Apartment buyers in New South Wales are set to gain a decade of insurance-backed protection against major building defects, after the NSW Parliament passed the Fair Trading and Building Legislation Amendment Bill 2026.&nbsp;

The Bill establishes decennial defect insurance, known in the market as Latent Defects Insurance (LDI), as an alternative to the existing two-year strata building bond. It cleared the Legislative Council with amendments on Tuesday evening (August 4, 2026), with the Legislative Assembly agreeing to those amendments shortly after.

Under the reform, eligible developers can satisfy their statutory bond obligation by taking out an approved decennial-style policy that gives owners 10 years of cover for major structural defects from completion, claimable directly, without first having to pursue developers or builders through costly legal action.&nbsp;

The change forms the final tranche of amendments arising from the 2021 statutory review of the Strata Schemes Management Act 2015 and related legislation.

Resilience Insurance, which originated the cover in Australia and has delivered it in NSW since 2022, welcomed the passage and credited the NSW Government for delivering it.

“This is protection apartment buyers have needed for a long time, and the credit for delivering it belongs to the NSW Government,”&nbsp;said Corey Nugent, CEO of Resilience Insurance.

“Minister Chanthivong and his team have shown real leadership in replacing an outdated two-year bond with cover that matches the lifespan of the buildings people are buying into. Reform like this is what good, evidence-based regulation looks like.”

Resilience has delivered LDI in NSW since 2022, protecting thousands of apartments, giving the State, and now the country, real-world evidence of how decade-long, no-fault protection works in practice.

The reform also places NSW within a wider national shift.

NSW is the third jurisdiction to put decennial cover into law. The ACT legislated for it in 2024, with the scheme taking effect in late 2025, and Victoria passed its own framework on 17 June. Between them, the three cover the majority of Australia's apartment market.

The reform commences once the legislation is proclaimed, which is expected in the coming weeks. From that point, developers of Class 2 residential apartment buildings can meet their statutory obligation with an approved decennial policy in place of the bond.

Buyers who purchased into projects that took out the cover early are among the first in the country to take keys to apartments carrying decade-long structural protection.

“With the legislation passed, the focus now turns to making it work for buyers,”&nbsp;Nugent said.

“There are already thousands of apartments in NSW covered by this insurance, bought by developers who moved early. The question every buyer should be asking in a display suite is a simple one: does this building come with 10-year defect cover, and who stands behind it?&nbsp;

“We look forward to working with the Government and the Building Commission in coming weeks as the framework moves to implementation, and to sharing what we have learned over the past four years so the protection reaches owners as smoothly and quickly as possible.”

Other states are working through their own reform programs. Western Australia has indicated that decennial cover is within consideration a later stage of its reform sequence, and Queensland has been examining the settings as it looks at the development pipeline ahead of the 2032 Olympics.

NSW parliament passes 10-year defect insurance laws for new apartment buyers

Builder-developer <a href="https://www.apartments.com.au/developers/mcnab-developments">McNab</a> has wasted little time reshaping one of South Brisbane's most significant undeveloped apartment sites after acquiring the property earlier this year.&nbsp;

McNab has lodged plans to scrap an existing approval for two 30-storey towers and instead deliver a single 28-storey residential building, preserving part of the site for a future development opportunity.

The proposal, lodged over <a href="https://www.apartments.com.au/new-apartments/64-peel-street-south-brisbane-qld-4101">64 Peel Street and 9 Cordelia Street</a>, is for a residential-led mixed-use development comprising 124 apartments above a landscaped podium, alongside a boundary realignment that preserves part of the land for a future residential project.

A five-level podium will accommodate 135 car spaces, while the ground floor will include a 66 sqm commercial tenancy, an activated residential lobby with work-from-home spaces, and a publicly accessible landscaped plaza linking Cordelia and Peel streets.&nbsp;

Communal amenities will span Level 6 and the rooftop, including indoor and outdoor recreation spaces, a swimming pool, barbecue facilities, kitchen and dining areas, lawn space, sauna, steam room and yoga facilities.

The application also proposes a boundary realignment to create a standalone 1,290 sqm development lot while retaining an adjacent parcel for future redevelopment, allowing the balance of the site to contribute additional housing over time.

Hayball said the architecture has been shaped by the site's elevated corner position at the intersection of Peel and Cordelia streets and Brisbane's subtropical climate.

The design incorporates generous landscaped setbacks, a masonry podium wrapped with planting, large north-facing balconies, and a slender tower profile intended to maximise natural light, cross ventilation and long-range views. The rooftop has been conceived as a wellness-focused retreat overlooking Brisbane, with amenities positioned to capture views towards Mount Coot-tha and the CBD.

The planning submission positions the proposal as a response to both changing market conditions and Brisbane's Kurilpa Sustainable Growth Precinct planning reforms.

McNab acquired the site after the previous approval was granted, with the existing scheme no longer reflecting current residential market demands, economic conditions, construction challenges, construction efficiencies or the quality of development outcome now being pursued, the planning report noted.

McNab continues to expand its residential development pipeline across Brisbane and the Gold Coast. The developer recently launched The Tannery in West End, securing more than 60 per cent of apartments before the project's public release. It is also delivering Elements Budds Beach in Surfers Paradise and Lucia Highgate Hill, an eight-apartment boutique development overlooking the Brisbane River.

A steeply sloping Bellevue Hill site is set to accommodate a new mid-rise apartment development, with plans lodged for 20 homes that respond to the site's dramatic topography.

The proposal for the consolidated land at <a href="https://www.apartments.com.au/new-apartments/138a-140-bellevue-road-bellevue-hill-nsw-2023">138A-140 Bellevue Road</a> has been designed by Sydney architecture practice Common Office, which has used the site’s substantial fall to distribute the building’s scale and unlock 20 apartments without presenting the full height to the street.&nbsp;

“The unique design strategy leverages the site’s substantial topographical fall to facilitate increased density, presenting a seven-storey profile to Bellevue Road while rising to 10 storeys at the rear,” Common Office said in its architectural design report.

The apartment mix spans one, two, three- and four-bedroom residences. Four two-bedroom apartments are designated as affordable housing, while the plans also include two adaptable dwellings. The mix is majority three-beds, with the typical three-bed apartment offering around 144 sqm internally, with balconies of around 15 sqm.

The affordable housing component represents 15 per cent of the residential floor area and allows the project to access additional height and floor space under the NSW Government’s in-fill affordable housing provisions. The site also falls within the inner area of the Low and Mid-Rise Housing Policy because it is within 400 metres walking distance of Double Bay Town Centre.

Common Office has arranged the building around a masonry podium and a lighter upper volume, drawing on two recurring elements of Bellevue Hill’s established architecture: sandstone bases and the vertical proportions of local Inter-war Art Deco apartment buildings.

“The proposal is governed by a holistic design language that reconciles the solid horizontal masonry of the neighbourhood’s podiums with the elegant verticality of its Art Deco heritage,” the architect said.

“The building maintains a consistent rhythmic logic utilising deep recesses and a sophisticated material transition to break down the 10-storey scale into a series of articulated, human-scale volumes.”

Large-format sandstone tiles will define the lower levels, establishing a robust base that negotiates the change in elevation from Bellevue Road. Above, red-tinted precast concrete frames, recessed balconies, anodised aluminium screens and expanded metal details will create a more vertically expressed façade. Integrated planter beds will introduce greenery across balcony edges and recessed sections of the building.

The elongated northern façade has been divided into three recessed vertical masses to reduce its perceived length. Triangular window elements and metal privacy screens reference the geometry of nearby Art Deco buildings while controlling overlooking toward surrounding homes. The southern elevation will incorporate further privacy screening, landscaped edges and deep balconies to maintain light and ventilation.

Private and communal landscaping is distributed throughout the development. A landscaped garden apartment is positioned within the lower portion of the site, while a communal terrace on Level 5 will include a central timber deck, barbecue facilities, resident planting plots and areas for outdoor dining and informal gatherings.

Common Office described the terrace as an elevated sanctuary designed to capture district views and sunlight. Its planting strategy incorporates endemic species associated with the Eastern Suburbs Banksia Scrub, extending the landscape vertically through the building and providing habitat for local flora and fauna.

A second communal outdoor area is proposed at roof level, with built-in seating, paved gathering areas and perimeter planting.

The podium has also been designed as an architectural feature rather than a conventional parking structure, with cascading planting, screening and natural-toned materials softening its appearance. Resident parking is elevated above ground level to address the site's flood constraints, while habitable apartments sit above flood planning levels. Upper-level communal facilities are designed to accommodate shelter-in-place arrangements during major flood events.

The development will provide 163 car spaces, including 152 resident bays and 11 visitor spaces, together with 144 bicycle spaces incorporating resident storage, visitor parking, bicycle maintenance facilities and e-mobility charging infrastructure.

The site sits within one of Brisbane's fastest-changing inner-city precincts, less than two kilometres from the CBD and within easy reach of South Bank, West End, the Queensland Cultural Centre and extensive public transport connections. The Kurilpa Sustainable Growth Precinct planning framework is encouraging higher-density residential development to help meet Brisbane's housing supply targets while supporting walkable, transit-oriented neighbourhoods.

From late 2025, eligible first home buyers in New South Wales will have access to a new federal government initiative aimed at addressing affordability: the Help to Buy Scheme.&nbsp;

<h2>What is the Help to Buy Scheme?</h2>

The program introduces a shared equity model intended to reduce the upfront cost of entering the property market, particularly in high-demand urban areas such as Sydney.

The scheme operates under a shared ownership structure in which the federal government takes an equity stake of up to 40 per cent for new homes, or 30 per cent for existing dwellings. This arrangement allows eligible buyers to significantly reduce their loan size and avoid the added cost of Lenders Mortgage Insurance (LMI).

Under this model, purchasers can enter the property market with as little as a two per cent deposit, well below the traditional 10 to 20 per cent usually required. The government’s contribution is not a loan but a co-ownership stake in the property. As such, there is no interest or rent charged on its portion.

Because the government’s equity combined with the buyer’s deposit typically meets or exceeds the 20 per cent threshold, LMI does not apply. The remaining balance, generally between 60 and 70 per cent of the property’s value, is financed through a standard home loan with a participating lender.

The government's equity in the property remains in place until the buyer chooses to repay it voluntarily or until the property is sold. Buyers can buy back the government’s share over time, in increments of at least five per cent, depending on their financial situation.

There is no fixed repayment timeline, but the amount to be repaid will be based on the property's market value at the time of repayment, not the original purchase price.

<h2>How do you qualify for the&nbsp;Help to Buy Scheme?</h2>

To qualify for the Help to Buy Scheme, applicants must meet the following conditions:

	<li>Be an Australian citizen at least 18 years of age.</li>
	<li>Be a first-home buyer who does not currently own property.</li>
	<li>Intend to live in the property as their primary residence.</li>
	<li>Earn less than $100,000 per year for individuals, or $160,000 for couples.</li>

Prominent New Zealand apartment and hotel operator, <a href="/developers/safari-group">Safari Group</a>, is offering up a prime investment opportunity for Australians to purchase off the plan in one of the world’s most popular ski destinations.

They recently took to market Mountain Oak Queenstown Apartments, in the growing precinct of Remarkables Park in Frankton, near the airport and at the foot of The Remarkables - the mountain range the locals like to call “The Remarks”.&nbsp;

Sydney investors have shown interest in the one, two and three-bedroom apartments that secure high-season occupancy six months over the year, primarily over summer and winter months.

They average 90 per cent occupancy across their portfolio over January, February, March, August, November and December, while shoulder season months of April, July, September and October are still occupied 70 per cent of the time, with the growing appeal of Queenstown becoming not just a hotspot for the snow, but a lifestyle destination.

Even in the low seasons of May and June, occupancy levels reach around 40 per cent.

Double-digit unit rental growth in major capitals, bar Brisbane, in past year: Residex

When purchasing an apartment, all investors and owners share common goals: to ensure the value of their property increases and that their property’s development is well managed for the entirety of its future.
This is why I am often surprised when I come across clients who underestimate the impact that a building management firm can have on their investment. Investing in a building that is managed by a reputable, knowledgeable and responsive company is essential for the maintenance of the development’s assets, which ultimately contributes to the property’s long-term growth.
When a new building’s executive committee is deciding on which company to appoint to manage the development, the decision is often based on cost. Unfortunately, this can affect the long-term value of the development, as there are many other factors that need to be considered.
An established and capable building management firm will have a highly skilled team and structured processes to ensure the building is maintained on a daily basis, preventative maintenance schedules are operational and managed effectively, bylaws are adhered to, a detailed monitoring system is in place, and security systems are well-maintained and updated annually.
The company should also be financially savvy, cost-effective, and have experience in preventative and corrective maintenance and dealing with OH&amp;S standards. The firm should also have a good selection of quality service providers to maximise the longevity of the development’s assets.
Defect management is another important issue which falls under the realm of building management. Where owners are within their seven-year home owner's warranty period, defects should be raised immediately to the builder and the Home Owner Warranty insurer.
My husband, George Ziri, who is director of Building Facilities Management Solutions (BFMS Pty Ltd ), says when discussing defect management, the building manager should always conduct themselves in an impartial manner to establish credibility between the owners and the builder/developer.
Building managers also need to be realistic when producing defect reports. According to George, it’s best to wait for the sixth year of the home owner's warranty before the owner works with an independent building consultant to review the property and status of defects.
This review will give both the owner and builder the assurance of independent advice. The consultant will also support the owner as an expert witness, in the event they wish to pursue any legal matters.
Reliable and trusty building management is essential in all developments. For investors, property location and views can go a long way in ascertaining the value of their purchase; but, it is also worth remembering the building’s management also plays a large part in determining what an investment is worth now and in the future.

The recent decision of the Victorian Court of Appeal in "Re Willmott Forests Limited (Receivers and Managers appointed) (in liquidation) [2012] VSCA 202" brings into question the security of a lessee’s tenure.  
It suggests the existence of a category or “class” of lease, which can be unilaterally brought to an end if the landlord goes into liquidation. 
This has broad-reaching implications, particularly for tenants proposing to invest significantly in businesses that require security of tenure and/or fit-outs that are only feasible if they can be amortised over the period of a long lease.
Will tenants now be asking landlords to provide security deposits or bank guarantees securing the value of their investment in the leased premises?
The Willmott Forests Case
The liquidators of Willmott Forests Ltd (receivers and managers appointed, in liquidation) intended to sell land on which a forestry scheme had been established.  As part of a set of project documents, the growers of the forestry scheme had rights to grow and harvest trees on the land.  Those rights included leases and licences for the occupation of the land. The liquidators wished to sell the freehold land unencumbered by the leases and licences by disclaiming the contract documents as onerous pursuant to section 568 of the Act and they asked the Court to clarify whether they could.
The Supreme Court decision
In the Supreme Court her honour Jennifer Davies held that the answer to the question above was "no" on the basis that:
<ul>
<li>a lease grants both contractual and proprietary rights;</li>
<li>a leasehold interest is the property of the lessee and a disclaimer by a liquidator only terminates the lessor’s rights, interest and liabilities under the lease;</li>
<li>it is not apt to describe a leasehold estate as a liability or an encumbrance on the lessor’s property; and</li>
<li>such a disclaimer would not bring the lessee’s proprietary interest in the land to an end as the proprietary interest has already vested in the lessee. 
</li>
</ul>
The decision of the Court of Appeal of the Supreme Court
On appeal, this decision was overturned, with the Court of Appeal finding that a leasehold estate cannot continue if the lessor has been released from its obligations under the lease agreement. This meant that a liquidator was empowered to end a lease and dispossess the tenant of its leasehold interest and tenure.
In terms of the competing interests of the landlord’s creditors and the lessees’, the Court of Appeal said:
Section 568D(1) allows the liquidator to terminate this obligation or liability despite its intrusion into the property rights of an innocent party.  The evident policy is to permit the loss of these rights in order to enable the company in liquidation to be free of obligations so that it can be wound up without delay for the benefit of its creditors.  To compensate, the rights of the affected parties are transmuted into various statutory rights and claims.
Of course in order for the “compensation” to be available, the liquidators must recover enough out of the liquidation to satisfy both its secured and unsecured creditors.  In the Willmott case this simply will not happen, so the idea that the loss of the innocent parties' rights will be compensated for in other ways will not be realised.
By prioritising the rights of the creditor over those of the tenant, risk is shifted from the lender (generally a sophisticated party who had an opportunity to consider its risks on the way in and who may have profited from the arrangement) to an innocent party who had no ability to mitigate the risk.

What is the lesson in this? 
 
Tenants who intend to invest significantly in fit-out or in acquiring new premises from which to run their businesses should beware.  If your landlord is on shaky ground, so potentially is your tenure. Tenants may want to consider seeking some form of security from their landlords at the commencement of a lease to ensure that their investment takes priority over a potential creditor’s interest.  It is conventional for landlords to seek a bank guarantee or security deposit from tenants to protect their income stream, but I predict that it will become increasingly common for tenants to seek reciprocal protection, particularly where:
<ul>
<li>the location of business is often a key strategic asset;</li>
<li>significant amounts of capital fit-out is required;</li>
<li>the lease is for a term exceeding five years; or</li>
<li>the lease is only one component of the commercial arrangement between the lessor and lessee.</li>
</ul>
Without that protection, a lessee will be left with the following less than satisfactory options:
<ul>
<li>prove its loss as an unsecured creditor; or</li>
<li>apply to the court to have the disclaimer set aside (under section 568E of the Act); or</li>
<li>attempt to negotiate a new lease with the liquidator.</li>
</ul>
We understand that the Willmott Growers have applied to the High Court of Australia for special leave to appeal this decision.

A historic store dating back to 1886 has been listed for sale in Gundaroo, NSW.
<a href="https://www.propertyobserver.com.au/https://www.mcgrath.com.au/buy/house-gundaroo-nsw-2620/161838" target="_blank">The Gunadaroo Store</a>, built in 1893, and an attached cottage named Sally Paskin’s Store, built in 1886, have been listed for sale and come with a potter's shed, a picnic garden and water features.
<a href="/news">Gundaroo </a>is just north of the ACT border, 30 kilometres north of Canberra.
The store currently operates as a boutique gift store and has been recently renovated and has high ceilings, kauri floors and expansive interiors.
“The Gundaroo Store and the Caladonia Store next to it were like Myers and Bunnings and Woolworths all rolled into one. It provided a wide range of goods for people to buy," says vendor Peter Thorne.

“It’s a lovely old building, particularly interesting because the floors are New Zealand kauri and they’re all original and the ceilings are baltic pine, from the other side of the world. Packing cases were pulled apart and used to construct buildings. If you look across the front there’s a section made of packing case timber,” Thorne says.
“Moving from Sydney has been the best thing we ever did for a whole range of reasons, but the community is fantastic. There are lovely people here. The craft festival especially sticks in our memory as being a wonderful occasion. “
Agent Chris Dixon says he enjoys the construction of the building.
“It really does a very solid feel and you don’t often see buildings constructed like that these days,” Dixon says.
“The lovely high ceilings, the kauri floors, the sheer size lends itself to many options and opportunities.”
Dixon says Gundaroo is a popular tourist spot.
“It’s very popular with Canberrans and those living the regional areas but it’s also quite popular with Sydneysiders. People often come down to Canberra and do the winery tours here and there are a number of villages within half an hour of Canberra,” Dixon says.
“Peter Thorne is a fascinating fellow. He’s an engineer by trade and he has dabbled in all sorts of enterprises, but he and wife Jenny have been quite enterprising running it as a boutique store. It was previously Devonshire teas and arts and crafts and for a while it was restaurant.”
The Sally Paskins store is still in largely original condition.
“It’s one of the only excellent examples of slab hut constructions left,” Dixon says.
Thorne bought the property in 1976 after leasing the property for a year. He and his partner discovered the property when driving down to Sydney to sell tiles in Canberra. They operated as an arts and craft store, then added a tea room and then ran a spit roast restaurant for a while.
The expressions of interest campaign closes at the end of November, and Dixon is seeking offers over $1 million for the property.

A “distracted” Rudy Giuliani, the former high-profile New York mayor, has told attendees at the Property Council of Australia annual congress in Sydney today of the role cities play as public relations ambassadors for their country.
Guiliani was the keynote speaker at the conference, with delegates paying up to $3,000 to hear him speak.
"Our cities are the public relations for our country," Guiliani said, according to tweets from those who heard him speak at the congress.
Guiliani was addressing the congress on how policy develoment and leadership can transform cities.
He said he had transformed New York City through long-term planning and decision making.
He added that the homelessness was a reflection of how a city respected its people.
Guiliani was mayor of New York from 1994 to 2001 and said at a press conference ahead of his address that he was “somewhat distracted” by what was going in his home country, his city and region following the devastation of Hurricane Sandy.
He also said that while it would be expensive to rebuild areas devastated by the storm, it would help the local economy.
“The devastation of the storm has been catastrophic,” he told Channel 10.
“Whenever I was mayor or just a private citizen the real loss was human life.
“Unfortunately there was significant loss of human life.”
Guiliani says property damage and the loss of profit because business and the stock exchange has closed can all be made up, but not human life.
But he stressed that New Yorkers are resilient and had already “been through so much” – referring to the September 11 tragedy.
“Twice as many people live in Lower Manhattan today then did before September 11,” Guiliani said, citing a statistic mentioned often by current New York mayor Michael Bloomberg.
This has been the case, he says, despite there being 15 known threats to attack New York since September 11, including a recent plot to blow up the Federal Reserve building in Lower Manhattan.

Listed property trust Charter Hall has received development approval to build a 12-storey office tower in Docklands in the last available office development site in the Etihad Stadium precinct.
The 685 La Trobe Street project is a joint venture with Flagship Property Holdings, with marketing of the office and retail space commencing in May this year.
Charter Hall paid $5 million to acquire a 50% interest in the development as part of an agreement with Flagship to jointly undertake the development of the project once a substantial leasing pre-commitment has been secured.
The 37,000-square-metre A-grade office building will feature 3,300 square metre floor plates, the largest of any readily available office building in Docklands.
Around 1,100 square metres of ground floor space has been designated for retail use.
The office building, which will feature a textured glass facade, has been designed by architects Bates Smart, the firm behind Fairfax’s Media House headquarters on Spencer Street in <a target="_blank" href="/news">Docklands</a>.
The building has been designed to meet five-star Green Star and five- star NABERS energy ratings and comprises 137 car spaces and a dedicated mezzanine for 250 bicycles.
It will link up with Southern Cross train station via the Etihad Stadium Concourse, as well as having a tram stop at its doorstep on La Trobe Street.
Its signature feature is its butterfly-shaped design, which creates two landscaped plazas, two wings of office space and a large central hub space that unites the building.
A double-height entrance lobby on La Trobe Street will have a sculpted blackbutt timber ceiling, flanked on either side by a vaulted ceiling that leads to the terrazzo tiled lift lobbies.
Construction of the project is due to begin mid-next year once a substantial leasing pre-commitment has been secured with a completion date of 2015 pencilled in.
The leasing of space in the building is being marketed by Nicholas Farley, head of Victorian leasing for Savills. 
"As the last office development to be built in the Stadium Precinct, it offers the best northern light, the best transport access and it’s close to everything,” says Chris Chapple, head of development services at Charter Hall.
Steve Wise, director of Flagship Property Holdings says 685 La Trobe Street reflects the “very best of commercial design that creates flexible work environments with great amenity for the people that will work there”.

Internationally acclaimed photographer Ken Duncan has secured exhibition space at 500 Collins Street for a flagship art gallery, in hopes of tapping into the strong core retail market in the Melbourne CBD.
The core Melbourne CBD market has a vacancy rate of 2.4% according to a recent Knight Frank retail report, with just 39 out of 1,604 shops recorded vacant in July this year.
His new art gallery will sit opposite the distinctive Venetian Gothic facade of the Rialto Intercontinental Hotel.
“Melburnians are well known for their love of art, and we have many staunch fans here. We believe our clients are going to love this new Collins Street location, and we will launch the new gallery in November with a Meet the Artists weekend,” says Duncan.
The five-year leasing deal was negotiated by CBRE’s Max Cookes and Zelman Ainsworth.
Duncan’s gallery will occupy a 120-square metre spot and will pay an estimated $1,000 per square metre rent per annum.
Ainsworth says Duncan’s new flagship Collins Street gallery will add value to the already established tenancy mix on the western end of Collins Street.
“In Sydney we are near the stock exchange and often the traders come in and sit in front of the prints and pretend they’re in the middle of the outback because I think they are stressed out,” Duncan said in an interview with The Age.
“Our galleries end up like sanctuaries, they come in and go bush. Where we need to be is Collins Street.”
Cookes says CBRE’s retail leasing team had concluded nine of the last 10 retail-leasing deals on Collins Street between King and William streets.
Ainsworth said the increasing level of rents achieved at this end of Collins Street over the past 24 months demonstrated the strong demand from quality retailers wanting to secure a presence in this heritage pocket of Collins Street.
Duncan is famous for his landscape photography and was awarded a Medal of the Order of Australia by the Australian government in 2009 for his services to landscape photography.
Duncan has also been honoured by the Photo Imaging Council of Australia with its highest award, The Gold Tripod.
Duncan prefers the panoramic format for images, saying it’s the way we see.
Collins Street will be Duncan’s second Melbourne gallery, with another located in Docklands.
Duncan also has a store in Sydney and one in Erina Heights on the New South Wales central coast.

The Couran Cove resort at South Stradbroke Island, which had a development cost of $150 million, is set to change hands with its reputed price less than $10 million.
Queensland property industry sources told the Gold Coast Bulletin that a sales contract had become unconditional.
It even pinpointed the unconfirmed buyer as Brisbane businessman Craig Dowling, a director of Indian-owned Adani Mining, who became a director of Couran Cove Holdings, a company registered only last month with Couran Cove Island Resort as its business address, according to the news report.
The 151-hectare site, which closed in June last year, has 358 accommodation units – hotel suites, villas, cabins, and marine lodges – of which 158 are unsold.
There is also approval for a further 212 units and a yacht club.
The resort has two restaurants, conference venues, function rooms, two gyms, running track, pool, waterfront building, surf club, jetties and 102 marina berths.
It was developed by US billionaire philanthropist Chuck Feeney via InterPacific Resorts (Australia), who opened it in 1998.
Feeney has invested some $300 million and after the resort made an $85.9 million annual loss, InterPacific and four associated companies went into in voluntary liquidation.
In the sales campaign David Devine's Metro Property Development took out a conditional contract but walked away earlier this year before the final signature was required.
More recently Colliers International undertook negotiations with the underbidder being an Asian hedge fund.
Colliers agent Darrell Irwin declined to comment to the Bulletin.

An 1878-built hotel in Portland, Victoria, has been listed for sale with $1.29 million hopes.

Annesley House was originally built as the residence and surgery of Dr Brewer, then chief medical officer and mayor of Portland.
The two-bedroom residence consists of seven furnished apartments, which have been run as self-contained holiday accommodation by vendor Mark Robinson, who bought the property in 2004.
The two-storey brick structure was designed by architect Daniel Nicholson. Heritage documents say the building is an interesting example of a substantial 19th-century townhouse design in an Italianate style.
Brewer passed the building on to the Wadmore sisters in the early 1900s. They converted the mansion into a guesthouse. In the 1940s the building passed onto a Mrs Luers, the daughter of a local politician and poet. She continued to run the building as a guest house until the current owners bought it in 2004.
When it was built the Portland Guardian reported it was “one of the finest that a private gentleman in a country district need desire”.

Robinson has undertaken significant restoration of the property, including remodelling the original kitchen, while keeping many of its original features and furnishings, including a bell to summon the servants.

Portland Bay was named in December 1800 when Lieutenant James Grant on the Lady Nelson sighted it for the first time and named it after a Secretary of State, the Duke of Portland.
It was set up as whaling station and trading port in the early 1830s, but it soon attracted pastoralists as the fertile nature of the land was discovered.
Eventually the sheltered bay became a permanent township, with the government commencing the set out of a new township in 1840.
As the Victorian goldfields became overcrowded ships were diverted to Portland, with the first immigrant ships sailing directly from Great Britain in Portland in 1852.
The 1,344-square-metre property includes proprietor's rooms and off-street parking and garages.
