Builder-developer&nbsp;<a href="https://www.apartments.com.au/developers/graya">Graya</a> has secured a prime Newstead site from fellow developer Fraser, subsequently lodging plans for The Silo, a major mixed-use residential project in Newstead designed around a new public laneway linking the James Street precinct with the wider Gasworks and Newstead neighbourhood.

Proposed for the corner of Chester and Morse streets, the <a href="https://www.apartments.com.au/architects/bureauproberts">Bureau^Proberts</a>-designed project places its strongest emphasis at ground level, where retail, landscaping and a new cobblestone pedestrian connection would open the site to the surrounding neighbourhood. The design team describes The Silo as “more than a residential building”, positioning the development as an extension of Newstead’s public realm rather than a standalone apartment tower.

“A new cobblestone laneway and landscaped connection between James Street and Gasworks unlock a missing pedestrian link, improving walkability and stitching together two of Brisbane’s significant urban destinations,” Bureau Proberts said in its Urban Design Report.

The Silo is planned as a mixed-use development incorporating apartments alongside a bar and centre activities including food and drink outlets, indoor sport and recreation, office and retail uses.

Architecturally, Bureau Proberts has conceived the building as a collection of vertically expressed, stepping forms rather than a single uniform tower. The composition rises from an articulated podium before being broken by a triple-height landscaped recreation level, with the upper section becoming more compact before terminating in a landscaped rooftop garden.

The project's name and architectural language draw directly from Newstead's industrial history. Patterned off-form concrete is proposed as the principal façade material, complemented by slender metal rod balustrades and extensive planting. The cylindrical and vertically ribbed elements give the building its silo-like expression, while curved balconies and planted edges introduce a softer subtropical layer.

“The Silo reinterprets its robust forms, scale and materiality through a contemporary subtropical architectural expression, creating a building that acknowledges its industrial legacy, while responding to the way the precinct is occupied today,” Bureau^Proberts said.

The recreation level is one of the defining breaks in the tower. Plans include a lap pool, mature subtropical planting and shared resident facilities within an elevated communal garden. Landscaping continues through the podium and onto the rooftop, where a further garden forms what the architects describe as a “subtropical crown” to the building.

Retail and hospitality tenancies address the public realm, while landscaped pedestrian spaces lead into the new laneway connection. Renders in the design report show the proposed “Silo Lane” as a substantial opening through the podium, framed by cylindrical concrete forms with cascading planting above.

Walker Corporation is doubling down on Maroochydore following the successful sales campaign at its first residential project in the emerging CBD.

The national developer has filed plans for <a href="https://www.apartments.com.au/new-apartments/celeste-30-sunshine-coast-parade-maroochydore-qld-4558">Celeste</a>, a new 29-storey apartment tower at Lot 30 Sunshine Coast Parade, just metres from its under-construction SOL by Walker development.

The plans, prepared by Plus Studio, would see 208 apartments delivered across a 100-metre tower on the 2,376 sqm site, which fronts Sunshine Coast Parade, First Avenue and Future Way within the Maroochydore Priority Development Area.

It represents Walker's next major residential move in the new Maroochydore CBD after the success of SOL by Walker, its $220 million two-tower project nearby.

SOL launched to market in early 2025 and has since seen strong demand, particularly from local owner-occupiers. By February this year, Walker said the first SOL tower was nearing sell-out, with a strong waitlist also emerging for its recently released penthouse collection.

Plus Studio has designed a single 100-metre tower above an activated podium, with the architecture responding to the site's prominent position and three street frontages.

The podium would incorporate commercial tenancies and public art, with sweeping façade elements wrapping the street edges. The scalloped concrete podium has been inspired by the patterns created in sand at low tide, while extensive landscaping would continue vertically through the tower.

The ground level plans show three commercial tenancies addressing Sunshine Coast Parade alongside the residential lobby and landscaped public realm. The podium would then accommodate several levels of car parking before the residential tower rises above.

Plus Studio said the tower had been designed to maximise views from each apartment, taking in the Maroochy River, Sunshine Coast hinterland, Cotton Tree and Maroochydore Beach and ocean.

Those views have also shaped one of the project's key features, with Walker proposing to put the primary resident amenity on Level 29 rather than lower within the building.

The rooftop would feature a 284.9 sqm pool area with an infinity edge, along with a cold pool, spa, sauna, 93.2 sqm gym, sunset lounge, BBQ and dining areas, pool deck and private dining space. Cabanas and day beds are also shown across the recreation level.

The two penthouses would extend across the upper levels and each feature private terraces and plunge pools.

Celeste further reinforces Walker's commitment to the transformation of Maroochydore City Centre.

Walker is one of the key partners delivering the new CBD alongside Sunshine Coast Council and SunCentral Maroochydore, with the broader 62-hectare Priority Development Area occupying the former Horton Park Golf Course and surrounding land.

The precinct is ultimately expected to accommodate at least 4,000 new homes as Maroochydore evolves into the Sunshine Coast's principal commercial and residential centre.

When SOL secured approval in February 2025, Walker Managing Director and CEO David Gallant described it as the "first of many residential projects" the company planned for the Maroochydore City Centre.

Celeste now provides the clearest indication yet of what comes next.

The site sits immediately within the new CBD, with the design report identifying Sunshine Plaza and surrounding parkland within walking distance and Maroochydore Beach around a five-minute drive away.

For Walker, the timing of the application comes as its first residential bet on the new CBD appears to have been vindicated.

SOL has progressed from planning approval to construction while its first release has approached sell-out, giving Walker confidence to push ahead with another 208 apartments and take its residential pipeline in the Maroochydore City Centre to around 450 dwellings across the two projects.

Celeste remains subject to planning approval, with the architectural material describing the scheme as a preliminary yield study that may change through the assessment process.

Sydney’s property market is known for high prices, competitive bidding, and mounting pressure on first home buyers. But change is on the horizon.

From late 2025, eligible first home buyers in New South Wales will have access to a new federal government initiative aimed at addressing affordability: the Help to Buy Scheme.&nbsp;

<h2>What is the Help to Buy Scheme?</h2>

The program introduces a shared equity model intended to reduce the upfront cost of entering the property market, particularly in high-demand urban areas such as Sydney.

The scheme operates under a shared ownership structure in which the federal government takes an equity stake of up to 40 per cent for new homes, or 30 per cent for existing dwellings. This arrangement allows eligible buyers to significantly reduce their loan size and avoid the added cost of Lenders Mortgage Insurance (LMI).

Under this model, purchasers can enter the property market with as little as a two per cent deposit, well below the traditional 10 to 20 per cent usually required. The government’s contribution is not a loan but a co-ownership stake in the property. As such, there is no interest or rent charged on its portion.

Because the government’s equity combined with the buyer’s deposit typically meets or exceeds the 20 per cent threshold, LMI does not apply. The remaining balance, generally between 60 and 70 per cent of the property’s value, is financed through a standard home loan with a participating lender.

The government's equity in the property remains in place until the buyer chooses to repay it voluntarily or until the property is sold. Buyers can buy back the government’s share over time, in increments of at least five per cent, depending on their financial situation.

There is no fixed repayment timeline, but the amount to be repaid will be based on the property's market value at the time of repayment, not the original purchase price.

<h2>How do you qualify for the&nbsp;Help to Buy Scheme?</h2>

To qualify for the Help to Buy Scheme, applicants must meet the following conditions:

For most Australians, buying an apartment is one of the biggest financial decisions they'll ever make

The location, floorplan and price are often the first considerations, but in recent years another question has become increasingly important: who is actually delivering the project?

A series of high-profile builder collapses, construction delays and defect concerns have fundamentally changed how many Victorians approach buying off the plan. The collapse of Porter Davis in 2023, which reportedly left around 1,700 homes unfinished, became one of the most visible examples of the risks that can emerge when a construction company fails. <a href="https://www.equifax.com.au/sites/default/files/lpassets/pdf/Final-Business-Market-Pulse-June-Sector-Deep-Dive-Report-2.pdf">Similar challenges across the broader construction sector</a> have left buyers asking more questions before signing a contract.

As Victoria continues encouraging higher-density housing to address supply shortages, transparency is becoming just as important as location or price.

One tool increasingly entering the conversation is the <a href="https://icirt.com/">Independent Construction Industry Rating Tool (iCIRT)</a>, an independent assessment framework designed to help buyers better understand the developer or builder behind a project. Originally developed by Equifax in consultation with government and industry as part of NSW's Construct NSW reforms, the system has since expanded nationally.

<h2 data-end="1519" data-section-id="7nmx3" data-start="1492">What is an iCIRT rating?</h2>

Most Australians are familiar with independent ratings in everyday life.

We compare ANCAP safety ratings before buying a car. We look at Health Star Ratings in supermarkets. Banks rely on credit assessments when lending money.

Until recently, however, there has been very little independent information available to help apartment buyers assess the business responsible for delivering a residential project.

That gap is what iCIRT was designed to address.

Builders, developers and other construction professionals with an iCIRT rating have demonstrated high-trust characteristics through an independent, evidence-based assessment across six criteria: Character, Capability, Conduct, Capacity, Capital and Counterparties. This involves a rigorous review of financial health, past project track record, and ethical conduct. Crucially, an iCIRT rating could help provide property buyers with confidence that they are working with a professional who has demonstrated the capability, capacity, and willingness to return and rectify issues.

Importantly, iCIRT is not a recommendation to purchase a particular property, nor is it a traditional credit rating. It is an independent assessment framework designed to provide objective information about a construction business using a <a href="https://icirt.com/sites/default/files/2025-08/iCIRT-Methodology-Issue1-May-2021.pdf">published methodology</a>.

The system has been widely adopted in New South Wales, where more than one-third of medium and large residential builders and developers now hold an iCIRT rating, representing over two-thirds of the state's residential building market by value as of 2025/26.

<h2 data-end="3126" data-section-id="h6ohtj" data-start="3084">Why buyers are doing more due diligence</h2>

For many buyers, particularly those purchasing off the plan, the biggest risk isn't whether they'll like the kitchen finishes.

It's whether the project will be delivered on time, to the expected quality, and by a company capable of completing the development.

<a href="https://icirt.com/sites/default/files/2026-07/iCIRT%202025%20Consumer%20Survey%20Report%20v05.pdf">Consumer research commissioned by iCIRT</a> found more than half of respondents believed current protections do not adequately safeguard buyers from builder insolvencies or defective projects. Other research found 88 per cent of prospective buyers would seek independent ratings or due diligence before purchasing, while 90 per cent said trust in construction professionals is essential.

That doesn't mean buyers should rely on a single rating alone.

Independent legal advice, understanding the contract, and seeking financial advice all remain important parts of the due diligence process.

However, an independent assessment can provide another source of information alongside those traditional checks.

<h2 data-end="4138" data-section-id="pquzxc" data-start="4094">Trust is becoming a competitive advantage</h2>

The conversation isn't only changing for buyers.

Developers are also recognising that trust has become an increasingly important part of the sales process.

Five years ago, purchasers typically asked about floorplans, finishes and settlement dates.

Today, sales teams are increasingly being asked about the developer's experience, financial stability, previous projects and construction partners.

For companies with strong governance and established delivery records, an independent iCIRT rating provides another way to demonstrate those credentials before buyers even visit a display suite.

According to Equifax, the assessment can also help businesses drive sales and <a href="https://icirt.com/resources-for-business/icirt-rating-helps-scion-secure-high-value-projects">secure high-value projects</a>, as well as identify operational improvements and <a href="https://icirt.com/resources-for-business/mirvac-reinforces-brand-trust-and-quality-independent-icirt-rating">attract top talent</a>.

<h2 data-end="4962" data-section-id="1j54ng5" data-start="4912">Beyond buyers: lenders are paying attention too</h2>

The influence of independent construction ratings is also extending beyond consumers.

According to Stamford Capital's Real Estate Debt Capital Markets Survey, an increasing number of lenders now incorporate iCIRT ratings into their due diligence processes when assessing residential development finance applications.

The survey found lender adoption has continued to rise, with many respondents saying independent assessments provide additional insight into governance, counterparties and delivery capability beyond traditional financial analysis. Some lenders also reported declining funding applications where businesses had poor or no ratings.

As construction costs remain elevated and access to development finance becomes more selective, demonstrating credibility is becoming increasingly valuable.

<h2 data-end="5801" data-section-id="1qazuxs" data-start="5772">What it means for Victoria</h2>

Victoria's apartment market is entering a new phase.

The state is seeking to accelerate higher-density housing while simultaneously introducing reforms aimed at improving confidence in residential construction.

For buyers, that means there are more tools available than ever before to research the businesses behind a project.

For developers, it signals that transparency is becoming another point of differentiation in an increasingly competitive market.

Buyers are asking more questions than ever before and increasingly expecting independent information, not just marketing material, before making one of the biggest financial commitments of their lives.

All in separate bedrooms under the same roof proved very rare.
Plenty of five bedroom homes. Lots of six bedders.
And seven bedrooms were available too.
At Brighton there's a brick home offering seven bedrooms (pictured below). There are two bathrooms, two spa baths and three toilets within the 270 square metre home. <a href="https://www.realestate.com.au/property-house-tas-brighton-114867611" target="_blank">There's $439,000 plus being sought through Belle Parker at Roberts Glenorchy</a>. There are views of Mount Wellington and Mt Dromedary from the grounds of the 2.75 acres there are fruit trees, veggie patch and the chook pen.

At Davenport a property for the extended family, or for its current use as tourists accommodation, has been listed. The property (pictured below) on 1,353 square metres is listed through John Ackroyd at <a href="https://www.realestate.com.au/property-house-tas-devonport-113491615" style="line-height: 1.3em;">$875,000</a>.

There is a grand old home at Bushy Park (pictured below)- an 1859's home with 55 squares of comfort and space, sits on 22 acres. "With seven bedrooms there will no longer be any arguments with siblings sharing rooms," <a href="https://www.realestate.com.au/property-house-tas-bushy+park-115849471" target="_blank" style="line-height: 1.3em;">listing agent Karen Storey at Sorell says</a>. It has three bathrooms.

All within meters to the main beach. <a href="https://www.realestate.com.au/property-house-tas-boat+harbour+beach-115819011" target="_blank" style="line-height: 1.3em;">The 233 square metre home is set on 2600 square metre block</a>. The home (pictured below) was built in 2002. 
Designed on three levels the bottom consists of garage with internal access, two bedrooms, gym room, storage room, study, 3rd bathroom and a huge rumpus room. Second storey features large open plan living, three bedrooms and main bathroom. Upstairs to two more bedrooms, master has full en-suite with corner spa, plus a sun or sewing room.

It had been passed in at March 2013 auction when $400,000 was being sought for the property which had been last sold at $348,000 in 2004.
It is the first regional, non-capital city location, filmed in the series.
"I walked in and didn’t even need to see the whole house... we just went ‘Yep’ and made an offer on the spot," says Maddi, a marketing manager and former reporter. Their large, high-set timber home with a wrap-around deck and pool is minutes to the beach and backs onto a reserve frequented by wildlife. The house has been ravaged by the region’s tropical weather over its 25 years with rot and mould a problem, along with leaky taps, uneven floors, an almost unusable kitchen and a "grotty" bathroom with pink floor tiles.
One of the rooms has been <a href="https://au.tv.yahoo.com/house-rules/clips/23668656/worst-rooms-maddi-and-lloyd-qld-/#page1" target="_blank">used just for Maddi's shoes</a>.

"I've been friends for 10 years or more….She tried to get into radio in Brisbane….as a news reader. She may have been a swimwear model for various magazines….she's pleasing on the eye," Brenden Wood chipped in, adding she was briefly at GWS in its foundation days.
Gray said the couple had an engaging personality with a big rambling Queenslander house that they thought had great potential.
"It was a tricky one for us…..is it going to be as good as a home in Brisbane in terms of rating?"
"All in all we thought it was worth going outside the capital city," she said. The series was filmed between October and Easter this year.

When interest rates are decreasing, property owners paying variable rates are among those who begin to feel a little bit more relaxed about their repayments.
However, the verdict from most economists is that the <a href="/expert-insights/finance/borrowers-warned-of-interest-rate-hikes-by-late-2014">next interest rate movement will be an increase from today’s record lows</a>. While it’s not time to panic quite yet – the general consensus is also that we will have a period of stability – it’s certainly time to put into place some measures if you haven’t thought about the impact of an interest rate increase.
In fact, ME Bank’s latest Household Financial Comfort Report, which noted that a “wait and see” approach is indeed likely from the Reserve Bank, saw 19% of people note that they had not budgeted for any rate increase.
ME Bank’s general manager for asset products Luke Easton told Property Observer that awareness of potential changes is crucial, and then those with mortgages must be allowing for changes.
So, what can you do?
Fixing your home loan
The first thing that jumps to everyone’s minds is fixing your loan while rates are low. While this may be a good solution for some, it can leave you locked in and unable to be as flexible as you may need with your loan.
Easton suggests that splitting your loan into part-fixed and part-variable might actually be a better plan. However, he notes: “Everyone is different. People should be doing what suits their own situation.”
This is good advice – not every investor and home owner will want to fix. While a fixed rate will ensure you have a low rate for a period of time, and regular repayments, it does tend to be higher than the variable rates you can currently achieve. If rates did fall further, you’d be left paying more.
Break costs, such as early repayment penalties, may come into play if you aren’t completely aware of what you’re signing up for with a fixed rate loan.

Creating a buffer
Paying off more now, while you have the opportunity, is a great way to give yourself some breathing space for if rates do suddenly increase, said Easton.
If you put in some extra, then if you suddenly struggle to keep up you will have some space on the other end. Those who pay off the minimum are not necessarily putting themselves in the best situation.
Recently, Smartline suggested that <a href="/expert-insights/finance/now-is-the-time-to-aggressively-make-mortgage-repayments-smartline">now is the best environment in which to be aggressively making mortgage repayments</a> as reduced interest expenses mean you can pay off your principal quickly.
Practice repaying at a higher rate
Consider what might happen to your loan if the interest rate increased. Look to be putting this amount in for each repayment and see how you manage. If you’re struggling, then you need to be looking to solutions quickly – sometimes a visit to your lender, or a financial planner, can assist.

How to: Prepare for an interest rate increase

Everyone likes to hear about the first home owner grants that regularly change and can strongly affect interest in the market. However, there are a number of less-discussed grants that affect other, non-first time buyers.
Here are the lesser known grants  by state and territory.

Property Observer notes that most states and territories do offer other grants for pensioners, farmers and for those in difficult situations, many of which are not mentioned here. Charitable bodies, and prime production land, are also offered numerous concessions. For further information on these grants, the relevant Treasury or Office of State Revenue website should provide more details.

ACT
There is an opportunity for those looking to buy new residential home or residential vacant land in the form of charging stamp duty at a concessional rate. Called the Home Buyer Concession Scheme, it is available until 30 June 2014.
Applicants are required to satisfy a current and previous property ownership test, which requires purchasers to have not hold, or held, an interest in property over the past two years.
There is also a gross income test, that requires those applying (including their partners) to not earn more than a certain amount to be eligible. For those without dependents, this amount sits at $160,000 total gross income, gradually increasing per child until a five child cap at $176,650.
For a new or substantially renovated home, the duty charged looks like the following:
For properties worth $435,000 or less, the charge is $20.
For those worth more than this amount, but less than $535,000, the charge is $20 plus $18.85 for every $100 over $435,000.
After $535,000, no concession is available.
For vacant residential land:
For land worth $260,000 or less, the charge is $20.
For land worth more this amount, but less than $290,000, the charge is $20 plus $25.75 for each $100 over $260,000.
After $290,000, no concession is available.
Northern Territory
HomeBuild Access is a slightly different opportunity for some home buyers, offering a loan product instead of a flat grant. It comes in two variants, either a Low Deposit Loan or a Subsidised Interest Rate Loan, and they must be for new builds.
The former requires you to get a loan with TIO, the only approved financier, for 80% of the purchase price. The Territory Government then loans you 17.5%, leaving you 2.5% to come up with. There is also an Off The Plan Deposit Loan available.
The interest rate loan offers help with repayments for the first five years of the loan, as well as a Fee Assistance Loan of $10,000 to help with associated buying costs, including white goods, and is primarily, although not completely, available to first home buyers.
The price limit on one to two-bedroom homes is $475,000, and three-bedroom plus homes are capped to $550,000.
There are, however, strict eligibility requirements to achieve either of these products, including that you must not currently own other residential property, and have demonstrated satisfactory rental repayments (or loan repayments on previously owned homes). You must also have held employment for 12 months.
Income limits may also apply.
A Principal Place of Residence Rebate is also available on new build homes, which can take up to $7,000 off of your stamp duty bill. You must live in the property for a specified period of time upon completion.

New South Wales
In New South Wales there is a push towards regional relocation – with two grants on offer. One is the Skilled Regional Relocation Incentive, which includes two $5,000 payments.
The other is the Regional Relocation Home Buyers Grant, which is $7,000 paid within 21 days from the receipt of an application. To achieve this grant, you must have purchased a regional property between 1 July 2011 and 1 July 2015, and either use or intend to use it as your principal place of residence.
It must not exceed $600,000 in value – or $450,000 for vacant land.
You must commence living in the property within 12 months from completion of purchase and, if you have purchased vacant land, you must commence construction within six months and live in it within 12 months of the data of purchase.
You must have owned and occupied a metropolitan home as your principal place of residence in the 12 months prior to purchasing the regional property – and it must have been sold in the 12 months after the regional purchase as well.
From May this year, relocations may include properties that are 50 kilometres from the metropolitan home, and that are not in the same LGA or in an adjacent LGA.
The New Home Grant Scheme is also available to non-first timers. This is available to investors and owner occupiers.
Introduced on 1 July 2012, it provides a $5,000 boost to new homes, off the plan purchases and vacant land on which news homes will be built.
The scheme provides a grant of $5,000 towards the purchase of new homes, homes off the plan and vacant land on which a new home will be built. There’s a limit of $650,000 on the value of a new home, and $450,000 in the value of the vacant land.
It is paid as credit against the duty required. There are no restrictions on the number of times you can apply for this grant.
South Australia
The Housing Construction Grant for those purchasing or building a new home to a value of $450,000 was a bonus of up to $8,500 – which can be used in addition to the FHOG for those who are first timers – however this is now no longer applicable (since December last year) unless you entered into the contract between October 2012 and December 2013.
Those buying a new or substantially refurbished apartment may, however, still be eligible for the OTP or Off-the-plan Stamp Duty Concession. RevenueSA says that this is also available in addition to the FHOG, and is an amount up to $21,330 – capped to the stamp duty available on a $500,000 apartment.
Where an apartment is worth that amount or less, no stamp duty is payable. Over that price, and the total concession is available, plus you will need to pay any extra funds.
This is available until 30 June 2014, after which time a “partial concession” becomes available from 1 July 2014 to 20 June 2016.
It only applies to properties within certain areas (see the defined boundaries on the RevenueSA site here <a href="https://www.revenuesa.sa.gov.au/grants-and-concessions/off-the-plan-concesson">https://www.revenuesa.sa.gov.au/grants-and-concessions/off-the-plan-concesson</a>).
Victoria
The Victorian government offers a concession to those purchasing off the plan property, that has been around since 2008.
It also applies to house and land packages and refurbished lots, and allows a deduction from the contract price of the cost of construction or refurbishment, meaning that duty is only payable on the improved value of the land, the non-deductible costs and the completed construction or refurbishment.

Grants for non-first time buyers: A state-by-state guide

GUEST OBSERVATION
Conveyancing is the process of transferring ownership of land from one person to another, under the terms of a contract for the sale of that land.
That's it!
Every Australian state has different law, forms, regulations, fees, time requirements, protections, jargon and government departments as part of the conveyancing process.
But basically each state follows the same steps - just the details changes.
Whether you are buying or selling, there is a contract that sets out the terms of the sale. The buyer and seller have obligations and rights under the contract. The conveyancer's job is to make sure you do what you are supposed to do when you are supposed to do it.
Queensland and ACT
Unlike the other Australian states and territories where there are conveyancing companies owned and run by licensed conveyancers, it is illegal in Queensland and the ACT to have conveyancing companies owned by licensed conveyancers. All paid conveyancing work in QLD and the ACT must be done by a law firm. That is the law!
Many law firms in Queensland and the ACT have set up conveyancing companies that are in fact law firms and are treated as law firms. These companies must therefore comply with the rules and regulations of a Legal Profession Act which is administered by the relevant law society. Licensed conveyancers and para-legals can be employed in these law firms run as conveyancing companies, but all work must be supervised by a solicitor.
The bottom line is that in Queensland and the ACT it doesn’t matter at all if you go with a conveyancing company or a law firm, because there is no difference between them. The solicitor/law firm must hold a current practising certificate as well as having professional indemnity insurance.
All Other States and Territories 
In NSW, Victoria, South Australia, Western Australia, Northern Territory and Tasmania, entities that provide a conveyancing service may be law firms or licensed conveyancers.
Like law firms, licensed conveyancers are able to prepare your documents and offer advice within the scope of the laws regarding conveyancing. They will provide you the services necessary to complete your property transaction including title searches, liaison with financial institutions, contract advice, preparing legal documents, stamping, calculating rates and taxes as well as preparing for and attending settlements.
Licensed conveyancers cannot give legal advice outside the area of conveyancing.
The <a href="https://www.aicnational.com.au/">Australian Institute of Conveyancers</a> (AIC) has divisions in all of these states and territories. They are the peak body representing conveyancing in Australia. Conveyancing entities may apply to become a certified practising conveyancer recognised by the AIC. Certified practising conveyancers would work to the best practice standards as governed by the AIC.
How to Pick Your Legal Advisor
You have the right to do your own conveyancing. However, you won’t have a legal practitioner’s or conveyancer’s professional indemnity insurance to protect you if you do something wrong. And you won’t know if something is about to go wrong if you don’t have the knowledge to foresee any issues that may arise and which you should have protected yourself against.
While only Queensland and ACT require a solicitor/law firm to do paid conveyancing, you still have the choice of using a solicitor to complete your conveyance in all other states and territories.
All law firms must comply with the minimum professional standards of their state and territory law society and every licensed conveyancing company will have their own standards. Each must comply with their own rules and recommendations and any legislative regulations. The ethical standards of law firms are higher than those of conveyancers, and the penalties for non-compliance are greater.
Some things to take in consideration…
<ul>
<li>Business people don’t give away anything that is valuable, especially their time. Be wary of anyone who works for nothing. Would you work for nothing?</li>
<li>The best legal advisor will charge reasonable prices because they know how valuable their time and experience is. Experience is earned the hard way and valued. Generally the inexperienced need to provide an inducement to attract business.</li>
<li>Be careful of giveaways that are being used to lure you in, especially if the company is the cheapest to start with or promise to undercut the rest. Quality will always beat quantity.</li>
<li>Beware of businesses that offer a low cost first and foremost. These tend to have a high turnover of clients to compensate for their low fees and that means you won’t get as much service as a company that isn’t doing a high turnover and promotes service over cost. Look for service at a reasonable cost. Reasonable means in relation to the experience being offered.</li>
<li>Conveyancing is a service industry and this is what you are paying for. There will be times in the conveyancing process where you will want immediate service and that’s a guarantee, but can you be sure you will get it when you want it on your terms, given the conveyancer may be snowed under with a high turnover of files?</li>
<li>If you're paying a low fee don’t expect as much personalised service. Often you get the bare necessities. More often than not you won’t get answers to questions or explanations and they will probably not want to meet with you as this will take up their time. Essentially, they will try to spend the least amount of time on your conveyancing transaction as possible because time is money and the more transactions they can do, the more money they can make.</li>
</ul>
Don’t be taken in by ads for conveyancing companies when they:
<ul>
<li>Say they are your saviour from chaos.</li>
<li>Try and convince you that conveyancing is complicated, confusing, intricate, involved and carrying huge financial and time risks if the slightest thing goes wrong.</li>
<li>Claim to be good guys.</li>
<li>Are giving away something not usually given away and then try and make it sound like those who don’t follow their lead are the bad guys.</li>
<li>Put down their competition by calling them dishonest, or accuse them of cutting corners. Truthful advertising talks about positives in self, not negatives in others.</li>
<li>Tell you it’s all a bit dramatic and frightening and intend to scare you into using them – these tactics are aimed at first home buyers especially.</li>
<li>Leave you feeling afraid or intimidated by the unknown because you don’t know anything, or very little, about conveyancing.</li>
</ul>

Should I use a Lawyer or Conveyancer?
Conveyancers and lawyers are doing the same job - are they the same? No.
Conveyancers often charge less than lawyers because they are offering a lower service, e.g. they aren't qualified to give advice other than on conveyancing.
Lawyers provide full legal services at a comparable cost with conveyancers - therefore their service is generally better value for money.
A bigger business isn’t necessarily a better one
Low cost conveyancers will likely have substantially more files and clients than the more expensive ones. And they will need more clients turning over to keep the business open. As a result, the attention to detail is reduced as will be the time that they can devote to your case and to you.
A lawyer relies on his reputation which is based on his broad legal experience. They will have fewer clients and can give a more personalised service.
Qualifications
A conveyancer will have completed a conveyancing course and can do conveyancing work only.
Lawyers have university law degrees and are trained in conveyancing, property law, contract law, tax law, equity law, trade practices law, consumer law, local government law, family law, company law, the law of who gets your land after you die and other areas of law. These areas may be relevant to your conveyance, e.g. if the house you're selling is part of a deceased estate, the lawyer can advise on the will and tax implications.
Access to greater advice
Conveyancers aren't property law experts. They can't give you legal advice on consumer law protection, tax advice, and family law implications on how to buy the land so that you and your family are most protected or to have the best advantage.
A lawyer can give you more comprehensive advice.
Duty to refer
Conveyancer should refer you to a lawyer where legal advice is required e.g. the legal issues are too complex for a conveyancer.
Lawyers have access to their Law Society for advice or barristers or fellow lawyers in their own business or the profession generally. Usually, lawyers already have the information because of their qualifications.
Professional Indemnity Insurance
Conveyancing entities must have this insurance in place to become registered but you should always ask if their insurance is current.A conveyancer carries insurance for doing "conveyancing work", not anything else they do.
Do you know where conveyancing work starts and finishes and if the conveyancer is giving you legal advice they aren't allowed to? This means that you may have no claim where something goes wrong and you won’t know that until after your claim has been declined, or you've paid a lawyer to investigate what went wrong.
It is compulsory for a lawyer to have this insurance. It covers everything they do. lawyers cannot be issued their annual practicing certificates unless they have this insurance.
Professional standards
Conveyancers are only required to work within the law. There is no requirement to work to any standard - legal or management wise.
All lawyers must work within the law. They must also work to the compulsory levels dictated by the Legal Profession Act, the Regulations of the Law Society and their Professional Indemnity Insurers who create protocols of behaviour, management, service and accountability, so their standard of work and accountability is higher. Failing to work to the standard can lead to being disqualified by a supervisory body set up by Parliament. Consumer recourse against a lawyer is stronger and more regulated .
Conveyancer v lawyer - Which one should you use?
Use a conveyancer if:
<ul>
<li>You are a first home buyer with limited funds and the transaction is low risk.</li>
<li>If a house sale looks to be a relatively simple, conveyancers may be cheaper, and service should be the main consideration over expertise in the legal field. The question is how do you know if the selling your property will be simple?</li>
<li>If you are on a tight budget and don’t expect personalised service.</li>
</ul>
Use a lawyer when:
<ul>
<li>The property is of ‘high value’ as there is more risk.</li>
<li>In very large real estate deals, or in complicated sales, it could be safer to go with a Lawyer as their legal experience, depth and breadth of knowledge delves into other applicable legal realms you may find yourself in need of help with.</li>
</ul>
If you want more one-on-one attention and the transaction is expected to be a difficult one.

The Australian Prudential Regulation Authority has issued tough draft guidelines on how it expects banks to monitor and manage home mortgage risks.
Upon <a href="https://www.apra.gov.au/adi/PrudentialFramework/Pages/adi-consultation-packages.aspx" target="_blank">the release</a>, APRA chairman John Laker noted "increasing evidence of lending with higher risk characteristics and it does not want this trend to continue".
the current concern sits  against the backdrop where residential mortgage exposures have exhibited low default and loss rates in the $1.3 trillion Australian mortgage market. But the continued low interest rate environment has authorities concerned for when rates take off again.
Aimed at complacency among residential mortgage lenders, the draft guidelines still fall short of the stricker macro­-prudential rules adopted in recent times by other regulators especially in New Zealand and Canada.
But the draft guidelines suggest banks consider "geographic concentrations" of risky loans.
There might also be new limits on loans relative to incomes along with stronger stress-testing borrowers.
There is also the possibility of reducing financial incentives and commissions to mortgage brokers.
APRA chairman John Laker said credit standards were needed given “very active competition” between lenders and rising property markets.
The Australian Financial Review columnist Tony Boyd recently calculated that the net present value of annual commissions paid to mortgage brokers is about $600 million, based on brokers handling about half of the $28 billion in mortgages settled each month.
APRA suggests commissions paid upfront tend to encourage less rigorous attention to loan application quality. 
APRA has told the banks to review appropriate monitoring and controls “to guard against incentives to pursue loans with inadequate or false verification, marginal serviceability, excessive leverage or unsuitable terms for a borrower”.
In Australia, it is standard market practice to pay brokers either an upfront commission or a trailing commission, or both. 
"Experience has shown that commissions paid upfront tend to encourage less rigorous attention to loan application quality," the report said.
"Trailing commissions are more likely to provide incentives for brokers to retain and monitor customers. 
"A prudent approach to the use of third parties for residential mortgage lending would include appropriate compensation measures for brokers.
"Such measures include the ADI being able to end or claw back commissions where there are high levels of delinquency or process failures on loans originated by third parties."
The acting chief executive of the Australian Bankers’ Association, Diane Tate, said the industry had expected the new guidance.
APRA said it expected banks to closely monitor the share of new loans with high loan-to-valuation ratios (LVRs). While Australia has no caps on LVRs, it said those above 90% clearly exposed banks to a higher risk of losses.
‘‘Historically, residential mortgage exposures have exhibited low default and loss rates,” it said in the draft.
“However, lengthy periods of economic growth combined with low interest rates and a sustained period of rising house prices can create a sense of complacency among residential mortgage lenders.’’
APRA is taking industry feedback on the draft policy until late July.

The site, acquired by Little Projects in 2009, is separated out into six buildings, all with bakery-appropriate names: Stables, Seeds, Silo, Rye, Grain and Malt; Rothelowman are the architects behind the design.
Rothelowman have been active across Melbourne recently, shaping South Yarra boutique development <a href="/news/vic/rothe-lowman-designed-lex-crowns-south-yarras-alexandra-avenue">Lex</a>, 29-apartment <a href="/expert-insights/buying/rothelowman-designed-mosaica-apartments-to-launch-in-melbourne">Maribyrnong development Mosaica</a>, the <a href="/expert-insights/buying/jazzed-up-residential-tower-strikes-key-with-melburnians">"piano" facade La Trobe Tower</a> that is set for 2016 completion and <a href="/expert-insights/buying/construction-on-rothelowman-designed-aqueous-kicks-off">Port Melbourne's Aqueous</a> that has an appropriately bubble-themed building.
Heritage elements have been retained for the <a href="https://livebrunswickeast.com.au/" target="_blank">Tip Top site</a>, including the art deco stables and brick façade.
The 1.2 hectare site is now a lifestyle precinct, including a childcare centre with 92 places in the Seeds building, that includes a specially designed rooftop outdoor space.
The base of the Seeds building will also house a new café and an office at its base, and there is a base site available in the Stables building for either a retailer or office.
Many of the buildings include large entertainer’s balconies and city views, while each has a separate street address and private access to their properties. The internal laneways were designed by Urbis.
Little Projects managing director Michael Fox said that the site is located between Edward and Weston Street and had been dormant for close to a decade.
“We have always seen Brunswick East as an up-and-coming suburb and we have now unlocked this potential through this project with settlements already underway. This is an exciting step forward for Melbourne’s North,” said Fox.
“We’re creating a community, so we consider the flow-on impact on the surrounding streets and wanted to create a precinct that adds value to the neighbourhood and that people want to be part of,” he said.
Settlements of the apartments commenced in April, with a few two-bedroom apartments remaining and some commercial leasing opportunities.
Two-bedroom apartments in Silo were selling for $539,000 plus.
Property Observer previously reported that <a href="/expert-insights/buying/a-not-so-little-project-for-brunswick-easts-tip-top-bakery-site">some of the apartments were being offered for rent</a>, with one-bedroom from $300 per week and two-bedroom from $420 per week, with a move-in from May.
The median price for <a href="/news">Brunswick East</a> units is $475,000, commanding a median advertised weekly rental price of $395, according to RP Data.

Brunswick East's $215 million Tip Top bakery redevelopment sees settlements take place

Following last week’s public hearing, the Senate Economics Legislation Committee is preparing to report on its <a href="https://www.aph.gov.au/Parliamentary_Business/Committees/Senate/Economics/FOFA" target="_blank">inquiry</a> into a government bill that would significantly water down the Future of Financial Advice (FOFA) legislation.
The legislation banned “conflicted remuneration” - commissions provided to advisers and financial planners by the producers of financial investment products such as banks and wealth management firms. FOFA also required bi-annual renewal of any ongoing fee agreements between investors and their planners on an “opt in” basis, and made it the duty of financial services providers to advise and act in the “best interests” of their clients.
The government argues the “streamlining” of FOFA will help to “cut red tape” and reduce costs to consumer investors. Unfortunately, while there is always room for fine-tuning new legislation to “streamline” it, the government’s proposals do far more. They seriously undermine the consumer protections in the FOFA legislation and, in some ways, take investors back to the pre-FOFA position.
Banks win under a ‘streamlined’ FOFA
While not attempting to reinstate product-based commissions for personal advice, the government’s bill does propose to allow them for “general advice”.
Bankers, planners and lawyers may understand the difference between “personal advice” and “general advice”, but the subtleties of this distinction may be lost on consumers in real-life situations. A bank employee may say to a consumer, “This product is very good for people (in general) of your age with your income/asset position,” without considering the consumer’s particular needs, objectives and financial situation. This is “general advice” only but under the current legislation, the employee still may not receive a commission if the consumer invests in the product as this would be “conflicted remuneration”.
The government proposes to exempt such “general advice” from the ban on commissions. Further, there will be almost no restrictions on commissions when the result of the conversation between the bank employee and the customer results in a basic banking product, general insurance or life insurance. Not surprisingly, this is one area where consumer groups agree with the Financial Planning Association of Australia (FPA) as the latter is concerned at the decline of properly remunerated personal advice and the total domination of a “sales culture” built on commission-driven “general advice”.
Where the consumer groups and the FPA part ways, however, is on the issue of bi-annual renewals. Currently, under FOFA, a planner or adviser who is receiving ongoing commissions, either from product issuers for old pre-FOFA investments, or directly from the client, must notify the client every two years and allow them 30 days to “opt in” and renew the ongoing fee arrangement.
Best practice for all
The government proposes removing this requirement and returning to the old pre-FOFA “opt out” situation. This is despite strong evidence, from many sources including ASIC itself, that large numbers of consumer investors are “inactive” and that many planners and advisers receiving commissions from these consumers or their investments don’t bother regularly contacting them to review them. Of course, “best practice” in the financial planning industry is to conduct such reviews, annually or bi-annually. FPA members who abide by its Code of Practice would do so.
It is surprising, therefore, for the FPA to oppose this requirement and to support the government’s attempt to “streamline” it away. Other financial services products, like house and car insurance, are renewed annually and consumers are given notice and opportunity to consider the product and shop around. Why not investments? Informed and updated consumers regularly considering their investment performance and their fee arrangements with their planners and advisers makes for a better-performing investment industry and confident consumers.
FOFA also repealed the requirement for advisers to have a “reasonable basis” for their advice and replaced it with the obligation to act and advise in the “best interests” of the client. This duty, however, can be satisfied if the adviser can prove they complied with a “checklist” of quite specific obligations followed by the general requirement to consider “any other step” that was in the client’s best interest. This last requirement is the only item in the relevant sub-section that actually mentions “best interest”. The government is proposing to remove this last “catch all” provision, saying it is too open-ended and “creates uncertainty”.
Most professionals have open-ended obligations which require the exercise of professional judgement. While their insurers produce checklists to help manage risks, these are no defence to a claim of professional negligence. Indeed, the principles of the law of negligence itself, which apply to everybody, not just professionals, are expressed in general terms such as “reasonable foreseeability”.
If financial planners and advisers want to be seen as a profession and to charge accordingly, they need to accept that not all their obligations can be neatly spelt out for them in a legislative checklist.

Financial advisers must accept that their obligations can't be spelt out in an easy checklist

I was asked this week if I could remember the last time we saw such a hostile response to a federal budget. I responded ‘no’ – as it would have been well before we had access to the internet.
When the world moved into the online space, the internet always appeared with a capital I, which has been replaced with a lower case 'i'. So what happened to the capital “I” one might ask? Well the “I” became you – the consumer, where through this very process (for better or worse) this online revolution has changed how we do business in the modern age.
When one looks at the problems facing the budget, it’s quite clear that Australia has a massive productivity problem. Wages have flat lined which has seen living standards rise just 2.6% over the last five years. The modern day terminology is “on hold”, which is exactly what the Reserve Bank of Australia is doing with the cash rate given our labour market is, best case scenario, neutral and employment growth won’t exceed population growth.
When you’re paying (an estimated) $1 billion just in interest each month, it’s time for any responsible government to say ‘enough is enough’. Just like our neighbours across the ditch did in recent years when they too had to re-calibrate their economy and today, are predicting a $370.5 million surplus with 4% growth.
Unfortunately in Australia’s modern day political arena, there is no room for compromise given the central influence is to play populist politics, not policy. We see differing opinions on how Australia will create a sustainable budget that successfully negotiates a path into the future. If Australia was to continue on the current path without significant change, the present budget would be seen as a soft – touch.

Again the significant point to be drawn from this graph is that with our declining terms of trade and an ageing population, our productivity needs a complete ‘about–turn’.
I wouldn’t hold your breath on that because, when one looks at <a href="https://www.ami.org.au/imis15/News_2013_May/Default/Australia_s_Top_100_Brands_2013__/News_2013_May/Australias_Top_100_Brands_2013.aspx?hkey=7621e19d-3bb4-4c3a-b08c-af2b0a18073d" target="_blank" title="Australia’s Top 20 Brands">Australia’s top 20 brands</a> not one is directly involved in technology. On the other hand when one looks at <a href="https://www.brandz100.com/site/reports/global/2014/report/download-report.pdf" target="_blank" title="2014 BrandZ Top 100">2014 BrandZ Top 100 </a>(this is a PDF file so takes a little while to download but well worth the read) we get a pretty good idea of how bad we are performing on a global stage.
Following three years at the top, Google has bumped Apple from the number one position when, in 2014, Google’s brand shot up 40% in a year to US$158.84 billion (A$171.86 billion). All up The BrandZ Top 100 Most Valuable Global Brands 2014 added $310 billion to reach $2.9 trillion in brand value. Prior to the BrandZ Global 2014 results, the Top 100 had increased an average of about 6%, $125 billion annually, since the global financial crisis of 2008 and 2009. This year, led by apparel, with a 29% overall increase, all categories rose in brand value. And 10 of 14 categories experienced double-digit growth, indicating that brands across the economy have moved beyond recovery into a period of new growth. In the meantime, Australia sits in a mental void trying to work out what to do following the mining downturn.

For those who recently raised concerns about China’s attraction to Australian property, Secretary of Treasury, Martin Parkinson, told a forum this week in Hong Kong that China’s foreign exchange reserves now approach $4 trillion. Today, China now accounts for around 11% of both world trade and global GDP but only accounts for 3% of gross holdings of overseas assets and liabilities. He went on to say that this figure, which includes foreign exchange reserves, could triple to $16 trillion. The rise of China as a superpower could see it control as much as half the world’s financial assets by 2030.
Puts the Australian budget into a different perspective, especially when you read how China is preparing for its ageing population – <a href="https://www.economist.com/news/china/21600160-pensions-crisis-looms-china-looks-raising-retirement-age-paying-grey" target="_blank" title="Paying for the grey.">paying for the grey.</a> Although Australia is a long way off telling families they have a limit of just one child.
For the second time in 2014 Mosman houses for sale managed to stay above the 100 mark which either tells us more people are selling or houses are not selling as fast. It will be interesting to see in coming weeks, what the correct reason is, although we should note that clearance rates have dropped significantly. Sceptics no doubt, will attribute that to the federal budget!
