Sydney developer <a href="https://www.apartments.com.au/developers/odus">ODUS Property Group</a> is continuing to expand its local Gold Coast development pipeline, filing plans for a new 40-storey tower in the Southport CBD.

Odus, which bought two luxury Main Beach projects, now La Mer and Le Reve, to make its move into the booming Gold Coast apartment market, has secured its third site. But it is tweaking the plans for a previously proposed 50-storey skyscraper, now seeking to deliver 40 storeys.

The project, dubbed <a href="https://www.apartments.com.au/new-apartments/80-marine-parade-74-80-marine-parade-southport-qld-4215">80 Marine Parade</a>, sits on a prime&nbsp;2,032 sqm amalgamated corner site at 74–80 Marine Parade and 4 Welch Street, across the road from the Gold Coast Aquatic Centre. It will have unobstructed, never-to-be-built-out views to the east given its position opposite the Broadbwater Parklands.&nbsp;

The plans are for 316 apartments, ground-floor retail, and resort-style resident amenities. The project sits within Precinct 1 (Central Business District) of the Southport Priority Development Area, where high-density residential and commercial development is actively encouraged.

BGD, ran by Bayden Goddard and the architecture firm behind Le Reve, has revised the original concept plans, substantially reworking the built form. Basement parking has been replaced by an expanded podium designed to improve functionality while reducing the tower's overall visual impact.&nbsp;&nbsp;

The tower rises above the eight-storey landscaped podium with a distinctive architectural language defined by sweeping arches, integrated greenery, bronze-toned glazing, and a sculptural rooftop crown.

The development will comprise 104 one-bedroom apartments, 208 two-bedroom apartments, and four four-bedroom penthouses across levels 9 to 36. Apartments are designed to accommodate both permanent residents and short-term accommodation within the same building.

A double-height lobby and reception will anchor the ground floor alongside a 23 sqm food and drink outlet, activating the Marine Parade frontage.

Parking will be accommodated within the podium, providing 288 vehicle spaces and 74 bicycle spaces, accessed from Welch Street.

Residents will have access to an extensive suite of amenities spread across multiple levels. A podium recreation deck will include a swimming pool, spas, sauna, steam room, cinema, residents' lounge and children's games room, while a second wellness level near the top of the building will feature a gym, co-working spaces, reading room, dining areas and communal kitchen. Extensive podium landscaping wraps the building to soften the built form and strengthen its interface with the surrounding streetscape.

The planning report notes the project responds directly to Southport's ongoing urban transformation.

"Consistent with much of Southport, the surrounding area is undergoing significant transition, with many older low-rise developments progressively being redeveloped for higher-intensity urban outcomes, as envisaged within Precinct 1."

It also states that the proposal "will contribute to a defined and legible eastern gateway to the Southport CBD, reinforcing the area's high-density urban character while maintaining a strong visual connection to the adjoining public open space network."

Located opposite the Broadwater Parklands, the site enjoys immediate access to the Gold Coast Aquatic Centre, Australia Fair Shopping Centre, TAFE Queensland Southport campus, the G:link light rail corridor and Southport's established commercial precinct. The location places future residents within one of the Gold Coast's fastest-evolving mixed-use centres, where numerous high-rise residential projects are reshaping the CBD skyline.

Odus is headed by development professionals Byron Sakha, Jarrod Younan and Sebastian Younan. The Younans also head family-owned builder Nazero Constructions, established in the 1960s.

They are currently delivering La Mer, 24 luxury apartments on Main Beach Parade, and Le&nbsp;Rêve, on the same street but on the prized beachfront side of the sought-after strip.

ODUS plans landmark 40-storey tower for Southport's Broadwater gateway

A boutique collection of just 10 residences could become the catalyst for the next phase of renewal along the southern end of Surfers Paradise Boulevard, with new plans laid for a mixed-use tower designed to transform a long-vacant site.

The proposal for <a href="https://www.apartments.com.au/new-apartments/3098-surfers-paradise-boulevard-surfers-paradise-qld-4217">3098 Surfers Paradise Boulevard</a> has been conceived as more than a standalone residential project. Designed by <a href="https://www.apartments.com.au/architects/bda-architecture">BDA Architecture</a>, the development aims to spark the revitalisation of what the design team describes as the "South Boulevard" precinct, creating an active streetscape with retail uses at ground level beneath a collection of full-floor luxury residences.

The application, by PR Property Holdings, an entity directed by the Brisbane-based Ryan and Petrovic families, seeks approval for a 17-storey, 62.2-metre mixed-use development on a compact 427 sqm site between Surfers Paradise Boulevard and Appel Street.

The project will comprise just 10 apartments, including eight full-floor residences and two duplex apartments, positioned above a two-level retail podium. Three podium parking levels will accommodate 26 vehicle spaces, while a recreation deck is proposed on Level 4.

Rather than pursuing apartment volume, the proposal focuses on large-format homes with a slender tower form intended to maximise outlooks while limiting visual bulk.

BDA Architecture said the proposal has been designed to become an urban renewal catalyst for the precinct.

"The ambition of 3098 Surfer's Paradise is that it provides the catalyst for incremental infill redevelopment and upgrade of what is coined the 'South Boulevarde' of Surfers Paradise which connects to the beating heart of Cavill Avenue."

The architects added: "An incremental approach to development that provides quality ground plane interface, human scale design, integrated subtropical landscape and semipublic permeable frontage can over time entirely upgrade a precinct."

The architecture adopts soft curves, articulated balconies and a slender tower profile rising from a human-scaled podium. The design report describes the project as delivering "bespoke residences of enduring distinction, sculpted with precision and quiet sophistication," with a focus on timeless coastal architecture.

The application also includes retail tenancies addressing Surfers Paradise Boulevard, reinforcing the site's role as an active mixed-use destination rather than a purely residential address. The planning report states the combination of the podium, landscaping and active frontage is intended to strengthen the pedestrian experience while contributing to the evolving character of the boulevard.

The site occupies a prominent position in the southern section of Surfers Paradise, directly opposite the G:link light rail corridor and within walking distance of Surfers Paradise Beach, Cavill Avenue, the Nerang River and Bruce Bishop Car Park. It is currently vacant, having previously accommodated a single-storey commercial building that was demolished in 2022. The planning report notes the surrounding area is characterised by a mix of commercial buildings and residential towers, with unlimited building height provisions applying under the Centre Zone.

The proposal also replaces an earlier 2022 approval for a restaurant and bar on the site, instead introducing a permanent mixed-use development that combines retail activation with boutique residential living.

Boutique apartment tower to "kickstart" Surfers Paradise's 'South Boulevard' revival

One of Hervey Bay's best-known waterfront landmarks could undergo its biggest transformation in decades, with plans lodged to redevelop the Hervey Bay Hotel &amp; Resort into a four-tower mixed-use precinct combining apartments, retirement living, a new hotel, wellness facilities, retail and an expanded hospitality offering.

The proposal seeks approval to redevelop the 8,981 sqm site at 249 Esplanade, Pialba, transforming much of the existing 1980s-era hotel and resort into a staged masterplanned precinct while retaining the Hervey Bay Hotel as its centrepiece.

Rather than a conventional apartment project, the proposal has been designed as four distinct towers delivered across four stages, each with a different role within the precinct.

The largest hospitality component sits within Stage Two, which combines a refurbished tavern, sports bar, gaming lounge, bottle shop, lobby café and wellness facilities beneath a new 52-room hotel and 55 apartments, including 30 dual-key residences. The tower rises 14 levels above the Esplanade and includes gym, spa and wellness facilities together with more than 260 car spaces.

Stage One introduces a retirement living component comprising 69 retirement apartments alongside communal facilities, while Stage Three delivers 59 apartments overlooking the Esplanade. Stage Four includes a retail tenancy at ground level with a further 45 apartments above. Collectively, the masterplan provides 228 apartments across the four towers in addition to the new hotel accommodation.

Urban Planet Town Planning Consultants, acting on behalf of Herbay Pty Ltd, says the redevelopment builds on the long-standing role of the hotel within the Fraser Coast community.

"The Hervey Bay Hotel is an iconic use (notwithstanding the current format) and the retention for this facility in the community as an effective and successful business will advance the goals of the Planning Scheme," the town planner noted in its planning documents.

The planning report argues the redevelopment responds to demand for greater housing diversity, additional tourism accommodation and expanded hospitality offerings within Hervey Bay's established urban area, rather than continued greenfield expansion.

"The delivery of contemporary services in the form of hotels, dining opportunities and short-term accommodation will be the cornerstone of the proposed development and does have a significant community outcome in the retention and expansion of existing services."

The masterplan has been prepared by <a href="https://www.apartments.com.au/architects/oge-group-architects">OGE Group Architects</a> and features three basement parking levels beneath towers rising to around 14 storeys, creating one of the largest integrated mixed-use developments proposed for the Fraser Coast. The design also incorporates gym and wellness facilities, communal recreation areas, retail space and new landscaped public interfaces across the four street frontages.

The site occupies a prominent waterfront block bounded by the Charlton Esplanade, Thomas Street, Watson Street and George Street, immediately opposite the foreshore and within walking distance of Hervey Bay's city centre, Wetside Water Park and surrounding commercial precinct. The existing Hervey Bay Hotel &amp; Resort currently occupies the site, with buildings dating largely from the 1980s.

The transformation of the Gold Coast’s CBD of <a href="https://www.apartments.com.au/developments/southport-qld-4215">Southport</a> is underway with the official commencement of one of the area’s first ‘next generation’ towers, the $200 million Maris residences.

More than 250 onsite and offsite workers will deliver the project being delivered by Malaysian company <a href="https://www.apartments.com.au/developers/mrcb">MRCB International</a> and its build partner, <a href="https://www.apartments.com.au/builders/binah-constructions">Binah</a>.

The start of construction by Binah follows an exceptionally strong sales campaign, with more than 90 per cent of apartments sold since its market launch less than a year ago.

The project has attracted predominantly local buyers and downsizers, many of whom who live and work in the CBD or the nearby Health and Knowledge precinct.

The commencement of construction was marked by an official sod turning ceremony on site today (Friday, August 7).

MRCB International CEO Ravi Krishnan said MRCB was delighted to be playing a part in the transformation of the Southport precinct.

“We’re very aware of the importance of Southport as the CBD hub of the Gold Coast and the need for high-quality residential facilities for locals who live and work in the area,” said Krishnan.

"Across Southeast Queensland, new apartment supply remains constrained, particularly in established precincts with infrastructure and amenity already in place. Projects like Maris are increasingly critical in meeting that demand, especially on the Gold Coast and in the city's CBD precinct."

Binah's Managing Director Khalil Hafza said the company was delighted to be constructing Maris in its first foray into the Gold Coast market.

“Binah has been in Queensland for some time but we are very pleased to be given the opportunity to construct a project of such magnitude on the Gold Coast,"&nbsp;Hafza said.

“Some 250 on and off-site tradespeople and consultants will work on Maris over the course of the next two years bringing significant economic benefits to the Gold Coast community.”

Maris will deliver 192 residences across 20 levels. The project forms part of an Australian and New Zealand development pipeline by MRCB now exceeding $1.6 billion in gross development value, alongside a growing portfolio of projects globally.

The company also commenced construction on its $600 million 26 Vista residences in Surfers Paradise last year, following strong sales momentum, with over 70% of residences sold.

Positioned next to the Broadwater in the Southport CBD, Maris will sit directly opposite the Broadwater Parklands light rail station and within easy reach of retail, dining and lifestyle precincts, placing residents at the centre of one of the Gold Coast's most connected and rapidly maturing urban centres.

Maris will offer a full suite of resort-style residential amenities, including a pool, gym and sauna, along with a rooftop level featuring decks, lounges and dining and yoga areas that command sweeping views across the Broadwater and out to the ocean.

Construction at Maris is anticipated to be completed in 2029.

MRCB and Binah mark start of construction on $200m Maris Residences in Gold Coast CBD

To say Frank Licastro is keen on Wyandra Street, the small 400m strip that straddles Teneriffe and Newstead, would be an understatement.

Licastro, who runs Frank Developments, first jumped onto the street with <a href="https://www.apartments.com.au/new-apartments/ducale-teneriffe-33-wyandra-street-teneriffe-qld-4005">Ducale Teneriffe</a>, just 26 apartments at 33 Wyandra Street.

With those apartments heading towards construction completion later this year, Frank went again just a few doors down with the recent launch of <a href="https://www.apartments.com.au/new-apartments/murano-teneriffe-37-wyandra-street-new-farm-qld-4005">Murano House</a>, a further collection of 41 apartments at 37 Wyandra Street.

Now Licastro is planning his third building on the strip.

Frank Developments has submitted plans to Brisbane City Council for a considerably larger 147-apartment project across an amalgamated 1,928 sqm site at <a href="https://www.apartments.com.au/new-apartments/22-40-wyandra-street-teneriffe-qld-4005">22-40 Wyandra Street</a>, which also runs through to Wyatt Street.

The Cavill Architects-designed proposal, on the opposite side of the street to Ducale and Munro House, will rise to 22 storeys at its tallest point, stepping down towards Wyandra Street as the building transitions between the higher-density Newstead skyline and the lower-scale character of Teneriffe.

The plans comprise just two one-bedroom apartments, with the project overwhelmingly geared towards larger apartments. There will be 80 two-bedroom apartments, 58 three-bedders, six four-bedroom apartments and a single five-bedroom residence.

The apartment mix continues the owner-occupier focus Frank has pursued across its recent inner-Brisbane developments.

There will be 222 resident car spaces and seven visitor spaces across four basement levels, along with 166 bicycle spaces.

Cavill has approached the architecture as a transition between two very different parts of inner Brisbane.

The site effectively sits on the dividing line between Newstead's high-density mixed-use precinct and Teneriffe's medium-density residential area, something that has heavily influenced the massing of the building.

Rather than presenting as a single 22-storey tower, the building steps up from a 13-storey form towards Wyandra Street to its taller 22-storey element towards Wyatt Street and Newstead. The design documents describe the taller component as the "backdrop massing", with the lower form creating the transition towards Teneriffe.

The architecture itself also changes as it rises.

At the lower levels, Cavill has drawn from Teneriffe's heritage buildings and the tuff stone found below ground, before shifting towards a more contemporary Newstead-inspired tower expression with continuous balconies higher up.

Frank is also proposing a significant amount of resident amenity throughout the building rather than concentrating everything on one recreation level.

Amenity terraces are proposed at levels 13 and 16, before another major rooftop terrace at the top of the building. The plans show a pool terrace and landscaped outdoor spaces, with shaded outdoor rooms, tree planting and protected "City Rooms" incorporated into the shared areas.

At street level, the project will also seek to open up the connection between Wyandra and Wyatt streets.

A currently constrained pedestrian laneway along the northern boundary would be expanded, while a double-height "City Room" would be created on Wyandra Street. A separate two-storey outdoor arcade would run through the site from Wyandra Street to Wyatt Street.

The ground floor plans also show food and beverage tenancy space alongside the residential lobby, lounge, office and landscaped public areas.

Cavill says the intention is to create a more generous and heavily landscaped Wyandra Street frontage, with weather protection and public spaces designed to encourage people to spend time at street level.

Frank has been busy across Brisbane and the Gold Coast in recent years, with two ultra-luxury projects under construction in Surfers Paradise, as well as several projects in the pipeline across New Farm and Hamilton in Brisbane.

First look: Frank Developments triples down on Teneriffe's Wyandra Street

Sydney’s property market is known for high prices, competitive bidding, and mounting pressure on first home buyers. But change is on the horizon.

From late 2025, eligible first home buyers in New South Wales will have access to a new federal government initiative aimed at addressing affordability: the Help to Buy Scheme.&nbsp;

<h2>What is the Help to Buy Scheme?</h2>

The program introduces a shared equity model intended to reduce the upfront cost of entering the property market, particularly in high-demand urban areas such as Sydney.

The scheme operates under a shared ownership structure in which the federal government takes an equity stake of up to 40 per cent for new homes, or 30 per cent for existing dwellings. This arrangement allows eligible buyers to significantly reduce their loan size and avoid the added cost of Lenders Mortgage Insurance (LMI).

Under this model, purchasers can enter the property market with as little as a two per cent deposit, well below the traditional 10 to 20 per cent usually required. The government’s contribution is not a loan but a co-ownership stake in the property. As such, there is no interest or rent charged on its portion.

Because the government’s equity combined with the buyer’s deposit typically meets or exceeds the 20 per cent threshold, LMI does not apply. The remaining balance, generally between 60 and 70 per cent of the property’s value, is financed through a standard home loan with a participating lender.

The government's equity in the property remains in place until the buyer chooses to repay it voluntarily or until the property is sold. Buyers can buy back the government’s share over time, in increments of at least five per cent, depending on their financial situation.

There is no fixed repayment timeline, but the amount to be repaid will be based on the property's market value at the time of repayment, not the original purchase price.

<h2>How do you qualify for the&nbsp;Help to Buy Scheme?</h2>

To qualify for the Help to Buy Scheme, applicants must meet the following conditions:

	<li>Be an Australian citizen at least 18 years of age.</li>
	<li>Be a first-home buyer who does not currently own property.</li>
	<li>Intend to live in the property as their primary residence.</li>
	<li>Earn less than $100,000 per year for individuals, or $160,000 for couples.</li>
	<li>Purchase a property within the regional price caps, currently $950,000 in Sydney, though this is expected to rise to approximately $1.3 million ahead of the program’s launch.</li>
</ul>

While the Help to Buy Scheme does not solve affordability challenges across the board, it does offer a more accessible pathway for a defined segment of the market, particularly younger buyers with moderate incomes who have been priced out of traditional lending routes.

The scheme is expected to commence in NSW in late 2025, as part of a national rollout.

For most Australians, buying an apartment is one of the biggest financial decisions they'll ever make

The location, floorplan and price are often the first considerations, but in recent years another question has become increasingly important: who is actually delivering the project?

A series of high-profile builder collapses, construction delays and defect concerns have fundamentally changed how many Victorians approach buying off the plan. The collapse of Porter Davis in 2023, which reportedly left around 1,700 homes unfinished, became one of the most visible examples of the risks that can emerge when a construction company fails. <a href="https://www.equifax.com.au/sites/default/files/lpassets/pdf/Final-Business-Market-Pulse-June-Sector-Deep-Dive-Report-2.pdf">Similar challenges across the broader construction sector</a> have left buyers asking more questions before signing a contract.

As Victoria continues encouraging higher-density housing to address supply shortages, transparency is becoming just as important as location or price.

One tool increasingly entering the conversation is the <a href="https://icirt.com/">Independent Construction Industry Rating Tool (iCIRT)</a>, an independent assessment framework designed to help buyers better understand the developer or builder behind a project. Originally developed by Equifax in consultation with government and industry as part of NSW's Construct NSW reforms, the system has since expanded nationally.

<h2 data-end="1519" data-section-id="7nmx3" data-start="1492">What is an iCIRT rating?</h2>

Most Australians are familiar with independent ratings in everyday life.

We compare ANCAP safety ratings before buying a car. We look at Health Star Ratings in supermarkets. Banks rely on credit assessments when lending money.

Until recently, however, there has been very little independent information available to help apartment buyers assess the business responsible for delivering a residential project.

That gap is what iCIRT was designed to address.

Builders, developers and other construction professionals with an iCIRT rating have demonstrated high-trust characteristics through an independent, evidence-based assessment across six criteria: Character, Capability, Conduct, Capacity, Capital and Counterparties. This involves a rigorous review of financial health, past project track record, and ethical conduct. Crucially, an iCIRT rating could help provide property buyers with confidence that they are working with a professional who has demonstrated the capability, capacity, and willingness to return and rectify issues.

Importantly, iCIRT is not a recommendation to purchase a particular property, nor is it a traditional credit rating. It is an independent assessment framework designed to provide objective information about a construction business using a <a href="https://icirt.com/sites/default/files/2025-08/iCIRT-Methodology-Issue1-May-2021.pdf">published methodology</a>.

The system has been widely adopted in New South Wales, where more than one-third of medium and large residential builders and developers now hold an iCIRT rating, representing over two-thirds of the state's residential building market by value as of 2025/26.

<h2 data-end="3126" data-section-id="h6ohtj" data-start="3084">Why buyers are doing more due diligence</h2>

For many buyers, particularly those purchasing off the plan, the biggest risk isn't whether they'll like the kitchen finishes.

It's whether the project will be delivered on time, to the expected quality, and by a company capable of completing the development.

<a href="https://icirt.com/sites/default/files/2026-07/iCIRT%202025%20Consumer%20Survey%20Report%20v05.pdf">Consumer research commissioned by iCIRT</a> found more than half of respondents believed current protections do not adequately safeguard buyers from builder insolvencies or defective projects. Other research found 88 per cent of prospective buyers would seek independent ratings or due diligence before purchasing, while 90 per cent said trust in construction professionals is essential.

That doesn't mean buyers should rely on a single rating alone.

Independent legal advice, understanding the contract, and seeking financial advice all remain important parts of the due diligence process.

However, an independent assessment can provide another source of information alongside those traditional checks.

<h2 data-end="4138" data-section-id="pquzxc" data-start="4094">Trust is becoming a competitive advantage</h2>

The conversation isn't only changing for buyers.

Developers are also recognising that trust has become an increasingly important part of the sales process.

Five years ago, purchasers typically asked about floorplans, finishes and settlement dates.

Today, sales teams are increasingly being asked about the developer's experience, financial stability, previous projects and construction partners.

For companies with strong governance and established delivery records, an independent iCIRT rating provides another way to demonstrate those credentials before buyers even visit a display suite.

According to Equifax, the assessment can also help businesses drive sales and <a href="https://icirt.com/resources-for-business/icirt-rating-helps-scion-secure-high-value-projects">secure high-value projects</a>, as well as identify operational improvements and <a href="https://icirt.com/resources-for-business/mirvac-reinforces-brand-trust-and-quality-independent-icirt-rating">attract top talent</a>.

<h2 data-end="4962" data-section-id="1j54ng5" data-start="4912">Beyond buyers: lenders are paying attention too</h2>

The influence of independent construction ratings is also extending beyond consumers.

According to Stamford Capital's Real Estate Debt Capital Markets Survey, an increasing number of lenders now incorporate iCIRT ratings into their due diligence processes when assessing residential development finance applications.

The survey found lender adoption has continued to rise, with many respondents saying independent assessments provide additional insight into governance, counterparties and delivery capability beyond traditional financial analysis. Some lenders also reported declining funding applications where businesses had poor or no ratings.

As construction costs remain elevated and access to development finance becomes more selective, demonstrating credibility is becoming increasingly valuable.

<h2 data-end="5801" data-section-id="1qazuxs" data-start="5772">What it means for Victoria</h2>

Victoria's apartment market is entering a new phase.

The state is seeking to accelerate higher-density housing while simultaneously introducing reforms aimed at improving confidence in residential construction.

For buyers, that means there are more tools available than ever before to research the businesses behind a project.

For developers, it signals that transparency is becoming another point of differentiation in an increasingly competitive market.

Buyers are asking more questions than ever before and increasingly expecting independent information, not just marketing material, before making one of the biggest financial commitments of their lives.

Buying off-the-plan in Melbourne? How independent iCIRT ratings are set to change Victorian property

The developers of the $2 billion Central Park mixed-used residential project in Chippendale have signed an historic agreement for a new green energy infrastructure aimed at greatly reducing carbon emissions. 
<a href="https://www.propertyobserver.com.au/retail/central-park-s-retail-precinct-set-to-launch-this-spring/2013032659989" target="_blank">Central Park</a> is a joint venture project between Frasers Property and Sekisui House Australia. It is being developed on 5.8 hectares of land that was formerly the Carlton &amp; United Breweries (CUB) site on Broadway.
Construction has commenced on the energy plant, which is touted as being about twice as efficient as a coal-fired power plant. 
It follows a $26.5 million Environment Upgrade Agreement (EUA) with the City of Sydney, <a target="_blank" href="companies/frasers-property-australia">Frasers Property</a>, and Eureka Funds Management.

This is the only the second such agreement to be signed in NSW, and the City of Sydney’s first EUA. 
The trigeneration plant could reduce greenhouse gas emissions by 190,000 tonnes over the 25-year life of the plant, according to estimates from environment consultants WSP group. 
This has the same effect on combating greenhouse gas emissions as removing 2,500 cars from the roads every year for 25 years. 
The plant will run on gas and produce low-carbon thermal energy, providing heating and cooling for the 3,000 residences planned for Central Park and 65,000 square metres of retail and commercial space across 14 buildings in the development. 
Electricity produced by the plant also has the potential to be exported to neighbouring buildings offsite. 
Trigeneration is the simultaneous production of three forms of energy: electricity, heating and cooling. 
A trigeneration system can provide power, hot water, space heating and air conditioning from a single system. It captures heat otherwise lost when generators create electricity, and uses it to generate both hot and cold water. 
The hot water in turn generates an absorption chiller, which operates like a refrigerator. The chiller then creates water at a sufficiently low temperature to be used for air-conditioning. 
When completed, the development will consist of around 2,100 apartments across seven residential towers, student housing, and 50,000 square metres of commercial office space across two towers. 
An additional 20,000 square metres of retail facilities have also been planned, as well as the restoration of 33 heritage buildings. 
A 6,400-square-metre public park will also be part of the development. 
Central Park will be completed in stages, from May 2013 to 2018. 
The energy plant will be completed and commissioned by December 2013. It will be housed in a multi-level subterranean bunker, which is part of the existing historic Brewery Yard building. 
Frasers Property and Sekisui House are currently seeking expressions of interest for an owner/operator of the trigeneration plant, with the owner/operator to be in place prior to the commissioning of the plant in late 2013.

Sydney’s Central Park residents to get energy efficient heating and cooling system

It’s time for the Real Estate Institute of Australia to stop carping about interest rates.
Before every <a target="_blank" href="/news">Reserve Bank board meeting</a>, the REIA shovels out its standard media release, depicting teeming millions of little Aussie battlers desperate for the RBA to throw them a bone.
After each RBA decision to leave things on hold comes the mandatory “first-home-buyers-cruelly-let-down-by-heartless-bureaucrats” release.
This week’s effort opined the “dwindling hopes” of home buyers whose pleas for more rate cuts have been shunned by Glenn Stevens and his mates.
There are several points the REIA boffins don’t get:
<ul>
<li>
Interest rates are already at historically low levels.
</li>
<li>
We have probably had the last cut in the current cycle, so get used to it.
</li>
<li>
The major lenders take little notice of the official interest rate anyway, so the REIA should be harassing them to cut, not the RBA board.
</li>
<li>
The RBA board has a lot more to consider in its decisions than the real estate market, although agents tend to think property is the only factor.
</li>
<li>
The link that the REIA appears to see between lower interest rates and rising markets does not exist.
</li>
<li>
There’s more to real estate markets than first-home buyers – a lot more.
</li>
<li>
We have had eight consecutive quarters of improving affordability, markets are now rising and this is as good as it gets, so give it a rest.
</li>
</ul>
In this week’s “please-help-us-we’re-desperate” press release, REIA president Peter Bushby says that “declining interest rates have been the major contributor to an improvement in housing affordability”.  
I’m not sure that’s true. Lower rates have been a contributor, but equally the decline in prices in 2011 and part of 2012, and the steady rise in average incomes (up about 5% last year) have been just as important in the affordability equation.
Nor are decreasing interest rates the prime catalyst for igniting real estate markets, a myth much cherished by real estate agents. There’s plenty of research, including a recent study by BIS-Shrapnel, showing there is little evidence that interest rate movements and home prices run hand in hand.
The obsession the <a target="_blank" href="/?option=com_googlesearch_cse&amp;q=REIA">REIA</a> has with first-home buyers needs adjusting as well. First-time buyers are never, not even at their peak (such as in 2009), a major part in the market. The greatest single force in residential markets is the next-time buyer – i.e. home buyers other than first-home buyers. At any point in time, they comprise the bulk of the market.
The other significant players ignored by agents are investors. Right now, investors are rising, currently comprising about 35% of buyers nationwide.  
Most agents miss this market because they focus all their attention and marketing on home-buyers. Just look at the typical agency house-for-sale advertisement and notice how irrelevant it is to investor buyers.
Right now, real estate agencies have it better than any time in the past three years. They and their institutes should be putting their energies into taking advantage.

REIA should stop complaining about interest rates: Terry Ryder

The biggest 'sleeper' issue in Australian taxation is capital gains tax. Capital gains tax (CGT) has been around for over 25 years now but it continues to bedevil SMEs (and others).
As time goes on, more and more assets will fall into the CGT net. We may not have a death duty in the strict sense, but wealth and asset transfers by an ageing population will cause CGT to become an issue for many.
Among other things, the tax law provides a range of concessions to reduce, eliminate or roll over a capital gain made on a CGT asset that has been used in a small business. These concessions are as follows:
<ul>
<li>The 15-year exemption – an individual small business taxpayer is entitled to a full exemption from CGT, for example, the sale of an asset that is subject to CGT, where the asset has been continuously held for 15 years, the taxpayer is at least 55-years-old, and the sale of the asset occurs in connection with the retirement of the taxpayer. The 15-year exemption has priority over the other small business CGT concessions.</li>
<li>50% concession – a capital gain on an “active asset” (ie. an asset used in carrying on the business) used in the business can be reduced by 50% if certain conditions are met.</li>
<li>Retirement exemption – basically, a taxpayer can elect to disregard a capital gain on the sale of a business asset up to a lifetime limit of $500,000. If the taxpayer is under 55 at the time of choosing to apply this concession, the amount of the gain must be rolled over to a complying super fund or retirement savings account within the specified time limits. If the taxpayer was 55-years or over, the gain can be taken tax-free. This exemption cannot be used if the 15-year exemption applies.</li>
<li>Rollover for replacement assets – in essence, where assets are sold and replaced by new assets, any capital gain on the sale of the old assets can be ignored up to the value of the replacement asset. </li>
</ul>
As usual, and as expected, there are numerous hoops (i.e., basic conditions) that need to be jumped through before access can be gained to these concessions.
There are two basic conditions that must be met for a capital gain made by a business to qualify for the small business concessions:
(1)  The business must satisfy either (a) the "maximum net asset value" test, or (b) the "small business entity" test, or (c) be a partner in a partnership that is a "small business entity" where the CGT asset is an interest in an asset of the partnership.
(2)  The CGT asset that gives rise to the gain must be an "active asset" that is, an asset used in carrying on the business.
It is the maximum net asset value test I will look at in this column. In general, under the maximum net asset value test, in order to access the concessions, the net value of all the CGT assets of the business must not exceed $6 million (it used to be $5 million some years ago).
A recent case before the Administrative Appeals Tribunal (AAT) highlighted the difficulties that can arise in meeting this test.
As might be expected, meeting this basic test requires obtaining valuations of assets, and that's where difficulties can arise.

In the AAT case, a company owned three properties. During the 2005 income year, a "CGT event" happened in relation to the company when it disposed of a property it owned. The company claimed small business relief from capital gains tax on the basis that it satisfied the then $5 million maximum net asset value test. However, the valuation of the property concerned ultimately caused the business to fail that test.
Unless the company's valuation was accepted in each case, the net value of all relevant CGT assets would exceed the $5 million limit and the CGT relief claimed would not be available. In the end, the company's valuations were not accepted.
The matter turned on the valuation by the business' valuer and the Commissioner's valuer of one industrial and two residential blocks of units owned by related entities. The three properties were all located in the Illawarra area. One was an industrial site in Albion Park and the other two properties were residential sites, each of them containing a block of residential home units.
The AAT said valuation was not an exact science – a true but unfortunate statement given the importance of valuations in so many tax matters. In this case, the valuers used three valuation methodologies:
Direct comparison – where reasonably contemporaneous sales of other properties are used to estimate the value of the subject property.
Capitalisation – where the value of a property is derived by dividing the presumed rental income achievable, by a “capitalisation rate”. For example, a capitalisation rate of 5% represents an expectation that the value of the property would be recovered over 20 years. If the income capable of being generated is $100,000 per annum, then the estimated value of the property would be $2 million ($100,000 multiplied by 20).
Summation – where the estimated value of the land is added to the estimated value of the improvements on it, to produce an estimated value of the property as a whole.
The AAT preferred the Commissioner's valuation, and found that the taxpayer's valuations were not reasonable in the circumstances, despite concerns with various aspects of the Commissioner's valuations (for example, assumptions made by the valuer).
Among other things, the AAT found the following problems with the approach adopted by the taxpayer's valuer:
<ul>
<li>the lack of suitability of the comparison properties selected;</li>
<li>the lack of evidence of recent sales for the direct comparison method;</li>
<li>the use of estimates of income-generating potential for one of the properties rather than actual figures that were available;</li>
<li>the application of the comparable sales method was not transparent; and</li>
<li>failure to explain why he used a particular value per square metre for the land of one of the properties.</li>
</ul>
Accordingly, the AAT concluded that the valuations relied on by the company were not reasonable. The difference between the valuations by the Commissioner and the company was over $650,000.
In tax law, the taxpayer bears the burden of proving that the Tax Commissioner's assessments were excessive, and in cases where valuations were at issue, a taxpayer could not do this by simply proving that the valuations relied on by the Commissioner were wrong. Rather, the AAT said a taxpayer must positively establish that its own valuations are right, or at least more reasonable than the Commissioner's valuations.
This case is a useful reminder to SMEs about the importance of obtaining accurate and supportable valuations of assets where the CGT small business concessions are being sought.

The difficult operating environment being faced by some businesses is also evident in the commercial property sector, the RBA has acknowledged in its latest Financial Stability Review.
Buried deep within the hefty bi-annual report, the RBA also notes that the banking system has “sizeable exposures” to commercial property.
“The pace of the recovery in commercial property rents and prices slowed in 2012, and conditions generally remain weaker than prior to the crisis across the main market segments,” says the RBA.
“In the CBD office market, where conditions had improved the most over the past few years, rents have fallen in recent quarters and vacancy rates have begun to increase again.
“The increase in office vacancy rates over the second half of 2012 was driven by weaker tenant demand across most capital cities, and followed large supply additions in the first half, particularly in Perth and Brisbane.
“While there is some new supply in the pipeline, private non-residential building activity has been fairly weak compared with the run-up prior to the financial crisis, and the outlook for construction in the near term is subdued: non-residential building approvals in the second half of 2012 were below their average level since the early 1990s as a per cent of GDP, and survey measures of investment intentions are weak,” says the RBA.

Conditions remain "difficult" in commercial property sector: RBA

 Stevens has been governor of the RBA since September 2006, helping to steer the country through the GFC following deep cuts to interest rates in late 2008 and early 2009.</div>

<div>ANZ economist Katie Deans notes that the early re-appointment avoids the appointment from becoming a potential political issue. Stevens's current term was due to expire three days after the Federal election. 
</div>
"The short term of three years - usually appointments are made for seven years - probably reflects a succession plan to the next governor.
"The likely successor to Glenn Stevens, deputy governor Philip Lowe, was only appointed to his current role last year (February 2012), so was probably viewed as needing more time in that role before being promoted to governor.  The shorter term mirrors the final appointment of the previous governor Ian Macfarlane, before he passed the governorship to Stevens," she says. 
"Given the relative resilience of the Australian economy under Stevens's stewardship, his reappointment should be seen as favourable by markets.  And what appears to now be a clear internal succession plan at the RBA introduces further certainty to Australian the monetary policy process."
The Treasurer also announced the appointment of Kathryn Fagg to the RBA Board for a five-year term (commencing 7 May 2013), replacing Woolworths director Jillian Broadbent. 
Fagg has worked across the resources, transport and finance industries.

Glenn Stevens re-appointed RBA governor until 2016

The controversy surrounding Gold Coast-based funds management firm LM Investment Management has continued, with administrators revealing the business lent its founder, Peter Drake, a loan worth $17 million.
The company has already been accused of <a href="https://www.smartcompany.com.au/financial-services-and-insurance/054792-queensland-fund-management-business-collapses-following-damning-four-corners-report" target="_blank">breaching Corporations Law</a> by ABC's Four Corners. The collapse has meant investors face <a target="_blank" href="https://www.propertyobserver.com.au/developments/irregularities-suspected-in-lmim-s-maddison-estate-mortgage-fund-reports/2013040160117?utm_source=po&amp;utm_medium=aida&amp;utm_campaign=latestnews">exposures worth more than $740 million in total</a>.
In its first report on the investment company, administrators from FTI Consulting said the firm had lent a total of $301 million to Drake and his companies, and had raised $740 million from retail investors. The loans were made from the LM Managed Performance Fund.
In total, LMIM loaned six parties millions of dollars, according to the report:

The administrators are currently reviewing all the loans, but say the most significant project under review is the Maddison Estate Development, which was lent $249 million. This was the main vehicle of the company's LM Managed Performance Fund.
An FTI Consulting spokesperson told SmartCompany investigations into the loans remain ongoing.
"There are various issues around the regulatory status of MPF [Managed Performance Fund] that have been raised by ASIC," the administrators say in the report.
"In particular, MPF has to date been operating as an unregulated fund outside of the Corporations Act."
The $740 million in LMIM assets is in the form of cash, foreign currency, direct real property, commercial loans secured by first or second mortgages and listed shares.
The company was founded by Drake in 1997 and on March 19 this year administrators John Park and Ginette Muller were appointed.
The first meeting of creditors was held yesterday afternoon in Broadbeach and the administrators announced they are seeking an extension of the standard 30-day period allowed before a second meeting.
Administrators told creditors they have petitioned for a 90-day extension due to complex company structures, as they need more time to complete their initial investigations.
The administrators also intend to apply to the Queensland Supreme Court on April 12 to take control of the LM Managed Performance Fund as its receivers, due to concerns over the legality of its operations.

Administrator investigates $17 million loan to LM Investment Management founder

Beer, food and beverage maker Lion will relocate its WA headquarters to the redeveloped historic Old Swan Brewery mixed use development on Mount Bay Road, south of the Perth CBD.
Originally established in 1857, the former grand Edwardian brewery building was fully restored and refurbished by Multiplex in 2001. 
It is a coming home in a sense for Lion given that the original occupier of the historic building was Swan Breweries – a company that was purchased by the since renamed Lion Nathan between 1990 and 1992.
Lion will occupy the entire first level of the redeveloped brewery, which is located at 171 Mounts Bay Road. 
CBRE Office services director Luke Bray negotiated the five-year lease over the 1,243 square metres office floor.
The lease commences this month. 
Bray says the building’s high profile, city fringe location and the unique nature of the space had been major draw cards for Lion, which was moving its offices from Canning Vale ahead of relocating its brewing operations interstate.
“Old Swan Brewery is one of Perth’s most identifiable buildings, combining three levels of office accommodation with restaurants and luxury apartments,” Bray says.
“All areas boast panoramic views of the Swan River, with the site also benefitting from its prestige location next to Kings Park, close proximity to the CBD, ease of access to the Mitchell and Kwinana freeways and abundance of on-site car parking.”
Upon completion of the refurbishment, Multiplex (now Brookfield Multiplex) moved into levels 1 – 3 of the building and today the company still occupies two floors in the building.

Lion comes full circle as it relocates offices to Perth's Old Swan Brewery

The latest HIA new home sales report suggests further woes for the outer Melbourne fringe land market with new detached house sales falling 13.7% in Victoria over February.
The state led a 5.3% seasonally adjusted national decline in new home sales over February reflecting a 4% reduction in detached house sales and an 11% drop in multi-unit sales.
Sales of new detached houses fell 2.8% in New South Sales and 6.7% in South Australia.
Increases in detached house sales occurred in both Western Australia (+1.9%) and Queensland (+0.8%) during February.
The results are based on a survey of Australia's largest volume builders
“These data are disappointing in the context of the growth in sales over previous months,” says HIA senior economist, Shane Garrett.
“The broadly based decline in activity during February is a reminder of how delicate the nascent recovery in the housing industry really is. 

“If we take a broader view of the situation, the overall direction of activity is still quite encouraging.
“New home sales are up strongly over the last three months in almost all states, in terms of both houses and multi-units. 

“Nonetheless, February’s data emphasise how far housing market activity has fallen from the levels of just three years ago. The industry is struggling in the current economic environment and strong policy measures will be required to bring market activity back up to levels consistent with Australia’s long term requirements."

New home sales "stumble" in February led by 13.7% drop in Victoria: HIA

Standard &amp; Poor’s has cut the credit rating of Adelaide-based debenture-issuer Angas Securities from ‘B+’ to ‘B’ and placed it on a credit watch with a negative outlook.
A rating of ‘B’ indicates the company has the capacity to meet its financial commitments but that “adverse business, financial, or economic conditions will likely impair the obligor's capacity or willingness to meet its financial commitments”.
The downgrade follows S&amp;P's revision of its outlook for Angas from stable to negative in April last year.
<a href="/news">In January this year</a>, Property Observer reported that Angas Securities revealed that a third of its loans were in arrears, with around $33 million of these loans more than a year in arrears.
Angas has raised $300 million from around 2,500 small investors who have invested in Angas Securities' debenture fund, which offers returns from 7.5% to 9% and principally lends the money on at high interest rates as commercial property loans.
S&amp;P noted last year that Angas had a “sizeable portfolio of non-performing assets includes some large exposures when assessed against the company's modest capital base”.
Angas Securities and its dozens of debenture funds are listed on the small cap National Stock Exchange.
In an investor newsletter published last month, Angas said the Standard &amp; Poor’s credit rating “is an objective, independent opinion of the willingness and capacity of Angas to meet its financial commitments in full and on time”.
In its most recent financial update following the release of poor interim results, Angas executive chairman Andrew Luckhurst-Smith says “the entire debenture funded commercial lending sector was facing significant scrutiny in the wake of two provincial companies entering receivership during the period”.
Debenture funds that have collapsed over the past year include Sydney-based Provident Capital, Brisbane-based Wickham Securities, regional Victorian-based Banksia and <a href="https://www.propertyobserver.com.au/developments/irregularities-suspected-in-lmim-s-maddison-estate-mortgage-fund-reports/2013040160117?utm_source=po&amp;utm_medium=aida&amp;utm_campaign=news">Gold Coast-based LM Investment Management</a>, which had its first creditors meeting yesterday.
Luckhurst-Smith added that “both were unlisted and un-rated issuers so were not directly comparable to companies such as Angas”.
Angas Securities posted a 34% drop in profit (before tax and dividends) of $1.019 million for the six months to December 30, 2012 on higher revenues (up 19%) of $20.839 million.
The financial report shows loans totalling $238 million on the balance sheet up from $179 million in the previous corresponding six-month period.
The company also holds $33 million worth of investment property and $27 million in cash.
Luckhurst-Smith said profits were lower on the year before due largely to expenses involved in the recovery of loans and the management of several impaired loans.
He also reported that the fund had finalised negotiations for the structured sale of Fernhill, a grand residential property near Penrith, on the outskirts of Sydney, which is being transformed into 88 residential allotments and a major tourism venue, expected to generate in excess of $50 million.
