The latest CoreLogic Pain &amp; Gain report had 20.1 percent of Perth homes resold at a loss, while in Darwin, 24.2 percent of homes resold at a loss; the highest proportion since December 2002.

Across the remaining capitals, the proportion of loss-making resales was: Sydney 2.4 percent, Melbourne 4.4%, Brisbane 8.4%, Adelaide 10.6%, Hobart 10.8% and Canberra 9.6%. Across the regional markets, the proportion of loss-making resales increased in New South Wales, Victoria, Queensland and Western Australia, and was unchanged in South Australia.
Across the individual areas, the proportion of resales at a loss were recorded at: 7.3% in regional NSW, 9.3% in regional Vic, 19.8% in regional Qld, 21.7% in regional SA, 33.8% in regional WA, 19.6% in regional Tas and 21.2% in regional NT.
The report uncovers the profits earned and the losses made from property sales over the June 2016 quarter, and reveals which locations have been the most valuable for investment.

Based on the June quarter findings, 5.9% of capital city houses resold at a loss, up from 5.7% from the March 2016 quarter while units at 9.5% resold for less than the previous purchase price. Across regional housing markets, 12.2% of houses &amp; 19.9% of units resold over the June 2016 quarter transacted below previous purchase price.
Regional areas experienced the highest proportion of total resales at a loss since the three months to August 2015 for houses and the three months to February 2016 for units.
Capital Cities Losses &amp; Profits:
• $164,239,771 in losses from resales of capital city houses = $94,926 on average; • $87,017,927 in losses from resales of capital city units = $67,456 on average; • $9,953,211,125 realised for resale profit for capital city houses = $363,442 on average;  • Total resale profit for capital city units - $2,828,164,261 = $229,596 on average.
Regional Areas Losses &amp; Profits:
• $139,475,875 worth of house resold at a loss = $64,423 average loss • $68,199,797 units resold at a loss = $61,944 average loss • $2,400,837,922 in profits realised for houses = $154,773 on average • $475,731,130 in profit realised for units across regional areas = $107,680 on average.
CoreLogic researcher Cameron Kusher said while loss-making resales increased over the quarter, historically, most cities are still seeing quite a low instance of homes reselling at a loss.
"However, Perth and Darwin are the exceptions with the proportion of loss-making resales at, or close to historic highs.”
Around the country, the proportion of loss-making resales over the quarter increased across each capital city excluding Melbourne and Canberra.

Perth's loss taking property sellers at 20 percent: CoreLogic

The benefits of creating low to mid-rise apartment dwellings in established inner and middle-ring suburbs are well documented, in terms of both urban planning and supporting the cultural health of citizens.
These developments meet the demands of buyers, mainly downsizers and first homebuyers, who have lived in established suburbs most of their lives and wish to remain in these areas for years to come.
In addition to this, the subdivision of middle-ring blue chip sites for multi-residential use has created a greater diversity of housing stock among tightly held areas, allowing more residents the opportunity to afford housing closer to the CBD
Despite the known benefits, councils and residents alike are wary of supporting new multi-residential developments, with concerns these buildings detract from the character and overall appeal of prestigious suburbs.
Design that emphasises local context is the solution here. The need to respect and respond to the context of the existing built environment may be one of the most important rules towards sensitively developing apartments in established suburbs.
At Rothelowman, we are currently developing a number of projects that both explore and honour their social, architectural and historical surroundings. In doing so, we are creating dwellings that gel with and attract the local people.
When designing an apartment building a strong focus is needed on the contextual, specific and unique elements of the site to connect it with the area, a generic formula is no longer enough.
Graceview (above), a five-storey apartment development located in the established middle-ring Sydney suburb of Turramurra, exemplifies this design philosophy.
This building takes its design cues from its neighbouring sites – the heritage-listed brick-built church, St Margaret’s, and Cameron Park. Architecturally, Graceview responds not only to St Margaret Church but also to the many large brick houses that characterise Turramurra.
Careful to preserve these much admired community spaces, our contextual design response was to build this 54- dwelling project around six beautiful, volumetric brick forms. These low, integrated brick towers respect the height of the church and sit back from the park, amid the foliage, in a manner that is unassuming yet sculptural.
Graceview gave us the opportunity to tell a tale in brick. Working with this local heritage material, as architects we were able to listen to the local story and incorporate this narrative into the design. As a result, people who have lived in Turramurra their entire lives have responded to the project in a very positive manner.
In projects such as Graceview, we are exploring new ways to provide neighbourhood connection. We are seeing higher levels of owner-occupancy from downsizers and first homebuyers looking to stay in the suburbs they already know and love. This in turn drives higher quality architecture.
For our recent development Canopy in Melbourne’s beach side suburb Elwood, we wanted to provide the experience of living in a beach road mansion, in keeping with the suburb’s ocean lifestyle.
Located in a largely single residential area, we designed Canopy as a four-storey development across two modern, geometrically inspired buildings to offer an aesthetically pleasing and proportionate response to suit the eclectic, existing architectural environment.
Graceview and Canopy are just two examples of Rothelowman projects that pay homage to their location and site history. Other examples include The Glass Factory in West End (once home to the Decorative Glass Company), Light + Co in West End (formerly The South Brisbane Gas &amp; Light Company), Tip Top in Brunswick (previously home to Northern Bakeries and later Tip Top Bakeries), and Corde in East Brisbane (which pays tribute to the Forsyth Rope Works site located adjacent – formerly the only rope manufacturer in Queensland).
It is our belief that by providing these strong links to site history and in our design, we cannot only preserve the history of established suburbs, but support population growth and future generations in a sustainable manner.

Designing density for blue chip suburbs

The Productivity Commission report favouring “greater competition, contestability and user choice” in social housing has caused concern among advocates for low-income tenants.
The report is an interim output from an ongoing review of the nation’s human services – including public hospitals, dental services and palliative care, as well as state-provided or regulated housing. The commission’s “pro-competition” statement, although a provisional finding, could presage a shake-up in the delivery of housing services for Australia’s most disadvantaged groups.
Critics have characterised the report as a charter for “privatisation” of public housing. While somewhat diminished, state-owned-and-managed housing still accommodates around 700,000 of our most vulnerable citizens.
This explains the fears that commission-inspired “reforms” could involve the forced sale of public housing to vulture capitalists unconstrained by enforceable obligations to provide tenant services or to maintain, upgrade and retain housing stock for its current purpose.
We need only look to Germany – so often referenced as a private-renter-friendly country – for an example of how a botched divestment of social housingto for-profit companies can lead to public authorities being forced to buy back stock.
However, rather than pushing towards an entirely marketised and deregulated framework underpinned by the profit motive, the commission report’s soberly couched analysis appears focused on how to make the existing social housing system work more efficiently and effectively to deliver established obligations.
The authors, for example, contend that:
"… there appears scope for improvement in the way social housing is delivered that could lead to better outcomes for tenants in the social housing system, as well as for people outside the system who are unable to access the support they need."
They rightly note that all is far from well with the status quo:
"Due to … funding pressures and demographic changes, the quality of the service received by social housing tenants has deteriorated … Additional maintenance expenditure as part of the Australian Government’s 2008 stimulus package has not alleviated deteriorating quality standards in public housing."
<h2>Towards a multi-provider system</h2>
The policy aspiration for a “contestable” social housing system has, in fact, been a mainstream orthodoxy for quite a while.
Indeed, it formed the centrepiece of Tanya Plibersek’s groundbreaking 2009 speech, Room for More. As Labor’s federal housing minister, she argued for a move away from the domination of social housing by large “monopolistic” state authorities and towards a “multi-provider” system. Under this vision, not-for-profit community housing providers would be supported to grow to a scale enabling them to both complement and compete with public housing entities.
Post-2009 developments have included some expansion of community housing. Part of this has been through the transfer of tenanted public housing properties.
Even so, community providers control only around a fifth of all social housing in 2016. They remain very much minority players in most states.
The Productivity Commission’s enthusiasm for greater contestability might result in a recommendation that state governments should consider further large-scale public housing transfers to community providers. Some contend that this amounts to damaging privatisation no less than if the recipients were for-profit companies.
In my view, this argument is highly questionable. Instead, community housing providers might legitimately position themselves as “the reform alternative to privatisation”.
In principle, greater competition, contestability and choice could be fostered within social housing in other ways. While observing that “allowing community housing providers to manage social housing appears to have had benefits, both in Australia and elsewhere”, the commission also notes:
"For-profit providers could introduce further contestability and choice."
In the absence of a new public subsidy, though, it’s debatable whether many companies needing to deliver shareholder returns would see the firmly regulated management of public housing as an attractive proposition.
Mid-1990s attempts by Queensland’s Borbidge government to outsource public housing to for-profit companies soon fell by the wayside. Similarly unsuccessful in the mid-1990s was the UK government’s effort to outsource the entire council housing service, under Housing Management Compulsory Competitive Tendering. Again, the inherently low returns from providing minimally subsidised services to poor people – as well as the complexity of social housing management – meant the UK program failed to attract the expected interest of for-profit companies.
A close reading of the commission’s report suggests anyway that the authors are at this stage more inclined towards diversifying social housing through boosting its community housing component than through a predominant role for private for-profit entities:
"Transferring the management of more properties to non-government providers could deliver more options for tenants who are offered a choice of housing provider."
Such a direction would, nevertheless, “not preclude the management of properties remaining with the public provider, if they were best-placed to provide the service”.
<h2>Obstacles to accountability</h2>
However, any reforms based on deciding which provider is “best-placed to provide the service” face a serious obstacle: the available data on the cost of social housing provision and service outcomes are woefully inadequate. This is true at the aggregate level and for individual social landlords.
Our research confirms that the capacity for quantifying management expenditure in public housing has decayed over recent years.
A fundamental problem has been the states’ and territories’ failure to honour a 2009 commitment to enhance and standardise their housing service accounting procedures. The financing of public housing services remains equally opaque. Only by repeating a major research exercise last undertaken in 2007 could we quantify the relative financial (un)sustainability of each state and territory housing authority.
In any event, diversifying social housing on a larger scale would call for Commonwealth government leadership in strengthening the regulatory framework and making it truly national. This would be needed to ensure effective monitoring and enforcement of responsibilities and obligations transferred to non-government providers. Indeed, the Productivity Commission report highlights the need for accountability:
"Improving the accountability of service providers could improve a range of attributes of social housing."
This supports the case for extending the current system for regulating community housing providers to cover public housing services.
In all of this, it is vital to keep in mind that Australia’s social housing system remains grossly underfunded. Currently available resources are inadequate even to properly maintain the existing portfolio, let alone to underpin the new supply needed to keep pace with growing need.
Any efficiency gains flowing from Productivity Commission-inspired managerial reforms will make only a tiny dent here. A commitment to overcoming this problem is a prerequisite if, in line with the report’s stated aspirations, the most disadvantaged are to have any real choice.

Productivity Commission stance has potential for social housing gains

De Dacha, the cute ski chalet in the Thredbo village which came with a $2.5 million asking price, has been sold by the former society model, Fiona Campbell.
It last traded in 1994 when a record $810,000 was paid Campbell and her then publisher husband, Matt Handbury to the the village developers, Lend Lease.
Overlooking the duck ponds, the European alpine-style lodge ranks as the loveliest of the village's private abodes.
The red-shuttered Da Dacha is a stand alone chalet which offered four bedrooms, four bathrooms, a lounge room with wood burning fireplace and a dining area with an office nook.
It was a $8000 a week peak season rental.
The lodge was designed by Lend Lease resort manager Albert Van der Lee, who occupied the lodge from 1962 to 1984.
Its building cost was a mere $28,000.
Following her split with Matt in 2001, Fiona famously received Point Piper's Altona, one of Australia's great harbourfront trophy homes, and De Dacha in the matrimonial settlement.
She sold Altona in 2002 for a record-breaking $28 million to hotelier Deke Miskin and his wife Eve.
It was followed by a marriage to a titled Englishman, the 10th Earl of Dartmouth William Legge, the grandson of the romance novelist Barbara Cartland, the son of Countess Raine Spencer, and stepbrother to Princess Diana.
De Dacha was listed by local estate agent Doug Edwards at Mountain High Real Estate. No sale price has yet emerged on the Kosciusko Thredbo sale records.
It has been a busier than usual snow season for property sales with whispers the famous Bernti's premises have been sold.
It still retains the name of the former hosts, Bernd and Tricia Hecher, the always welcoming couple who built their mountain ski lodge in the late 1970s.
He was the stonemason, turned ski instructor and she was the clerk of works, who became the leader of opinions in the tiny village. 
Iconic Athol Lodge is in the process of duplex subdivision with one of the five bedroom apartments just listed at $2 million. Orthopedic surgeons outlaid $1.69 million for Jodee Rich's Athol Lodge back in 2004. 
Obergurgl, located on the corner of Buckwong Place and Brindle Bull, seems set for alterations with a two storey master suite being proposed by the Malouf family. They have consulted the original architect Peter Muller.
The Bellevarde is the newest approved development with construction starting early next year by the veteran snow developer John Fielding.

Consumer confidence: The ANZ/Roy Morgan consumer confidence rating rose by 4.4 percent to 120.6 in the week to September 25.
It was the biggest weekly gain in 11 months and the confidence reading is well above the average of 112.6 since 2014.
Finances healthy: The estimate of family finances compared with a year ago has hit the highest levels in seven years.
What does it all mean?
Just like other financial commentators and analysts, the Reserve Bank takes an interest in the regular readings of consumer confidence. Roy Morgan and ANZ compile a weekly index and the Melbourne Institute and Westpac produce a monthly confidence measure.
But from the Reserve Bank’s point of view, the questions posed on family finances are the most revealing. Clearly if consumers believe that their finances are in good shape, and are expected to stay that way, then they are far more likely to spend.
So it is important that the latest survey shows the current state of family finances at the best levels in seven years. Or expressed another way, finances are the best since the global financial crisis. Expectations of another rate cut have been receding and the latest consumer confidence readings will reinforce that trend.
The consumer survey is clearly great news for any business dependent on consumer spending, especially the more discretionary or non-essential purchases.

<li>The estimate of family finances over the next year was up from +25 to +30; 
</li>
<li>Economic conditions over the next 12 months was up from +1 to +6; 
</li>
<li>Economic conditions over the next 5 years was up from +9 to +12; 
</li>
<li>The measure of whether it was a good time to buy a major household item was up from +33 points to +39 points.</li>
</ul>
What is the importance of the economic data?
The ANZ/Roy Morgan weekly survey of consumer confidence closely tracks the monthly Westpac/Melbourne Institute consumer sentiment index but the former measure is a timelier assessment of consumer attitudes and is now closely tracked by the Reserve Bank.
What are the implications for interest rates and investors?
Consumer confidence is clearly healthy and is supporting a lift in spending - a result that was largely confirmed in the August Commonwealth Bank Business Sales Index, a gauge of economy-wide spending.
More confident consumers are more likely to spend – although there are no guarantees.
While we haven’t yet ruled out a November rate cut, much will depend on the inflation readings released in late October.

Australia’s population is estimated to have clocked 24 million during the March quarter.
The annual growth rate has been tracking around 1.4 percent for the past six quarters. It is quite a bit lower than the pre-GFC boom years when population growth was running around 2.0 percent pa. But it remains high by OECD standards and is considered to be a strong pace.
Robust population growth means the economy needs to be expanding at a faster rate than otherwise to achieve full employment. That of course means that the economy has the capacity to expand at a faster rate too.
The slowdown in Australia’s population growth rate is a contributing factor to why most estimates of trend growth for the economy have been lowered in recent years – both Treasury and the RBA have lowered their estimates of trend growth to be in 2 3⁄4 to 3 percent range.
In the short run, however, the economy can expand  above that pace because; (i) the unemployment rate is above the non-accelerating inflation  rate of unemployment (NAIRU) and can move lower; and (ii) productivity in the resources sector will continue to lift as production comes on stream.

The major driver behind Australia’s population growth continues to be net overseas migration (NOM). However, its contribution to growth has come down over the past few years. Both sides of federal politics favour high levels of immigration to partially offset some of the effects from the ageing of the population. It also allows the economy to grow at a faster rate than would otherwise be the case which boosts aggregate demand. And it has significantly boosted demand for housing which flows through to higher prices. 
The ‘grey army’ – those aged 65 and over – has continued to grow as a share of Australia’s population. The growth of this age cohort underpins the structural decline in labour force participation. The ageing of the population has increased the dependency ratio (the age-to-population ratio of those typically not in the labour force) which underpins the need for fiscal reform, particularly tax policy. 
The detail
Australia’s population is estimated to have risen by 328k in QI (+0.4 percent). The lift takes the population to 24.1 million as at March 2016. NOM was 181k in the year to March 2016,  up from 177k in the year to March 2015. But well down from the peak of 315k in 2008.

Population growth is well above the national rate in Victoria. This underpins very strong employment growth in the Garden State, robust residential construction and strong State Final Demand (SFD). It does little for per capita SFD growth, however. The decline in mining investment and associated downturn in mining-related employment has contributed to a sharp slowdown in WA’s population growth rate.

Australia clocked 24 million people in the March quarter: CBA's Gareth Aird

The creative industries – ranging from game development to architecture, media, design and the arts – are a hot issue in urban development.
Creative businesses, almost by definition, are innovative. They drive new ideas, people and technologies into the market from the experimental edge. It follows, then, that strategies to make a state, city or town more creative can fuel cultural development, urban regeneration and economic growth.
The logic flows: attracting creative talent is increasingly tied to competing in global markets. Places with a creative industries base attract businesses and skilled workers from other knowledge-intensive industries like health, science, engineering and technology. This realisation has prompted regional governments across the globe, including some in Western Australia, to implement policies to make themselves more creative.
Australia’s creative industries contribute A$90 billion to the economyevery year. While making a city “more creative” has obvious economic rewards, gaps can emerge between policy and reality.
Creative businesses often struggle in the face of rising rents and development pressures. They may have difficulty in accessing property, finance and business advice.
The sector is also characterised by freelance, part-time and portfolio work. This means financial insecurity, uncertain employment and demanding working conditions are real challenges for a large proportion of its workers.
What do creative industries need to thrive?
Many cities, including some Australian state capitals, have to unpick the mechanics of city regeneration, which complicate creative industry development, through investment.
This public investment is often most visible in designated innovation or cultural precincts. The large public institutions and signature buildings typically found in these areas make plain governments’ involvement.
However, iconic architecture and major events alone aren’t enough to build robust creative economies. The creative economy in Australia is underpinned by the 98% of creative businesses with fewer than 20 employees. This sector plays an outsized role in innovation, experimentation and new ideas.
When municipal or state governments join forces with these smaller creative communities to shape urban regeneration the results can be far-reaching, although government’s role is often less visible.
The creative sector feeds on affordable commercial space, physical and digital connectivity and a critical mass of like-minded but diverse neighbours.
Small-to-medium creative enterprises are often deeply embedded in their local contexts. They are also highly networked, using formal and informal platforms to match ideas with potential collaborators, as well as private, government and third-sector investors.
Creating clusters from scratch is notoriously difficult. Building on latent and emerging clusters by leveraging existing property assets and local knowledge is far simpler. It also usually works a lot better.
This approach sounds intuitive, but often doesn’t happen. The reason is a heavy stakeholder focus on building something new, as well as control over land and property use.
Lessons from Amsterdam and Toronto
Amsterdam’s municipal council has introduced economic, cultural and spatial development policies that involve partnering small-to-medium creative entrepreneurs to rehabilitate brownfield sites. Creative-led partnerships have developed clusters at De Ceuvel, NDSM Wharf and Tolhuistuin.
The municipality has ceded some of its usual powers to the sector, with responsibility for delivery and success shared.
At Tolhuistuin, the council provides the land, old building stock and a maintenance budget for a fixed period while the creatives develop the precinct themselves (under the watch of a board). The outcome is a new asset-based blueprint for sustainable mixed-use urban development.
Tolhuistuin’s early seeded clusters set the stage for larger projects. These include the Eye Film Institute, the A’DAM Toren and the redevelopment of the Van Der Pek and Overhoeks precincts.
This all builds on the municipality’s longstanding broedplaatsen (breeding ground) program. This promotes creative clustering in underutilised buildings across the city by releasing 10,000m² of studio space per year.
The creative industries are empowered to take the lead in developing these projects. Amsterdam council unlocks funding sources and offers expert advice on bureaucratic and legal processes.
In Canada, Section 37 of the Ontario Planning Act has helped transform private, government and creative sector partnerships. It allows development regulations to be relaxed in exchange for community benefit, which includes creating living spaces for creatives.
In the early 2000s, social enterprise Artscape, supported by the City of Toronto, leveraged Section 37 to develop Artscape Triangle Lofts, home to 68 creative live/work units and Propeller Gallery. An innovative affordable ownership and rental program ensures a mix of uses and incomes in the building.
Toronto’s far-sighted policy decision helped the city retain and grow its creative community in the face of rising property prices. Today the sector contributes C$9 billion a year to Toronto’s GDP and employs 130,000 people.
Get in early, start small
The takeaway from this is that constructing a creative economy means implementing long-term transitional strategies to build talent and capacity over time. This avoids the need for more interventionist, expensive and risky strategies down the line.
WA towns and cities have an enviable opportunity to set up the conditions for a healthy creative economy before regeneration of their older building stock comes to pass. Nurturing this sector through a mix of smaller policy interventions could be an affordable and effective way to kick-start sustainable creative economies.
More modest interventions allow the luxury of learning from failure and trialling more experimental ideas. These can then flow through to the wider creative ecology.
All ecologies rely on an ongoing interplay between the large, medium and small. Each brings something different to the table to create a whole greater than the sum of its parts.
This requires a policy mix that can support big-ticket projects along with investment in sustainable careers and spaces for small-to-medium creative enterprises. This is true creativity at work.

The Strata Schemes Management Act 2015 (NSW), which is now expected to commence on 1 October 2016, makes some significant changes to the existing statutory dispute resolution procedures that strata manager’s, owners corporations and lot owners should be aware of. These are detailed below but first, we look at the existing dispute resolution process.
The Current Dispute Resolution Process
The current Act, the Strata Schemes Management Act 1996 (NSW), requires most strata disputes to be mediated prior to an application being accepted by the NSW Civil &amp; Administrative Tribunal (NCAT) registry. There are a few exceptions including applications for interim orders and applications for the compulsory appointment of a strata manager. Mediations are usually conducted by mediators from the Office of Fair Trading. Mediations can take between one to three weeks to arrange.
Adjudicator’s Orders 
If an agreement was not reached at mediation, or, if the mediation agreement has been breached, in most instances the next step is to file an application for Strata Scheme’s Adjudicator’s orders. These applications are “heard on the papers”. This means that the applicant, respondent and any interested parties must file written submissions and evidence in accordance with the timetable provided by the NCAT registry. Evidence is usually by way of a statutory declaration. To view submissions made by interested parties you must contact the NCAT registry and make arrangements to view the file. NCAT copying fees will apply if you wish to make copies. After the closing date for submissions, an Adjudicator is assigned and they review the filed documents and make a written decision which is then posted out to the parties.
If you wish to appeal the decision of an Adjudicator then you must file an application for NCAT orders. Strict time limits apply and legal advice should be sought on the date the order takes effect and the time limit for filing an appeal. Leave to appeal outside of time can be applied for however it can be difficult to obtain. Costs orders are not available in this type of application.
Interim Orders 
These are Adjudicator’s orders that are made on an urgent and usually ex parte (meaning without the other party being present) basis. They are generally reserved for matters where an order is required to preserve the status quo prior to an Adjudicator making final orders. Interim order applications must be filed together with applications for Adjudicator’s orders.
Tribunal Orders
Applications for Tribunal orders are filed with the NCAT Registry. The Registry serves the application and a notice of directions hearing. Unlike Adjudicator’s orders, the parties must attend NCAT for hearings. Applications can be made for telephone hearings in some circumstances.
There is no right of appearance in NCAT and leave to appear must be sought at either the first directions hearing or in writing beforehand. At the first direction hearing, orders setting out a timetable for the progression of the matter are made. These will include dates when submissions and evidence are due. The Registry will also re-list the matter, for a further directions hearing or for final hearing.
Although the rules of evidence do not apply (except in civil penalty matters such as for a breach of a notice to comply) the proceedings are similar to court proceedings in that both parties are to appear and argue their case before a NCAT member. The Member may restrict each parties’ time to provide arguments and adduce its evidence. At the end of arguments the Member may reserve their decision or give an oral decision when the arguments have closed. You have the right to request written reasons for the decision.
Appeals are strictly limited both in time and the types of appeals that can be made. We recommend you seek legal advice before instituting any appeal.
 The new NCAT Process
The Strata Schemes Management Act 2015 provides for a new dispute resolution process. Owners Corporations can establish their own independent dispute resolution process and the NCAT is given wider powers. Mediation is still required however prior to applying for orders for most types of matters.
Arguably the largest change is that there will be no more applications for Adjudicator’s orders and all applications must be made for Tribunal orders. This means that all applications will now be heard in person (or if leave is granted over the telephone) and parties will need to attend the NCAT to present their arguments and evidence. Leave to appear is still required and the same provisions of the Civil &amp; Administrative Tribunal Act 2013 (NSW) apply to applications for leave. The process for Tribunal orders detailed above will remain the same although it is expected that there will be an increase in the number of matters listed at each directions hearing (meaning more time should be set aside to attend directions hearings) due to all matters now being heard by the Tribunal.
The ability to appeal from a Tribunal decision is unchanged.

Property 101:  Dispute resolution and NCAT

When talking property investment most people generally think residential real estate, often giving little or no thought to commercial property as a viable investment solution.
But a growing number of everyday Australians are recognising the potential of this sector and are cashing in.
In particular, a flood of mum and dad investors utilising self-managed superannuation funds are investing in small commercial properties, in what has become an extremely competitive market, but for good reason.
Commercial real estate, classified as property assets primarily used for business purposes, consists of three sectors – retail, office and industrial. Each with a range of asset classes, these sectors have their own cycle representing often very different risks and rewards.
Although some commercial properties offer investors yields akin to residential property, around 4 percent, others can achieve a return of up to 10 percent, after costs, depending on the asset class and risk rating.
The benefit of investing in commercial property is that it is characterised by longer leasing covenants than residential property – typically three, five or 10 years – with fixed or CPI annual increases and the added benefit of the tenant meeting the cost of all outgoings, including land tax if the tenant is publicly listed.
Furthermore, commercial tenants will generally take better care of a property, ensuring it is maintained and presentable.  But while also offering potential for high capital growth, the high return from commercial property investment is not without risks.
Historically, commercial property is far less predictable than residential property markets, with the potential for longer vacancy periods and poor resale for some specialised assets, influenced significantly by economic factors such as unemployment and consumer confidence.
Additionally, investment in the commercial market can sometimes be difficult due to stricter lending conditions, which may require buyers to have a minimum 30 to 50 percent deposit.
For the average investor diversifying into commercial property there are several important factors to consider. Similar to investing in residential property, location is key.
The type of commercial asset you purchase should be strategically located, paying particular attention to zoning restrictions that govern the sites potential highest and best use. Furthermore, consider the development potential of both the site and the building in instances where the current use ceases to be viable.
There are many commercial investment options, including mixed use dwellings, such as a retail shop with dwelling, which offers a double income stream, small industrial factories, strata-titled offices, retail strip shops, fast-food outlets and service stations. While the risks associated with commercial property are higher than residential, the benefits can be significantly greater.

Property investment: Commercial or residential?

Developer <a href="https://www.apartments.com.au/developers/auyin-property-development">Auyin</a> is the latest to turn to the Victorian Government's Development Facilitation Program in an effort to secure approval for its long-planned, mixed-use project in Elsternwick.

In 2018, Auyin lodged plans with Glen Eira City Council for a 14-storey building, however Council approved a reduced eight-storey scheme. A subsequent VCAT appeal in 2019 upheld the eight-storey height limit.

The project was later amended to nine storeys, but Auyin is now seeking to revive something closer to its original vision. The developer argues that the planning context has evolved significantly over the past decade, particularly within the Elsternwick Activity Centre, where higher-density development has increasingly been encouraged along Glen Huntly Road.

The proposal would transform the 1,239 sqm site at <a href="https://www.apartments.com.au/new-apartments/7-12-horne-street-elsternwick-vic-3185">7-15 Horne Street</a>, opposite Elsternwick Railway Station, into a 13-storey residential and retail development designed by CBG Architects, with 40 apartments

The site currently comprises three commercial properties.

A publicly accessible 135 sqm plaza would be created on the north-east corner of the site, providing seating, landscaping, and a new gathering space adjoining Horne Street.

The design adopts a four-storey podium that references the finer-grain character of the surrounding streetscape, with the upper tower recessed behind generous setbacks on all boundaries.

A key element of the proposal is the reconfiguration and widening of the surrounding laneways. Vehicle access would be retained from Lois Lane, with upgraded pedestrian connections linking Ross Street and Horne Street. The development would provide 58 residential car spaces, two retail car spaces, and 52 bicycle spaces across two basement levels and ground-floor facilities.

Architecturally, the building draws inspiration from the established character of Elsternwick Village. The façade combines dark charcoal brickwork, textured concrete, bronze-toned metal detailing, and extensive planting integrated into podium and tower levels. The design also incorporates a chamfered corner treatment and publicly accessible plaza intended to strengthen pedestrian activity around the station precinct.

Elsternwick's last new development completion was&nbsp;EVA Elsternwick by Pitard late last year. <a href="https://www.apartments.com.au/developers/milieu-property">Milieu</a> is working away on its nature-led neighbourhood, <a href="https://www.apartments.com.au/new-apartments/elsternwick-gardens-by-milieu-8-gordon-street-elsternwick-vic-3185">Elsternwick Gardens</a>, on Gordon Street, with its first stage expected to complete next year.

Investors may soon find themselves with fewer reasons to buy established property and more incentives to look towards the new apartment market.

Proposed changes to negative gearing and capital gains tax concessions would see new and off-the-plan apartments retain access to the tax benefits, while established properties would miss out, creating a clear advantage for buyers purchasing newly built housing.

The policy direction aligns with what many developers have been saying for several years. Australia needs more housing supply, and governments are increasingly looking for ways to encourage investment into new stock rather than existing homes.

The challenge for investors is that suitable product is becoming harder to find.

For much of the last decade, one-bedroom apartments were the cornerstone of investor demand. They offered a lower entry price, strong rental appeal, and were a common feature across most apartment developments.

Today, the development pipeline looks very different.

Across both New South Wales and South East Queensland, developers are increasingly targeting owner-occupiers and downsizers, delivering larger two, three and four-bedroom apartments in response to changing buyer preferences. While one-bedroom apartments still exist, they now form a much smaller portion of many new projects.

That shift has created a shortage of investor-friendly stock, particularly in well-located projects close to transport, employment hubs and lifestyle amenity.

At the same time, rising apartment prices have pushed many new developments beyond the reach of traditional investors. On the Gold Coast and across South East Queensland, it's becoming increasingly difficult to find new apartments priced around the $1 million mark, particularly those offering strong rental fundamentals and long-term growth prospects.

We've rounded up four new apartment developments where investors can still secure a foothold in the market for around $1 million or less.
