Half of Aussie mortgagors don’t have a will – but where does that leave your assets?

The <a href="/expert-insights/buying/how-will-the-coronavirus-impact-australia-s-property-market">corona virus crisis</a> has had a devastating impact on many livelihoods, resulting in thousands of job losses, record unemployment, and great uncertainty for would-be first home buyers in terms of their ability to obtain and service a home loan.

The crisis has also severely impacted property sellers who have had to endure a period of months during which social distancing rules restricted the ability to hold in-person open house inspections and conduct sales auctions, with the result that many sellers have been forced to postpone the sale of their property. On the other hand, those sellers who were not subject to time pressures have simply withheld their property from the market to avoid the prospect of it languishing there for months without enquiries from interested buyers – or worse, being perceived as a desperate seller and only attracting “low-ball” offers.

On the flipside of all this doom and gloom, the pandemic has also coincided with the lowest home loan interest rates in living memory, which have been predicted to remain with us for the next few years. That fact, coupled with new incentives being proposed by the government to assist first home buyers in particular, has encouraged many people who may not have sufficient resources of their own to be able to obtain a loan from a bank to look to the “bank of mum and dad” for assistance, especially in terms of helping out with getting the essential deposit for the purchase. In some cases the solution has been for the purchaser’s parents to even become a part owner in the new property.

Whilst these strategies may have enabled many first home buyers to get into the <a href="/expert-insights/buying/4-reasons-to-have-faith-in-australia-s-property-market-for-the-long-run">property market </a>and perhaps take advantage of both record low interest rates as well as the odd real estate bargain where a seller was indeed forced to sell at less than fair market value, there are some traps for first home buyers (and their parents) in these arrangements that need to be considered carefully to avoid future discord, such as:

Making a gift or a loan?

Often the home buyer has the ability to service a loan, but can’t scrape together enough funds for the initial deposit. In these circumstances often their parents are called upon to assist with a cash contribution.

In many cases the bank will want to see this parental contribution styled as a gift, so that the bank does not need to be concerned about taking into account the impact on borrowing capacity of this additional loan commitment (and also to ensure that the bank maintains first preference in terms of any security obtained for their lending).

However, if the amount is significant, irrespective of how the contribution is treated as far as the bank is concerned, it would be much preferable for the parents if the contribution was treated as a loan as between themselves and their child for the following reasons:

<ul>
<li>As a loan, it means that it can if necessary be paid back to the parents. Whilst the parents may believe that they do not need the loan to be repaid, as they get older they may find that their health is deteriorating and they need to access funds to pay for emergency surgery or other ongoing increased medical needs such as going into aged care or hiring a nurse for at home care. Whilst it is important to help out your family members when you can, you cannot ignore the possibility that unforeseen health and medical circumstances may mean that you need the return of the funds more than your child needs them.</li>
	<li>Whether or not the loan is ultimately repaid, it is also a clear reminder of how much the parent has provided in support to their child, and can be taken into account in the parent’s estate planning after they die - and if it is never repaid at least it can be netted off against that child’s share of their parent’s estate.</li>
	<li>Often the loan is made on the basis of being interest free and repayable on demand. However, whilst the issue of payment of interest is entirely up to the parent, by making the loan repayable on demand the 6 year period under the relevant statute of limitations begins to run from the date of the loan, so that unless the loan is in some way acknowledged by the borrower during that period it will become unenforceable after that period expires. A better approach would be to specify a number of years as the loan term, which may be subject to early repayment and any specified events of default (like a bank loan) that may trigger earlier repayment.</li>
</ul>
Lending to a couple

Often the borrower child is in a legal or de facto relationship with another person. If so, another reason why it may be <a href="/guides/how-to-secure-a-mortgage-free-lifestyle-sooner">desirable for the loan</a> to be repayable is that in the event that the relationship breaks down, the parent would wish to exclude the amount of the loan from any settlement between the child and their former partner. If so, the following points should be observed:

<ul>
<li>The loan should be secured against the home, ideally by a registered mortgage;</li>
	<li>If the property is to be purchased in both names of the couple, then the loan should also be made to the couple to ensure that the child’s partner is also primarily responsible for repayment (including on the untimely death of the child) – if the child’s partner resists, it needs to be pointed out that this is a condition of the loan being made at all in the first place;</li>
	<li>The loan should be made on ordinary commercial terms (like a bank loan), although it is up to the parent whether they wish to require the payment of interest. However, if interest is specified to be repayable only upon repayment of the loan, and one of the events that may trigger early repayment is a relationship breakdown, it may enable some portion of any increase in the value of the home itself to be recovered by way of the payment of interest.</li>
</ul>
Consequences of parental co-ownership

In some cases it may be decided that the parent should become a co-owner with the child, where the proportion of ownership by the parents correlates with the proportion that their financial contribution represents of the total purchase price.

This strategy has the advantage that the loan amount is automatically secured by reason of the co-ownership of the property by the parent. However, some consequences need to be borne in mind:

<ul>
<li>Capital gains tax may be payable by the parent on any capital gain made in relation to the sale of their <a href="/guides/5-key-tips-to-buying-an-off-market-property">share of the property</a>, unless they also live in the property as their own principal place of residence;</li>
	<li>Land tax may be payable by the parent in respect their share of the property, unless they also live in the property as their own principal place of residence;</li>
	<li>If the parent dies, their share of the property becomes part of their deceased estate, and may be subject to the terms of their Will. In this situation it would be important for the parent to make a specific provision regarding their co-ownership share of the property in their Will, such as leaving their interest in the property to their child (or to the child and their partner, as the case may be).</li>
</ul>
Going guarantor

Another popular method of a parent providing financial assistance for a child buying their first home is to agree to be a guarantor for the loan. The main advantage of this approach is that it does not require any upfront cash payment by the parent. However, it is absolutely fraught with danger for the parent, particularly if the parent has to provide security for their guarantee (such as by a registered mortgage over their own separate real estate). In these cases it is not unheard of for the failure of the child to make their loan repayments to result in the loss of not only their own home but also that of their parents!

If agreeing to be a guarantor for their child is the only option that will enable the child to obtain a bank loan, then at the very least it should be agreed with the bank to limit the amount of exposure of the parent under the guarantee – for instance, if the reason for requiring the guarantee is that the child could not come up with a 10% deposit, then the amount secured by the guarantee should be limited to the dollar amount representing that deposit.

Conclusion

The “bank of mum and dad” is these days an important resource for many first home buyers to get their foot in the door of the property market. Whilst that can be a sensible strategy in these trying times, the traps for the unwary must be borne in mind and guarded against wherever possible.

The Traps for First Home Buyers Borrowing from their Parents

I wanted to discuss how residential developments have put in place hotel operational models into these types of buildings and how you can look at alternatives within your own development strategies for an exit, greater flexibility, and/or return.  The idea of a residential developer to look to include a hotel operation within its scope is for these reasons and also varies. 

Typically the developer will allow a mixed-use to accommodate various solutions. One is a “turn key” solution which is the sale of the hotel component as a single line, this allows a reduced percentage of pre-sales required on the remaining residential apartments to seek construction debt funding. However not <a href="/news/hotels-hotels-hotels-why-so-many-new-hotels">all hotel operators</a> like to buy freehold, therefore the other options are to treat this stock as investment stock and take the strata units to the market with a guaranteed return, thus allowing the operator to have a lease in place. 
You may still sell as a single line entry to a freehold investor or typically in these arrangements individual passive investors. In return, the operator is managing a number of landlords vs one. 

A Developer likes to take to the market a guaranteed return and in addition a brand that has loyalty in the marketplace for the success of pre-sales for such stock. A great marketing strategy.  Most new developments provide a lifestyle product that reflects the DNA of a hotel and vice versa “a home away from home”, so there is a natural fit for the residential and hotel operations to co-exist. New developments are also providing concierge services and only make sense having a strong reputable operator to deliver on these services for not only hotel guests but residential owner-occupiers. 

Another option is providing a structure under management rights, the investor of the apartments in these buildings gets the income of the short term letting and in return, the Hotel Operator receives a management fee income. This is a higher return for the investor if appropriately appointing the right operator, a risk-reward option, and also depends on the investor risk profile if this is best suited (hence the lease option as an alternative).   By setting management rights this way generally only works in large residential complexes to cater enough into the rental pool for short term letting to make the hotel operation profitable. The ideal number is 80 rooms. 

The lease and freehold options depend on the product type and its market so this can vary in terms of how many rooms is necessary. It is crucial that the developer prior to going to the market assures and does the appropriate campaign to obtain the right operator that performs, has a loyal brand, strong reputation and has a natural fit for the product that they are branding themselves to whom their buyer is. <a href="/developers">As a developer</a>, there are many benefits in terms of brand, value proposition, and some comfort when trying to get the residential development out of the ground. It is always necessary to carry out your feasibility to ensure the demographic precinct caters towards the short term letting that in turn will meet the investment demand and appetite.

Hotel Operations in a Residential Development - benefits for the developer.

Living in a luxury apartment with all the <a href="/buildings/sapphire-by-the-gardens-63-la-trobe-street-melbourne-vic-3000">amenities</a> is an absolute pleasure. You get the full use of a <a href="/buildings/hawthorn-park-33-camberwell-road-hawthorn-east">resort style pool </a>and lounge without having to worry about cleaning the pool filter every day. There is the barely used gym with brand new, five-star equipment that is always clean and fresh. All gardens and common areas are maintained by discreet gardeners whom you never see. And of course, let us not forget the wine room with a 15-seater table and individual wine fridge for each apartment owner to store that chardonnay they picked up while on holiday.  

Apartment complexes such as these have become far more common and whilst there are hefty strata fees, this has done little to dissuade purchasers. It is not unreasonable to expect owners to pay well into the thousands per quarter, depending upon their unit entitlement. Both owner occupier and investors has been quick to see the appeal of high-end amenities. 

However, we have noticed a trend that sees buyers being deterred by high strata levies, especially if they are worried about cash flow. This is often the case with downsizers who are asset rich but cash poor. It is also the case that some purchasers feel they will not use the amenities so therefore do not wish to pay high levies for services they will not utilise. 

Developers have been quick to recognise this shift in the buying trend and are creating schemes to cater for this <a href="/expert-insights/8-of-nsws-top-luxury-apartments">particular buyer demographic</a>. Ensuring that they purchase lots that are close to upmarket shopping strips, cafes, pools, beaches and gyms, they are providing these amenities in easy walking distance to potential residents. 

The communal areas that have been provided are being exceptionally well received by this type of buyer. <a href="/news/martin-brothers-sees-the-rooftop-amenities-area-take-precedence-across-brisbane">Rooftop terraces</a> with open lounge areas for all residents and their guests to enjoy are perfectly sufficient. Often these areas are accompanied by BBQ’s and kitchen facilities to be used by guests. Whilst there will always be a market that likes the extra amenities that larger developments offer, developers should not discount purchasers who will be attracted to a property with lower strata costs and simple, communal amenities.

Let’s get real about strata levies

Introduction

We recently considered the restrictions that are placed on the powers of an owners corporation during the initial period of a strata scheme. Those restrictions exist to reduce the scope for a developer who controls an owners corporation to make decisions during the initial period that are not in the interest of the owners corporation. But what happens when those initial period restrictions are breached by a developer? What are the consequences for a developer? In this article we take a closer look at that issue.

The Initial Period 

The initial period of a strata scheme <a href="/guides/how-to-make-strata-fees-work-in-your-favour">commences when the strata plan</a> is registered and ends when the developer has sold lots whose unit entitlements are at least one third of the aggregate unit entitlement. Typically, during the initial period, the developer controls the owners corporation and the decisions that are made by the owners corporation because the developer owns the majority of the lots during the initial period. Over time, some developers have abused their powers during the initial period and have made decisions that are not in the interest of the owners' corporations that they control. In many cases, those decisions have involved the approval of building management or caretaker agreements that run for many years and that are on commercial terms that favour the building manager or caretaker.

Initial Period Restrictions

As a result of a perceived abuse of power by developers during the initial period, the strata legislation was amended to introduce restrictions on the powers of an owners corporation whilst it is under the control of a developer during the initial period. Some of those restrictions are now found in section 26 of the Strata Schemes Management Act 2015. One of those restrictions prevents an owners corporation from incurring debt for an amount that exceeds the amounts that are available for repayment of the debt from its administrative fund or its capital works fund. What does that restriction mean? And when can it be used against a developer? Those questions were considered in a case involving “The Carlisle”.

The Bondlake Case

“<a href="/buildings/the-carlisle-33-37-carlisle-street-rose-bay">The Carlisle</a>” is a strata building containing 139 apartments situated at 105-113 Campbell Street, Surry Hills. The strata plan for the building was registered in 1999. A little over one week after the strata plan was registered, the developer convened and held an extraordinary general meeting of the owners corporation. At the time of the meeting, the developer was still the owner of all of the lots in the building. At the meeting, the owners corporation passed a resolution to enter into a caretaker agreement for the appointment of a caretaker for a period of five years with three options for renewal each for five years. The caretaker agreement was signed on the day of the meeting.

A Breach of the Initial Period Restriction

The agreement required the caretaker to carry out specified duties for the owners corporation in return for a payment of a fee. The fee for the first year of the agreement was $84,042.00. The fee was payable by monthly installments the first of which was due on the date the agreement started. At the time the agreement started, there was no money in the administrative fund or the capital works fund of the owners corporation. Three days later the caretaker issued an invoice claiming payment of the first monthly caretaker fee.

The Owners Corporation’s Claim

The owners corporation claimed that the caretaker agreement had been entered into in breach of the initial period restriction which prevented the owners corporation from incurring a debt for an amount that exceeded the amount then available for repayment of the debt from its administrative fund or capital works fund. The owners corporation claimed that the breach of the initial period restriction meant that the caretaker agreement was invalid and null and void.

Was the Agreement Null and Void?

The <a href="/new-apartments/rose-bay-nsw-2029">NSW</a> Court of Appeal agreed that there had been a breach of the initial period restriction because the court held that the owners corporation incurred a debt by entering into the caretaker agreement and became liable to pay the first monthly caretaker’s fee when the caretaker issued its first invoice and at that time the owners corporation had no money in its administrative fund or capital works funds. However, the court did not agree that this resulted in the caretaker agreement being null and void. The court said that the strata legislation did not intend that an agreement that was entered into by an owners corporation in breach of the initial period restriction would be rendered null and void. The court did not consider that it would be fair to visit upon innocent persons dealing with the owners corporation, such as the caretaker, the extreme consequence of invalidating their agreement and making it impossible for the innocent party to recover fees claimed under the agreement. This meant that the caretaker agreement would continue even though it was entered into in breach of the initial period restriction. 

Consequences for the Developer

One of the reasons the court concluded that the caretaker agreement was valid is because the strata legislation provided the owners corporation with remedies against the developer. For example, the legislation gives an owners corporation the right to recover <a href="/developers">from a developer</a> any amount for which it is liable because of a breach of the initial period restriction on incurring a debt. In other words, the owners corporation of “The Carlisle” could have sued and recovered from the developer the fees it was liable to pay the caretaker under the caretaker agreement. Section 26 of the Strata Schemes Management Act 2015 still gives an owners corporation the right to sue and recover from a developer any amount for which it is liable because of a contravention of the initial period restriction on incurring a debt. A developer who is sued under that section is given limited protection by the legislation. The developer can gain protection if the developer can show that he or she did not know that the initial period restriction had been breached or was not in a position to influence the conduct of the owners corporation in relation to that breach or used due diligence to prevent the breach.

Conclusion

The purpose of the initial period restrictions is to protect the people who become owners in a strata scheme after the end of the initial period from burdensome arrangements entered into by the developer before the owners corporation comes under the control of the owners. A breach of those initial period restrictions by a developer can have dire financial consequences. For that reason, it is important for any developer to be familiar with the initial period restrictions that apply to an owners corporation and to be careful not the breach of those restrictions.

The Property Industry has been the Achilles heel of the Australian economy since the 1800’s, <a href="/developments">Australian property</a> prices grew on average 0.5% per year from 1890 to 1990 after inflation and for the vast majority of Australians, purchasing a property will be their largest investment in their lives.

So here lies the question, why since 1851 has the government introduced so many new tax laws, so many changes and you simply require being an accountant, a tax expert and property lawyer rolled into one to make any sense of all these changes. 

We all enjoyed listening to Kerry Packer famous quote, when he was questioned for trying to evade tax.

“I pay whatever tax I am required to pay under the law, not a penny more, not a penny less... if anybody in this country doesn't minimize their tax they want their heads read because as a government I can tell you you're not spending it that well that we should be donating extra.”

For the average Australian, this simply causes greater confusion and for any foreign investor, the tangled web makes; doing business in Australia too difficult.   They simply look to invest in other countries such as America, Canada and the UK, as the top three countries Australia competes with on the Global Property Investment footprint.

From 1990 to 2017 property prices grew far greater than 0.5% per year, due to vast population growth was the reason for pushing property prices higher than we had paid for in the years previous.  Also relaxing credit guidelines, allowed for borrows to purchase properties with a 10% deposit. The Productivity Commission Inquiry Report No. 28 First Home Ownership (2004)

"That Growth in immigration since the mid-1990s has been an important contributor to underlying demand, particularly in Sydney and Melbourne.”  

Projections for population growth <a href="/developments/melbourne-vic">in Victoria,</a> was to exceed <a href="https://blog.id.com.au/2014/population/demographic-trends/how-urbanised-is-australias-population/">10 million people</a> by 2051. 
House prices rose by an average of <a href="/developments/sydney-nsw">64% in Sydney</a> and Melbourne in the decade from 2004 to 2014. At the same time foreign investment proposals in developed real estate rose by almost tenfold.

The numbers are hard to find and a little rubbery, but our best econometric estimate is that about one-quarter of the growth in house prices in Sydney and Melbourne can be attributed to foreign investment.

If the foreign investment had been steady over the period, average house prices would have grown by about 50% compared with the actual growth of 67%.  The hype about Chinese buyers driving up house prices appears to be overstated – at least in terms of the effect on average house prices – there may have been more significant effects in certain locations.  The Parliamentary Inquiry essentially came to this conclusion. It found that there is no accurate data on foreign investment in Australian real estate and therefore “no-one really knows how much foreign investment there is in residential real estate”.

Why did Melbourne, Australia attract so such a spike in population?

The Australian economy expanded by 1.9% in chain volume terms in 2018-19, the 28th consecutive year of economic growth.  The easing growth in household consumption was driven by discretionary spending, which declined from 3.3% in 2017-18 to 1.4% in 2018-19. Purchase of vehicles fell for the first time since 2008-09, while spending on hotels, cafes and restaurants (1.6%) and furnishings and household equipment (1.1%) were subdued.

Future threats to the sector include a forecast substantial undersupply of dwellings entering the market in FY19/20 and FY20/21, weak purchasing power due to low wage growth, a reduction in the availability of finance for purchasers and the significant retreat of investors from both the greenfield and apartment markets 
State and Local Governments need to continue delivering planning and development approvals and essential infrastructure to ensure they are available to meet real demand and to enable the development industry to deliver a robust pipeline of new housing, jobs and economic value for Victoria.

The Government have first-hand crippled high density to medium dwellings around our major suburbs.  The very people, who contribute approx. 10% of total GDP to the economy, are the ones that are penalised the harshest, without any reprieve.

The softest growth in household loan liabilities in over 25 years

The value of land and dwellings held by households was 2.9 times the value of household borrowing in 2018-19, decreasing from 3.1 in 2017-18. The value of land and dwellings owned by households fell 3.8% (-$265.1 billion) to $6,687 billion, the first decrease since 2011-12, reflecting the declining residential property prices throughout the year. This was driven by falls in the value of land (-$326.0 billion), while the growth rate of the value of dwellings (3.1%) was the softest since 2011-12. The tighter lending environment and the weak housing market in 2018-19 also impacted the demand for loans by households. Household loan liabilities grew 3.8% ($85.7 billion), the softest growth rate since 1991-92.

The Federal government has done a great job to provide financial stimulus support for businesses and the unemployed.  The major financial institutions have been wonderful in providing mortgage relief for property owners.  

This would be the opportune time to provide stronger incentives targeting ‘Property Investors’ to prevent the brute <a href="/guides/how-to-navigate-buying-property-during-the-covid-19-crisis">force of Covid-19</a>: sweeping through the economy that upheld this nation, the property industry.

Here are my personal suggestions.

<li>- Only $5,000; Stamp Duty payable for any new dwelling purchased off the plan for Australian Residents as owner occupiers and investors.</li>
	<li>- 50% off all land tax, as the ratio to rates payable is disproportionate</li>
	<li>- Maximum of 20% income tax, from Rental Income on all properties</li>
	<li>- Foreign Buyers, to pay 5.5% of the dutiable land value, on all new dwellings </li>
	<li>-  FIRB approval on Property to be 40 days.</li>
	<li>-  On established dwelling Foreign Buyers pay 5.5% of the sale contract price.</li>
	<li>- Deposits paid to purchase investment properties are 100% tax deductable.</li>
	<li>-  Capital Gains Tax, to be exempted for all properties purchased prior to 1999.</li>
</ul>
The economy requires urgent stimulation; we cannot lower interest rates any further.

We need to act swiftly, responsibly, and proactively today, to avoid a catastrophic disaster.  Let’s make doing business in this great country easier.

The flexible ventilation of the ground floor allows 24 hour accessibility to pedestrians and cyclists, further improving upon the vibrant streetscape and its engagement to people. The building’s design caters to a new generation of consumers who yearn for interactive, connected and collaborative environments that reflect their authentic passions and tastes.

<figcaption>Rendering of Fender Katsalidis’ Merdeka PNB118, Kuala Lumpur, Malaysia.</figcaption></figure>Australian architecture firm Fender Katsalidis has designed the upcoming Merdeka PNB118 skyscraper in Kuala Lumpur, standing at 644 metres tall with 118 floors of office, hotel, topped by an observation deck and restaurant. 
The crystalline tower will be the centrepiece of Kuala Lumpur’s Merdeka site, where Malaysian independence was declared in 1957. 
The tower’s design is an expression of its structural pathways, resulting in geometric patterns in the facade which are reminiscent of traditional Malaysian arts and crafts.

Cementing itself as one of the World’s top 10 tallest buildings when completed, the design of the tower is influenced through Fender’s <a href="/news/urban-com-au-profiles-10-of-melbourne-s-top-luxury-apartments">Eureka Tower</a> and how its design form represents a piece of Victorian history. The Malaysian capital wanted a landmark tower that represents in form its cultural history and significance in this same way. The project will preserve two heritage buildings on the site including the Merdeka Stadium and Negara National Stadium.

The podium interior has a soaring, dramatic atrium fit with stone surfaces which will include the lower lobby access at one end and office and retail lobby access at another. 
The retail component will offer over 300 stores of upmarket to high end clothing. 
The project in collaboration with local architect, RSP Architects and landscape architects Sasaki Associates has an expected completion in 2020.

 

CAPITAMALL 1818, WUHAN - <a href="/architects/the-buchan-group">BUCHAN GROUP</a>

Located along the prosperous Zhongshan, the high end mall features 8 levels of retail, entertainment and dining and is one of seven CapitaLand developments in the city.

It was important that through this revitalisation of the downtown mall, that all 10 million of Wuhan’s residents feel represented with a design reflecting the vast cultural catchment with a rich past, whilst still responding to the innovative retail future and its trends.

The podium creates a vibrant streetscape amongst the integrated office and residential mixed use precinct and ensures that the buildings perform a civic function, providing a meeting place and community engagement for locals. 
The responsibility to respect Wuhan’s deep cultural history was felt by the Buchan Group as well as the need to embrace a modern urban community with aspirations to adapt to recent retail trends.

 

NATIONAL MARITIME MUSEUM OF CHINA, TIANJIN - <a href="/architects/cox-architecture">COX ARCHITECTURE</a>

Rendering by coxarchitecture.com</figcaption></figure>The Binhai New Area is an important economic zone as Tianjin expands as an important international port, with over 2000 high tech companies developed in the area and urban residential spaces built upon reclaimed land. 
The National Maritime Museum of China by Cox Architecture whose design won the international competition for China’s first maritime museum, sits in the Binhai New Area of Tianjin. The Museum covers 150,000 square metres of space and includes three levels, a large exhibition hall and an observation tower which also acts as the Museum’s energy plant.

One of the main details of importance for the new museum was its connection and relation to the water as much of Chinese cities developed out of the canals or by the water’s edge. 
Not much is known of the country’s Maritime past, so for Cox Architecture, designing a space of such importance had to reflect a strong identity.

As the Chinese Government collected elements to fill the Museum, the designs of the structure had to evolve and adapt to their findings. Cox Architecture needed to provide a space to raise public awareness and develop into an educational base for scientific research and environmental protection.

Opened in 2019, the National Maritime Museum of China will be free for visitors and include six divided sections with an enriched array of themes arranging from Culture and History, Marine Ecology and Environment, Science Education and interactive programs as well as shopping, restaurants, cafes, cinema and gardens surrounding and connecting to the waterfront.

Linking the city to the waterfront via pedestrian access was key to the design of the centre. 
Designed as a hybrid facility, the building comprises of exhibition and convention spaces which are flexible to host a large variety of events and simultaneous meetings. 
The enclosed roof utilises an alternating shell structural system to which substantially reduces steel tonnage and successfully resists the strong harbour winds and seismic forces. 
Skylights allow the building to respond to its natural environment with the ability to fill the spaces with light and ventilation which improves the overall sustainability.  
It was important to Cox Architecture to design a structure that responds to its surroundings and is an expression of the Taiwanese people and was a conscious and thoughtful process.

In this article, we’re going to explore why undertaking a dual occupancy is a great idea. Why a Dual Occupancy Project?

There are several reasons why this sort of development is a wise choice for those looking to invest in property.

You mostly have two options here. You can choose what is known as a volume builder, or an independent. A volume builder is your big players. These vary from state to state, but they have billboards, a branded fleet, ads on TV, and rely on churning through builds for their revenue.

The other option is an independent builder. These are smaller companies who usually do just a few jobs at a time. Their owner is generally working on the job with the crew, and often you can’t tell the general from the soldiers.

You are only limited by your architect and designer and your plans. They can also be more allowing of any changes or updates during the build. Keep in mind that they will still bill you for any variations. They don’t work for free, like you. And why should anyone, for that matter?

An independent will also cost more. This is due to the flexibility, the ability to customise and the fact that they rely on each job for their income, unlike the volume builders where it is a numbers game. A custom build will also take longer. So if you have the endgame in sight - the sale of the property, you need to factor this into your thinking.

There is also the risk with an independent. Remember the law that if things can go wrong, they will. Sometimes an independent will go bust <a href="/news">halfway through a build</a>. You have less risk of this with a more prominent company.  
Even with these risks and drawbacks, a smaller builder will have more pride and quality in their build. You will end up with a unique dual occupancy that screams quality.

East Brunswick Village, master planned by <a href="/developers/banco-group">Banco Group</a> and designed by <a href="/architects/jam-architects">JAM Architects</a>, is possibly one of the country’s greatest mixed use developments at the moment with homes across 5-6 level apartment buildings connected by tree-lined laneways filled with public art, local bakeries, pharmacy, wellness centre, yoga studio, bike repair store, cafes and a supermarket.

For residents, over 2500sqm of communal space including a children’s playground, an apiary providing free honey for all, rooftop gardens, a workshop and <a href="/news/what-will-the-future-of-cycle-culture-in-australia-look-like">960 bicycle spaces</a> to motivate and embrace a non car dependent environment. Residents also have access to a car share facility and electric vehicle charging stations to decrease their carbon footprint.

Construction of the long awaited Minnippi 18-hole championship public Golf Course and club in Cannon Hill is underway after receiving approval from Brisbane City Council earlier this year. 
The golf course stretches between the Fursden Road playing fields at Carina and the hill beside Cannon Hill Shopping Centre.

Construction of Brisbane's first new and highly anticipated golf course in 70 years has begun

Queensland builder-developer MAYD has revealed the first look at its major North Kirra beachfront development, lodging amended plans that reduce the number of apartments and increase the proportion of larger residences.

The project is planned across a substantial 4,742 sqm amalgamated site spanning seven lots at <a href="https://www.apartments.com.au/new-apartments/2-6-pacific-parade-bilinga-qld-4225">2-6 Pacific Parade</a> and 27-33 Golden Four Drive in Bilin​ga, directly opposite Nor​th Kirra Beach.

<a href="https://www.apartments.com.au/developers/mayd-group">MAYD</a> secured the site for $32.5 million in 2025, in what was one of the Gold Coast's largest property transactions of the year.

The development will be delivered across two stages, with the first stage carrying an estimated gross realisation value of around $360 million.

The latest amendments seek to reduce the overall apartment count and shift the project further toward the owner-occupier market, with larger residences designed for buyers wanting considerably more space than traditionally offered in a beachfront apartment.

The residential mix will include townhomes, oversized two-bedroom apartments, substantial three-bedroom residences and four-bedroom homes.

MAYD has appointed Cera Stribley to lead the architecture and interiors, with the Melbourne-based design practice drawing on the beachfront setting through a series of ocean-facing terraces and heavily landscaped balconies.

Strong horizontal forms and curved balconies will define the exterior, with subtropical landscaping integrated throughout the building to soften the built form and increase the connection between the residences and the beachfront.

The project will also include an extensive collection of resident wellness and lifestyle facilities, continuing the broader shift across the Gold Coast's luxury apartment market toward larger homes supported by resort-style amenity.

MAYD Founder Todd Mould said North Kirra was increasingly appealing to buyers attracted to the more established, lower-density character of the southern Gold Coast.

"North Kirra presents one of the most compelling luxury residential opportunities currently emerging in Australia, combining absolute beachfront with the character and authenticity that buyers are increasingly seeking, and the same sense of tight-knit community that defined Burleigh and Currumbin perhaps 10 or 15 years ago," Mould said.

"With Gold Coast Airport on its doorstep, it also offers a level of accessibility that broadens its appeal across almost every market demographic."

The project comes as the southern Gold Coast continues to attract an increasing share of high-end apartment development and buyer activity.

Kirra in particular has emerged as one of the region's more tightly held beachfront markets, with its relatively low-density character, established surf and hospitality scene and proximity to Gold Coast Airport differentiating it from the higher-density markets further north.

Mould said those characteristics had informed the approach MAYD and Cera Stribley had taken to the project.

"We've worked closely with Cera Stribley to create a vision that is deeply connected to its surroundings," he said.

"Inspired by the coastline itself, the architecture has been shaped around space, privacy and resort-style living, creating a collection of homes that reflects the next generation of luxury on the southern Gold Coast."

MOTIV Managing Director Carly Cottam, who has been appointed to market the project, said buyer attention had continued to move south along the Gold Coast.

"Purchasers who may once have defaulted to Broadbeach, Main Beach or Surfers Paradise are increasingly recognising the value of a genuine beachfront location that offers lower density, strong amenity and a more established sense of community," Cottam said.

"Kirra has a powerful combination of growing demand and genuine scarcity. Beachfront supply is inherently constrained, the area remains relatively low density, and buyers are increasingly placing a premium on locations that feel established, uncrowded and authentic rather than heavily developed."

Cottam said the proximity to Gold Coast Airport was also proving increasingly important for interstate and second-home buyers.

"Being minutes from Gold Coast Airport makes it particularly compelling for interstate buyers, frequent travellers and second-home purchasers who can access an authentic coastal lifestyle almost immediately after stepping off a flight."

The acquisition takes MAYD's active development portfolio to more than $500 million, with the North Kirra project representing one of its largest undertakings to date.

MAYD is targeting an early 2027 launch.

Castle Hill, the longtime hub of the Hills District, has been one of the major beneficiaries of Sydney's Metro expansion, with improved connectivity helping drive continued population growth, development and buyer demand across the Hills District.

But despite that growth, the suburb has seen relatively few major new apartment projects brought to market over the past 18 months.

Hills District developer Reve Group is looking to fill that gap with <a href="https://www.apartments.com.au/new-apartments/nova-r-ve-castle-hill-2-garthowen-crescent-castle-hill-nsw-2154">Nova Rêve</a>, a major new mixed-use precinct on the corner of Garthowen Crescent and Old Castle Hill Road, a short walk from Castle Hill Metro Station and Castle Towers.

The project will comprise three residential towers alongside a hotel, restaurants, cafes and a skybar, more than 1,600 sqm of ground-floor retail and almost an acre of landscaped gardens.

It represents the largest project undertaken by Reve Group, the development arm of the Kassis family, which has been building across the Hills District for more than 30 years through Kassis Homes.

Nova Rêve also represents a significant step up from the family's first apartment development, Grand Rêve, which was delivered nearby on Garthowen Crescent.

Grand Rêve introduced larger, house-like apartment layouts and premium inclusions including Wolf and Sub-Zero appliances to the Castle Hill market.

Nova Rêve takes that approach to a precinct scale, combining the residential component with hospitality, retail and substantial public and resident landscaping.

Reve Group Managing Director Sam Kassis said the project reflected the family's three decades of building in the Hills, which has evolved from trophy homes on quarter-acre blocks to larger-scale apartment development.

"Grand Rêve was our first apartment project here and it showed us what this pocket of Castle Hill could be. Nova Rêve is the refinement of that idea: not just apartments, but a place the whole suburb can use," Kassis said.

A key part of that approach is the hotel, which has been designed to operate as an amenity for the wider Castle Hill community rather than solely hotel guests.

It will include restaurants, cafes, skybars and all-day dining, alongside conference and event facilities catering to business functions, community groups and private events.

At ground level, more than 1,600 sqm of shops and cafes will open onto the surrounding streets and landscaped areas.

Almost an acre of gardens designed by Land and Form Studios will run through the precinct, incorporating pathways, seating, barbecue areas and children's play spaces.

Reve Group's Romio Georges said creating an active ground plane had been central to the planning of Nova Rêve.

"There are gardens with pathways, barbecues, seating and play areas, shops and cafes opening onto the street, and a hotel with restaurants and a skybar that anyone in Castle Hill can walk into," Georges said.

The project's elevated position on one of Sydney's highest ridgelines will also provide apartments with outlooks toward the Sydney skyline, surrounding parkland and the Blue Mountains.

More than 80 per cent of the apartments will occupy corner positions, with Turner responsible for both the architecture and interiors.

Nova Rêve arrives as Reve Group bets on Castle Hill's next growth phase

A collection of just 25 large-format apartments and penthouses overlooking Goodwin Park is entering the Coolangatta market, with <a href="https://www.apartments.com.au/new-apartments/marea-residences-coolangatta-27-27a-dixon-street-coolangatta-qld-4225">Maréa Residences</a> combining a low-density, residential-only approach with uninterrupted park and Pacific Ocean outlooks.

Located at 27 Dixon Street, Maréa comprises three and four-bedroom residences alongside a limited number of dual-level penthouses, with the project positioned between Goodwin Park and <a href="https://www.apartments.com.au/developments/coolangatta-qld-4225">Coolangatta</a>’s coastal precinct.

Construction has commenced, with completion currently estimated for late 2027. Three-bedroom residences are priced from $1.8 million.

The project has been designed around its northern outlook across the park, with the building’s architecture, landscaping and material palette intended to establish a connection with the neighbouring green space. The residences have been configured to maximise natural light and views across Goodwin Park towards the ocean.

Inside, the material palette incorporates timber, stone and brushed brass, complemented by curved detailing and ambient lighting. Kitchens and bathrooms carry the same natural material approach, while residences also include basement parking, storage and lift access.

Maréa’s penthouses are arranged over two levels and include private pools, adding another layer to the project’s focus on larger-format apartment living. Across the development, residences are configured with three or four bedrooms rather than the broader mix of smaller apartment types commonly found in larger projects.

The project has so far been particularly well received by local owner-occupiers and downsizers, according to Urban Activation Property Sales and Marketing Director Matt George, with the residential-only format, construction quality and northern park outlook among the features resonating with purchasers.

Maréa Residences brings parkside apartments to Coolangatta

Melbourne developer PDG has secured Victorian Government approval for its $1.5 billion Southbank development <a href="https://www.apartments.com.au/new-apartments/the-one-1-queens-bridge-street-southbank-vic-3006">The One</a>, clearing the way for the long-dormant riverfront site opposite Crown to finally be developed.

The Minister for Planning has approved the project at 1-29 Queens Bridge Street, with the Department of Transport and Planning issuing the planning permit following its assessment.

The approval will allow PDG to develop the prominent 5,059 sqm site with a major mixed-use tower comprising premium apartments, including branded residences, a luxury hotel and boutique office space.

PDG acquired the site in late 2024, with its position directly opposite Crown's main entrance and near Melbourne's Arts Precinct making it one of Southbank's most significant remaining development opportunities.

Designed by COX in collaboration with ODO and PDG, the tower's architecture draws on the movement of the Yarra River, with six vertical pleats running the height of the sculpted facade.

The project will also see the heritage-listed Queens Bridge Hotel restored and incorporated into the development&nbsp;with new hospitality and public uses, including a rooftop venue.

A significant component of The One will be its residential amenity.

More than 5,000 sqm of resident facilities will be delivered across a single level, making it one of the largest consolidated residential amenity offerings proposed in an Australian apartment development.

The planning approval also incorporates a major upgrade of Queensbridge Square, which PDG will deliver in partnership with the City of Melbourne.

The existing square will be revitalised as a new civic and pedestrian space along the Yarra River, strengthening the connection between the project, Southbank and the riverfront.

PDG Founder and Managing Director Vince Giuliano said the approval represented a major milestone for a site which has remained largely underutilised for more than 15 years.

“This is the most significant Planning Permit approval Melbourne has seen in recent years,” Giuliano said.

“For more than 15 years, this site has remained underutilised. This approval enables us to deliver a project that will contribute meaningfully to the revitalisation of Southbank, restore and reactivate an important heritage building, and create a new civic and hospitality destination for Melbourne.”

The latest approval follows an earlier planning permit issued by the City of Melbourne covering demolition works across part of the site at 9-29 Queens Bridge Street. Those demolition and early works are already underway.

PDG has also started generating early interest in the residential component from owner-occupiers ahead of a planned public launch in early 2027.

PDG secures approval for $1.5bn Southbank apartment development, The One

Local developer Harridan is seeking to turn its Woolloongabba apartment project into the first stage of a broader transformation of Burke Street, using a new 16-storey mixed-use building to establish a greener pedestrian connection toward the rapidly evolving Boggo Road transport and knowledge precinct.

The South East Queensland developer has filed plans for 154 apartments on the <a href="https://www.apartments.com.au/new-apartments/4-burke-street-woolloongabba-qld-4102">southern side of Burke Street</a>, where its proposal has been designed alongside a wider vision by LatStudios for the street.

That vision positions the southern side of Burke Street for buildings of 15 storeys and above, while envisaging lower-rise development of up to five storeys on the northern side to transition into Woolloongabba's existing character housing. It also proposes wider pedestrian verges, deep planting, new street trees and upgrades to the pedestrian approach to Boggo Road Station.

The Harridan development itself has been designed by Brisbane-based Arqus Design and will comprise 154 apartments across 16 storeys. The mix is weighted heavily toward two-bedroom apartments, with 121 proposed alongside 10 one-bedroom and 23 three-bedroom residences. There will typically be around 14 units per floor.

A lower-ground car park and three podium levels will accommodate 156 resident parking spaces, along with visitor and commercial parking. There will also be 154 resident bicycle spaces and 40 visitor bicycle parks.

Harridan is a family-owned developer and part of the Holmwood Highgate Group, with more than three decades of development activity across South East Queensland. Its portfolio spans residential, commercial and industrial property, with current residential projects including Riverbank on Byron in Bulimba, Esperance Residences in Carina and The Precinct at Kinross Road in Thornlands.

Wooloongabba has been popular for apartment developers, particularly since the announcement of the 2032 Summer Olympics games in Brisbane.

While there have been a lot of development applications, it has failed to materialize into real supply.&nbsp;

Sarazin has been the major player in the area. They are under construction at Murcia Residences, on the fringe of East Brisbane and Woolloongabba. They have just launched <a href="https://www.apartments.com.au/new-apartments/the-stanley-residences-woolloongabba-8-trafalgar-street-woolloongabba-qld-4102">The Stanley Residences</a>, in Woolloongabba on Trafalagar Street.
