The residential transformation of St Kilda Road is set to continue into with more new apartment plans for the sought-after boulevard.

Wing Tai Asia has lodged plans for a major residential tower at 464-466 St Kilda Road, replacing the former VACC House with an 18-storey mixed-use development designed around a retained heritage podium and a sculpted contemporary tower.

The proposal, prepared under Victoria’s Significant Residential Development with Affordable Housing pathway, would deliver 325 apartments and ground-floor retail across the prominent 4,653 sqm boulevard site in Melbourne’s St Kilda Road North Precinct.

The project centres on the adaptive reuse of the site’s heritage-listed VACC Building, an eight-storey office designed by Bernard Evans that has occupied the address for decades. Planning documents state the development would involve “carefully dismantling and conserving off-site the original metal fabric of the podium visible from St Kilda Road,” before reinstating it as the defining frontage of the new scheme.

Above the restored podium, Wing Tai is proposing a curvilinear residential tower. The scheme includes 172 one-bedroom apartments, 63 two-bedroom apartments, 66 three-bedroom apartments, and 24 four-bedroom apartments, alongside two ground-floor food and beverage tenancies fronting St Kilda Road.

The tower has been designed with substantial articulation and variable setbacks to minimise perceived bulk and maintain view corridors along the boulevard. Urbis, which prepared the planning report, said the design “has been significantly articulated through a curvilinear design” with “an interplay with materials, façade expression and depth” to create visual separation and visual interest.

The proposal also includes 254 basement car spaces, landscaped pedestrian links connecting St Kilda Road and Queens Lane, and a biophilic landscape strategy featuring canopy trees, raised planters, cascading greenery and a glass oculus pool overlooking the eastern frontage.

Planning documents confirm the $270.1 million development will contribute 3 per cent of project costs to the Social Housing Growth Fund as part of the application process.

Wing Tai acquired the St Kilda Road property in 2018 alongside Abacus Property Group for $95.38 million, before later consolidating ownership of the site. The property previously served as the Victorian Automobile Chamber of Commerce headquarters for around 60 years.

The transformation of the St Kilda Rd boulevard is already beginning to materialise, with a number of high-profile projects recently completed, launched, or approaching launch as developers continue to back the long-term appeal of the precinct.

Among the most notable recent completions is Louise by Samuel Property Group, just off the strip on Queens Lane, the same pocket Hirsch &amp; Faigen recently launched The Queensbury. Mirvac is too on the same street with The Albertine, which is approaching completion.

Dexus recently secured approval for its slice of St Kilda Road, while Gurner also has approved plans for the precinct.

Wing Tai unveils 325-apartment St Kilda Road tower on former VACC House site

Malaysian developer <a href="https://www.apartments.com.au/developers/s-p-setia">SP Setia</a> is the latest to jump into St Leonards booming Transport Oriented Development precinct.

The developer, which has previously delivered Sapphire by the Gardens apartment development in Melbourne, identified the Atchison Street site in 2023. It filed a Scoping Report around 12 months ago, and now has revealed the designs for the new&nbsp;40-storey mixed-use tower.

The State Significant Development Application covers <a href="https://next-portal.urban.com.au/projects/14650/summary">20-22 Atchison Street</a>, a 1,374 sqm site positioned between St Leonards Station and the new Crows Nest Metro station.

Designed by <a href="https://www.apartments.com.au/architects/cox-architecture">COX Architecture</a>, the project would deliver 181 apartments, above a four-storey commercial podium, five basement levels, and new public domain works along Mitchell Street. The apartment mix comprises 35 one-bedroom apartments, 39 one-bedroom-plus-study apartments, 85 two-bedroom apartments, and 22 three-bedroom residences.

The proposal has been lodged as a shop-top housing development under the NSW Government’s TOD planning pathway, which allows increased density around key transport infrastructure. The site sits within the recently rezoned Crows Nest Accelerated TOD Precinct.

SP Setia acquired the Atchison Street site as part of its continued expansion into the Australian apartment market. In comments made to City &amp; Country (The Edge Malaysia) in 2023, SP Setia President and CEO Datuk Choong Kai Wai described the acquisition as “a strategic move” aligned with the group’s post-pandemic market recovery strategy.

“Our target for this exceptional development is local and overseas buyers, including first-home buyers, downsizers and investors,” Choong said.

The tower has been designed as a slender vertical form rising from a mixed-use podium, with COX Architecture positioning the development as a response to the evolving St Leonards and Crows Nest skyline.

“The purpose of the project is to facilitate the delivery of high-quality housing at a strategically located site and deliver a built tower outcome that is consistent with the desired future character of St Leonards and aligns with the TOD controls,” the design report stated.

The podium would incorporate retail uses fronting Atchison Street, commercial tenancies, landscaped communal areas, and pedestrian improvements along Mitchell Street. Vehicle access and loading would be consolidated via Atchison Lane.

Residents would have access to more than 665 sqm of communal indoor and outdoor spaces, while the development proposes 96 parking spaces across five basement levels.

The proposal also includes a commitment for 10 per cent of residential floor space to be allocated toward affordable housing through a monetary contribution.

COX said the tower form responds directly to the emerging high-density character of the precinct while seeking to maximise solar access, cross ventilation, and outlook from apartments.

“The building is orientated towards north,” the Apartment Design Guide compliance report noted, adding that the tower’s slim form was driven by the constrained inner-urban site dimensions.

The design also incorporates landscaped setbacks and communal open space at podium level, intended to soften the interface with surrounding streets and improve pedestrian amenity.

The project adds to a growing wave of redevelopment proposals reshaping St Leonards and Crows Nest following the opening of the Sydney Metro City line and the NSW Government’s push for higher-density housing around major transport nodes.

<a href="https://www.apartments.com.au/developers/urban-property-group">Urban Property Group</a> has revealed plans for a new mixed-use tower at 10 Dangar Street, Wickham, advancing a proposal that would reshape the southern gateway to Newcastle’s city centre with one of the city’s tallest residential buildings.

The State Significant Development proposal, now on exhibition, seeks approval for a <a href="https://www.apartments.com.au/new-apartments/bowline-10-dangar-street-wickham-nsw-2293">43-storey tower</a> immediately adjacent to the Newcastle Interchange. The project would deliver around 200 apartments, including 42 affordable housing dwellings, alongside 99 co-living units, a 171-room hotel, retail space, and new public domain integrated through the site.

The scheme marks a significant escalation of plans previously approved for the site. Urban Property Group took over the prominent 2,904 sqm parcel, where excavation and demolition had already commenced under an earlier consent for a 14-storey mixed-use development.

SJB said the site presents “a valuable opportunity to anchor the precinct by setting the standard for design, active ground planes and character at the key southern gateway.”

The architecture responds directly to the site’s position beside major transport infrastructure and within one of Newcastle’s fastest-evolving urban renewal precincts. The tower form sits above a sculpted podium designed to frame new public spaces, including a through-site pedestrian link connecting Station Street to Hannell Street, landscaped plazas, and activated retail edges.

Creative Road’s curatorial framework for the project, titled Unveil, draws on “stratified surfaces, carved volumes, and light-filled apertures” while referencing Newcastle’s transformation from an industrial city into a contemporary education and technology hub.

Sydney’s property market is known for high prices, competitive bidding, and mounting pressure on first home buyers. But change is on the horizon.

From late 2025, eligible first home buyers in New South Wales will have access to a new federal government initiative aimed at addressing affordability: the Help to Buy Scheme.&nbsp;

<h2>What is the Help to Buy Scheme?</h2>

The program introduces a shared equity model intended to reduce the upfront cost of entering the property market, particularly in high-demand urban areas such as Sydney.

The scheme operates under a shared ownership structure in which the federal government takes an equity stake of up to 40 per cent for new homes, or 30 per cent for existing dwellings. This arrangement allows eligible buyers to significantly reduce their loan size and avoid the added cost of Lenders Mortgage Insurance (LMI).

Under this model, purchasers can enter the property market with as little as a two per cent deposit, well below the traditional 10 to 20 per cent usually required. The government’s contribution is not a loan but a co-ownership stake in the property. As such, there is no interest or rent charged on its portion.

Because the government’s equity combined with the buyer’s deposit typically meets or exceeds the 20 per cent threshold, LMI does not apply. The remaining balance, generally between 60 and 70 per cent of the property’s value, is financed through a standard home loan with a participating lender.

The government's equity in the property remains in place until the buyer chooses to repay it voluntarily or until the property is sold. Buyers can buy back the government’s share over time, in increments of at least five per cent, depending on their financial situation.

There is no fixed repayment timeline, but the amount to be repaid will be based on the property's market value at the time of repayment, not the original purchase price.

<h2>How do you qualify for the&nbsp;Help to Buy Scheme?</h2>

To qualify for the Help to Buy Scheme, applicants must meet the following conditions:

	<li>Be an Australian citizen at least 18 years of age.</li>
	<li>Be a first-home buyer who does not currently own property.</li>
	<li>Intend to live in the property as their primary residence.</li>

National Australia Bank (NAB) has brought forward the timing of the first RBA cash rate cut by three months.

NAB is now expecting a cut in February, in line with ANZ and Westpac, having initially thought a cut wouldn't come until May.

Commonwealth Bank, the nation's largest lender, still thinks the first cut will come in December.

NAB changed its call following the August monthly inflation figures that were released at the end of September, showing it had dropped to 2.7 per cent.

"The risk has been skewed to a first cut earlier in 2025, and today’s change acknowledges the balance of risks has likely shifted sufficiently for the RBA to feel comfortable cutting a little sooner than we earlier expected," NAB noted in its latest update.

They added that the cadence of the cuts may be faster than its central profile.

"Domestic inflation pressures are cooling, but only gradually, and we continue to expect the conditions for a cut will not be in place this year.

NAB believes the easing cycle will end at 3.1 per cent by early 2026, which is five cuts from the current 4.35 per cent cash rate.&nbsp;

CBA also thinks 3.1 per cent will mark the end of the cutting cycle, while Westpac is forecasting 3.35 per cent, and ANZ is the most pessimistic at 3.6 per cent, which would be just three interest rate cuts.

Canstar Data Insights Director, Sally Tindall, says if core inflation continues to track in the right direction, or unemployment starts to accelerate significantly, we could well see a cash rate cut as early as February of next year.

“All four big banks now believe the RBA will be ready to cut the cash rate in just over four months’ time, if not before, in the case of CBA.

“However, the outlook for both inflation and unemployment is still highly uncertain. A couple of wobbly sets of inflation data could see the RBA holding for longer, particularly if unemployment remains relatively steady."

Even Jessica Simpson could have done his job. In my book Australia: Boom to Bust I argue that since 2008, the Reserve Bank of Australia (RBA) and Australia's politicians have been managing a credit fuelled property bubble– not an economy.
Here are the simple facts:

<li>Interest rates are at record lows</li>
<li>Speculation (lending/negative gearing) on property is at an all-time high</li>
<li>Property prices; particularly in Sydney and Melbourne (37% of Australia's population) are at an all-time high</li>

Under the watch of RBA Governor Glenn Stevens, this is what Australia's economic reality is. In recent time, the RBA has maintained record low interest rates on the bet that the housing sector would pick up the slack as investment in the mining sector declines.
What is clear is that the RBA governors' bet has paid off only to leave the heart of Australian household wealth and liabilities 100% dependant on property price growth.
Australian households have not only bet on house prices only rising. But their retirement &amp; superannuation funds have also bet the banking system will forever be able to lend more to homebuyers than the previous year. That is what the Australian banking system relies on. Any changes break-down the flow of money in the form of debt to new homebuyers.
As Bubble Economics authors Philip Soos and Paul Egan rightly point out, property investors today are chasing net-yields comparable to the tech bubble of the late 90's. In a nutshell, when there is such heavy demand to invest in a market that secures incredibly lousy yields, history tells us the particular market is in a heavy state of speculation.
Furthermore, it also overshadows the oversupply of toxic debt, which is the real reason property prices are where they are today.
First time home buyers (FHBs) are (without the help of parents lifesavings) utterly priced out of home ownership. With the strong possibility that macroprudential tools may be implemented in an attempt to cool the housing market, it is clear that whatever tools are used, FHBs will make up an even smaller proportion of property buyers.
Pushing FHBs to the sideline for an immediate period of time might actually help protect this segment of the property buyers out there from getting themselves into too much debt. But negate their fair chance to own a home like their previous generations have– for a much lower cost. Where does this leave us? With the real risk a generation of retirees, self-managed super fund investors and other recent property buyers holding large sums of debt that will become underwater mortgages when the property market turns south.
The RBA has had six years to make housing more affordable for all Australian's and to not let the property bubble grow. In this instance, the RBA has chronically failed by successfully keeping the property bubble inflated at the cost of the rest of the domestic economy. On top of this there is a chronic oversupply of toxic debt which has been successfully overshadowed by the banking and real estate pundits.
They argue that there is an apparent shortage of housing stock, but never question or mention an oversupply of debt. This is Australia's reality today. This was also America and Ireland's reality back in 2006. It did not end well for those two nations, and it will end no better for Australia.
It's time Australia's central bankers and politicians were actually held accountable for the decisions (or lack thereof) they have made. They must be challenged by our local mainstream media on the facts, not the talk. If our powerful media dives deeper into the decision making process of the RBA board, they will find that they are truly living in Disneyland. Because that's what the maths tell us.
If you think the RBA would not have been better managed under another leader, just think of this simple fact.
Even if Jessica Simpson was the RBA governor between 2008-2012, the Australian economy would have continuously grown.
Why?
Because a country 5,000 miles away called China made a once in a lifetime investment into an iron ore intensive construction binge.
It was almost mathematically impossible for the Australian economy to fail, or enter recession between late 2008 and late 2012.
Now this binge seems en-route to end. And Australia is now a country with absolutely nothing to fall back on but an overseas banker's willingness to lend more wholesale debt to the Australian banking system - and from the Australian banking system to households.
A failed RBA lead by a failed Governor.

Variable rates remain Australian borrowers’ favourite option, however fixed rates have been growing to a now four month high over September, according to Mortgage Choice’s latest Homeloan Choices data.
Fixed rates in September accounted for 25.45% of loans written, up from 24.19% in August.
New South Wales home borrowers were keenest for fixed rates, with 30.75% opting for fixed products, up from 25.30% in August. Meanwhile, Victoria saw an uptick to 18.10% from a previous 16.70% result.
Jessica Darnbrough, spokesperson for Mortgage Choice, said that the lift was largely expected with lenders pushing fixed rates aggressively.
“At the end of July and the beginning of August, many of Australia’s lenders actively cut the interest on their suite of fixed rate products, which encouraged more borrowers to opt for a fixed rate mortgage,” Darnbrough said.
“It usually takes a month or two for us to see any increase in demand for a particular product flow through the data, but we are definitely starting to see that now.”
She noted that despite lenders trimming interest on fixed rate products, the majority are still happy to “take their chances on a variable rate mortgage.”
“Variable home loan rates are still sitting at historical lows, and as such, it isn’t surprising to see that this type of loan is popular with borrowers. That said, with fixed rates also sitting at historical lows, borrowers can rest assured that regardless of the product they choose, they should be able to snag a very competitive rate,” she said.

Housing prices in Australia have been rising strongly, the Reserve Bank (RBA) told the House of Representatives inquiry into housing affordability today.
"Some of this perhaps represented an element of catch up after some earlier weakness.
"Nonetheless, prices have continued to rise significantly faster than incomes, and this has been associated with strong growth in investor activity," Dr Malcolm Edey, the RBA Assistant Governor (Financial System) advised in its submission.
Emphasising that the banks in Australia are resilient, and mortgage lending in this country has historically been relatively safe, he noted broader concerns with the "macroeconomic risks associated with excessive speculative activity, since this activity can amplify the property price cycle and increase risks to households."
He advised the RBA's discussions with the Australian Prudential Regulation Authority and other agencies on these matters are ongoing, but suggested it was “unlikely” to involve New Zealand-style loan-to-valuation caps.
The steps that might be taken to reinforce sound lending practices were "particularly for investor finance, though not necessarily limited to that,” he added.
The submission was made by Dr Edey and Luci Ellis, the RBA's Head of Financial Stability Department.
Their submission noted affordability measures will differ depending upon whether we are talking about owners or renters, and on whether we are interested in some specific market segment, like first home buyers or low-income households. 
"For owner-occupiers, perceptions of affordability will depend on many things including price, household income, the cost and availability of finance, and a host of factors affecting the needs and aspirations of the buyer," the submission said. 
"In any analysis it is necessary to make use of summary measures, while acknowledging that these inevitably gloss over the diversity of experience across different types of households.
"Much of the public discussion on affordability is focused on home purchasers.
"A useful summary measure is the repayment on a typical new housing loan expressed as a ratio to disposable income.
"On that metric, housing affordability in Australia has fluctuated around a broadly stable average over the past three decades, with average repayments varying between around 20% and 30% of disposable incomes.
"Currently this figure is a bit below average, but it has been rising, as the housing market has gathered momentum.
"Over the same 30-year period, the ratio of housing prices to incomes has increased substantially.
"These developments in prices and affordability have been inter related.
"Housing prices received a substantial boost from the combined effects of disinflation and financial deregulation, which lowered the cost and increased the availability of finance.
"Much of the increase in the price-to-income ratio was concentrated over the 10-year period to the end of 2003, when this ratio increased by around two-thirds.
"It is reasonable to think of this as a transitional impact on housing prices that will not re-occur.
"Both the shift to low inflation, and the comprehensive deregulation of the financial system, are things that only happen once.
"In broad terms, the adjustment of the housing market to this new environment seems to have been completed by around the middle of the last decade.
"Since then, the ratio of housing prices to incomes has been relatively stable but, for reasons already alluded to, it has been rising recently and is now at the upper end of its recent range."

The Reserve Bank of Australia has published data showing Australia’s household debt to disposable income ratio has risen to the highest since March 2008.
The amount of mortgage debt Australians have relative to their incomes sits higher than the debt-to-income ratio realised just prior to the onset of the global financial crisis.
Households and investors are utilising home loan rates as low as 4.6%.
The data comes against the backdrop where commentary has been suggesting the recent credit growth had been slow.
The Reserve Bank estimates that the housing debt across the country is 37% greater than total household incomes, up from 33% a year ago.
Even though households have taken on more risk, the RBA says households continue to pay down their mortgages more quickly than required.  “The aggregate mortgage buffer – balances in mortgage offset and redraw facilities – has risen to be around 15% of outstanding balances, which is equivalent to more than two years of scheduled repayments at current interest rates."

Comparison website Finder has put out a warning about high-risk home loans, after recording a jump in interest-only home loans and larger loans across the board.
In fact, 81% more Australians were searching for interest-only loans compared to the same period last year, Finder recorded.
Over a third of home loans financed since the March quarter to June quarter 2014 were interest only, at 35%. This is the highest level since the data was collected, according to Finder’s money expert Michelle Hutchison, and loans are now at a record high of $319,000.
This puts the average borrowing $24,000 higher than last year.
“It's a real concern to see borrowers taking on more risk because interest rates are at record lows and expected to rise next year, which means borrowers can find themselves in financial trouble if they take on more debt than they can afford,” said Hutchison.
“For instance, if interest rates rise back to historical average levels of 5%, it would cost borrowers with a $300,000 home loan an extra $400 per month or about $4,800 in one year.”

A new record low fixed rate offering is now available at Bankwest, through the broker channel, across two fixed mortgage products.
The two-year fixed rate is now at 4.59%, down 19 basis points, with the three year fixed rate at 4.74%, down 10 basis points, for both the Complete Fixed Home Loan and the Fixed Rate Home Loan.
Borrowers can obtain these rates up to 90% LVR.

Bankwest drops fixed rates to new record low

Capital appreciation often forms a large part of the return on an investment property. In general, investors are liable to pay tax on that capital gain.

The rules on when and how much tax applies are not straightforward, particularly when the investment property starts out as the owner’s primary residence, or becomes the owner’s home after having been rented out for a period of time.
“The fundamental principal is that a taxpayer’s main residence is exempt from CGT and that a taxpayer can only have one main residence,” says HLB Mann Judd director of tax Bill Nussbaum.
“Commonly, circumstances can change, especially when the main residence is also used for income producing purposes for certain periods of ownership. Such circumstances include absences from the property and renting out the property for the first time.”
Nussbaum prepared the following case study examples for Property Observer to illustrate the CGT outcomes in various situations. Each person’s circumstances are different and you should seek professional tax advice if you have questions on how CGT applies to your situation.
Primary residence becomes an investment property Absences &amp; the “Six Year Rule”
<ol start="2">
<li>The main residence home is rented out as the taxpayer is transferred to another city/overseas or decides to move to rented accommodation and keep the existing home. 
</li>
<li>Home therefore stops being a “main residence”. 
</li>
<li>The “Six Year Rule” allows the taxpayer to continue to treat the home as their main residence for a maximum period of six years (See Example 1) 
</li>
<li>If the taxpayer moves back into the property after having rented it out for some time and re-establishes it as the main residence, a further period of six years starts to run if the property is rented again in the future. 
</li>
<li>If the “Six Year Rule” is breached, as the property is rented for more than six years, then a partial exemption is applicable (See Example 2)</li>
</ol>
Special rules
<ol>
<li>In addition to the “Six Year Rule”, there is also a special rule for properties which first become income producing after August 20, 1996.</li>
</ol>
<ol start="2">
<li>The Special Rule relates to determining the cost base of the property. 
</li>
<li>The property is assumed for tax purposes to have been acquired at its market value when it was first rented out, rather than the actual purchase price.</li>
</ol>
Example 1: Dwelling first used to produce income – “Six Year Rule” On July 1, 1994 Bev paid $250,000 for a house that she used as her main residence until July 1, 2007, at which time its market value was $350,000. If Bev then rented the house until she sold it before July 1, 2013, she would still be able to claim a full CGT exemption by relying on the six-year extended exemption. She would not have to pay CGT on the sale proceeds.
Example 2: Dwelling first used to produce income – Breaching the “Six Year Rule” Following on from Example 1, if Bev continued to rent the house before selling it for $700,000 on July 1, 2014 (seven years after its first income use), she could only claim a partial exemption for CGT. In that case, the market value of the house at the time of its first income use ($350,000 on July 1, 2007) is used to determine the capital gain because the property first became income-producing after August 8, 1996. The capital gain in this case is $350,000 ($700,000 − $350,000 = $350,000). The taxable capital gain would be worked out (ignoring leap years) as follows:

Since Bev has held the property for more than 12 months, a 50% CGT discount would apply. She would have to pay CGT at her marginal tax rate on $25,000 (ie 50% of the $50,000 capital gain).
Investment property becomes a main residence
Only a partial main residence exemption is available if a property is initially rented out as an investment and then becomes the taxpayer’s main residence for part of the ownership period. If the residence is used as a rental property initially, the overall capital gain on eventual disposal is reduced via a pro rata apportionment by reference to the period the taxpayer used the property as their main residence, as explained in Example 3.
Example 3: Former investment property- now main residence
Lisa acquired a dwelling on October 19, 2008 which she let out to tenants until October 21, 2011. From that date she used the dwelling as her main residence. Lisa eventually sold the dwelling on September 7, 2013 and made a capital gain of $40,000, calculated without regard to the CGT exemption provisions. The capital gain is reduced pro rata by reference to the period Lisa used the dwelling as her main residence. The reduced capital gain is:

Capital gains tax explained, Part 3: Investment property appreciation

This is a continuation from Part 1: <a href="/expert-insights/finance/capital-gains-tax-explained-part-1-common-misconceptions">Common misconceptions around capital gains tax</a>.

“There are no death duties in Australia and a main residence property acquired from a deceased estate is generally not subject to CGT,” says HLB Mann Judd director of tax Bill Nussbaum. “However there are some important rules to consider to ensure the CGT exempt status is not lost.”

Pre-CGT Property 

Capital gains tax was introduced on September 20, 1985. Nussbaum says that if the deceased person acquired the main residence on or before September 19, 1985, the following rules apply:

<li>The property is CGT exempt if it is sold within two years of deceased’s death. 
	 </li>
	<li>It is still CGT exempt if sold after  two years, providing the following tests are met:
	<ul>
<li>The property was not used to produce income (rented out)</li>
		<li>It was the main residence of the person inheriting the property, for example the deceased’s spouse or an individual having a right of occupancy the property under the will.</li>
	</ul>

Post-CGT Property

If the deceased person bought their main residence after September 19, 1985, stricter tests apply to determine whether gains on the sale of the property will be subject to CGT.

All conditions noted above must be satisfied. In addition, the property must have been the deceased person’s main residence just before their death and not used to produce assessable income at that time.

Investment properties of the deceased

Generally, no CGT is payable on the transfer of a property to a beneficiary under a will. CGT will be applicable when the property is eventually sold by the beneficiary. The cost base is calculated as follows:

<li>For pre-CGT investments properties the cost base is calculated based on the market value of the property at the deceased date of death. </li>
	<li>For post-CGT investment properties the cost base is calculated based on the deceased’s original cost.</li>
	<li>The 50% CGT discount also applies to the sale of inherited properties that have been held for more than 12 months. </li>

Capital gains tax explained, Part 2: Deceased estates

Questions on capital gains tax on investment property were among the top five queries to financial advisers during this month’s Financial Planning Week, the Financial Planning Association says.
Australians’ love of residential property and the favourable tax treatment of investments in real estate mean capital gains tax is on many people’s radars, explained Stephan Strategic Certified Financial Planner, Joe Stephan.
“People are happy to reduce tax now through strategies such as negative gearing but eventually there will be a capital gain and there will be tax to pay,” said Stephan, who lectured on taxation at La Trobe University.
Capital gains tax (CGT) can be confusing, particularly if the property was purchased before September 21, 1999 when the rules were simplified.
There are variations in the way the tax is applied depending on the situation. For example, CGT paid on investments held inside superannuation is different from CGT paid on assets held by an individual.
“It’s also tied with timing,” Stephan says. “How long you hold an asset determines how much you pay.”
A common misconception about CGT is that it is charged at a flat rate. That’s not the case, said Stephan.
“The amount paid depends on your marginal tax rate and that depends on the income you generate,” he added.
This means it can be tax effective to time the disposal of an asset so that the sale goes through in a year when the person’s taxable income will be lower.
“Sometimes people like to wait until they are getting towards retirements and start taking an income stream from their private pension so they don’t have to pay any income tax. Then their capital gain is assessable at a lower tax rate,” Stephan said.
CGT was introduced in 1985, so the sale proceeds of properties that were bought before then are not subject to the tax.
The CGT discount was introduced on 21 September, 1999. This is a 50% discount that applies to the capital gain made on assets bought since that date if they have been held for more than one year, Stephan explained.
Most people understand there is no CGT to pay on the sale of the family home, said Stephan, but many people are confused by the special rules that apply to other properties, such as an inherited home.
“You don’t have to pay CGT on inherited property unless you sell it. The cost base might change and not be the purchase price but you don’t pay CGT until the property is sold,” Stephan said.
Different rules apply when people turn their home into a rental property or move into a property that was formerly an investment. Stephan warns that some mortgages do not allow the property to be converted into an investment. For simplicity, some people like to sell up and buy another similar property rather than converting the property’s use.

Capital gains tax explained, Part 1: Common misconceptions

The perennial debate about negative gearing of residential property investments has been reignited yet again, by two reports in the past week.
The International Monetary Fund has <a href="https://www.theaustralian.com.au/national-affairs/imf-calls-for-exemptions-to-be-stripped-from-the-gst/story-fn59niix-1227066994700">nominated taxes</a> on housing as ripe for reform in order to improve the efficiency of the tax system. And the Reserve Bank of Australia has <a href="https://www.rba.gov.au/publications/fsr/2014/sep/pdf/bus-house-fin.pdf">argued</a> that housing credit to investors has become excessive and is driving up house prices.
Although neither report specifically recommends changes to negative gearing rules, the mere suggestion that we look at housing taxation or lending for housing investment is enough to awaken the anti-negative gearing lobby.
Before we go on, a definition: negative gearing arises where the interest on money borrowed for investment in an income-earning asset is greater than the income earned from that asset. The asset is said to be negatively geared.
Investors are prepared to bear this income loss if they think the price of the asset will rise sufficiently to more than offset the income loss. What <a href="https://theconversation.com/explainer-why-negative-gearing-is-bad-policy-21882">upsets some people</a> is that the excess of interest over income is allowed to be deducted against income from other sources, such as wages or business income, for the purpose of calculating taxable income.
<a href="https://theconversation.com/its-time-to-abolish-negative-gearing-9879">Critics</a> see negative gearing as the source of all kinds of evils: it inflates house prices making housing unaffordable for first home buyers and inflates a house price bubble that will eventually burst causing wider economic problems; it is an unfair tax handout to the rich; and it bleeds the government’s budget which is all the worse in these times of stubborn budget deficits. And according to some critics there is no upside – negative gearing serves no useful purpose.
House price rises have other causes
Let’s take a look at these claims. House prices have risen by an average of about 10% per year in Sydney and somewhat less in Melbourne in the five years since the global financial crisis. But in the rest of Australia house price growth has not even kept pace with inflation at 2 to 3% annually.
Part of the growth in Sydney and Melbourne is due to investor demand since, as the RBA notes, housing credit growth is running at twice the rate for investors (about 10%) than for owner-occupiers. But even if we think house price growth in Sydney is a problem caused by excessive investment demand, negative gearing is not the prime culprit.
The rules around negative gearing have not changed significantly in Australia for at least 25 years, so it can’t explain house price growth over the past five years. Persistent record low interest rates over the past few years is the main driver, which the RBA <a href="https://www.rba.gov.au/publications/fsr/">acknowledges</a> has meant that loans remain affordable. In fact the ratio of interest payments to household income has actually fallen since 2009.
Sure, if we restricted the tax advantages of negative gearing we would dampen investor demand for housing which would slow house price growth in Sydney and everywhere else. But at what cost? It would be tougher to rent a property, hurting low income households.
Rental vacancy rates are already low in Sydney and Melbourne and in fact have fallen in the last couple of years. Critics <a href="https://www.macrobusiness.com.au/2014/09/hia-continues-negative-gearing-subterfuge/">refute</a> this argument. They say that the vast majority of investment demand is for existing properties rather than investments in new housing stock, which simply drives up house prices. True, but higher house prices make new housing construction profitable, which boosts the rental housing stock. So restricting negative gearing is a very inefficient way of tackling a perceived house price bubble – which in any case is restricted to Sydney and, as I’ve <a href="https://theconversation.com/memo-to-the-imf-there-is-no-housing-bubble-27925">argued</a> before, is not about to burst.
What about the fairness argument? The RBA <a href="https://www.rba.gov.au/publications/fsr/2014/sep/pdf/bus-house-fin.pdf">report</a> shows that negative gearing is by no means restricted to the rich. About half of all housing property investors have household incomes under A$100,000. Half of all household property investors are young – 30% are under age 40 and 60% are under age 50. Also, if we want to be fair we have to be consistent. This would mean tackling negative gearing on other income-earning assets such as company shares and business ownership. And we would have to explain why we would want to tax the interest income received by the lender but not allow the borrower to deduct the interest paid, which would amount to double taxation.
Consider the many alternatives
If we want to tackle fairness in the tax system, there are lower hanging fruit. For example we could bring the family home into the pension assets test, address tax avoidance through artificial structures such as discretionary trusts, and tax superannuation contributions at marginal tax rates (as long as we keep withdrawals tax-free).
The budget saving argument is also overstated. According to the <a href="https://www.ato.gov.au/uploadedFiles/Content/CR/Research_and_statistics/In_detail/Downloads/cor00345977_2011TAXSTATS.pdf">Australian Taxation Office</a>, the total losses on rental property in 2011/12 were A$6.8 billion. Applying an average marginal tax rate of, say, 35%, this amounts to A$2.4 billion in tax revenue forgone, or 0.6% of total tax revenue in 2012. However we would save much less than this if we were to abolish entirely negative gearing for rental property because investors would switch to other investments and other ways of minimising tax.
We need to be clear about what problem we are trying to fix and consider whether there are better ways of doing it.<img src="https://counter.theconversation.edu.au/content/32014/count.gif" alt="The Conversation" width="1" height="1">
