Around 400 additional homes could be built at Southwark Grounds on Port Road, lifting total site capacity from 1300 to around 1700 dwellings.

A recently approved code amendment would allow apartment towers of up to 14 storeys in some areas of Renewal SA’s redevelopment of the former West End Brewery.

Renewal SA Acting Chief Executive Shane Wingard said he welcomed the code amendment, with the increase in heights and homes making a positive impact on the supply of high-quality, well-connected housing close to the city.

“By going higher across some parts of Southwark Grounds, we are adding a substantial number of very well-located homes with little impact on project delivery time or planned open space,” Mr Wingard said.

Since the project officially launched in 2025, Mr Wingard said more than 12,000 enquiries had been received about living at Southwark Grounds.

“The very strong early interest we’ve seen since homes were first released in the precinct reinforces our plans to create more housing opportunities,” he said.

The Southwark Grounds code amendment was launched in December last year, with community engagement undertaken over five weeks from January.

It proposed increasing maximum building heights from eight to 14 storeys on the eastern section of Southwark Grounds, and to 12 storeys across the remainder of the site, with minimum building heights ranging from two to four storeys.

The code amendment was implemented through an Early Commencement policy in late January, allowing developers to quickly explore the viability of increased height and housing yield while other planning processes continue.

One of the first developers delivering apartment sites have already finalised redesigns to increase the number of apartments following the code amendment.

Samaras’ development adjacent to the future Colonel Light Park is now planning to deliver 125 apartments across 11 storeys, significantly greater than original plans of around 50 apartments across four storeys.

The developer is also exploring the potential for additional affordable housing outcomes.

Most of the apartments at Southwark Grounds will be delivered within a master-planned precinct on a large parcel of land on the eastern portion of the site, covering around two-thirds of its 8.4 hectares.

Wingard said detailed precinct planning over the coming months may identify further opportunities to increase yield further that could see total apartment numbers at Southwark Grounds, exceed this number.

Affordable homes at Southwark Grounds will also see a net increase, with Renewal SA maintaining its commitment to a minimum of 20 per cent affordable housing across the development.

Civil works have begun across the site, with construction under way on the first new roads surrounding a townhouse precinct in the south‑west corner of Southwark Grounds. This includes Renewal SA’s 17 Founder’s Row homes, which are on track for completion by Christmas.

“We expect to have people living at Southwark Grounds by the end of the year, so delivering roads and public spaces for those residents is among our highest priorities.”

Construction of 40 townhouses off Anderson Street, known as West Village and being delivered by Contour, is forecast to begin in mid‑2026. Kolabb’s Anderson Lane development will follow shortly after, delivering a further 26 townhouses.

Southwark Grounds is a state government‑led urban renewal project now set to deliver around 1,700 homes over the next decade.

Homes will be supported by a supermarket, a range of retail and hospitality offerings anchored by a revitalised Walkerville Brew Tower, a childcare centre, car parking and well‑connected public spaces.

400 new homes planned for Adelaide's former West End Brewery site

Brisbane developer&nbsp;<a href="https://www.apartments.com.au/developers/cavcorp">Cavcorp</a> has lodged plans for a new mixed-use residential development at <a href="https://www.apartments.com.au/new-apartments/55-wyandra-street-teneriffe-qld-4005">55 Wyandra Street</a>, Teneriffe, anchored by an 85-metre public laneway designed to reconnect the suburb’s riverfront with the Gasworks precinct.

The buildings, known as Teneriffe House and Teneriffe Lane, would replace the existing Queensland Cotton head office site with a 15-storey residential tower transitioning to eight storeys toward Helen Street. The project has been designed by Plazibat Architects and lodged as a code assessable development application for 93 apartments across a 3,401 sqm mixed-use site within the Newstead and Teneriffe Waterfront neighbourhood plan.

Central to the scheme is the transformation of an existing service easement into a publicly accessible cross-block connection linking Wyandra and Helen Streets. Cavcorp says the new laneway will act as both a pedestrian shortcut and a landscaped civic space between the Teneriffe Riverwalk, ferry terminal, and Gasworks precinct.

“The revised proposal delivers a legacy public-realm cross-block link, permanently secured for community use, transforming an existing private easement into a safe, high-quality pedestrian connection between the Teneriffe heritage riverwalk and the Gasworks–Long Island precinct,” the planning report states.

The laneway will sit beneath a large subtropical loggia integrated into the podium levels of the development. The design incorporates deep landscaping, water gardens, lobby spaces, business lounges, and ground-floor apartments to create what Cavcorp describes as a climate-responsive “urban verandah.”

The tower itself has been designed as a slender form with recessed floorplates and curved translucent corners inspired by contemporary Japanese architecture. The building height aligns with the Commercial Road precinct controls, which permit towers up to 15 storeys within proximity to Longland Street.

The project will comprise a mix of larger-format apartments aimed at owner-occupiers, downsizers, and families. The proposed apartment mix includes 11 loggia apartments across the lower levels, 50 four-bedroom Sky-Terrace apartments from levels three to seven, and 32 Sky-Pool Homes occupying the upper tower levels. The Sky-Pool Homes will feature private thermal plunge pools integrated into oversized balconies.

According to the application, the apartments are intended to reinterpret the scale and character of Teneriffe’s woolstore conversions and Queensland homes within a vertical residential format.

“The sky-pool homes build on Cavcorp’s previous projects and introduce a distinct apartment typology to Teneriffe, informed by both local and international precedent and responding to an identified market demand for enhanced safety, space and amenity,” the planning submission notes.

A major focus of the proposal is its five-level wellness and lifestyle offering, extending from the basement through to the rooftop.

Amenities proposed include a rooftop Swim &amp; Racquet Club with a 25-metre Olympic lap pool and tennis court, coworking spaces and libraries, golf simulators, wine storage, concierge facilities, business lounges, pet wash areas, and rooftop longevity-focused wellness spaces with spas, outdoor fitness zones, and landscaped terraces.

All parking will be concealed within basement levels accessed from Wyandra and Helen Streets. Cavcorp says the deep-basement engineering approach allows the entire ground plane to prioritise landscaping, pedestrian movement, and active frontage rather than vehicle infrastructure.

The development continues Cavcorp’s concentration in Newstead and Teneriffe, where the Brisbane developer has delivered a number of apartment projects including Lucent, Le Bain, and Luminare, as well as the Long Island Wellness Precinct nearby. Several of those projects have received national design and architecture awards, including recognition under Brisbane’s “Buildings that Breathe” program.

Focus Group Investments has lodged plans for a new apartment development at <a href="https://www.apartments.com.au/new-apartments/64-70-hanover-street-fitzroy-vic-3065">64–70 Hanover Street</a> in Fitzroy, seeking to utilise the Victorian Government’s recently introduced Great Design Fast Track pathway to accelerate approvals for the project.

The proposal is among the latest developments to emerge through the state-led initiative, which was established to fast-track well-designed residential projects in activity centres and transport-connected inner-city locations. The pathway allows qualifying developments that meet elevated design and housing benchmarks to bypass traditional council planning timeframes and instead be assessed directly by the Department of Transport and Planning.

Designed by SJB, the development will comprise a mix of apartments above activated lower levels, with a strong focus on architectural articulation, landscaping, and communal amenity. The design response seeks to balance the industrial character of Richmond’s former warehouse precincts with a more contemporary residential form.

The architectural material highlights the project’s integration of landscaped elements and communal spaces throughout the building. The proposal also incorporates sustainability initiatives aligned with the Victorian Government’s push for higher-performing apartment developments under the fast-track program.

The Great Design Fast Track was unveiled by the Victorian Government in 2024 as part of a broader housing supply strategy aimed at accelerating the delivery of new homes. The application sought approval for a masterplanned urban village on the existing Benowa Gardens Shopping Centre site, combining new housing, retail, dining, health and lifestyle amenities within a walkable, integrated precinct.&nbsp;

The proposed redevelopment includes around 413 apartments integrated above a revitalised mixed-use centre featuring a full-line supermarket of 4,000 sqm, 6,000 sqm of specialty retail and dining space across around 30 retailers, a 7,000 sqm health and wellness precinct, and roughly 9,630 sqm of office and medical suites.&nbsp;

Surfers Paradise is officially set for its first new residential development with a 45-storey skybridge connecting the two towers.

John Camilleri’s Celestino Developments has been given the green light by the Gold Coast City Council to develop its major beachfront precinct across its huge 4,000 sqm oceanfront site at <a href="https://www.apartments.com.au/new-apartments/63-79-garfield-terrace-surfers-paradise-qld-4217">63–79 Garfield Terrace</a>, just five months after its <a href="https://www.apartments.com.au/news/qld/first-look-exclusive-billionaire-winx-breeder-s-bold-two-tower-surfers-paradise-play-with-45th-storey-skybridge">submission in late 2025</a>.

The approved scheme will deliver two towers rising 55 and 48 storeys, connected by a skybridge positioned on level 45 that will house a range of resident-only wellness and entertainment spaces.

In its notice of approval, the Gold Coast City Council said the&nbsp;proposed overall built form has been designed to complement the scale, intensity and protect the adjacent amenity and surrounding streets through the use of varied setbacks, site cover and architectural elements.

Designed by <a href="https://www.apartments.com.au/architects/dbi">DBI</a>, the development will comprise 275 apartments across the two towers, including a mix of two-, three-, and four-bedroom residences, as well as several penthouses. The apartments will sit above a landscaped podium featuring more than 90 metres of beachfront pool frontage, private resident lawns, lounges, and wellness spaces.

DBI said the design draws heavily from the movement and form of the coastal environment, with curving balcony lines and sculpted façades intended to soften the scale of the towers while maximising ocean outlooks and passive shading outcomes.

“The project occupies a rare, uninterrupted oceanfront site and has been shaped by a design philosophy that merges architectural elegance with environmental responsiveness and a carefully curated lifestyle experience,” DBI said in planning documents submitted to the Gold Coast City Council.

The most distinctive element of the approved project is the skybridge linking the two towers at level 45. The elevated communal space is planned to include executive lounges, formal dining areas, wellness facilities, and panoramic ocean-facing outlooks.

“The skybridge enhances the identity of the development, promotes social interaction, and delivers a lifestyle experience not found elsewhere on the Gold Coast,” DBI said.

At podium level, residents will have access to a suite of resort-style amenities, including resident lounges, private dining rooms, a yoga lawn, gymnasium, plunge pools, and treatment spaces. The beachfront pool has been designed with separate lap, lounge, and children’s areas extending across the width of the site.

The project will also introduce new food and beverage offerings along the Enderley Avenue and Oceanway frontages, contributing additional activation to the beachfront precinct.

Sydney’s property market is known for high prices, competitive bidding, and mounting pressure on first home buyers. But change is on the horizon.

From late 2025, eligible first home buyers in New South Wales will have access to a new federal government initiative aimed at addressing affordability: the Help to Buy Scheme.&nbsp;

<h2>What is the Help to Buy Scheme?</h2>

The program introduces a shared equity model intended to reduce the upfront cost of entering the property market, particularly in high-demand urban areas such as Sydney.

The scheme operates under a shared ownership structure in which the federal government takes an equity stake of up to 40 per cent for new homes, or 30 per cent for existing dwellings. This arrangement allows eligible buyers to significantly reduce their loan size and avoid the added cost of Lenders Mortgage Insurance (LMI).

Under this model, purchasers can enter the property market with as little as a two per cent deposit, well below the traditional 10 to 20 per cent usually required. The government’s contribution is not a loan but a co-ownership stake in the property. As such, there is no interest or rent charged on its portion.

Because the government’s equity combined with the buyer’s deposit typically meets or exceeds the 20 per cent threshold, LMI does not apply. The remaining balance, generally between 60 and 70 per cent of the property’s value, is financed through a standard home loan with a participating lender.

The government's equity in the property remains in place until the buyer chooses to repay it voluntarily or until the property is sold. Buyers can buy back the government’s share over time, in increments of at least five per cent, depending on their financial situation.

There is no fixed repayment timeline, but the amount to be repaid will be based on the property's market value at the time of repayment, not the original purchase price.

<h2>How do you qualify for the&nbsp;Help to Buy Scheme?</h2>

To qualify for the Help to Buy Scheme, applicants must meet the following conditions:

	<li>Be an Australian citizen at least 18 years of age.</li>
	<li>Be a first-home buyer who does not currently own property.</li>
	<li>Intend to live in the property as their primary residence.</li>

National Australia Bank (NAB) has brought forward the timing of the first RBA cash rate cut by three months.

NAB is now expecting a cut in February, in line with ANZ and Westpac, having initially thought a cut wouldn't come until May.

Commonwealth Bank, the nation's largest lender, still thinks the first cut will come in December.

NAB changed its call following the August monthly inflation figures that were released at the end of September, showing it had dropped to 2.7 per cent.

"The risk has been skewed to a first cut earlier in 2025, and today’s change acknowledges the balance of risks has likely shifted sufficiently for the RBA to feel comfortable cutting a little sooner than we earlier expected," NAB noted in its latest update.

They added that the cadence of the cuts may be faster than its central profile.

"Domestic inflation pressures are cooling, but only gradually, and we continue to expect the conditions for a cut will not be in place this year.

NAB believes the easing cycle will end at 3.1 per cent by early 2026, which is five cuts from the current 4.35 per cent cash rate.&nbsp;

CBA also thinks 3.1 per cent will mark the end of the cutting cycle, while Westpac is forecasting 3.35 per cent, and ANZ is the most pessimistic at 3.6 per cent, which would be just three interest rate cuts.

Canstar Data Insights Director, Sally Tindall, says if core inflation continues to track in the right direction, or unemployment starts to accelerate significantly, we could well see a cash rate cut as early as February of next year.

“All four big banks now believe the RBA will be ready to cut the cash rate in just over four months’ time, if not before, in the case of CBA.

“However, the outlook for both inflation and unemployment is still highly uncertain. A couple of wobbly sets of inflation data could see the RBA holding for longer, particularly if unemployment remains relatively steady."

The major banks independently lifted their mortgage rates last week, and I was surprised with the number of questions I was being asked.
Many mortgage borrowers want to switch to a cheaper lender after these interest rate rises, but they’re confused about three questions: how much money will I save? What options do I have outside the major banks? And, is it worth the hassle of switching?
Let’s start with the first question: the answer is that you can save hundreds from your first new mortgage payment and you can save tens of thousands over the life of the new loan.
Let’s say two customers have an average $350,000, 30-year mortgage. The Westpac customer, with a standard variable rate of 7.46%, will pay $55,440 more over the life of the loan than the Yellow Brick Road customer, who has a rate of 6.84%.
Even a NAB customer, with the lowest standard variable rate of the big banks, will pay $38,160 more than a Yellow Brick Road customer.
This is simply the comparison sitting on my desk right now. Your job is to find your own examples and know how much you will pay over the life of your loan and then run different interest rates through the online calculators.
This brings me to the second question: what mortgage options are available to me?
To understand your options, I suggest two paths: you get online and research the comparison web sites, or you see a mortgage broker.
There are many comparison sites available on the internet. The service I find simplest is Canstar Star Ratings, but there are quite a few.
You should start by knowing exactly how your current loan works: the interest rate, the features, the fees, etc. Perhaps make a list of what you like about your current loan, because even if you think you’re paying too much, there may be features that you have come to rely on, such as 100% offset, fortnightly payments and easy redraw.
Be honest about the features – their value may be greater than what you can save.
Scroll down and look at how many home loans are cheaper than you’re paying, and then weed them out until you find the loans that also have the features and fees you want.
If it’s too daunting or time consuming, you can see a mortgage broker. These experts know the market and can match you with the best priced and best featured home loan.
It’s very rare that a broker can’t find a better loan than the one you have already – it’s their job.
The harder you look, the more you’ll find lenders you may not have heard of: credit unions, regional banks, building societies and mutuals.
Don’t be put off by their supposed obscurity. According to Abacus, the industry body for the Australian mutual sector, there are 119 mutual lenders in this country with a combined 4.6 million customers. Generally speaking, these lenders are the ones with the lower interest rates because they don’t need the high profit margins that the big banks rely on.
Armed with options and convinced you can save money, is it a hassle to actually change a home loan?
That depends on how organised you are. Personally I don’t think a few hours of collecting paperwork is a high price to pay for saving $40,000.
I suggest you do it this way: organise a new, lower-priced loan at a lender. You will need proof of identity, of employment and of earnings.
You’ll receive a written loan offer in which the new lender will commit to “buying out” your current loan, without exit fees of course.
Your options will now expand because in my experience, nine times out of 10 your current bank – when contacted by the new lender – will offer to match your new rate.
Having gone through this process, you now have real choice: choice of price and choice of who you borrow from. You have answered your own questions and come out with a better result than when you started.
This is how home lending should operate. That fact that it doesn’t frustrates me.
Borrowers either become complacent about their set-and-forget mortgage, or they’re scared of changing from a big bank.
What I would tell them is that the first thing you do when you change mortgage is change your attitude.
So you’d like to save $40,000 over the life of a mortgage? It could be time to change your attitude.

Don’t be afraid to refinance – it could save you tens of thousands: Mark Bouris

An investigation by consumer group Choice has found that banks are neglecting their duties to give out key loan fact sheets.
Only one out of 18 Sydney bank branches visited by Choice spokesman Matt Levey provided a copy of the fact sheet when he requested information about comparable fees and interest rates.
A key fact sheet helps borrowers compare the home loan they are being offered with other similar loans to help them make an informed decision.
Since January 2012 mortgage providers must give customers a key facts sheet on request.
"We ended up with a lot of paraphernalia ... a lot of handwritten notes, a lot of glossy brochures with photos of bank CEOs," Levey told the ABC.
"We got one home loan fact sheet. We say that's not good enough.
"If the banks were serious about standing behind their products and serious about competing, then they'd be providing Australian consumers with the information they needed to shop around."
Levey says he did not ask for the fact sheet by name, but says Choice does not believe it is realistic to expect customers to ask for the fact sheet by its official name: the federal government's key home loan fact sheet.
“We think it's enough to go in and say, ‘Can we have some information to go away and compare loans?'
"If that doesn't work, then we think the requirement needs to change."

Banks not giving out key home loan fact sheets: Choice

Property valuations (and valuations of equipment and other assets for that matter) are relevant in many tax contexts, including capital gains tax (CGT) and GST. Getting a valuation wrong can mean more tax to pay.
A disagreement with the Tax Office on a valuation can materially alter the tax consequences of a transaction. Indeed, a recent decision by the Administrative Appeals Tribunal saw a taxpayer fail the CGT maximum net asset value test (so the CGT small business concessions could not be accessed) because of a valuation issue. My recent article <a href="https://www.smartcompany.com.au/tax/20111215-another-year-and-capital-gains-still-causes-problems?utm_source=SmartCompany&amp;utm_campaign=b8d9118ba4-Monday_12_December_201112_12_2011&amp;utm_medium=email">Another year and capital gains still cause problems</a> discussed this case further.
Hand in hand with the need for valuations is the corresponding need to keep good records. In the CGT context for example, an asset that may be subject to CGT when it is later sold, needs to have records kept about its purchase price, any improvements to the asset, etc. If an asset is inherited, it is highly prudent to obtain a valuation of it, in case tax consequences later arise.
The Tax Office has released a paper highlighting what it says are recurring issues it has found concerning valuations of property in relation to the application of the GST margin scheme provisions. The margin scheme essentially allows less GST to be paid where sales of land or strata units are involved, provided certain conditions are met.
The Tax Office does not automatically accept every valuation submitted to it. Many valuations it receives are referred to the Australian Valuation Office (AVO) for evaluation, particularly as to whether or not the valuation specifies a value that is within a range that is reasonable.
Often, when certain elements of a valuation are outside an acceptable range, the Tax Office says the ultimate valuation is higher than it should be resulting in a lower margin and less GST payable.
The paper sets outs the main issues regarding what the ATO considers are non-complying valuations it has identified and its position when those issues occur. Some issues include the following.

The Tax Office says that valuations also need to reflect reasonable allowances for commencement and completion dates as well as selling timeframes, etc as these factors will affect holding costs, financing costs and overall project risk. In examining valuations, the AVO found that in a number of cases, lead times for example were unrealistic given the size and the peculiar characteristics of the property development. The ATO view is that project lead times, selling timeframes and completion timeframes must reflect the commercial, market and planning reality of a project.
Many valuations reflect a value of the real property interest that is being sold rather than the interest that existed at the valuation date. In these situations, the ATO considers that if the valuer is asked to value a real property interest that did not exist at the valuation date but was derived from another interest that existed at that date, the valuation must be made as follows:
<ul style="list-style-type: none;">
<li>
a valuation of the interest in existence at the valuation date must be made;
</li>
<li>
the valuation of that interest must be apportioned on a fair and reasonable basis, to ascertain the part of the valuation that relates to the interest that is being sold. The ATO requires all factors taken into account in the apportionment to be explained to show why the apportionment is fair and reasonable.
</li>
</ul>
The ATO said it accepts that valuations can, by their very nature, be a subjective assessment of a property's value and in many cases there are interpretive assessments of impacts on the property value. However, it said that regardless of this subjectivity, it still has an expectation that values will fall within a "reasonable range".
Where the AVO opinions are supported by evidence, and also align with the ATO's perception of reasonableness, the ATO said these will be referred to the relevant valuer to enable those noted elements of the valuation to be reviewed. If there is sufficient merit in the valuer's adopted assumptions and conclusions, such that these can be considered reasonable, the ATO said the valuation can be accepted as a complying valuation.
Where the valuer's assumptions and conclusions are not sustainable based on evidence, or are not reasonable, the ATO said the valuation cannot be considered a complying professional valuation. This, in turn, can have tax flow-on implications.
Getting valuations is important in a tax context. But not every valuation will necessarily be acceptable to the Tax Office.

The future of mortgage broking franchise Refund Home Loans and its 300 franchisees remain undecided five months after it collapsed as receivers remain quiet on a possible sale of the business.

An industry source told Property Observer current franchisees were growing increasingly frustrated at the lack of information from the administrator as they hold out for a possible sale.

It is understood that a group of franchisees who had expressed interest in buying the business have now backed out of a management buyout.

Property Observer has put in numerous calls to administrators SV Partners, but has not received any response.

In January it was reported that three businesses had submitted expressions of interest in Refund Home Loans, with Broker News naming one of the suitors as non-bank lender Liberty Financial.

A spokesperson for Liberty Financial said it did not comment on market speculation.

As a lender on Refund Home Loan’s mortgage panel, Liberty Financial would have good knowledge of the business.

Refund has a network of 300 brokers and would provide an instant distribution arm to a non-bank lender, but is unlikely to be appetising to a major lender because of its controversial business model.

As a result of the expressions of interest the court granted SV Partners an extension until March to secure a buyer or wind up the business.

Both Channel Nine’s A Current Affair and Channel Seven’s Today Tonight have run exposés about the collapse of Refund Home Loans.

Speaking on condition of anonymity, a creditor told Property Observer the exposés, particurlarly the more attacking one by ACA, might reduce the sale price of the business.

Today Tonight ran two stories, both including interviews with Ormond and portraying his personal loss (including having to sell his $500,000 Bentley) and featuring support from former Wheel of Fortune host John Burgess.

Refund Home Loans franchisees wait for any news of possible sale

All investment and development properties incur a land tax liability annually. The annual land tax liability for a property is derived from the value of the land only and doesn’t include the value of any improvements. In brief, anyone can object to the valuation which is provided by the NSW Valuer-General, however there is only a 60-day window in which this can be done. In many instances there are significant savings to be made.
Property developers and owners of major investment properties are the most likely to be hit with excessive land lax assessments.
What property types incur land tax?
Land tax is paid on most properties that are not a principal place of residence or not used for primary production. Development sites and land banks, retail and commercial investment properties, vacant land, land improved with a dwelling or apartments, a holiday home and many other property types incur land tax.inst
There are various concessions/exemptions from land tax such as the property being a primary place of residence, the property is intended to be a primary place of residence, a new residence is acquired while the previous one is yet to be sold, you have a home office but the majority of business is done elsewhere, absence from principal place of residence (e.g. move overseas) or a deceased estate.
How much is land tax and how is the amount calculated?
Land tax is payable over a certain threshold. For 2012 the threshold is $396,000. Land tax is calculated at $100 plus 1.6% of the land value between the premium rate threshold ($2,421,000) and 2% thereafter.
The amount payable is based on the average of the last three years’ assessments. It is possible to object to any of the three assessments. If you are objecting to a value that has previously been objected to, new information must be provided.
In most instances it is too time-consuming to lodge an objection for a small investment property, as a successful objection may only reduce the burden slightly. However, with major development sites and investment properties land tax liabilities can be reduced by many hundreds of thousands of dollars.
Residential strata buildings and land tax
In order to determine the land value for individual residential units the Valuer-General assesses the land value of the site the apartment building is erected on. The overall liability for the entire site/building is allocated to each of the units based on their unit entitlement under the strata scheme.
 
How is land tax assessed and what difficulties impact the assessment process? Why might the assessment be wrong?
To arrive at the land value of a property the valuers working for the NSW Valuer-General analyse recent comparable sales. The opinion of value is arrived at after adjusting the identified sales based on their various characteristics, such as location, site conditions, zoning, development approval, scale, floor space ratio, view profiles, aspect and proximity to employment bases and infrastructure.
Although this method is the simplest way to determine land value, there are often points of contention because of the number of adjustments that need to be made to the sales evidence in order to arrive at a land value of the subject property. Small oversights in the valuation process can change an assessment greatly.
Ideally a valuer will use sales of vacant land to determine the unimproved value of the subject land, however in most built-up areas vacant land sales are not available and sales of properties with improvements (units, houses, offices) need to be used. In this instance the valuer will deduct the value of the buildings from the sale price to arrive at the land component of the sale price. This process includes a number of assumptions and a large margin for error, particularly as the buildings are given a value without being internally inspected.
In addition, sales of properties such as development sites and major commercial office buildings often do not transact under simple conditions. Often sales include conditions such as extended settlement periods, various types of options, rental guarantees or staged payments and these conditions can allow a purchaser to pay more for a property for any number of reasons. The value for land tax purposes assumes unconditional sale so it can’t be compared to a conditional sale without making the necessary adjustments. If these adjustments have not been made by the valuer then the identified sale might be contributing to an inflated land value assessment.
There are any number of reasons a property owner might disagree with their assessment and these may be reasonable cause for an objection. Any objection needs to have supporting evidence based on analysis of the sales used by the Valuer General or sales not considered. Some reasons to object might be:
<ul>
<li>My development site has been given the same rate/sqm in value as all the comparable sales but it is in an inferior location and does not similar amenity.</li>
<li>There have been a number of sales around my property that have not been used by the Valuer General and I am of the opinion they are the most comparable and they support a lower land value for my assessment.</li>
<li>My land is heritage listed and the valuer general did not take this into account in their assessment.</li>
<li>Two of the sales used by the Valuer-General were between related parties (e.g. family members) and as such cant be relied upon. I have new sales that support a lower value. </li>
</ul>
How long do I have to consider an objection?
A period of 60 days is provided in which an objection can be lodged. This can be lengthened at the Valuer-General's discretion. This is only a narrow time to object and it is in the objector’s best interest to object before the end of the 60 days.
Notwithstanding the above as previously mentioned your land tax liability is based on the average of the previous three years and it is possible to object to any of the three years that appear on the notice. As such, if you miss the 60 day window you will have another chance to object to the value the following year. 
Things that ought be taken into consideration before lodging an objection?
<ul>
<li> How much of my time will it take to lodge a professional and well researched objection?</li>
<li>Should I appoint a third party to make the objection on my behalf? If so how much will they cost?</li>
<li>How much do I think I can reduce my liability by? After considering the time and cost to lodge an objection is it worthwhile?</li>
<li>Who is a property consultant that can provide some guidance/advice in this?</li>
<li>Do I have the expertise to properly lodge an objection?</li>
<li>The assessment is based on an average of three years and this should be taken into account when deciding what years out of the three can be objected to.</li>
</ul>
What increases chance of success?
<ul>
<li>Properly analyse the sales identified by the Valuer General so that all details of the sale are known and their impact on the value explored.</li>
<li>Identify any key sales not used by the Valuer General.</li>
<li>Provide a clear and concise objection.</li>
<li>Instructing a qualified valuer and/or land economist to prepare an objection for you.</li>
</ul>
Determining objections and how to appeal. Is it worth appealing?
After an objection is lodged it will be reviewed by an independent valuer appointed by the Valuer-General. Once the objection has been reviewed a notice of determination of the objection is sent to the relevant party. If a notice is not received within 90 days of lodgement then the objection is deemed to be disallowed.
If an objection is not successful then you have 90 days to lodge an appeal with the Land and Environment Court of NSW.
The cost of an appeal can be significant due to the inclusion of lawyers and property valuers/land economists. The high cost of an appeal is part of the reason it is important to lodge an professional objection.

Time ticking on 60-day objection period in NSW: Land tax 101

Victorian borrowers appear to be growing increasingly unhappy with their mortgage lenders, with borrowers in the state accounting for more than a quarter (28%) of all refinancing activity in Australia during the final three months of 2011, according to the latest data from ABS. 
In total over 14,100 Victorian borrowers refinanced their mortgages over this three-month period (totalling $3.6 billion), compared with 13,000 in the corresponding quarter in 2010 and 10,500 in last quarter of 2009. 
The surge in Victorian refinancing activity comes as part of a national increase in refinancing activity over this period, which soared to a record high of $12.6 billion (50,000 borrowers) in the final quarter of 2011, a 14% increase on $11.1 billion refinanced in the December quarter of 2010. 
There were also sharp increases in refinancing activity in NSW (up $4.3 billion from $3.7 billion) and Western Australia ($1.6 billion from $1.3 billion). 
A poll carried out by Property Observer found that 81% of borrowers will investigate the option of refinancing with a different lender following the recent interest rate increases made independently of the RBA. 
More than half (56%) of those polled said they’d changed lenders in the last six years.

Refinancing activity remained flat or fell in all the other states. 
On a seasonally adjusted basis refinancing rose by 2.3% in December 2011 after a fall of 0.9% in November 2011. 
The increase in refinancing activity comes as mortgage lending to owner-occupiers increased by just 0.7% in December 2011 with overall mortgage growth at its lowest level since statistics were recorded 35 years ago.

Disgruntled Victorian borrowers lead national surge in mortgage refinancing: ABS

Online bank ING Direct will raise rates on its variable mortgages by 0.1% on Friday. 
Rates on its Mortgage Simplifier (the bank’s standard variable loan) will rise to 6.72% on Friday 17 January. 
The Australian arm of the Dutch-based bank is the fifth biggest lender in Australia, with a $38 billion mortgage book. 
Westpac brands St George, Bank of Melbourne and BankSA have also announced that they will raise interest rates on variable mortgages. 
St George and BankSA will lift rates by 0.12% to 7.42% on Friday (a greater increase than Westpac), while Bank of Melbourne has lifted its rates by 0.1% to 7.4% effective immediately.

ING Direct and Westpac subsidiaries St George, Bank of Melbourne and BankSA push up variable rates

The current 15-basis-point gap between the standard variable interest rate of the major banks will widen in the future, according to Mortgage Choice CEO Michael Russell.
NAB currently has the lowest variable rate of the 7.31% with Westpac the highest at 7.46%.
Russell says the latest round of major bank interest rate increases shows that the major banks are now prepared to move interest rates out of cycle with the RBA and has also signalled to existing and prospective borrowers, that the major banks no longer adopt the same pricing movements.
“While major banks’ standard variable rates have, up until a couple of years ago, been on par each other, borrowers now need to be aware that their standard variable rates are likely to differ going forward,” he tells Property Observer.
“The difference between the standard variable rates for the  big four banks was a significant 14 basis points prior to the latest round of increases and now sits at 15 basis points,” he says.
While Mortgage Choice does not track this data, Russell says the major banks have kept their interest rates on par until the out-of-cycle rate moves by the majors in November 2010.
In November 2010, the Commonwealth Bank announced a 45-point hike after the RBA's Melbourne Cup Day 25-point increase.
Furthermore, he says using a professional mortgage broker has just become even more imperative for existing and prospective borrowers, “to help ensure they obtain the most suitable loan product for their individual needs and requirements”.

More choice likely among big four bank mortgage rates: Mortgage Choice CEO Michael Russell

Credit Union Australia (CUA) has today confirmed it will not be increasing any of its variable-rate mortgages. 
ME Bank has also left its variable interest rates unchanged following the RBA announcement. The bank’s standard variable rate remains at 6.74%. ME Bank is wholly owned by industry super funds.
CUA, one of Australia biggest customer-owned lenders, will leave its standard variable rate unchanged at 6.72%, more than 50 basis points lower than the lowest rate of the big four, NAB, which has increased its standard variable rate to 7.31%. 
CUA and ME Bank have taken what Yellow Brick Road chairman Mark Bouris has referred to as the “opening” created for smaller lenders by the major banks slugging customers with interest rate increases outside of the official rate cycle.
Chris Whitehead, chief executive of the CUA, says the company remains committed to offering customers the best deal possible and points out that since April 2010, CUA’s standard variable rate has consistently been at least 0.5% cheaper than the average of the big fours’ equivalent products. 
“While CUA is certainly not immune to the funding pressures facing the big banks, our ability to focus entirely on our customers, rather than on dividends to shareholders, allows us more flexibility to make rate decisions that are in their best interests,” he says.
Another mutual lender, the Jerry Seinfeld-fronted Greater Building Society, did not follow the CUA, raising its variable rates by 0.1% and pushing up its standard variable mortgage to 6.9%. 
Despite this increase, the Greater is still offering a standard variable rate 0.56% lower than Westpac, which has the highest variable rate of the big four at 7.46%. 
“On current rates, a customer with a 30-year, $300,000 standard variable home loan is still $1,464 a year better off than a Westpac standard variable home loan customer. The Greater customer will save $43,920 over the life of the loan,” says Greater chief executive Don Magin. 
The Greater variable rate increase is effective from tomorrow for new loans and for existing customers from February 22.
