OSK unveils AURA, the latest stage in Southbank's $3.5 billion Melbourne Square precinct

National developer Time &amp; Place appears to have settled on a design for its long-anticipated Potts Point project.

After several years of back and forth with local council and the NSW Government, the developer, which has spent seven years targeting the former The Chimes site on Macleay Street, has now progressed its plans.

Following a concept design submission last year by SJB, Time &amp; Place has lodged a full State Significant Development Application with the NSW Government, this time for a scheme designed by Kerry Hill Architects.

The 16-storey proposal includes 44 apartments, 21 of which will be build-to-sell. These will comprise 19 three-bedroom apartments and two four-bedroom units.

More than 50 per cent of the development will be dedicated to affordable housing, with 23 studio apartments to be delivered in line with the NSW Government’s Housing SEPP.

Kerry Hill Architects said the proposal is driven by a strong response to place.

“Our proposal for a new residential building for Potts Point in Sydney is driven by a deep consideration of place,” the practice said in its submission.

“This operates on multiple levels, including a landscape approach that reinstates endemic flora of the Sydney peninsula and provides a ground-floor garden for residents, reconnecting the site to its pre-European history. A brick podium further strengthens this relationship to context, integrating planting and fine bronze detailing that references the predominant material language of Macleay Street.”

The three-level podium will be topped by a communal resident space, featuring a covered pool designed to receive direct afternoon sun in winter, a neighbouring reflection pool, dining and event areas oriented to maximise sunset views, and an outdoor exercise zone.

They are currently selling Park Modern, 246 apartments near the famous Botanic Gardens in South Melbourne.

The developer has approval for The Burke, a mixed-use project in&nbsp;<a href="https://www.apartments.com.au/new-apartments/glen-iris-vic-3146">Glen Iris</a>&nbsp;being delivered in partnership with Woolworths. The 60 apartments, positioned above a new Woolworths supermarket, are expected to launch in the coming months. <a href="https://www.apartments.com.au/developers/develotek">Develotek</a> is joining the likes of TOGA, Deicorp, and One Global Capital, betting on a boom in Five Dock ahead of the 2032 mooted opening of the Five Dock Metro Station.

Develotek, which is currently developing Bianca on the Drummoyne waterfront and has plans approved for a tower in Chatswood, has filed a State Significant Development Application for a <a href="https://www.apartments.com.au/new-apartments/79-81-queens-road-five-dock-nsw-2046">two-building project in the evolving Kings Bay precinct</a>.

The buildings, one more boutique just five storeys and the other 26 storeys, will rise from an 3,158 sqm site across&nbsp;79–81 Queens Road and 2–8 Spencer Street, will home 134 one-, two-, and three-bedroom apartments, above ground-floor retail and five basement levels of parking.

A key component of the proposal is the inclusion of 15 per cent of residential floor space as in-fill affordable housing, unlocking additional height and density under the Housing SEPP.

At the upper levels, the tower façade has been conceived using a modular system to support prefabrication and reduce construction waste, while improving build efficiency. The splayed form draws on the geometry of surrounding industrial rooftops, reinterpreting the area’s heritage in a contemporary expression while also helping to reduce solar heat gain to east and west-facing apartments.

Ascot’s Racecourse Road continues to be a hive of activity for Brisbane developers.

Fractional property investment company DomaCom has announced the conclusion to the legal proceedings which the company has been supporting in the Federal Court of Australia.
The proceedings centred on superannuation legislation permitting investment in the DomaCom Fund by an SMSF where a related party was the tenant in the underlying property.
The ATO had (unless an extension of time is granted by the High Court) until 7 September 2018 to file with the High Court an application for special leave if it was to appeal the decision of the Federal Court of Appeal. 
DomaCom's lawyers have advised no such appeal or application for an extension of time has been filed.
Orders were issued last week by the Federal Court as follows:

<li>There be a declaration that the leasing of the Burwood property by the DomaCom Fund would not cause Aussiegolfa Pty Ltd as trustee of the Benson Fund (Aussiegolfa) to breach the sole purpose test set out in section 62 of the Superannuation Industry (Supervision) Act 1993 (Cth);  </li>
<li>Aussiegolfa pay 40% of the ATO’s costs of the first instance proceeding (as agreed or otherwise assessed); and/</li>
<li>Aussiegolfa pay 40% of the ATO’s costs of the appeal (as agreed or otherwise assessed).</li>
</ul>
In relation to the Administrative Appeals Tribunal Appeal, the Court orders that the ATO pay 100% of Aussiegolfa’s cost of the appeal.

The Full Federal Court has handed down judgment in the appeal by Aussiegolfa Pty Ltd (in its capacity as trustee of the Benson Family Superannuation Fund (BFSF) which clarifies SMSF rules regarding the sole purpose test. 
The Court held that the primary judge was incorrect in concluding that the leasing of a property held by the sub-fund to a child of a member of the BFSF was a breach of the ‘sole purpose test’. 
It related to a $104,000 student residential property in Melbourne's Burwood.
DomaCom had entered into a leasing and managing authority with Student Housing Australia for the leasing of the Burwood Highway property. The first two longterm tenants of the studio apartment were persons unknown, and unrelated, to the Benson family, but then Student Housing Australia agreed to lease an apartment to a daughter of the Benson family with the lease at the same $869 monthly rental as had been paid by the first two tenants. 
The DomaCom chief Arthur Naoumidis has welcomed the decision.
"DomaCom is very pleased to have the court confirm that it was not a breach of the sole purpose test when a related party of the BFSF rented a property held by the DomaCom Burwood sub-fund.
"We believe that this finding, on its own, represents a milestone for the SMSF industry.” 
DomaCom supported the action against the Commissioner of Taxation in the Federal Court hoping a ruling would confirm that SMSFs can invest in property sub-funds where the tenant of the underlying property is a related party of the SMSF.
The court heard it was in 2015 that the Benson family fund made a decision to invest in student accommodation and other ‘relatively low-cost, relatively high-return’ opportunities through a DomaCom sub-fund with a return of approximately 6.5%.
The decision to lease the Burwood property to the daughter was not made until 2017.
The appeal judges' ruling noted four reasons why the finding made by the primary judge was in error.
But the Court also held that the primary judge was correct to conclude that the units held by Aussiegolfa Pty Ltd in a sub-fund of the DomaCom Fund constituted an investment in a ‘related trust’ of the BFSF. 
“In relation to the related trust determination, we are reviewing the comprehensive judgment with our lawyers and will make a further announcement about the effect, if any, of the decision on the DomaCom Fund.
The DomaCom Fund disclosure documents have been amended significantly since the Burwood sub-fund was created in 2015.
"Accordingly, we will analyse the effects of the judgment on sub-funds created using the current version of the DomaCom Fund constitution and disclosure documents," Arthur Naoumidis said.
"If our analysis determines that it is necessary, we will consider amending our constitution and disclosure documents to address this issue with respect to future sub-funds.”

DomaCom win Federal Court battle in SMSF breakthrough

Crowdfunding platform DomaCom have been given the green light by the ATO to offer a product in where parents can buy property with their self-managed super fund and allow their children to rent it out.
The sole purpose test (SPT) prevents self-managed superannuation funds buying a home and renting it to a related party, however the ATO have allowed DomaCom to go ahead with the practice.
It will allow the younger generation to co-invest with their parents and apply to live in the property.
They will have to pay a market rate rent however.
DomaCom CEO Arthur Naoumidis says he is pleased to confirm that DomaCom has obtained ATO confirmation on how SMSF trustees in DomaCom can satisfy the Sole Purpose Test.
“We thank the ATO for providing this practical clarification so that SMSFs can continue to invest in DomaCom property sub-funds where, subject to certain protocols being observed, related parties may happen to become the tenant of the underlying properties.”
A trustee of a SMSF will have to invest in a Sub-Fund of the DomaCom Fund and sign the sole purpose disclosure statement.

Under the arrangement, Cultivate Farms will source appropriate properties from farmers looking to retire and match these to aspiring or next generation farmers.
DomaCom will provide the investment capital through its crowdfunding platform.
The AFL great and farming sector advocate Kevin Sheedy has come on board as ambassador.
“We need to encourage the next generation to stay on the land and build a future for our country," Kevin Sheedy said.
"Through crowdfunding all Australians can now invest into farming families and regional Australia’s future.
Some of the footy’s greatest players grew up kicking a Sherrin on the dairy farms, market gardens and sheep farms out the back of nowhere.
"I struggle to see where the next generation of farmers, and therefore, AFL players will come from if it is financially impossible to own a farm.”
"The idea behind this project is to enable young farming families to get their foot on a property they can farm commercially, while at the same time enabling a retiring farmer to sell down or sell out in order to retire," said Warren Gibson, sales and marketing manager at DomaCom.

"We are 50 per cent to closing our first property and through our partner, Sam Marwood of Cultivate Farms, have another 19 in the pipeline," he told The Australian Financial Review.

Each farm will be held in a separate DomaCom sub-fund with investors receiving a share of the rent.
They can also benefit from any capital growth through the trading of units in the fund or when the property is eventually sold and the fund wound up.
Funds typically have a five-year term and a targeted gross return of 5 per cent. The minimum investment is $2500.
Springview Eco-Farm, located in the Eastern Riverina area of southern NSW, a 2.5 hour drive from Canberra, is run by vendor, Pennie Scott, who will retain some equity via the DomaCom property sub-fund units.
The farm has an indicative value of $800,000 with a target amount of $400,000 being raised. Its indicative capital growth is tipped as 6%* p.a. with a targeted rental return of 5%* p.a.
As DomaCom will be the landlord for Springview EcoFarm, a property manager will be appointed to manage the property including collecting the rent and future tenancy if or when required. 
The gross rent is targeted to be around 5% which should result in an approximate income return of 4% to investors after the 0.88% management fee, plus capital growth.

DomaCom approved for retail super investment

In another crowdfunding first, DomaCom Australia announced that the crowdfunding campaign to fund a mortgage backed loan has been successfully completed. 
Newcastle based financial advice firm Shartru Wealth Management has used the DomaCom platform to acquire a $1.6 million residential property in Melbourne using both debt and equity.
A crowdfunding campaign was completed to raise around $682K for the equity component and another campaign was completed to raise the remaining $948K debt. 
In executing both sides of the transaction, Shartru have been able to satisfy the growth needs of their accumulation clients as well as the income needs of their retiree clients with an attractive net return of 5.06% in a low risk environment.
The loan is secured by a first mortgage security on residential property with a conservative LVR of around 60%. 
Shartru CEO, Rob Coyte, said it delivered a tax effective investment for our growth-oriented clients whilst also being able to deliver an attractive income investment to our retiree clients.
"An investment option returning 5.06% and secured by first registered mortgage with a low LVR is attractive in today’s environment where retirees are lucky to receive a 2.5% return from term deposits,” he said.

First mortgage backed loan crowdfunded by DomaCom

CWP Renewables and Partners Group are pioneering Australia’s first, large-scale, public, community investment into a utility-scale wind farm. 
The Sapphire Wind Farm Community Co-investment allows investment in the Sapphire Wind Farm in the New England district.
At 270MW it is the largest wind farm in New South Wales. The energy generated by the Sapphire Wind Farm is enough to power around 115,000 homes and to displace 700,000 tonnes of carbon dioxide each year.
DomaCom, who has partnered with developers CWP Renewables and Partners Group, are closing applications for the co-investment initiative of Sapphire Wind Farm in rural New South Wales at the end of the month.
The Sapphire Wind Farm, in Kingsland is an Australian first for its community co-investment.
Initially the opportunity, closing June 30 was only made available for those in the local community, however building on the success of the campaign, the developers extended the initiative to all residents from NSW and the ACT.
Over $7.4 million of pledges were made by community members interested in investing throughout 2017/2018.
DomaCom's <a href="https://domacom.com.au/" target="_blank">fractional property platform</a> allows small investors alongside institutional investors.
The platform allows multiple investors to aggregate their investments into an asset, typically a real estate asset, but now also renewable energy projects.
Andrew Dickson at CWP Renewables, the company behind constructing the wind farm, said DomaCom is a great fit for the community co-investment initiative.
"Their online platform makes it very easy for people to establish and manage their investment," Dickson said, adding that after testing the community's interest late last year, he was surprised with the level of interest."
The project is projected to have a return of 6% which Andrew said, "represents a good investment... better than the bank."
A minimum investment of $1,250 is required (maximum investment of $200,000).
The latest fund raising seeks $3 million of pledges.
Ross Laidlaw from DomaCom said, "the Sapphire Wind Farm Community Fund is a clear demonstration of the vision of DomaCom taking large institutional assets and breaking them down into fractional components to allow retail investors to obtain exposure to an asset class not previously available.”
Construction of the wind farm began in January, and the final turbine was installed in October. 
100MW of the wind farm's capacity has been contracted to the ACT government, as part of the Territory’s 100 per cent renewable target for 2020.
Another 50MW of the project’s capacity was contracted to renewable energy retailer Flow Power, which has now sealed a deal with the Sydney Opera House.
Under that deal, the Opera House will buy 16 gigawatt hours of wind and solar output a year from both Sapphire and the Bomen solar farm, also located in NSW.

DomaCom Sapphire Wind Farm co-investment opportunity closes this month

During the quarter, DomaCom continued with remote working arrangements due to COVID-19 and progressed the development of key products which are expected to drive future revenue growth.
The Company also saw a strong growth in Funds Under Management, which rose 11.2 per cent in Q4 FY20 to A$71.4 million. 
Product development ramps up
During the quarter, the Company made progress across four products currently in development: Rent to Own, Essential Worker, Equity Mortgage, and Senior Equity Release. 
Rent to Own: The Rent to Own product documentation was completed in the June quarter along with the acquisition of the first RTO property. The Company is now looking for its second property to be acquired in Sydney. This product uses the develop distribution margin to provide a discount to investors whilst gifting equity to tenants each year. 
Essential Worker: DomaCom is progressing its Essential Worker affordable housing product with one of Australia's leading Community Housing Providers. This product aims to leverage the Government's affordable housing lending facility to deliver an RTO product for essential workers with a 25 per cent discounted rent. This product is expected to be attractive due to low vacancy risk stemming from the security of the tenants' employment (nurses, firefighters, teachers, police) in addition to the emotional impact of supporting essential workers at this time. The targeted launch period for this product is Q3 CY20. 
Equity Mortgage: Work is ongoing to deliver a Shariah-compliant mortgage product that is targeting Australian Islamic communities who, in accordance with their religion, are prohibited from borrowing money. This product is believed to be less exposed to the current negative property environment as it is aiming to provide a method of obtaining leverage for those who wish to purchase a home but cannot borrow.

Senior Equity Release: Adviser accreditation for the Company’s Senior Equity Release (SER) product has progressed with a dozen advisers having completed accreditation. DomaCom has commenced a direct marketing campaign aimed at the retirees to help identify those needing equity from their homes. Covid-19s recent impact on self-funded retirees’ income has increased the market for this product and the Company is now seeking to obtain regulatory clarity on how the SER product works with the Government’s Downsizer legislation.

FUM increased from A$64.2 to A$71.4m in the quarter ended June, 30 2020.
Payment of remuneration to executive and non-executive directors and their related parties amounted to $184,000 during the quarter ended June 30, 2020.
As part of facilitating the completion of the Avery’s Green property development being carried out for a sub- Fund within the DomaCom Fund, DomaCom Australia paid a limited number of supplier invoices on behalf of the sub-Fund during the year ended June 30, 2020. In the 30 June quarter, these amounts were repaid by the DomaCom Fund resulting in a net inflow of $802,000 in the current quarter. DomaCom Australia, a subsidiary of DomaCom Limited, operates the DomaCom Fund. The DomaCom Fund is a separate legal entity with separate investors. It is designated a related party as DomaCom Australia is the Investment Manager.
DomaCom continued to carefully control costs during the quarter. Staff and administrative costs fell to $709,000 compared to $716,000 in the previous quarter. Advertising and marketing costs increased to $143,000 in the current quarter compared to $90,000 in the previous quarter as the Company introduced the market to new product offerings.
DomaCom’s cash position at the end of the June quarter was A$1.45m. The Company has refreshed its placement capacity via the EGM that was conducted 22 July 2020 and discussions are now progressing with an institution regarding a placement to top up the cash position.
DomaCom CEO Arthur Naoumidis said: “While the current environment is a challenging one, we are pleased that several of our key products are starting to gain traction in this environment. In particular, the ability to complete our first RTO syndication in the middle of the pandemic is a promising result. Encouragingly, we have seen significant investor interest in further RTO syndications and we are currently assessing potential acquisitions in Sydney."
