Two bedroom $60,000 West Gladstone unit mortgagee sale

Century 21 Australia Pty Ltd has been ordered to pay more than $109,000 in compensation, plus $28,000 in interest, after the misappropriation of trust account funds by an estate agent with which it was in a franchise agreement.
Century 21 Australia Pty Ltd (ACN: 003 145 346) was ordered to pay the funds into the Victorian Property Fund (VPF), after the misappropriation of trust accounts by an estate agent.
The actions of Victorian Realty Group Pty Ltd (ACN: 135 903 374), trading as Century 21 Complete Properties, caused 13 clients to lose money.
The company was deregistered in 2013.
Those clients received compensation from the VPF. 
In 2016, the Secretary to the Department of Justice and Regulation (of which Consumer Affairs Victoria is a business unit) took action in the Supreme Court of Victoria against Century 21 Australia to recover those funds and return them to the VPF. 
Under the Estate Agents Act 1980 (the Act) each party to a franchise agreement (that is, the franchisee or franchisor) is liable for any misappropriation by an estate agent subject to the agreement. 
The original case was dismissed, as the court found that the agreement between Century 21 Australia and VRG did not constitute a franchise agreement. 
The Secretary appealed that decision, and the Court of Appeal found that the agreement between the two parties was a franchise agreement.
As such, Century 21 was liable for VRG's defalcations, in accordance with the Act.
Real estate agents Kon Balasis and Victorian Realty Group Pty Ltd (VRG), operating as Century 21 Craigieburn, were permanently disqualified from holding estate agents’ licences after breaking the law on trust accounts.
At a hearing on 1 October, 2012, the Victorian Civil and Administrative Tribunal (VCAT) found that VRG and Mr Balasis breached the Estate Agents Act 1980 in relation to:
<ul>
<li>a deficiency in the Century 21 Craigieburn trust account of $166,935.27 on 27 March, 2012, regarding deposits paid on six property sales  </li>
<li>VRG holding deposits as a stakeholder pending completion of transactions and not retaining that money in its trust account until paid to the persons entitled.</li>
<li>VRG fraudulently omitting to pay about $177,000 to the persons entitled to that money, which money was being held by VRG as a stakeholder pending completion of sales of land. Mr Balasis at the time was an officer of VRG and he knowingly authorised these contraventions</li>
<li>VRG not keeping full and accurate accounting records so as to show the true position of all moneys it received.</li>
</ul>
VCAT also found that VRG breached the Sale of Land Act 1962 in that:
<ul>
<li>it received deposit moneys in the course of transactions for the sale of land and did not hold that money as stakeholder until the purchasers became entitled to those deposits.</li>
</ul>
The tribunal ruled that Mr Balasis was guilty of conduct as an estate agent that rendered him unfit to hold a licence and he was not of good character or otherwise a fit and proper person to hold an estate agent’s licence.
VCAT cancelled Mr Balasis’ licence and permanently disqualified VRG and Mr Balasis from holding a licence.

Craigieburn estate agent misappropriation triggers $109,000 compensation order against Century 21 Australia

Sydney based national wedding dress retailer, The Sposa Group, has set up shop in Melbourne’s eastern suburbs having agreed terms on the lease of a retail building on Glenferrie Road in the heart of Hawthorn’s popular retail precinct.
Located within walking distance of Glenferrie Railway Station and Swinburne University, the 622-624 Glenferrie Road property comprises a single level 170 square metre retail/showroom space with 11 metres frontage and rear access to on-site parking.
According to Teska Carson’s Tom Maule, who brokered the deal, the property was leased on a three year term at $110,000 per annum net or $650 a square metre.
He said the tenant had sought a property in a strongly performing retail precinct within Melbourne’s coveted inner east and with the benefit of extensive main street exposure.
"This is a prime address for fashion retailing and one which has attracted numerous national retailers including Fonda, Huxtaburger, Coles, Chemist Warehouse, Woolworths and a wide variety of specialty retailers.
"The property benefits from excellent exposure to one of Melbourne’s wealthier suburbs with very good transport access and strong growth prospects,’’ Mr Maule said.
The lessor was a private investor.

The Sposa Group takes Glenferrie Road lease

CBD markets for capital cities, bar Sydney and Melbourne, are seeing improving rental conditions though their growth rates are low compared to the two biggest cities, according to Colliers International’s CBD Office research and forecast report.
Sydney and Melbourne have benefitted from a “hold on supply” and consistently strong demand, pushing office rents higher and higher. 
Over the year to June 2017, prime grade face rents grew by 7.8 per cent in Sydney, and 14 per cent in Melbourne. 
Population growth in New South Wales and Victoria has been the key catalyst in the market’s “perfect storm” conditions, with migration figures well above their 10-year averages in both states fuelling strong white collar job creation – but the Colliers report revealed that office supply will be constrained during this time of strong demand.
Colliers International’s national director of Research, Anneke Thompson, said office supply for the next 12 months was “even more ominous”.
“We’re forecasting the Sydney CBD office market to contract by 50,000 sqm throughout the year to July 2018, and the Melbourne CBD to reduce by circa 5,000 sqm, based on the supply that we know will enter the market and forecast withdrawals,” she said.
The story is not as bright for other capital cities.
Brisbane appears to be in recovery mode, with a solid level of premium and A-grade office leasing deals completed throughout the first half of 2017, Colliers noted.
In line with this comeback, the vacancy rate is forecast to decline to 13-14 per cent by January 2019.
A major development was QSuper signing a heads of agreement with Shayher Group to negotiate a lease for its 300 George Street office building, which is due for completion mid-2019.
In Adelaide, vacancy is starting to fall with the market recording its highest net absorption figures since January 2014.
Net absorption in the six months to July was 4,624 sqm, while the annual figure was 6,016 sqm.
This has seen vacancy fall ever so slightly to 16.1 per cent, down from 16.2 per cent in January 2017, said Colliers.
The small decline can be partially attributed to the remainder of the recently refurbished 1 King William Street being added back into supply.
Meanwhile, Perth CBD is also seeing some stability in the office leasing market, with vacancy falling to 21.1 per cent.
Net absorption is being driven by tenants’ flight to quality and new investment spend into increasing Western Australia’s output capacity of iron ore.

The start of demolition at 137 Old Burleigh Road signals DVB Projects’ underlying confidence in the Gold Coast’s luxury beachside apartment sector.

DVB Projects to launch second Broadbeach apartment tower as demolition commences

A proposal to redevelop one of North Sydney's ageing commercial buildings has taken another step forward, with plans for a 38-storey mixed-use tower adding momentum to the long-awaited transformation of the Alfred Street precinct.

Now on public exhibition through the NSW Government's Housing Delivery Authority-led State Significant Development pathway, the proposal for 271-273 Alfred Street would replace an underutilised commercial building with 95 apartments, ground-floor retail, commercial space and affordable housing. The proposal was submitted by&nbsp;Tara Shore Pty Ltd, acting for the John Taylor Family Trust.

While the project will deliver much-needed housing on the southern edge of the North Sydney CBD, it also represents another piece of a broader precinct that has spent years in planning limbo.

Despite its proximity to both North Sydney Station and the Victoria Cross Metro, redevelopment of Alfred Street has progressed slowly over the past decade as broader planning controls, zoning and building heights remained unresolved. The introduction of the Housing Delivery Authority pathway has provided a new avenue for projects to progress, allowing rezoning and development assessment to occur concurrently and unlocking sites that have long been earmarked for renewal.

Designed by Office of Cortese &amp; Gilder, the proposal seeks to do more than replace an ageing office building. The architects have positioned the project as the first stage of a wider public domain vision that would improve pedestrian connectivity and create a more cohesive mixed-use precinct as neighbouring sites are redeveloped over time.

The proposal includes a widened Alfred Street setback, new street trees, landscaping and outdoor seating, along with a landscaped through-site pedestrian link connecting Alfred Street with Little Alfred Street. The connection is intended to become the first section of a future east-west pedestrian network extending across the precinct.

The mixed-use tower would comprise retail space at ground level, commercial uses on level two and apartments from level three upwards.

In total, the development would deliver 95 apartments, including nine one-bedroom, 28 two-bedroom, 56 three-bedroom and two four-bedroom residences. Twenty-one apartments, representing 15 per cent of the residential gross floor area, would be secured as affordable housing and managed by a registered community housing provider for at least 15 years.

Nine basement levels would provide 133 resident car spaces, seven motorcycle spaces and 111 bicycle spaces.

According to the Architecture and Urban Design Report, the public domain strategy is designed to transform what is currently an inward-facing commercial edge into a more active and connected pedestrian environment, creating a stronger relationship between the commercial core and surrounding residential neighbourhoods.

Office of Cortese &amp; Gilder has also prepared a broader public domain framework spanning neighbouring properties between 263 and 283 Alfred Street, arguing that a coordinated approach to redevelopment will deliver better public spaces, improved tower separation and a more connected streetscape as the precinct evolves.

The proposal comes at a time where North Sydney is slated for future residential growth. Commercial developer FiveX has residential plans for the neighbouring site at 275 Alfred Street. The $210 million project by Vitale Property Group has now secured more than $70 million in sales, led by residences that changed hands for $12.75 million and $11.75 million.

The record-breaking transactions reinforce the shift occurring in Byron Bay's premium property market, where affluent downsizers and lifestyle buyers are increasingly opting for high-end apartments over large beachfront homes.
