<a href="https://www.apartments.com.au/developers/s-p-setia">SP Setia</a> has lodged plans for a $750 million, three-tower mixed-use precinct that would complete the long-running redevelopment of Carlton's former Carlton United Breweries site.

The proposal at <a href="https://www.apartments.com.au/new-apartments/185-195-queensberry-street-carlton-vic-3053">46-78 Bouverie Street and 185-195 Queensberry Street</a> spans a 6,468 sqm site, the last remaining undeveloped parcels within the former brewery's 2007 masterplan.

Designed by <a href="https://www.apartments.com.au/architects/cox-architecture">COX Architecture</a>, the development will comprise two purpose-built student accommodation towers and a third build-to-sell apartment tower above a shared commercial podium and basement.

Across the three towers, SP Setia is proposing 606 build-to-sell apartments and 1,499 student accommodation units containing 2,009 beds.

The apartments will sit in the tallest tower, which will rise nearly 200m and 55 storeys. It will become&nbsp;one of the more substantial new build-to-sell apartment projects at the northern edge of Melbourne's CBD.

The apartment mix is weighted toward smaller inner-city product, with 188 studios, 206 one-bedroom apartments, 192 two-bedroom apartments and 20 three-bedroom apartments

Part of the precinct will be a large-scale&nbsp;3,684 sqm supermarket and a further 2,198 sqm of speciality retail, creating close to 5,900 sqm of new commercial space within the precinct.

But one of the biggest components of the proposal is what sits between the buildings.

Around 4,650 sqm, or roughly 72 per cent of the site, will be publicly accessible open space, incorporating plazas, pedestrian connections, landscaped laneways and retail spill-out areas.

The ground plane is intended to finally complete pedestrian connections envisaged when the CUB masterplan was first approved nearly two decades ago, stitching together Victoria Street, Queensberry Street, Bouverie Street and Swanston Street through the former brewery precinct.

Urbis said the development would "complete the CUB precinct", with the public realm providing important north-south and east-west connections through what is currently the final undeveloped portion of the masterplanned site.

SP Setia is also exploring a new linear park within the Bouverie Street road reserve, with the concept to be developed further with the City of Melbourne through the planning process.

The proposal is being pursued through the Victorian Government's Development Facilitation Program under Clause 53.23 for significant residential development with affordable housing.

The planning report acknowledges the proposed heights exceed those contemplated under the original Comprehensive Development Plan and masterplan, but argues the built-form context has changed considerably over the past two decades.

Urbis said the three towers would instead create a stepped transition between Carlton and the Hoddle Grid, rising progressively from the 94.1-metre Tower One along the Queensberry Street edge to the 199.44-metre Tower Three closer to the established CBD-scale buildings to the south.

SP Setia plans to deliver the development across three stages.

Stage One would deliver the basement, podium and retail areas for the entire precinct alongside the first student tower. Tower Two would follow in Stage Two, before the 606-apartment Tower Three is delivered as the final stage.

If approved and delivered, the project would close out a redevelopment process that has been underway since the former brewery masterplan was approved in 2007, adding more than 2,600 student beds and apartments to a precinct already home to Swanston Central, the Barak Building, RMIT Design Hub and several large student accommodation developments.

SP Setia plans three-tower finale for Carlton’s former CUB precinct

Melbourne developer Lowe Living is seeking to add to its growing bayside apartment pipeline, filing plans for a boutique eight-residence development in tightly held Middle Park.

Lowe Living, which has built much of its development portfolio across Melbourne's affluent bayside and south-east suburbs, is behind the plans for the 730 sqm site at <a href="https://www.apartments.com.au/new-apartments/123-125-erskine-street-middle-park-vic-3206">123-125 Erskine Street</a>, just off Armstrong Street and within the Armstrong Street Neighbourhood Activity Centre.

The developer is seeking approval for a five-storey residential building above two basement levels, with just eight large-format apartments and 18 car spaces.

“This is a deliberately very different proposition for us,"&nbsp;Tim Lowe, Co-Founder of Lowe Living, said.

"Eight residences is exceptionally boutique, but that's precisely what this site calls for.

“There is a strong community in Middle Park and the surrounding suburbs who have spent decades building a life here. They no longer want the maintenance of a large period home, but they aren't prepared to compromise on space, quality or location. We think there is a real opportunity to capture that hyper local market. A site like this rarely comes to market.”

The low-density proposal has been designed by Cera Stribley and is being progressed through the Victorian Government's Great Design Fast Track pathway, having already secured eligibility from the Minister for Planning.

The Office of the Victorian Government Architect supported its eligibility after finding the proposal demonstrated consistency with the program's seven design principles, while the project's financial feasibility has also been independently confirmed by Invest Victoria.

The project is targeting the downsizer market, with the planning documents describing the homes as larger-format residences and noting the two penthouses could otherwise have been configured as four separate apartments.

The site has dual frontage to Erskine Street and Canterbury Place and currently comprises a collection of commercial buildings used as offices, including a former heritage bakehouse, a former stable, a later gabled addition and a central courtyard.

It sits within the Commercial 1 Zone and the Armstrong Street Commercial Precinct heritage overlay, with the existing property classified as a contributory heritage place.

Heritage has subsequently played a significant role in Cera Stribley's design.

The front section of the former bakehouse facing Erskine Street will be retained, including its return walls, street-facing hipped roof and chimneys, while the Erskine Street façade and part of the western return wall of the former stable will also be incorporated into the new development.

Levels four and five will be set back five metres from the retained stable façade, while bricks removed through demolition are proposed to be salvaged and reused within the new building where possible.

Rather than presenting as a single five-storey building to Erskine Street, Cera Stribley has broken the development into a series of distinct forms.

A three-storey infill element will sit between the retained bakehouse and stable façades, with the upper levels recessed behind the heritage fabric. Canterbury Place will similarly feature two three-storey podium forms, separated by a central pedestrian accessway, before the upper two levels step back from the street.

A pedestrian through-link will run through the centre of the project between Erskine Street and Canterbury Place, creating entrances from both sides of the site and introducing landscaping and communal areas through the ground plane.

Landscape architect Acre has designed planting across the ground level, private terraces and upper levels, including a feature canopy tree at level three and integrated planting and arbours across the level four terraces. Five existing Erskine Street trees are proposed to be retained.

Sustainability is also a significant component of the Great Design Fast Track application. The apartments are targeting an average eight-star NatHERS rating, with no residence below 6.5 stars, while the project has achieved a 75 per cent BESS score. Seven of the eight apartments are designed for cross-ventilation, with the remaining residence using mechanically assisted natural ventilation.

The plans also incorporate an 8kWp rooftop solar system, a 5,000-litre rainwater tank and infrastructure allowing future electric vehicle charging for every residence.

Lowe has a strong portfolio across Melbourne's blue-chip suburbs. A broken mortgage broker remuneration model and loose lending could trigger a subprime mortgage crisis, according to the the outgoing chief of the Australia’s corporate regulator.
Australian Securities and Investments Commission chairman Greg Medcraft said the situation in Australia was not comparable to the US subprime mortgage crisis, but said Australia should learn lessons from what happened in the United States.
Earlier this week, a UBS report said the amount of home loans extended based on "factually inaccurate" information is estimated to have reached $500 billion.
Medcraft said observations in the UBS report were consistent with ASIC's findings on responsible lending.
"It is amazing how people keep saying, 'It couldn't happen here'," Medcraft was cited as saying at a Reuters Newsmaker event by The Australian Financial Review.
"Thinking about the subprime crisis, [the] big issues were basically the issue of overstatement of income, understatement of expenses and overstatement of property values."
Factually incorrect mortgages on the banks' books were known as "liar loans" during the global financial crisis.
The UBS report suggested more borrowers were lying by under-representing their expenses and living costs. Borrowers were also over-stating income and assets and understating loans.
It said the level of liar loans meant the impact on the broader economy from a housing downturn was likely to be more severe than anticipated by the banks.
However, Finance Brokers Association of Australia labelled the UBS analysis "reckless" because the analysis was not based on UBS data or data from a bank or a lender.
In 2015, ASIC reviewed interest-only home loans and found 11 lenders, including the big four banks, had to change their home lending practices because they fell short of their responsible lending obligations.
The ASIC found that a majority of the lenders relied on indices to estimate the living expenses of borrowers rather than assess borrowers' actual living expenses.
In March, the regulator took Westpac to court, alleging the mortgage lender failed to properly assess whether potential borrowers could repay their home loans.
Medcraft said there could be more court cases of a similar nature in future.
He said irresponsible lending is facilitated because of the mortgage broker remuneration model which rewards brokers for securing larger loans for their clients.
"The mortgage commission is based on [the model] the larger their loans, the more you get. So logically what would you do?
"It's human behaviour. I'd do it," he said.
He said problematic aspects of the mortgage broker remuneration model included volume rebates, which are bonuses paid to brokers based on the overall volume of home loan sales.
 “Soft dollar" benefits, such as brokers' membership to loyalty programmes run by lenders which gives brokers improved service, were also a problem. 
The increased regulatory scrutiny has forced banks to tighten their lending practices in the past few months. 
In July, National Australia Bank has introduced tougher credit controls on new loans and reassessed its appetite for risk as household debt blows out to record highs.

'Liar loans' could spark mortgage crisis, says ASIC chief Greg Medcraft

Westpac’s dispute with the markets regulator over lending practices has brought into focus the limitations of indexes for assessing mortgage applications.
The Australian Securities and Investments Commission had launched civil proceedings earlier this year against the second largest mortgage lender alleging that between December 2011 and March 2015 Westpac failed to properly assess whether borrowers could meet their repayment obligations before entering into home loan contracts.
The bank has denied the claims.
ASIC alleges that Westpac relied on an index, University of Melbourne's Household Expenditure Measure (HEM), to help determine how much to lend to would-be borrowers.
In court filings, ASIC said the HEM benchmark was based on "conservative" estimates of household expenditure”, according to The Australian Financial Review.
The benchmark "represents only an estimate of what Australian families consume" and "was not compiled by reference to expenditure data collected during the relevant period", it said. 
Westpac relied on HEM benchmarks based on data from 2009-10 to assess borrowers for loans that were issued between December 2011 and March 2015, it said adding that the bank only "scaled" the benchmark to account for the location of applicants, number of dependents and marital status. It should have taken into account the total household income, net wealth decile, savings pattern and number of credit cards per household, according to the ASIC.
The National Credit Act provides consumer protections to ensure that credit providers make reasonable inquiries about a borrower's financial situation and assess whether a loan contract will be unsuitable for the borrowers.
Westpac said the court action did not concern any current lending policies or practices.
The bank has defended the HEM benchmark as an "objective measure that does not depend on the quality of a consumer's estimation of their expenses ... [and] excludes discretionary non-basic expenses that a consumer could reduce to meet their commitments without substantial hardship".
Westpac head of consumer banking, George Frazis, has said earlier its assessment processes are comprehensive and take into account a customer’s specific circumstances, including income and expenditure, previous repayments' history and the overall customer relationship.
The bank did not rely solely on the HEM benchmark, Frazis said in a statement in March after the case went to court in March.
"In our experience this survey is a useful input into our loan assessment process, in combination with our understanding of customers' circumstances."
ASIC's statement of claim describes the circumstances of seven loans.
Westpac has previously said all borrowers are up to date with their repayments.
Regulators, include APRA, have been clamping down on banks’ lending practices in recent months to cool the property markets on the East Coast.
Of the major banks, Westpac has the largest proportion of loans made on interest-only terms, reflecting a book weighted towards property investors.
It also asked mortgage brokers to grill clients on why they want an interest-only loan.
Bright Corporate Law principal David Jacobson told the AFR benchmarks like HEM were widely used.
"But they have moved in the last few years to be a cross-check against declared individual expenses rather than a standard default amount to be used as a substitute for getting that information," he said. "In other words, if the information obtained shows declared expenses are lower than the benchmark then the lender needs to get more information.
"But if the declared expenses are higher than the benchmark, lenders calculate affordability on the declared expenses, subject to any other queries or inconsistencies."

Westpac, ASIC court battle over responsible lending heats up

The former Principal of Sherwin Financial Planners Pty Ltd and Chairman of Wickham Securities Ltd has today pleaded guilty to 25 charges brought by ASIC, arising out of the collapse of his financial planning business.
Bradley Thomas Sherwin, 62, of Everton Hills, Queensland, appeared in the Brisbane District Court, and pleaded guilty to:
<ul>
<li>twenty four counts of dishonestly causing a detriment between May 2009 and December 2012 to the value of nearly $10 million to a number of clients of Sherwin Financial Planners; and</li>
<li>one count of dishonestly breaching his duties as a director of Wickham Securities Limited between June 2010 and October 2010.</li>
</ul>
Mr Sherwin will be sentenced on 14 November 2017.  Mr Sherwin did not apply for bail and was remanded in custody.
The Commonwealth Director of Public Prosecutions is prosecuting the matter.
Wickham Securities collapsed in December 2012, owing more than $27 million to approximately 300 debenture holders. 
Sherwin Financial Planners and other companies of which Mr Sherwin was a director collapsed in January 2013, owing more than $30 million to clients of Sherwin Financial Planners.
In May 2016, ASIC permanently banned Mr Sherwin from providing financial services.
In September 2016, the former Chief Executive Officer of Wickham Securities, Garth Peter Robertson, was sentenced to 5 years imprisonment after pleading guilty to various charged brought by ASIC, including fraud.
In June 2013, ASIC cancelled the registration of the auditor of Wickham Securities, Brian Kingston, after forming the view he failed to carry out or perform adequately and properly the duties of an auditor.

Principal of Sherwin Financial Planners pleads guilty to fraud

ASIC has disqualified Ross Russo of New South Wales from being an approved self-managed superannuation fund (SMSF) auditor.
ASIC determined that Mr Russo had breached fundamental independence and audit requirements.
Given the nature of these breaches, it was considered appropriate to disqualify Mr Russo.
ASIC found that Mr Russo had breached:
<ul>
<li>auditor independence requirements of APES 110 Code of Ethics for Professional Accountants, where he audited the fund of a close family member;</li>
<li>audit evidence requirements of Australian auditing standards.　</li>
</ul>
ASIC Commissioner John Price said, “SMSF auditors play a fundamental role in promoting confidence in the SMSF sector so it is crucial that they adhere to ethical and professional standards. ASIC will continue to take action where the conduct of SMSF auditors is inadequate.”
SMSF trustees and members can check whether their auditor is registered, or whether a person has been disqualified, by searching ASIC's SMSF auditor register at <a href="https://www.propertyobserver.com.au/connectonline.asic.gov.au" target="_blank">connectonline.asic.gov.au</a>
Information about Mr Russo was referred to ASIC by the Australian Taxation Office (ATO) under section 128P of the Superannuation Industry (Supervision) Act 1993 (the SIS Act).
From 1 July 2013, the SIS Act required all auditors of SMSFs to be registered with ASIC.
This was to ensure that all SMSF auditors meet the base standards of competency and expertise.
ASIC and the ATO work closely together as co-regulators of SMSF auditors.
The ATO monitors SMSF auditor conduct and may refer matters to ASIC for possible action such as disqualification or suspension of their registration.

SMSF auditor disqualified by ASIC

ASIC has permanently banned former financial adviser Neil Bruce Trower from providing any financial services.
Mr Trower is a former representative of Millennium 3 Financial Services Pty Ltd (M3), and a former employee of Lifestyle Financial Services (Qld) Pty Ltd a corporate representative of M3, who provided risk advice from the outer Brisbane suburb of Cashmere.
M3 is the holder of an Australian financial services licence and is ultimately owned by Australia and New Zealand Banking Group Limited (ANZ).
ASIC found that between August 2015 and December 2015, Mr Trower had:
<ul>
<li>not complied with a financial services law by failing to give a number of his clients a Statement of Advice, as required, at the time he provided them with oral financial advice; and</li>
<li>applied the signatures of a number of clients to both internal and external documents for the purpose of passing an internal compliance audit.</li>
</ul>
Further, ASIC found Mr Trower's conduct to be dishonest, as he did not tell the affected clients that he had applied their signatures to documents.
He submitted these documents to the internal audit team knowing that the team would rely on the documents as being genuine during the conduct of the audit.
The M3 audit team identified the signature irregularities during an internal audit of Mr Trower's files and reported them to ASIC.
ASIC Deputy Chairman Peter Kell said, "Certain compliance requirements are in place for advisers to ensure they are meeting their obligations to clients, and to ensure they act honestly and with integrity.
"Anyone whose conduct falls short of these standards will be removed from the financial services industry."
Mr Trower has the right to appeal to the Administrative Appeals Tribunal for a review of ASIC's decision.
The banning of Mr Trower is part of ASIC's Wealth Management Project. The Wealth Management Project was established in October 2014 to lift the standards of major financial advice providers.
The Wealth Management Project focuses on the conduct of the largest financial advice firms (NAB, Westpac, CBA, ANZ, Macquarie and AMP).
ASIC's work in the Wealth Management Project covers a number of areas including:
<ul>
<li>working with the largest financial advice firms to address the identification and remediation of non-compliant advice; and</li>
<li>seeking regulatory outcomes, where appropriate, against licensees and advisers.</li>
</ul>
As part of its Wealth Management Project, ASIC has banned 38 advisers from the financial services industry.
Two adviser bannings are the subject of appeals.

ASIC bans former Cashmere, Brisbane financial adviser over fake signatures

Jana Jaros and Jackson Laurence Malcolm Capper have appeared in the Southport Magistrates Court on charges of operating an unlicensed financial services business following an ASIC investigation.
ASIC documents state Ms Jaros and Mr Capper have been charged under section 911A of the Corporations Act for allegedly aiding and abetting Astra Group Pty Ltd and Old Cambridge Pty Ltd to carry on a financial services business without holding an Australian Financial Services licence.
They also face two charges each under section 1308(2) of the Corporations Act for lodging with ASIC documents containing false or misleading material.
Providing assistance to operate an unlicensed financial services business carries a potential maximum penalty of $36,000 or two years' imprisonment or both, while providing false or misleading documents carries a maximum penalty of $36,000 or five years' imprisonment or both.
This matter is being prosecuted by the Commonwealth Director of Public Prosecutions.
Ms Jaros and Mr Capper appeared on 7 August 2017. The matter was adjourned until 4 September 2017.
Background
ASIC alleges that Ms Jaros and Mr Caper set up the websites www.investradirect.com and later www.investradirect.co to attract and service clients of Astra Group Pty Ltd and Old Cambridge Pty Ltd.

Operators of unlicensed Gold Coast financial services business charged

Nicholas Ellis, an accountant and former financial adviser from Valentine, New South Wales, has pleaded guilty in the Downing Centre District Court in Sydney to two charges of making false or misleading statements to obtain money from clients and fraudulent misappropriation of client funds, respectively.
Following an ASIC investigation, Mr Ellis admitted that between about 23 March 2009 and about 18 July 2009 he:
- sent 10 letters and one email to a number of his clients for the purpose of raising investment funds from them to purchase a hotel in Tura, New South Wales through his company, Tura Pty Limited. The letters and email contained false and misleading statements in relation to the purchase of the hotel
- he fraudulently misappropriated over $500,000 of client funds received by Tura Pty Limited for his own purposes.
The Commonwealth Director of Public Prosecutions is prosecuting the matter.
Mr Ellis pleaded guilty to the charges on 4 August 2017. The matter has been set down for a sentence hearing at the NSW District Court on 26 April 2018.
ASIC banned Mr Ellis in 2013 from providing financial services for a period of 6 years for other conduct

Valentine accountant pleads guilty to fraudulent misappropriation in client Tura hotel deal

ASIC has brought two charges against Mr Shane Thompson, of New Gisborne, Victoria, has appeared in the Bendigo Magistrates' Court on two charges brought by ASIC that he forged financial planning documents.
ASIC alleges that between 27 December 2012 and 1 March 2013, Mr Thompson completed 22 false client change of adviser forms and submitted them to MLC Ltd to transfer National Australia Bank (NAB) clients to his personal financial planning client list.
ASIC alleges that Mr Thompson forged client signatures on each form and undertook this process without clients' knowledge or authorisation so that he could receive additional financial planning remuneration from his employer, the NAB.
At a hearing on 31 July 2017, the matter was adjourned for a plea hearing in the Melbourne Magistrates Court on 26 October 2017.
The Commonwealth Director of Public Prosecutions (CDPP) is prosecuting the matter.
<h2>Background</h2>
Mr Thompson was employed by the NAB as a financial planner during the time the alleged misconduct took place.
Mr Thompson has been charged under sections 83A(1) and 83A(2) of the Crimes Act 1958 (Vic). The maximum penalty for each offence is ten years imprisonment.
ASIC has previously banned Mr Thompson from providing financial services and credit activities for seven years.
Wealth Management Project
This outcome is a result of ASIC's Wealth Management Project. The Wealth Management Project was established in October 2014 with the objective of lifting standards by major financial advice providers. The Wealth Management Project focuses on the conduct of the largest financial advice firms (NAB, Westpac, CBA, ANZ, AMP and Macquarie).
ASIC's work in the Wealth Management Project covers a number of areas including:
<ul>
<li>working with the largest financial advice firms to address the identification and remediation of non-compliant advice; and</li>
<li>seeking regulatory outcomes when appropriate against licensees and advisers.</li>
</ul>
As part of its Wealth Management Project, ASIC has banned 35 advisers from the financial services industry (two advisers have current appeals before the Administrative Appeals Tribunal).

Former NAB adviser charged with forging documents

ASIC has started legal action in the Federal Court in Melbourne to wind up a land banking scheme known as the Realestate Equity Investment Trust (REIT) and an associated company, Timeline Project Management Pty Ltd (Timeline).
The REIT scheme owns land located at Flinders Avenue in Lara, Victoria.
ASIC understands that at least 82 investors have invested a total of at least $800,000 into the REIT scheme and that, since 2013, investors have been making payments in respect of their investment to Timeline.
Lotus Pty Ltd (in liquidation) was the responsible entity which managed the REIT scheme until 21 September 2016 at which time its Australian financial services licence was cancelled by ASIC for various compliance breaches.
It was placed into liquidation on 14 December 2016, on the application of a creditor.
ASIC alleges that REIT is operating as a managed investment scheme in circumstances where it has no responsible entity and no reasonable prospects of obtaining one.
The matter is listed for hearing at the Federal Court in Melbourne on 4 August, 2017 at 9.30am.
These proceedings are part of ASIC's wider and ongoing investigation into land banking schemes.
1. What steps has ASIC taken?
Following an investigation, ASIC started proceedings on 25 July, 2017 in the Federal Court of Australia to wind up:
<ul>
<li>Realestate Equity Investment Trust (ARSN 094 623 515) (REIT), and</li>
<li>Timeline Project Management Pty Ltd (ACN 145 830 851) (Timeline).</li>
</ul>
If ASIC's application is successful then liquidators will be appointed to REIT and Timeline.
2. Why did ASIC issue the proceedings?
REIT is a land banking scheme which owns land at 490 Flinders Avenue, Lara, Victoria, which was intended to be rezoned and developed.
ASIC understands that at least 82 investors have invested at least $800,000 in the REIT scheme.
Lotus Securities Pty Ltd (Lotus) was the former responsible entity of REIT.
On 21 September 2016, ASIC cancelled the Australian financial services license (AFSL) of Lotus due to a number of compliance concerns including failure to lodge financial statements for Lotus (for the years 2014 onwards) and REIT (for the years 2012 onwards). 
Lotus was not permitted to act as a responsible entity following the cancellation of its AFSL and no new responsible entity has been appointed.
Lotus is now in liquidation, having been wound up by the Court on 14 December 2016, on application by a creditor. 
ASIC understands that, since June 2013, investors have been making payments in respect of their investment to a bank account in the name of Timeline.
Timeline is not (and has never been) the responsible entity of REIT.
ASIC commenced these current proceedings to protect the interests of investors in the REIT scheme given ASIC’s allegations in the proceedings that, amongst other matters:
<ul>
<li>REIT has been operating despite it not having a validly appointed responsible entity as required under the Corporations Act 2001 (Cth) (the Act)</li>
<li>the REIT scheme appears to be unviable given that there has been no progress in developing the real estate investments of the fund since the initial fundraising</li>
<li>financial statements for REIT have not been prepared or lodged with ASIC since 2012, and</li>
<li>the interests of investors appear to be prejudiced due to the fact that they are still paying monies apparently into the scheme via a bank account held by Timeline.</li>
</ul>
3. What orders does ASIC want the Court to make?
ASIC is seeking orders from the Court to wind up, and to appoint liquidators to, each of REIT and Timeline.
The application is listed before the Court on 4 August, 2017.
4. Will investors get a refund?
ASIC is not seeking compensation or refunds for investors in these proceedings. 
However, if the Court orders the winding up of REIT and Timeline there may be a return to creditors as part of the liquidation process.
The realisation of assets and any distribution to investors will be undertaken by the liquidators appointed by the Court.
5. What rights do investors have?
ASIC is unable to advise investors as to any rights that they may have in relation to ASIC's application.
If investors wish to be represented at the hearing of ASIC's application, then they should seek legal advice.
Investors may also wish to seek independent legal and/or financial advice in relation to their investment in the REIT scheme.
