<p>&nbsp;Developer CPDM is continuing to put its stamp on Sydney's Lower North Shore.</p>

<p>Just a few months after seeking to develop <a href="https://www.apartments.com.au/news/nsw/first-look-neutral-bay-transformation-continues-as-new-eight-level-building-pitched">25 apartments in Neutral Bay</a>, CPDM is now looking to deliver something similar in the neighbouring suburb of Cremorne.</p>

<p>They have gone through the NSW Government's Housing Delivery Authority to file a State Significant Development Application for 32 apartments across an eight-storey building at&nbsp;<a href="https://www.apartments.com.au/new-apartments/57-61-reynolds-street-cremorne-nsw-2090">57–61 Reynolds Street</a>.</p>

<p>Like the majority of development applications being submitted in recent months, <a href="https://www.apartments.com.au/developers/cpdm">CPDM</a> is looking to trigger the affordable housing uplift under the&nbsp;State Environmental Planning Policy (Housing) 2021 guidelines.</p>

<p><a href="https://www.apartments.com.au/architects/pbd-architects">PBD Architects</a>, who have worked on the project since its inception. They noted in their design statement that the Reynolds Street frontage more closely resembles the scale of multi-residential buildings in the area, while Gerard Lane has a smaller scale to match the presentation of the existing buildings on that lane.</p>

<p>The majority of the 32 apartments will be three-bedrooms (27), with the remaining five two-bedroom units.</p>

<p>The building will include two rooftop communal spaces and two basement levels with 51 car parking spaces allocated for residents, visitors, motorcycles, and bicycles.</p>

<p>PBD noted that the project’s “density is thoughtfully planned to be sustainable, capitalising on existing and future infrastructure, access to public transport, the site’s cultural and community value, and its environmental attributes”.</p>

<p>CPDM has been steadily growing its development footprint across Sydney’s North Shore, with previous and current projects in Lindfield, Gordon, and Neutral Bay. Their recent application in Neutral Bay, also designed by PBD Architects, similarly leveraged the Housing SEPP bonus provisions to deliver a mid-rise apartment building with affordable housing units.</p>

First look: Developer CPDM doubles down on Sydney's Lower North Shore

<p data-end="219" data-start="76">The first new apartment development in Gladesville to offer 10-year Latent Defects Insurance (LDI) protection is soon to welcome its residents.</p>

<p data-end="441" data-start="221">Respected boutique developer Geron Property has partnered with the Gladesville RSL to deliver Jordan Hall Residences, named after the historic Jordan Hall building on Western Crescent, on the edge of the town centre.</p>

<p data-end="850" data-start="443">The façade of the original 1938 building has been kept intact by the development team. The Inter-War Free Classical community venue is known for its Art Deco parapet, dual-tone brickwork, and decades of RSL Youth Club activity. The building once anchored the view down Jordan Street, and its façade will continue to do so as the hall becomes the architectural centrepiece of the new residential project.</p>

<p data-end="1022" data-start="852">Innovate Architects has designed a new structure that rises behind Jordan Hall, featuring 29 large-scale apartments that are setting new benchmarks in the suburb.</p>

<p data-end="1334" data-start="1024">Local construction company Gauge is putting the finishing touches on the apartments, which are designed primarily for local downsizers. Each apartment features three bedrooms, kitchens with integrated Miele appliances, generous natural light through strategically placed windows, and private outdoor areas.</p>

<p data-end="1495" data-start="1336">Beyond the private spaces, the project includes communal areas on the first and seventh levels, positioned to take advantage of Gladesville’s elevated outlook.</p>

<p data-end="1636" data-start="1497">Jordan Hall will be the first new apartment development in Gladesville with Latent Defects Insurance, a new insurance policy that gives peace of mind for off the plan buyers when it is secured by the builder or developer of the new building.</p>

<p data-end="1993" data-start="1638">Offered by Resilience Insurance, LDI is a first-right insurance product that protects purchasers from structural or waterproofing defects within the first 10 years after completion. Geron Property's adoption of the policy aligns with broader industry movement toward more rigorous assurances and supports buyer expectations around long-term asset performance.</p>

<p>Geron Property, led by Tom Zarimis, is intending on taking out the policy on its next project, a luxury development on Cronulla's Gerrale Street.</p>

<p>Zarimis appointed&nbsp;Adobe Property Agents to sell Jordan Hall Residences. There are just a handful of apartments remaining.</p>

<p>The final apartments in the most recently completed new development in Balwyn present some of the largest and most exclusive ever delivered in one of Melbourne’s most established and character-rich neighbourhoods.</p>

<p>Boutique developer&nbsp;<a href="https://www.apartments.com.au/developers/wulff-projects">Wulff Projects</a>,&nbsp;alongside partner <a href="https://www.apartments.com.au/developers/pga-group">PGA Group</a>, has just finished <a href="https://www.apartments.com.au/buildings/threadneedle-balwyn-1-5-threadneedle-street-balwyn-vic-3103">Threadneedle</a>, 17 home-sized residences designed completely for the owner-occupier.</p>

<p>Named after its location on Threadneedle Street, the new project has been shaped by the heritage fabric of Balwyn. It offers two low-rise buildings of eight and nine apartments respectively, designed to emulate traditional standalone homes.&nbsp;</p>

<p>“Given the quiet residential character of the street with many homes dating back to the 1930s and 1940s, we approached Threadneedle wanting to appear less as a collection of apartments and more as a traditional residence. This led to creating not one but two buildings that could “breathe” with larger garden-based apartments functioning more like small homes.”</p>

<p>The north-facing residences are nestled among extensive landscaped gardens by Ben Scott Garden Design, with over one-third of the site dedicated to greenery. The resulting setting is one of calm seclusion, where architecture and landscape work in tandem to offer immediate liveability.</p>

<p>With construction now complete, the final apartments include a top-floor, single-level penthouse residence priced from $2.8 million. This home offers three bedrooms, a dedicated study, two bathrooms plus powder room, and three car spaces with an oversized storage room.&nbsp;</p>

<p>Interiors prioritise spatial comfort and natural light, with three-metre-high ceilings, oversized internal doors and a full-width terrace oriented to the north, east and west.&nbsp;</p>

<h3>Does the <em>Neighbourhood Disputes (Dividing Fences and Trees) Act 2011</em> apply to all fence disputes?</h3>
<p>No. The laws do not apply to pool fencing, State plantation forests, cropping land greater than 0.5 hectare or unallocated State Lands. The laws do not override covenants, non- QCAT agreements, body corporate by-laws, easement rights or retaining wall laws.</p>
<h3>What is a dividing fence?</h3>
<p>A dividing fence is generally constructed on the common boundary line of adjoining land. A fence is a structure, ditch or embankment, or a hedge or similar vegetation barrier, natural or artificial watercourse, enclosing any land, whether or not it extends along the whole boundary of land separating the neighbours. A retaining wall is NOT a fence.</p>
<h3>Who owns a dividing fence?</h3>
<p>A dividing fence is owned equally by the adjoining neighbours if it is built on the common boundary line. However, a fence or part of a fence built on one neighbour’s land is owned by that neighbour, even if the other neighbour contributed to the cost of construction of the fence.</p>
<h3>Who is responsible for a dividing fence?</h3>
<p>Generally neighbours must contribute equally to building and maintaining a dividing fence. Either neighbour should not attach things to the fence which may damage or alter it unless agreed e.g. clotheslines, car ports, shade sails.</p>
<h3>Why is a retaining wall not considered a fence?</h3>
<p>Retaining walls serve a different purpose than fences. They are engineered to support built up or excavated earth. Retaining walls are not normally a matter of joint responsibility for neighbours because a retaining wall is usually of more benefit to one neighbour.</p>
<h3>Are retaining walls covered by the <em>Neighbourhood Disputes (Dividing Fences and Trees) Act 2011</em>?</h3>
<p>No. Retaining walls are not defined as part of fences because they usually benefit one neighbour more than another, therefore equal contribution is unsuitable.However, QCAT can make orders about carrying out fencing work that includes work on a retaining wall if the repair of the fence is dependent on the work for the retaining wall.</p>
<h3>What sort of dividing fence disputes will QCAT help resolve?</h3>
<p>If you have given your neighbour a Notice to contribute to proposed or urgent fencing works, you can apply to QCAT if you are unable to agree on construction or repair of a dividing fence. <h3>What if my neighbour wants a dividing fence that exceeds requirements? Do I have to pay more?</h3>
<p>No. If your neighbour wants a more expensive fence than one which would meet requirements to be a sufficient dividing fence, they are liable for the extra costs and maintenance.</p>
<h3>My neighbour is constructing fence without my permission. What can I do?</h3>
<p>Try talking to your neighbour – you may be able to resolve the issue. If you cannot reach an agreement, you can apply to QCAT for an order preventing the construction of the fence. After you have applied to QCAT you will need to give a stamped copy of your QCAT application to your neighbour as soon as possible and at least three days before the application is heard by QCAT. QCAT will also send to you and your neighbour a notice with the details of the hearing.</p>
<h3>My neighbour is demolishing a fence without my permission. What can I do?</h3>
<p>Try talking to your neighbour – you may be able to resolve the issue. If you cannot reach an agreement, you can apply to QCAT for an order preventing the demolition of the fence. After you have applied to QCAT you will need to give a stamped copy of your QCAT application to your neighbour as soon as possible and at least one day before the application is heard by QCAT. QCAT will also send to you and your neighbour a notice with the details of the hearing.</p>
<h3>What can I expect when I lodge a dividing fence dispute application with QCAT?</h3>
<p>If you are unable to reach and agreement with your neighbour regarding your dividing fence through a Notice to contribute, you may wish to make an application to QCAT.
