on the horizon.</p>

<p>From late 2025, eligible first home buyers in New South Wales will have access to a new federal government initiative aimed at addressing affordability: the Help to Buy Scheme.&nbsp;</p>

<h2>What is the Help to Buy Scheme?</h2>

<p>The program introduces a shared equity model intended to reduce the upfront cost of entering the property market, particularly in high-demand urban areas such as Sydney.</p>

<p>The scheme operates under a shared ownership structure in which the federal government takes an equity stake of up to 40 per cent for new homes, or 30 per cent for existing dwellings. This arrangement allows eligible buyers to significantly reduce their loan size and avoid the added cost of Lenders Mortgage Insurance (LMI).</p>

<p>Under this model, purchasers can enter the property market with as little as a two per cent deposit, well below the traditional 10 to 20 per cent usually required. The government’s contribution is not a loan but a co-ownership stake in the property. As such, there is no interest or rent charged on its portion.</p>

<p>Because the government’s equity combined with the buyer’s deposit typically meets or exceeds the 20 per cent threshold, LMI does not apply. The remaining balance, generally between 60 and 70 per cent of the property’s value, is financed through a standard home loan with a participating lender.</p>

<p>The government's equity in the property remains in place until the buyer chooses to repay it voluntarily or until the property is sold. Buyers can buy back the government’s share over time, in increments of at least five per cent, depending on their financial situation.</p>

<p>There is no fixed repayment timeline, but the amount to be repaid will be based on the property's market value at the time of repayment, not the original purchase price.</p>

<h2>How do you qualify for the&nbsp;Help to Buy Scheme?</h2>

<p>To qualify for the Help to Buy Scheme, applicants must meet the following conditions:</p>

<ul>
	<li>Be an Australian citizen at least 18 years of age.</li>
	<li>Be a first-home buyer who does not currently own property.</li>
	<li>Intend to live in the property as their primary residence.</li>
	<li>Earn less than $100,000 per year for individuals, or $160,000 for couples.</li>
	<li>Purchase a property within the regional price caps, currently $950,000 in Sydney, though this is expected to rise to approximately $1.3 million ahead of the program’s launch.</li>
</ul>

<p>While the Help to Buy Scheme does not solve affordability challenges across the board, it does offer a more accessible pathway for a defined segment of the market, particularly younger buyers with moderate incomes who have been priced out of traditional lending routes.</p>

<p>While the FHOG is a nationwide program, it is administered separately by each state and territory, meaning the eligibility criteria, grant amounts, and property requirements can vary depending on your location. This means that the amount available and the conditions attached to the grant will differ, so it is important to check the specific guidelines for your state or territory.</p>

<p>Are mortgage holders set to get a reprieve from the RBA in 2026?</p>

<p>Big Four bank NAB believes so. They are now expecting the next move from the RBA to be a cut, rather than a hike, which they had pencilled in for August. They are unsure of the timing of the cut however, they note in their latest&nbsp;NAB Economics RBA Watch.</p>

<p>NAB Chief Economist, Dr Sally Auld, said recent data suggests the economy has lost momentum and the outlook for rates has shifted, noting that the broader economic backdrop has changed since earlier in the year.</p>

<p>“The next move in the cash rate is likely to be down, but the timing is uncertain," Dr Auld said.</p>

<p>"In February, growth was above trend, the economy was operating above capacity and there was uncertainty over the restrictiveness of rates. None of these conditions exist today,” she outlined.</p>

<p>Dr Auld said recent data pointed to softer momentum across the economy while acknowledging that at the same time, uncertainty remains a key feature of the outlook.</p>

<p>“Both Q1 GDP data and the NAB business survey suggest momentum in the economy has slowed, meaning that growth has likely peaked for the cycle. That said, we are cognisant there is still considerable uncertainty around the outlook, both with respect to activity and inflation.”</p>

<p>Dr Auld said inflation risks and labour market outcomes would be important to watch.</p>

<p>“On the prices side, we are still forecasting above target core inflation through to mid-2027. Margins will compress and weaker labour market outcomes are a risk.”</p>

<p>She said tighter financial conditions are expected to weigh on housing and activity.</p>

<p>“Tighter financial conditions will be reflected in a slowing in house price growth and housing credit growth. In summary, we have greater conviction that the next move in rates is down, but less conviction on the timing.”</p>


Mortgage relief? NAB forecasts RBA rate cut, not hike, after softer economic conditions

Billionaire Bob Ell makes 50 plus percent on Ingleburn warehouse sale

<p>"I don't think another investor-led housing boom is around the corner and a key reason is investors will be sitting on the sidelines for a while given falling rents and, for now, falling prices," he said.</p>
<p>"For someone who has watched the residential market for 40 years, you know that when building activity drops off, so too does GDP. The relationship is very strong," he told the Australian Financial Review.</p>
<p>He is forecasting a drop in migration of about 60,000 this financial year and another 150,000 next financial year.</p>
<p>With about 2.7 people per household, the forecast drop equates to about 80,000 fewer houses needing to be built.</p>
<p>"These people who are no longer coming impact on the rental market, so it will significantly reduce demand and that will lift vacancy rates and increase risks around residential property," Mr Mellor said.</p>
<p>Mellor says ongoing state border closures will put substantial pressure on apartment demand in the months ahead.</p>
<p>"All our numbers show the apartment sector is moving into significant oversupply because of lower net migration and rising number of people per household," Mr Mellor said.</p>
<p>"Even if migration level stays at around 100,000 over the next couple of years, this is still just half of the normal demand."</p>
<p>Inner-city apartments in particular are likely to be hit, as rentals continue to flood the market even as landlords struggle to find tenants.</p>

<p>The supply of new capital city apartments is set to dry up over the next three years as completions plunge.</p>
<p>They are expected to plunge from their present levels in Sydney by 81 per cent and in Melbourne by 75 per cent.</p>
<p>New projects are tipped to be delayed or cancelled because of poor demand following the pandemic slowdown.</p>
<p>The forecasts were made in the <a href="https://charterkc.com.au/research/state-of-the-market/" target="_blank" rel="noopener noreferrer"><em>State of the Market for Residential Apartments</em> report</a> by consultancy firm Charter Keck Cramer.</p>
<p>It also expects a sharp decline in the number of completed apartments in Brisbane, where supply is forecast to slump as much as 90 per cent by 2023.</p>
<p data-gtm-vis-first-on-screen-7770372_137="15827" data-gtm-vis-total-visible-time-7770372_137="1900">Charter Keck Cramer director of residential research and strategy Angie Zigomanis said the expected drop in apartment completions could help stem the slide in apartment prices and rents.</p>
<p>"The apartment market could see a relief from lower supply and starts, which will place upward pressure on rents, yields and prices, and in turn should kick-start off-the-plan demand," Mr Zigomanis said.</p>
<p>"If a quick recovery in net overseas migration to pre-COVID levels occurs, the sharp reduction in new dwelling completions from FY2022 is likely to cause a significant dwelling deficiency to re-emerge.</p>

<p>"However, if net overseas migration inflows and population growth continue to remain weak, then the Melbourne and Sydney apartment markets could be subdued for some time."</p>
<p>The report noted Victoria's recent share of the national total suggested that its net inflow of overseas migrants will fall dramatically from a peak of 91,000 in FY2017, to 11,000 in FY2021.</p>
<p>"On these numbers, the requirement for new dwellings in Melbourne is expected to more than halve from a peak of 57,500 new dwellings in FY2017 to an estimated 27,200 in FY2021."</p>
<p>The supply of new apartments has continued to flow this year through the pandemic, the report noted.</p>
<p>A total of 17,100 apartments were being completed in Melbourne – the third highest on record.</p>
<p>In Sydney, 22,500 apartments were being finished.</p>
<p>It is 5000 in Brisbane.</p>
<p>But the pipeline is diminishing quickly, with project launches and commencement falling sharply.</p>
<p>Only 5300 apartments started marketing in Sydney – an 84 per cent drop from the 2016 high and its lowest level since 2010.</p>
<p>The number of apartments starting construction has tumbled by more than half (57 per cent) to 9200 – the lowest commencements in nine years.</p>
<p>In Melbourne, 12,500 new apartments began construction – a slight increase from a year ago. Only 5600 apartments were being released for sale, which was the lowest number of launches recorded over the past decade.</p>
<p>The time it took to deliver new apartments from launch has blown out as slower sales volumes and more onerous requirements to secure finance has held up projects.</p>
<p>The lag in Sydney has pushed out to an average of 18 months compared to eight months in 2011 and 2016. In Melbourne, the delay widened to an average of 20 months from nine months in 2009.</p>
<p>Historically, larger projects take longer to proceed from launch to construction, however the time frame has converged, highlighting the difficulties in achieving pre-sales and obtaining finance across the board, Mr Zigomanis said.</p>
<p>The report noted the Sydney owner occupier market is holding up, supported by low interest rates, which have improved affordability for those with jobs.</p>
<p>"First home-buyer demand is being encouraged by stamp duty concessions.</p>
<p>"In turn, this is supporting demand for affordable apartments that are suitable for owner occupiers. Both upgraders and downsizes remain active where they are transacting within the same market."</p>

<p>The Australian master franchisee for multinational discount retailer Miniso has collapsed into voluntary administration amid the COVID-19 pandemic.</p>

<p>It is understood the company suffered from a lockdown decline in foot traffic, and it did not have a very strong e-commerce strategy.</p>
<p>Miniso’s local landlords, including ASX-listed centre owners Scentre Group, GPT Group, Vicinity Centres and Stockland, are not receiving rent payments during the pandemic.</p>
<p>Other creditors, including ANZ Bank, the Australian Taxation Office and parent company Tabata Holdings, are owed more than $6 million combined, with the China-based parent the largest creditor.</p>
<p>Earlier this month an application was granted to the joint and several voluntary administrators of Miniso Master Franchisee Pty Ltd to extend the convening period for its next creditors meeting for a period of six weeks up to and including 21 September 2020.</p>

<p>Miniso operates a hybrid ownership model of business whereby the stores operate through franchisee agreements, joint venture arrangements and stores wholly owned by the Miniso corporate group.</p>
<p>The company purchases and holds stock on behalf of the entities within the Miniso group. The administrators identified 12 group owned stores, 13 franchises, six joint ventures and one wholesale store within the group.</p>
<p>The administrators have, amongst other things, undertaken to continue to trade in order to conserve its value for a potential sale and/or recapitalisation.</p>
The known unsecured creditors of the company, including the landlords, are owed approximately $24.3 million and the secured creditors of the company are owed approximately $132,431.<br><br>A stocktake showed a stock value of $3.8 million.</div>

<div>The administrators continue to work with a related party that has expressed interest in putting forward a DOCA proposal. </div>

<p>Miniso Master Franchisee Pty Ltd, the main revenue generating entity associated with its business in Australia, appointed Grant Thornton as administrators in July.</p>
<p>Miniso has 32 trading stores in Australia, however they are not all in administration.</p>

<p>The NSW Government has announced building industry reform, introducing protection for consumers during the building certification process.</p>
<p>Minister for Better Regulation Kevin Anderson said the <em>Building and Development Certifiers Act 2018</em>, effective on 1 July, will tighten the NSW Government’s regulation of building certifiers, restoring consumer confidence in the industry.</p>

<p>“We have now strengthened the regulation of building certifiers, improving their accountability and independence and providing greater protections for consumers,” Mr Anderson said.<br><br>Certifiers will be required to attain a higher level of ongoing education in order to achieve registration, ensuring that only those with the requisite competence, skills and knowledge are authorised to carry out certification work.</p>
<p>The Act also outlines minimum limits for insurance that certifiers are required to hold.<br><br>“Many building owners might not have known that they have the right to choose a building certifier, so we’ve embedded this protection in building and certification contracts to make it crystal clear.”<br><br>Strengthened contract requirements for certification work will ensure that there is no conflict of interest between the certifier and the builder.<br><br>The Government has also moved to strengthen compliance and oversight of certifiers in four key areas. This includes:</p>
<ul>
<li>increased auditing;</li>
<li>increased penalties for corruption and negligence;</li>
<li>a certifier code of conduct with restrictions on a certifier’s ability to practice in the event of a breach in the previous 12 months; and</li>
<li>the provision of more information to homeowners, ensuring they have the transparency they need on a certifier’s compliance history.</li>
</ul>
<p>These reforms are accompanied by the Government’s historic building reform package, the <em>Residential Apartment Buildings (Compliance and Enforcement Powers) Act 2020</em> and <em>Design and Building Practitioners Act 2020</em>, which passed in early June.</p>

NSW home building certification reform for greater consumer protection

<p>Amendments to the Plumbers Licensing and Plumbing Standards Regulations 2000 are being drafted in Western Australia to include new plumbing standards for subdivision plumbing work in relation to survey strata schemes.</p>
<p>The changes are outlined in Industry Bulletin 125 – New requirements for plumbing services to survey strata lot developments.</p>

<p>The new standards for plumbing services in relation to survey strata schemes commenced operation on 15 August 2020.</p>
<p><span>Plumbing services to individual survey strata lots consist of sanitary drainage service lines and connection points, and water supply service lines and connection points. </span></p>
<p><span>The requirements apply to survey strata developments consisting of two or more survey strata lots.</span></p>

<p><span>Prior to 2015 the Water Corporation provided guidance and direction to land developers in the form of ‘Plumbers advice kits’ for the provision of sanitary drainage service lines and connection points and </span><span>to;</span><span>water supply services to individual survey strata lots.</span></p>

<p><span>The developer would then engage an LPC to install the services where necessary as part of the process towards obtaining titles for the lots. This generally ensured that survey strata lots were provided with suitable plumbing services prior to the lots being sold and building commencing.</span></p>
<p><span>In 2015 the Water Corporation came to a decision that it was not in their remit to enforce requirements for plumbing services to individual survey strata lots beyond providing a connection point at the main lot boundary. Since then there have been consistent issues regarding the provision of plumbing services to individual survey strata lots including:</span></p>

<p><span>Where sanitary drainage services are required a developer must engage an LPC to install a suitable sanitary drainage service line(s) and connection point(s) to each lot. </span></p>
<p><span>Where water services are required the developer must enter into an agreement with a water services provider (in most instances the Water Corporation) to either install infrastructure, or provide direct services </span><span>or </span><span>multi-metering to each lot on the survey strata scheme, or alternatively engage an LPC to install water supply services to each lot on the scheme.</span></p>

Plumbing standards regulations being drafted for strata subdivision plumbing work

<p class="s7">2020 was set to present an opportunity for investors to capitalise on lucrative growth potential in the Australian middle markets office space, according to Colliers International.<span style="font-size: 12.16px;"> </span></p>
<p class="s7">Colliers’ Office Middle Markets Transaction Review for 2019, found that current investment opportunities available in the $10 million - $100 million range which comprises the Middle Markets Office space, offers investors a competitive yield in the current rental landscape and strong value-growth potential.<span style="font-size: 12.16px;"> </span></p>
<p class="s7">There were 154 transactions in the middle market’s office space in 2019, totalling $4.7 billion. Despite metro markets recording significantly more transactions (103 Transactions, totalling 67% of assets, compared to 51 CBD assets; 33%), CBD Assets were the star performers with an average yield of 4.89% and average capital value of $7,904 per square metres.<span style="font-size: 12.16px;"> </span></p>
<p class="s7">By contrast, Metro assets recorded a 6.23% yield and capital value of $5,638 per square metres.<span style="font-size: 12.16px;"> </span></p>
<p class="s7">According to Colliers's analysis, the 2019 track record suggests that middle markets will offer large institutional clients including REITs, Syndicates, Unlisted and Wholesale fund purchases, as well as private investors, the opportunity to invest and capitalise on this currently untapped sector of the office market.<span style="font-size: 12.16px;"> </span></p>
<p class="s7">“Transactions from 2019 indicate that the tightening yields in the office sector have not yet affected the Middle Markets space, when compared to office assets valued at over $100 million,” said Matt Meynell, Head of Investment Services at Colliers International.<span style="font-size: 12.16px;">  </span></p>
<p class="s7">“This is being seen across all Australian capital cities in both the CBD and fringe/metro office markets; however, the geographic trend becomes most obvious when comparing the tight CBD office market to the Metro Markets nationally.”<span style="font-size: 12.16px;"> </span></p>
<p class="s7">The active purchasers in the Office Middle Markets space throughout 2019 include Charter Hall, and Centuria with four acquisitions, ESR with three and Collective Capital, Australian Unity Property Income Fund acquiring two assets each throughout 2019. <span style="font-size: 12.16px;"> </span></p>
<p class="s7">These acquisitions totalled $675m in transaction value and achieving an average yield of 6.42%.<span style="font-size: 12.16px;"> </span></p>

Office market shows signs of growth-potential in 2020; Colliers International

<p>ASIC recently published Regulatory Guide 271<em> Internal Dispute Resolution</em> (RG 271). The guide updates requirements for financial firms in dealing with consumer and small business complaints under their Internal Dispute Resolution (IDR) procedures.</p>
<p>Among other things, RG 271 clarifies ASIC’s expectations of financial firms in their dealings with paid representatives – including debt-management firms.</p>
<h2>Debt-management firms and their role in dispute resolution</h2>
<p>Debt-management firms promise to assist consumers in financial hardship. They offer a range of services such as debt negotiation and ‘cleaning’ or ‘fixing’ credit reports.</p>
<p>As part of their service offering to indebted consumers, these entities often lodge complaints with financial firms directly at the IDR stage and/or to an external dispute resolution (EDR) scheme such as the Australian Financial Complaints Authority (AFCA).</p>
<p>Debt-management firms operate on a for-profit basis and charges consumers fees for their services, either upfront or on a ‘success’ basis. Fees can be very high, and the services can sometimes leave consumers already in financial difficulty worse off.</p>
<p>Importantly, it is free for consumers to complain directly to their financial firm or to AFCA.</p>
<p>Financial firms, AFCA and consumer groups continue to raise concerns with ASIC about the conduct of debt-management firms and the potential harms these entities may cause consumers, including that they may provide unsuitable services and engage in predatory conduct.</p>
<h2>When is it appropriate to <em>not </em>engage?</h2>
<p>Responding to concerns from financial firms, ASIC has included guidance in RG 271 to clarify when we would consider it to be appropriate for a financial firm not to engage with a paid representative. This includes circumstances where a financial firm reasonably believes that a paid representative is not acting in the best interests of the consumer.</p>
<p>ASIC’s guidance also makes it clear that if AFCA has excluded a paid representative from representing a consumer in relation to a complaint under the AFCA Rules, this would also be an acceptable reason for a financial firm to no longer engage with the paid representative, for the duration of the exclusion period.</p>
<p>If financial firms cease to engage with a paid representative by relying on the updated guidance in RG 271, financial firms:</p>
<ol type="a">
<li>should clearly explain to a consumer why contact is being made directly and provide reasonable time to respond; and</li>
<li>can continue to communicate with a consumer directly, even if the consumer still expresses an intention to retain the paid representative.</li>
</ol>
<h2>Paid representatives: ASIC’s guidance for financial firms</h2>
<p>ASIC is currently considering technical updates to Regulatory Guide 96 <em>Debt collection guideline: for collectors and creditor</em><em>s</em> (RG 96), and intends an amendment to the section on ‘when a debtor is represented’ to ensure consistency with RG 271.</p>
<p>In the interim, financial firms can engage with paid representatives in a manner that is consistent with RG 271 and the approach set out in this article.</p>
<p>ASIC expects this article will provide financial firms with more clarity about how they can engage with paid representatives including debt management firms. We also support financial firms developing their own initiatives that help to protect consumers.</p>
<h2>Background</h2>
<p>There is no uniform regulatory framework applying to the activities of debt management firms in Australia. Most debt management firms are not required to hold an Australian credit licence or an Australian financial services licence to provide debt management services.</p>
<h2>AFCA bans MCR Partners</h2>
<p>On 1 July 2020, AFCA announced its decision to ban paid representative MCR Partners from lodging complaints on behalf of consumers and small businesses. The decision means that MCR Partners including its directors, employees or agents are excluded from lodging complaints with AFCA for a period of 15 months until 30 September 2021. </p>

Handling complaints and paid representatives: ASIC provides financial firms with guidance

<p style="text-align: left;" align="center"><span style="text-align: left;">The largest CBD freehold, mixed-used development site with holding income, is set to hit the market in the coming weeks.</span></p>
<p>Colliers International in conjunction with CBRE are selling this significant holding known as the South Yards precinct, on behalf of Honeycombes Property Group who are one of Queensland’s largest private developers.
