Property 101: hipages partners with the HIA

The developers of the Pacific Bondi, Rebel Property Group's Allen Linz, Capit.el Group's Eduard Litver along with Gil Baron have splashed out $19.12 million for one of Bondi Beach's most iconic retail premises, the 1951 Bates Milk Bar.
<a href="https://www.realcommercial.com.au/property-retail-nsw-bondi+beach-502077466" target="_blank">The 124 Campbell Parade corner milk bar</a> was known for its choc-malt milkshakes until its closure in 2001.
It sold at just over 3 percent given heavy competition from developer, Theo Onisforou who was the underbidder for the premises on the corner of Campbell Parade and Hall Street.
Developer Danny Avidan, who recently secured the Bronte RSL site, also attended the 45 minute auction which saw a $10 million opening bid.
The buyers plan to redevelop the property which is currently leased to retailers Platypus Shoes, Natalie Alamein, Mezi Retail and Gelatissimo.

Bates Milk Bar at Bondi Beach sells for $19.12 million

ASIC has discontinued its proceedings against Simon Tickner and Lisa Darcy, former directors of LM Investment Management Ltd (LMIM). 
In 2014, ASIC commenced civil penalty proceedings in the Federal Court of Australia seeking financial penalties and banning orders following the collapse of the Gold Coast-based fund manager against founder Peter Charles Drake and former directors Francene Maree Mulder, Eghard van der Hoven, Simon Jeremy Tickner and Lisa Maree Darcy.
The claims against Mr Tickner and Ms Darcy focused on their conduct as directors in signing off a loan to Maddison Estate Pty Ltd, which Mr Drake owned and controlled, in 2011. Proceedings against the other directors focused on both the 2011 transaction and another transaction that occurred in 2012.
The trial commenced on 29 August 2016. On 12 September 2016, after the close of its case, ASIC discontinued its claim against all directors in relation to the 2011 transaction.   
The proceeding related to the 2012 transaction continues against Mr Drake, Ms Mulder and Mr van der Hoven and has been adjourned until 23 September 2016 for closing submissions.
LMIM was the responsible entity for seven registered managed investment schemes and the trustee for MPF, an unregistered managed investment scheme with about 4,500 investors. More than $400 million was invested in MPF. In total, LMIM was responsible for managing at least $800 million on behalf of approximately 12,000 investors in Australia and overseas.

ASIC discontinues proceedings against LM Investment directors

At first glance you’d be forgiven for thinking the new Sydney Metro rail line will turn the suburbs between Sydenham and Bankstown into an urban paradise.
Amid cheerful community facilities and cycle paths, the Department of Planning’s zoning brochure shows a colourful mass of new higher-density zones. Every town centre along the route – including Campsie, Lakemba, Canterbury and Belmore – is in line for a facelift. A raft of new apartment towers, pavement cafes and boutiques will crowd around the Metro stations.
All cities need renewal and no-one would argue that this part of Sydney isn’t crying out for it. However, the Baird government needs to explain what the changes will mean for existing residents. Compared with the rest of the city, they are typically poor, older and renters. What’s in it for them?
And who’ll profit from the value uplift that will flow from the massive investment of taxpayers’ funds, both from higher land values resulting from the new density and from being snug up against a new Metro line?
These are just two of the outstanding questions to which the government should already have articulated some answers. That’s because, as each day passes, developers are doing their maths based on the existing scenario set out by the Department of Planning. Soon it will be too late to retrofit any changes.
<h2>Where do existing residents fit in?</h2>
To understand the reality, it’s worth taking a closer look at the area along this stretch of the new Metro.
The Sydenham-to-Canterbury corridor is home to one of the largest concentrations of lower-income renters in Sydney, compounded by a large population of retirees on fixed, low incomes. Gentrification, the driver for urban renewal across much of Sydney, has not come knocking on these doors – yet.
So, what percentage of the 36,000 new apartments and other dwellings along the renewal corridor has been allocated for affordable housing? We can be sure they won’t be pitched at the pockets of those who live there now.
And as new investment comes in, so rents will rise. Without a significant affordable housing component, many of the essential workers who live there today – the mechanics, care attendants and shop workers – will be pushed further towards Sydney’s periphery. That will leave the rest of the city struggling to get the lower-paid workforce it needs to function productively.
In comparable renewal projects in cities like London and New York, a significant proportion of new stock is set aside as affordable housing, precisely to avoid such problems. It’s accepted as completely reasonable that lower-income working families should also benefit from new housing delivered as a result of public investment.
The Baird government must make it clear to developers exactly what proportion of the new homes will be set aside for this purpose – and quickly. The case for a zoning policy that mandates a proportion of all new homes as affordable has never been clearer.
The government also needs to show us where it is placing services, such as the new schools that the expanded population will need. With the government’s zoning map not identifying where these services will go, land-owners will rightly question any subsequent proposal for a school or park that would diminish their profits from possible residential development.
The government has not yet provided any explanation of the expected amount of the massive value uplift that will come from the Metro and all the amenity upgrades.
Nor have we been told whether any of it will be used to fund the Metro itself or investment in the infrastructure that will be needed to make this extensive new precinct vibrant and liveable – let alone whether it will be used to provide for affordable housing.
<h2>A model for inclusive renewal</h2>
Let me suggest a way the government can tackle all this.
We need a new model of inclusive renewal. Why not establish an arm’s-length, non-profit corporation to work in consortia or joint ventures with councils, landowners, businesses, residents (particularly in older strata properties), developers and the community housing sector?
Innovative funding for new infrastructure could come through hypothecated value-capture mechanisms. These could take the form of up-front levies on land and property sales and public borrowing supported by the increased local rates that will be collected. In this way the value uplift will be properly shared and paid for over the longer term.
Planning should be devolved to the newly amalgamated council in line with the district plans being drawn up by the Greater Sydney Commission. Affordable housing would be the responsibility of community housing providers, working with developers and the new agency. The model would also apply to other town centre and corridor renewal projects.
The new Sydney Metro promises a revolution in mass transit. However, the accompanying renewal of this corridor will affect one of the most socially and economically disadvantaged communities in Sydney. Perpetuating – or indeed enhancing – that disadvantage through wide-scale displacement and unaffordable apartment building would be disastrous.
This new urban paradise must not be just for those with deep pockets.

A Brunswick landmark has been listed for sale by negotiation with a $3.5 million price tag.
The 1903 Federation Free Style building at <a href="https://www.realcommercial.com.au/property-offices-vic-brunswick-501942650" target="_blank">307 Victoria Street</a> features a warehouse, showroom and penthouse.
It has housed designer printing business Papers Of Distinction since 1997, founded by vendor Jillian Houlihan.
Set on the Boase St corner, the 529sq m property has Art Nouveau detailing, including tulip mouldings.
It was also formerly the United Friendly Societies medical dispensary building.
IRC Property Group agent Raff De Luise said most of the potential buyers planned to live in the two-bedroom penthouse and operate their business beneath.

It had been listed at $629,000 through Wilson Real Estate.
The Verdon Street premises last sold at $290,000 in 1998. 
The two star $80 a head motel was featured in the south west Victorian <a href="https://www.bluestonemagazine.com.au/2014/10/26/turning-in-to-the-turn-in-motel/" target="_blank">Bluestone</a> website magazine.

For some time now, Australia has featured at the forefront in the growth of green buildings, a trend which has been reinforced with the recent Global Real Estate Sustainability Benchmark results.
However, while Australia’s premium office market moves toward the next building evolution in optimising human health and wellness, the mid-tier office market is yet to see any notable shifts in energy and emissions reduction.
Mid-tier office challenges and opportunities
The breadth and size of this market is compelling. The Australian Sustainable Built Environment Council’s recent Low Carbon High Performance report cites mid-tier offices are estimated to make up 52 million square meters of the 64 million square meters of office space nationally.
Policy makers have taken this into account and have started to focus more heavily on investigating the associated challenges and opportunities facing this sector. One of the resulting reports has been the 2015 Mid-tier Commercial Office Buildings in Australia (‘Pathway’) report produced by Green Building Council of Australia, following extensive collaboration between government and industry stakeholders.
This report shone a light on the complex barriers affecting change - notably the lack of knowledge, capital, resources and time faced by building owners / managers with respect to the adoption of energy efficiency measures.

Carrot and stick approaches
Drawing on some of the recommendations contained within the Pathway report, there have been a number of recent policy and program developments. A planned reduction in the threshold for the Commercial Building Disclosure program in mid-2017 is expected to see a good deal more small building owners being legally required to measure and disclose the energy efficiency of their assets. While there is potential for this scheme to work, it will be heavily influenced by tenant demand for green office space at this end of the market.
At the other end of the carrot and stick approach lies the need for targeted financial incentives:

<li>Sustainability Victoria’s Energy Efficient Office Buildings Program was aimed at mid-tier office buildings through matched funding grants of up to $150K.</li>
</ul>
<ul>
<li>NSW’s Office of Environment and Heritage has recently initiated the ‘No More Average Buildings’ program, which provides financial assistance for energy efficiency improvements in buildings with low NABERS Energy ratings. </li>
</ul>
<ul>
<li>At a national level, there are calls to consider measures such as ‘green depreciation’ in which tax breaks could help drive greater investment in energy efficiency measures when building refurbishment works are carried out.  </li>
</ul>
Efficiency in a global context
Looking around the world, locations such as the United States, European Union and Japan are aiming to achieve net zero energy performance for their respective commercial buildings in the next few decades.
In the United Kingdom, by mid-2018, it will be unlawful for commercial building owners to lease poorly performing buildings, which at current estimates represent close to 20 percent of the national market.
The penalties for non-compliance with the legislation are expected to be considerable, but balanced against this is the provision of grants and subsidies to assist building owners. With talk of the energy-efficiency bar being raised in subsequent years, this new approach in the UK is sure to provide an interesting litmus test for other jurisdictions around the world, including Australia, to consider.

Energy efficiency in the mid-tier market: should we be dangling the carrot or brandishing the stick?

The next ‘live’ RBA meeting will be November 1, Bill Evans, Westpac's chief economist suggests.
However he expect rates will be held steady in November as well as October.
The Reserve Bank Board next meets on October 4, the first meeting under the new Governor Philip Lowe.
"It is extremely unlikely that there will be any change to rates at that meeting.
"Since the cash rate returned to its historical low of 3 percent in 2013 all six subsequent cuts have occurred at meetings in February, May, August or November when the Bank has a ‘fresh’ print on inflation and is able to communicate any forecast changes in its quarterly Statement on Monetary Policy.
"Signs of stability in the real economy point to steady rates being the most appropriate policy.
"Of course there is always the possibility of a shock from the inflation report on October 26 but both our inflation forecasts and our assessment of current high RBA ‘inertia’ around moving again this year point to stability in November," he said.

Evans noted the six month annualised growth rate in the WestpacMelbourne Institute Leading Index, which indicates the likely pace of economic activity relative to trend three to nine months into the future, rose from –0.01 percent in July to +0.20 percent in August.
 
He said the August reading is consistent with a trend that has been building for some months now.
 
"The positive Index growth rate follows 15 consecutive months where growth has been below trend.
 
"It is the first above trend result since early last year and the second strongest since December 2013.
 
"The Leading Index is clearly signalling that the economy is likely to continuing growing around its long run trend rate of about 3 percent a year.
 
"That outlook is consistent with Westpac’s forecast for growth holding steadily around a 3 percent pace over the course of both this year and next."
 
The Leading Index growth rate has lifted sharply over the course of 2016, from a 1.44 percent below trend reading in March to 0.20 percent above trend in August.
 
Almost all components have contributed to the improvement. The biggest lift has come from: commodity prices (+0.64ppts).

Cup Day is next "live" meeting, but Westpac's Bill Evans expects a hold decision

Home values across Australia’s eight capital cities rose at the slowest annual rate in more than three years at the end of the June quarter, according to the Australian Bureau of Statistics.
National prices increased by 4.1 percent annually.
It was the lowest rate of growth since March 2013, when the rate was 3.1 percent.
For the year to June 30, Melbourne residential property ­prices rose 8.2 percent.
Sydney prices were up 3.6 percent annually.
Sydney and Melbourne, led growth in the quarter too, with 2.8 percent and 2.7 percent respectively.
Perth dropped 1.2 percent over the quarter and 4.8 percent over the year.
Darwin fell 2.4 percent in the quarter and 6.5 percent for the year.
The Sydney slowdown was evident as prices rising 3.6 percent in the year to June, was down from 9.7 percent in the year to March. 
Sydney's median house price rose to $880,000 in the quarter – equal to its value a year earlier – from $850,000 in the March quarter. 
The pace of growth also ticked slightly lower in Melbourne, to 8.2 percent from 9.8 percent in March.
The declines worsened in Perth – to a 4.8 percent fall from 4.5 percent – and also in Darwin, where prices declined 6.5 percent compared with 4.9 percent in March.
Growth picked up in Brisbane (to 4.3 percent from 4.1 percent), Adelaide (to 3.5 percent from 3.1 percent), Hobart (to 4.9 percent from 4.2 percent) and Canberra (to 6 percent from 4.6 percent).

Melbourne price growth leads nation while Darwin and Perth residential prices continue to decline

The romantic Woollahra residence, Listowel listed with $16 million plus hopes by retired printing businessman Costa Vrisakis and his wife Despina last September disappeared from websites this week.
It is thought to have been sold for $16 million plus.
It was built in the early 1930s for the well known Sydney family, the Cobcrofts on its 2776 square metre holding to a design by Spain &amp; Cosh architects.
Back then just lawn, later coming with a tennis court.
As glamourous venue for fashion shoots and celebrity weddings over more recent times, including Rachael Finch and Michael Miziner, it has much much admired. Title Tattle remembers many late 1980 parties when I am sure I met a Minogue there.
Listowel, on Edgecliff Road, fetched $1 million in 1980, probably the first off-harbour Sydney trophy home to do so. The Vrisakis family have been there 35 years having paid $1.5 million.
Woollahra's record was a Rush Street compound sold for $16 million in 2008 which was bought by Rosanne Williams, partner of John Grill, from the oil and gas engineering firm Worley Parsons.
During the prior Pagent family ownership, the Rush Street terraces had been extensively renovated by architect Alexander Tzannes.
McGrath agent Ben Collier took it to September auction last year, with it then also going to open listing with several eastern suburbs agents.
Meanwhile Singaporean billioniare Ronald Ooi has also finally sold the historic Clyde Cottage in Woollahra for just shy of $13 million after transforming it into a contemporary home.
Ronald paid $4 million for the Queen Street heritage residence that was the childhood home of opera star Dame Joan Sutherland.

Listowel, Woollahra finds buyer

A landmark former orphanage site in Surrey Hills could be transformed into a new residential community under plans lodged by <a href="https://www.apartments.com.au/developers/antipodean-land-developments">Antipodean Land Developments</a> that would deliver 76 apartments and townhouses while restoring some of the suburb's most significant heritage buildings.

The burgeoninng Melbourne-based developer has submitted plans for the 9,158 sqm site at 1 Kent Road and 24 Durham Road, home to the former St Joseph's Home for Destitute Children, a historic institutional complex dating back to the late 19th century. The proposal seeks to adaptively reuse several heritage buildings while introducing two new four-storey residential buildings set within extensive landscaped grounds.

Designed by <a href="https://www.apartments.com.au/architects/woods-bagot">Woods Bagot</a> and Kerstin Thompson Architects, the project has been conceived as a contemporary residential village embedded within a restored heritage precinct. The development team describes the design approach as "The Village in the Garden," with new buildings positioned among mature landscaping by OCULUS and significant heritage structures.

The proposal would deliver 76 dwellings comprising a mix of apartments and duplex-style residences, significantly increasing housing supply on one of the largest privately held residential landholdings in Surrey Hills. The development includes 127 car spaces, 24 bicycle spaces and more than 1,000 sqm of communal amenity, with the existing chapel building earmarked for conversion into resident facilities.

According to the planning submission, the project centres on the restoration and adaptive reuse of the site's most significant heritage assets, including the original c.1889 St Joseph's building, the chapel designed by architect Augustus Andrew Fritsch, and the historic brick perimeter walls and entry gates. The proposal also incorporates the retention of other contributory buildings including the former infirmary and school building.

Tract Consultants, in the planning report accompanying the application, said the scheme had been shaped through extensive heritage analysis and design development.

"The shared vision for the Site by the project team has culminated in a scheme which successfully breathes life back into a historic site while delivering upon the objectives of Victoria's Housing Statement in a carefully curated and contextually responsive manner."

The proposal is being assessed under Victoria's Significant Residential Development with Affordable Housing pathway. As part of the application, three per cent of the project's residential development cost would be contributed to the Social Housing Growth Fund. The development would also provide a diverse mix of one, two and three-bedroom residences targeting a broader range of buyers than typically found in Surrey Hills' detached housing market.

Sustainability initiatives include an anticipated 66 per cent BESS score, natural cross-ventilation to 80 per cent of apartments, 28 per cent deep soil landscaping and a canopy cover outcome exceeding local planning requirements. The proposal also sets aside more than 1,083 sqm for communal indoor and outdoor resident amenity spaces.

Planning documents describe the property as one of the largest underutilised residential sites in Surrey Hills, arguing it presents a rare opportunity to introduce "missing middle" housing in an established inner-eastern suburb while preserving and revitalising a significant heritage precinct.

Antipodean Land Developments has built a reputation for design-focused residential projects across Melbourne, particularly in the medium-density sector. Previous developments include Neighbourhood in Brunswick East, delivered with Breathe Architecture, and Balfe Park Lane, designed by Kerstin Thompson Architects.

They've been very active in site acquisition as they build out their future development pipeline. They recently launched Thornubury House, 45 apartments above a mix of commercial, retail, and food and beverage tenancies, and have plans for a boutique project in Fitzroy and another <a href="https://www.apartments.com.au/news/vic/antipodean-plan-apartments-for-deepdenes-missing-middle-on-whitehorse-road">"missing middle" project</a> on Deepdene's Whitehorse Road.

First look: Antipodean Land Developments plans heritage-led apartment community in Surrey Hills

Developer <a href="https://www.apartments.com.au/developers/auyin-property-development">Auyin</a> is the latest to turn to the Victorian Government's Development Facilitation Program in an effort to secure approval for its long-planned, mixed-use project in Elsternwick.

In 2018, Auyin lodged plans with Glen Eira City Council for a 14-storey building, however Council approved a reduced eight-storey scheme. A subsequent VCAT appeal in 2019 upheld the eight-storey height limit.

The project was later amended to nine storeys, but Auyin is now seeking to revive something closer to its original vision. The developer argues that the planning context has evolved significantly over the past decade, particularly within the Elsternwick Activity Centre, where higher-density development has increasingly been encouraged along Glen Huntly Road.

The proposal would transform the 1,239 sqm site at <a href="https://www.apartments.com.au/new-apartments/7-12-horne-street-elsternwick-vic-3185">7-15 Horne Street</a>, opposite Elsternwick Railway Station, into a 13-storey residential and retail development designed by CBG Architects, with 40 apartments

The site currently comprises three commercial properties.

The proposed apartment mix comprises 25 two-bedroom and 15 three-bedroom residences above 200 sqm of retail space at ground level. Residents would have access to a 90 sqm wellness facility, a 351 sqm communal indoor and outdoor terrace on the third level, and extensive landscaped areas throughout the development. A publicly accessible 135 sqm plaza would be created on the north-east corner of the site, providing seating, landscaping, and a new gathering space adjoining Horne Street.

The design adopts a four-storey podium that references the finer-grain character of the surrounding streetscape, with the upper tower recessed behind generous setbacks on all boundaries.

A key element of the proposal is the reconfiguration and widening of the surrounding laneways. Vehicle access would be retained from Lois Lane, with upgraded pedestrian connections linking Ross Street and Horne Street. <a href="https://www.apartments.com.au/developers/skymark-group">Skymark</a>'s boutique Cronulla development Solis has secured a 10-year Latent Defects Insurance policy through Resilience Insurance, providing buyers of the 16-residence building on Ewos Parade with structural and waterproofing protection that extends a decade beyond the building's completion.

Currently under construction and due for completion in late 2027, <a href="https://www.apartments.com.au/new-apartments/solis-cronulla-8-ewos-parade-cronulla-nsw-2230">Solis</a> is one of a small number of new developments in the Sutherland Shire to carry Resilience LDI coverage, a distinction that carries increasing weight as buyer confidence in the off-the-plan sector continues to be shaped by how developers stand behind their product.

Latent Defects Insurance, which entered the Australian market in 2022 when Resilience Insurance was approved to offer the cover, protects buyers against major structural or waterproofing defects for ten years post-completion. Unlike traditional statutory warranties, it operates as a first-resort policy, if a covered defect arises, the insurer responds directly, without the buyer needing to pursue the builder or developer through a lengthy claims process.

Resilience Insurance CEO Corey Nugent has noted that the product addresses something fundamental to the new apartment market.

"The overarching feedback from prospective buyers in the new development space is that they want more confidence and assurances around the quality of the build," Nugent says.
