<a href="https://www.apartments.com.au/developers/s-p-setia">SP Setia</a> has lodged plans for a $750 million, three-tower mixed-use precinct that would complete the long-running redevelopment of Carlton's former Carlton United Breweries site.

The proposal at <a href="https://www.apartments.com.au/new-apartments/185-195-queensberry-street-carlton-vic-3053">46-78 Bouverie Street and 185-195 Queensberry Street</a> spans a 6,468 sqm site, the last remaining undeveloped parcels within the former brewery's 2007 masterplan.

Designed by <a href="https://www.apartments.com.au/architects/cox-architecture">COX Architecture</a>, the development will comprise two purpose-built student accommodation towers and a third build-to-sell apartment tower above a shared commercial podium and basement.

Across the three towers, SP Setia is proposing 606 build-to-sell apartments and 1,499 student accommodation units containing 2,009 beds.

The apartments will sit in the tallest tower, which will rise nearly 200m and 55 storeys. It will become&nbsp;one of the more substantial new build-to-sell apartment projects at the northern edge of Melbourne's CBD.

The apartment mix is weighted toward smaller inner-city product, with 188 studios, 206 one-bedroom apartments, 192 two-bedroom apartments and 20 three-bedroom apartments

Part of the precinct will be a large-scale&nbsp;3,684 sqm supermarket and a further 2,198 sqm of speciality retail, creating close to 5,900 sqm of new commercial space within the precinct.

But one of the biggest components of the proposal is what sits between the buildings.

Around 4,650 sqm, or roughly 72 per cent of the site, will be publicly accessible open space, incorporating plazas, pedestrian connections, landscaped laneways and retail spill-out areas.

The ground plane is intended to finally complete pedestrian connections envisaged when the CUB masterplan was first approved nearly two decades ago, stitching together Victoria Street, Queensberry Street, Bouverie Street and Swanston Street through the former brewery precinct.

Urbis said the development would "complete the CUB precinct", with the public realm providing important north-south and east-west connections through what is currently the final undeveloped portion of the masterplanned site.

SP Setia is also exploring a new linear park within the Bouverie Street road reserve, with the concept to be developed further with the City of Melbourne through the planning process.

The proposal is being pursued through the Victorian Government's Development Facilitation Program under Clause 53.23 for significant residential development with affordable housing.

The planning report acknowledges the proposed heights exceed those contemplated under the original Comprehensive Development Plan and masterplan, but argues the built-form context has changed considerably over the past two decades.

Urbis said the three towers would instead create a stepped transition between Carlton and the Hoddle Grid, rising progressively from the 94.1-metre Tower One along the Queensberry Street edge to the 199.44-metre Tower Three closer to the established CBD-scale buildings to the south.

SP Setia plans to deliver the development across three stages.

Stage One would deliver the basement, podium and retail areas for the entire precinct alongside the first student tower. Tower Two would follow in Stage Two, before the 606-apartment Tower Three is delivered as the final stage.

If approved and delivered, the project would close out a redevelopment process that has been underway since the former brewery masterplan was approved in 2007, adding more than 2,600 student beds and apartments to a precinct already home to Swanston Central, the Barak Building, RMIT Design Hub and several large student accommodation developments.

Melbourne developer Lowe Living is seeking to add to its growing bayside apartment pipeline, filing plans for a boutique eight-residence development in tightly held Middle Park.

Lowe Living, which has built much of its development portfolio across Melbourne's affluent bayside and south-east suburbs, is behind the plans for the 730 sqm site at <a href="https://www.apartments.com.au/new-apartments/123-125-erskine-street-middle-park-vic-3206">123-125 Erskine Street</a>, just off Armstrong Street and within the Armstrong Street Neighbourhood Activity Centre.

The developer is seeking approval for a five-storey residential building above two basement levels, with just eight large-format apartments and 18 car spaces.

The low-density proposal has been designed by Cera Stribley and is being progressed through the Victorian Government's Great Design Fast Track pathway, having already secured eligibility from the Minister for Planning.

The Office of the Victorian Government Architect supported its eligibility after finding the proposal demonstrated consistency with the program's seven design principles, while the project's financial feasibility has also been independently confirmed by Invest Victoria.

The project is targeting the downsizer market, with the planning documents describing the homes as larger-format residences and noting the two penthouses could otherwise have been configured as four separate apartments.

The site has dual frontage to Erskine Street and Canterbury Place and currently comprises a collection of commercial buildings used as offices, including a former heritage bakehouse, a former stable, a later gabled addition and a central courtyard.

It sits within the Commercial 1 Zone and the Armstrong Street Commercial Precinct heritage overlay, with the existing property classified as a contributory heritage place.

Heritage has subsequently played a significant role in Cera Stribley's design.

The front section of the former bakehouse facing Erskine Street will be retained, including its return walls, street-facing hipped roof and chimneys, while the Erskine Street façade and part of the western return wall of the former stable will also be incorporated into the new development.

Levels four and five will be set back five metres from the retained stable façade, while bricks removed through demolition are proposed to be salvaged and reused within the new building where possible.

Rather than presenting as a single five-storey building to Erskine Street, Cera Stribley has broken the development into a series of distinct forms.

A three-storey infill element will sit between the retained bakehouse and stable façades, with the upper levels recessed behind the heritage fabric. Canterbury Place will similarly feature two three-storey podium forms, separated by a central pedestrian accessway, before the upper two levels step back from the street.

A pedestrian through-link will run through the centre of the project between Erskine Street and Canterbury Place, creating entrances from both sides of the site and introducing landscaping and communal areas through the ground plane.

Landscape architect Acre has designed planting across the ground level, private terraces and upper levels, including a feature canopy tree at level three and integrated planting and arbours across the level four terraces. Five existing Erskine Street trees are proposed to be retained.

Sustainability is also a significant component of the Great Design Fast Track application. The apartments are targeting an average eight-star NatHERS rating, with no residence below 6.5 stars, while the project has achieved a 75 per cent BESS score. Seven of the eight apartments are designed for cross-ventilation, with the remaining residence using mechanically assisted natural ventilation.

The plans also incorporate an 8kWp rooftop solar system, a 5,000-litre rainwater tank and infrastructure allowing future electric vehicle charging for every residence.

Lowe has a strong portfolio across Melbourne's blue-chip suburbs. The proposal follows an extensive pre-application process with the City of Monash. Three formal meetings were held between the project team and Council from December 2025 to March 2026, with the scheme evolving through several concept iterations before the current design was lodged.

ASIC’s surveillance program that looks to identify illegal phoenix operators has now been widened to look at the building and construction sector’s use of false statutory declarations.
Commissioner Greg Tanzer said that there had been feedback from small businesses, industry bodies and government agencies that false statutory declarations have been used to claim payments for work.
Tanzer said that there are concerns that some officers of larger companies are falsely declaring that they have paid small businesses contracted to work on commercial and residential projects, when this is untrue.
This will see a focus from ASIC on eight major commercial and residential developments that are currently under construction across the country.
“Falsely declaring that you've paid a contractor has serious flow-on effects in the building and construction industry. Many contractors are small business operators who have operating expenses and debts to pay. When they are not paid for work undertaken it puts their businesses, livelihoods and creditors at risk,” he said. “While false statutory declarations and fraud matters are matters for other regulatory and enforcement agencies, company officers who knowingly make a false statement regarding payments to creditors may find themselves facing criminal or civil action by ASIC,” Tanzer explained.
Administrative action may also be taken against company officers who engage in misconduct, under the Corporations Act. This has seen 60 directors banned in the past year over misconduct involving phoenix activity.

Eight undisclosed major commercial and residential developments on ASIC's radar

Mark Ronald Letten, a South Yarra accountant, was sentenced in the Melbourne Country Court today to five years and eight months imprisonment.
The charges were brought against Letten, 60, by ASIC after he had earlier pleaded guilty to 27 charges under the Corporations Act 2001.
His charges included operating 21 unregistered managed investment schemes related to property development as former director of LGH Holdings Ltd and principal of Lettens Pty Ltd (The Letten Group formerly).
LGH is now in liquidation.
He also admitted to dishonestly using his directorship to use investor funds totalling more than $533,000 and carrying on a financial services business without a license.
A minimum of three years in jail must be served before being eligible for release.
Letten’s accountancy practice sourced the majority of more than 1,000 investors between 1998 and 2010 who placed more than $100 million in investment property schemes across Australia and New Zealand.
Letten managed and promoted these projects.
These companies and schemes were wound up following applications by ASIC in the Federal Court of Victoria. This began in 2010.
Losses of at least $67 million to investors were caused by the schemes, which the judge, during sentencing, acknowledged to have been exacerbated by the non-registration of the schemes and absence of associated investor protections.
ASIC Chairman Greg Medcraft said that Letten acted in disregard for the law, and with little concerns for the interests of property investors. “His jailing should send a strong message to company directors and scheme operators about the serious consequences of operating property investment schemes outside the legal requirements,” he said.

South Yarra accountant involved in property development schemes imprisoned for over five years

Property investors are increasingly using self-managed super funds (SMSF) as low cost investment vehicles.  
But recent moves by the Australian Securities and Investments Commission (ASIC) serve as a helpful reminder to SMSF investors that nothing comes for free.  
ASIC issued three infringement notices to Esuperfund Pty Ltd for false or misleading online advertising. The online SMSF establishment and administration service provider has paid $30,600 in penalties after it ran advertisements and articles that misrepresented the costs and benefits of using its services or SMSFs.  The three statements ran between 31 January 2014 and 8 May 2014.
ASIC was concerned that one advertisement implied that Esuperfund clients would not pay any fees or costs when establishing a SMSF in 2014, while another article, entitled '9 Benefits of Setting Up A Self Managed Super Fund' misrepresented the costs associated with SMSFs in comparison to retail and industry superannuation funds.  
According to ASIC, a third advertisement falsely claimed that ASIC reviewed Esuperfund's operations yearly to make sure it was complying with its legal obligations.  
Esuperfund has now removed the statements from its website.  
Another SMSF service provider, Your Super Accountant, paid $2,040 after receiving an infringement notice for making potentially misleading statements about the costs of setting up a SMSF when using their services.  
Despite publishing claims on their website homepage that it was free to set up a SMSF with Your Super Accountant, investors were required to pay $200 upfront (20% of the annual administration fee) in order to be eligible for the "free" set up. The website homepage did not disclose that condition, or any others, when advertising the "free" service.  
ASIC noted that using a corporate trustee to set up a fund is never free.   According to ASIC deputy chairman Peter Kell, consumers should be on the lookout for services that advertise themselves as "free".
  "Some terms and phrases – such as "free" – have such a strong connotation for consumers that particular care should be taken so that investors are not misled," said Kell.  
"Setting up an SMSF is an extremely important financial decision and consumers should clearly understand the set up costs involved. ASIC has a particular focus on misleading claims that a financial product or service is 'free', as this may lead consumers to make inappropriate financial decisions," he said.

A Sunbury man appeared in the Melbourne Magistrates Court after the Australian Securities and Investment Commission alleged that he fraudulently obtained more than $1 million from investors.
Barry John Patrick, a 71 year old from Sunbury, Victoria, allegedly obtained the money from 14 investors between 2007 and 2010, telling investors it was to be used to fund a property development.
The Australian Securities and Investment Commission (ASIC) allege that Patrick took some of the funds for personal use, and used some of the money to pay interest payments to past and existing investors and to make loan repayments. According to ASIC, investors were persuaded to refinance their self managed superannuation funds and homes, take out additional loans or use credit cards to pay Patrick.
Patrick has been charged with eight counts of obtaining property by deception, five counts of obtaining financial advantage by deception, one count or theft and one count of running a financial services business without an Australian financial services license.
The charges relate to the three-year period between 2007 and 2010, in which ASIC alleges Patrick formed companies to purchase properties for development and consequently persuaded investors to refinance their homes or self-managed super funds, or take out additional loans or credit cards.
“ASIC allege the funds raised by Mr Patrick were not used to develop the properties, instead, they were used to pay interest payments to past and existing investors and to meet repayments on loans as well as for personal use,” said the regulator.
But this is not the first time Patrick has fallen on the wrong side of the law.
In 2010, Patrick <a href="https://www.asic.gov.au/asic/asic.nsf/byheadline/10-257AD+Melbourne+director+sentenced?openDocument" target="_blank">received a four-month suspended jail sentence</a> and a five-year good behaviour bond after pleading guilty to one charge of carrying on a financial services business without holding an AFS license and three charges of managing a corporation while disqualified.
According to ASIC, during August 2003 and December 2006, Patrick persuaded 40 investors to invest in three companies: E.K.B Properties, Sandgrove Specialised Securities and Cardinia Specialised Securities.
During the time, E.K.B Properties raised approximately $4 million, Sandgrove Specialised Services raised approximately $1.5 million and Cardinia Specialised Services raised approximately $1 million.
<a href="https://www.moneymanagement.com.au/news/superannuation/2014/victorian-charged-with-smsf-property-fraud" target="_blank">According to Money Management</a>, ASIC alleged Patrick and his associate Karl Heinz Veljkovic were pushing investors to roll over their superannuation into self-managed funds and then invest those funds into the three companies.
However, the companies, which were controlled and managed by Patrick and Veljkovic, were placed into liquidation by the Federal Court in 2007 following investigations by ASIC. As of December 2010, ASIC said none of the investors had been repaid.
In 2007, both men consented to Federal Court orders banning them from carrying on a financial services business; parting with any funds that have come into their possession by issuing, selling or offering a financial product; and managing corporations for a period of 20 years.
Graeme Colley, director of technical and professional standards at the SMSF Professionals’ Association of Australia, said these kinds of cases arise from time to time, and are the result of a “failure of the independence between initial advice given to individuals and where the money ends up”.
Colley says cases like this don’t preclude investing your self-managed super fund in property, but says “the hotter it gets, the closer you are getting to the fire”.
As a general rule, Colley says investors should only consider advice from advisers with AFS licenses. This way, if something goes wrong, the investor potentially has some recourse against the licensee and can use formal complaints arrangements.
Colley says it is also important to do your own research and be as thorough as possible. “Make some investigations into who owns the business, the relationship between the adviser and the organisation, and if there are any other real investors,” says Colley.
Patrick is next due to appear in court on 16 September. He faces a maximum 10 years in jail for each of the deception and theft charges, and a maximum jail sentence of two years if found guilty of operating a financial services business without an AFS license.

Melbourne property developer charged with $1 million fraud

Rudy Noel Furgtniet, a former director of Unique Mortgage Services Pty Ltd and Victorian finance broker operating under MortgageandMigration.com.au, has been banned by ASIC from engaging in credit activities.
It was found he’d provided misleading information and a lack of full disclosure on an application for a credit licence.
His lack of disclosure and misleading answers were given in relation to questions for the business’ application for a credit licence, and he had been the former person responsible for the licence for his practice, which is based in Melbourne.
He also had an adverse disciplinary history, including involvement in the breach of the company’s travel agent’s licence.
He’s also made a false declaration to the Migration Agents Registration Authority, had two rejected applications to be admitted as a solicitor, made a false statement on Newstart allowance application forms, misrepresented himself as a lawyer with standing to appear in court, had his conveyancing licence cancelled and made a false or misleading declaration to the Tax Practitioners Board.
ASIC decided that his conduct was incompatible with the qualities required of someone allowed to engage in credit activities – that is, good character, honesty, integrity and judgement.
Deputy chairman for ASIC, Peter Kell, said that they would remove quickly to remove people like this from the industry.
“Those who deliberately provide misleading information in their credit applications simply should not be in the industry,” he said.

ASIC permanently bans Victorian finance broker

Finance Minister Mathias Cormann was asked on radio this morning about ASIC’s failure to investigate tip-offs against the CBA.
“ASIC of course has come out and has acknowledged they got some of these things wrong, and they’ve certainly got to lift their game,” said Cormann.
The Senate inquiry yesterday condemned the conduct of the CBA, calling for a Royal Commission to investigate the scandal involving rogue financial planners.
The Commonwealth Bank has said it is sorry some of its financial advisers failed customers, but denies it has downplayed the wrongdoing and tried to minimise its compensation, according to The Australian.

Federal government tells ASIC to “lift their game”

An adviser who operated in Sydney for more than 25 years has been banned from providing financial services and engaging in credit activities.
The Australian Securities and Investment Commission (ASIC) found that Nigel Keith Flowers, 49, of Coolangatta, Queensland, had engaged in dishonest conduct while acting as a financial adviser.
The veteran financial adviser who specialised in providing advice to the medical professionals was the director of Flowers Financial Group Pty Ltd, now in liquidation, and Flowers Financial Management Ptd Ltd, also in liquidation. Flowers Financial Management’s financial services license was cancelled in April last year.
Flowers raised $1.475 million in funds for a proposed initial public offering by Avior Australia Ltd from long term clients of Flowers Financial Management.
Between February 11 and March 2012, ASIC found that Flowers improperly paid out at least $720,332 from the trust account that held the funds, with at least $696,138 going to parties related to Flowers.
After the initial public offering was cancelled, Avior put $30,000 back into the trust account to be returned to investors. But Flowers again improperly disbursed funds, paying out at least $27,000 to parties related to him.
ASIC found that Flowers was not of good fame and character and not a fit and proper person to engage in credit activities.
ASIC Commissioner Greg Tanzer said that financial advisers were expected to act honestly.
“Dishonest conduct by financial advisers undermines confidence and trust in the financial services industry. ASIC regards these actions very seriously and will remove those who disregard the law” said Tanzer.
Flowers has the right to appeal the decision.

Financial advisor banned by ASIC after dishonest conduct

Selection One Finance Pty Ltd’s former directors, Ronald David Williams, 46, and Gary David Maile, 64, have been sentenced to four years and three months imprisonment with a non-parole period of 16 months, after pleading guilty to breaches of director duties.
Their company, Selection One, advertised big win investment solutions, borrowing funds from investors for 12 months at an interest rate of 3% per month or 36% per annum.
However, both men pleaded guilty to failing to exercise their powers and discharge their duties as company directors in good faith in the best interests of the company. This failure was said to be intentionally dishonest.
These funds were then supposed to be used to fund short-term mortgages at high interest rates – to the tune of 6% per month, according to ASIC, which would have made these high returns feasible. However, a small number of these funds was on-lent to borrowers compared to the funds received. This meant that Selection One needed to raise more investor funds to pay its previous investors the promised return.
They did not disclose to new or existing investors the poor performance that the company was seeing, and neither of the directors took steps to change the high-risk business model. In fact, investors were encouraged further until the company was placed in voluntary administration on 3 March 2009.
Debts totalled $20,915,330 to 88 investors.
ASIC commissioner Greg Tanzer said that the jailing of Williams and Maile should send a clear message to company directors who act dishonestly.
“The investing public is entitled to expect that company directors are acting in their interests. ASIC will act to ensure that blatant breaches of directors' duties are pursued in the courts,” Tanzer said.
Some Selection One investors have reportedly lost their homes as a result of investing in the company.

High-risk 36% per annum return promises turn to dust as former Selection One directors sentenced to jail

An ASIC investigation and subsequent District Court conviction has found New South Wales-based former mortgage broker, Moustafa “Muzi” Dandachli, of Georges Hall, guilty of falsifying loan application documents.
These documents were in applications for 10 people that included loans ranging from $196,000 to $640,000, and saw home loans totalling almost $3.8 million over a six month period.
Dandachli pleaded guilty in 2013.
Income and employment documents were those that contained false or misleading documents, and he admitted to submitting these knowing that they were untrue.
A number of penalties were handed down by the District Court, including a nine month sentence in jail and then a two year good behaviour bond.
His remorse for acting dishonestly, cooperation with ASIC, and good prospects for rehabilitation were considered by the court.
He had been authorised to provide credit services from 23 December 2010 until 27 February 2012, <a href="/news/former-bankstown-mortgage-broker-pleads-guilty-to-submitting-false-loan-applications-worth-3-8-million">upon which time his employer terminated his authorisation, Property Observer previously reported</a>. He supplied the false applications to two banks from July 2011 to January 2012. The maximum penalty he could have been given would have been two years imprisonment, or $11,000, for each charge, or both.
Deputy chairman for ASIC Peter Kell said that loan fraud is unacceptable. “ASIC’s campaign to identify and crackdown on loan fraud is continuing,” he said. ASIC has banned Dandachli from providing credit activities in the future.
Dandachli operated under Prolink Finance Solutions as Senior Finance Executive, as well as working as a finance consultant with The Finance group in 2012. He was a 2011 finalist for Vow Financial's Altitude Award Broker Partner of the Year (Rising Star). In December 2011, Broker News reported that he was looking to recruit loan writers in a particularly busy market, even putting off his holidays until January due to the rush, with the RBA having chopped rates.
The MFAA had expelled Dandachli from membership in 27 August 2012, having been suspended on 6 July 2012 pending further investigations.

Former NSW broker convicted of falsifying loan applications

Victorian broker Kieu Thi-Thanh Huynh, of Sunshine, has been sentenced to four years in prison, with a minimum of two years served before she becomes eligible for parole after being convicted of serious fraud offences.
Huynh has also been permanently banned by ASIC from engaging in credit activities and has been disqualified from managing a corporation for five years.
In February this year she pleaded guilty in the Supreme Court of Victoria on 27 charges of obtaining more than $9.4 million of property by deception. She was also charged with one attempt to obtain property by deception.
As the former sole director of St Andrews Mortgage Solutions Pty Ltd (SAMS), she was authorised between July 2010 and March 2013 for a number of Australian Credit Licensees.
The charges related to her involvement in creating false payslips to provide to various credit providers, supporting loan applications which she submitted on behalf of her clients. 27 loan applications totalling $9,411,688.30 were successful.
Huyhn's upfront commissions were $41,231.14, with trailing commissions of $14,510.85, a total of $55,741.99. She also received cash payments of $10,000 in relation to the false payslip scheme.
Huhyn has the right to appeal.
