When buying a property – be it a detached dwelling or an <a href="/developments">off-the-plan</a> apartment, it’s essential to make sure you have your legal documents drawn up correctly. Which is why getting legal advice early in the process is so important. 

Here’s what a sound off-the-plan contract should include: 

<h2>A reasonable cooling-off period</h2>

The cooling-off period affords the buyer time to change their mind. Once this period ends, the buyer is legally bound to buy the property. 

In NSW, new legal protections (which came into effect in December 2019) give buyers a 10-business day cooling-off period. This period is longer than the usual five business days for most properties. Buyers who change their mind will forfeit 0.25% of the purchase price. The cooling-off period can be waived or shortened, but only if the buyer’s lawyer or <a href="/guides/a-new-step-by-step-home-buyer-checklist-for-2020-post-covid-19">conveyancer</a> provides a certificate to prove the buyer understands the consequences of varying the cooling-off period. This helps protect the buyer from exploitation. 

Make sure the cooling-off period in your contract is reasonable and in line with the legislation in your state. If the seller asks to shorten or waive it, give this a serious consideration first and talk to your lawyer or conveyancer about whether this is a good idea. 

<h2>The disclosure of key information by the developer</h2>

Your off-the-plan contract must include <a href="/news/everything-you-need-to-know-about-australias-25-000-homebuilder-grant-how-much-off-the-plan-homebuyers-could-save">key information about the project</a> such as proposed plans and specifications, a floor plan, a detailed list of fixtures and finishes, sunset clause dates, other conditional events, and draft by-laws.

Before signing the contract, ensure you have a thorough understanding of the plans and are satisfied with the level of disclosure. Make sure you have asked questions if you’re confused about anything listed in the plans. 

Remember that developers will almost always have a right to alter their plans, within reason, to complete the project. Make sure your conveyancer reviews the contract to make sure enough information has been disclosed and that only reasonable alterations are permitted. 

<h2>The ability to withdraw or be compensated if significant alterations take place</h2>

While the contract will require the property to be constructed in accordance with what is disclosed in the contract, developers usually have the right to alter things in certain circumstances. Those changes must be delivered at the same quality and must not materially prejudice the buyer. 

To mitigate the risk of the <a href="/news/why-is-design-important-is-bigger-better-a-developer-s-perspective">developer making alterations</a> which substantially change the quality of the project and disadvantage the buyer, the contract should be very clear on warranties and inclusions. It should also give the buyer the right to withdraw and have the deposit returned to them or claim compensation. 

In NSW, for contracts entered into from 1 December 2019, vendors must notify purchasers of changes outside of what was disclosed, and which will adversely affect the use or enjoyment of the lot being purchased. Make sure you seek legal advice on the rules in your state. 

<h2>Other things to consider:</h2>

Building/apartment defects 

Other parts of the contract that require <a href="/guides">close review</a> include how defects are treated. Ideally, it will be up to the developer to remedy defects prior to settlement. Your lawyer and conveyancer should review your contract to make sure you are protected. 

Deposits

You should also have a look at the rules in your state on who holds your <a href="/expert-insights/buying/build-your-deposits-to-grow-a-large-investment-portfolio">deposit</a>. In NSW, for example, deposits are held by the stakeholder (usually the real estate agent) and that money cannot be released to the developer before settlement. That protects the buyer in the event the developer becomes insolvent. 

Sunset clauses 

A <a href="/guides">sunset clause</a> provides a deadline whereby if the property has not been completed in time then the potential buyer’s deposit is refunded, and the contract is cancelled. The problem is that the clause has been exploited by developers who were delaying completion of projects in order to cancel contracts and re-sell properties at a higher price in a rising market. 

In NSW, new legislation has been introduced which requires that developers seek the buyers’ consent before ending contracts using the sunset clause. Alternatively, the developer will need to apply to the NSW Supreme Court to justify terminating the contracts. Seek advice from your lawyer or conveyancer on the sunset clause in your contract and the rules in your state. 

For both property investors and potential new homeowners, the <a href="/guides">concept of buying off-the-plan</a> is enticing due to its affordability and flexibility compared to buying an already existing property. However, it is important that you take all these considerations into account and seek legal/conveyancing advice before you sign the contract of your future home or investment property.

Sign with confidence: How to ensure you have a sound off-the-plan contract

Almost 2 months ago the property industry was abuzz with talk of the <a href="/expert-insights/buying/why-axing-stamp-duty-will-help-everyone">removal of stamp duty</a> on property transactions. The NSW Treasurer announced he was seriously contemplating such a move and was being advised by a high-powered advisory board. At the time, no one asked the obvious question – when has any Government voluntarily given up such a significant revenue contributor without replacing it with another way to collect the same amount (if not more) revenue or relying on bracket creep? I cannot recall one time in the last 30 years.

On the 20th anniversary, David Thodey and the NSW Treasurer did a song and dance routine at the <a href="https://www.smh.com.au/politics/federal/nsw-calls-on-other-states-to-back-recession-busting-gst-plan-20200701-p55820?ref=rss&amp;utm_medium=rss&amp;utm_source=rss_feed">National Press Club</a> calling on a broad-based land tax amongst other things.

When you view the public statements since then, it now makes perfect sense.

Since the initial announcement, we have seen numerous kites being flown. The first one in the air was a <a href="https://www.parliament.nsw.gov.au/committees/DBAssets/InquiryOther/Transcript/8810/Additional%20information%20Tenants'%20Union%20of%20NSW%20Land%20tax.pdf">broad-based land tax.</a> From a pure public policy perspective, this isn't such a bad idea and has been around since the late 1800s. There’s only one issue, and that is that in New South Wales there is an unimproved capital valuation regime for all properties – so valuations only relate to land and not improvements. Hence, as it relates to the land alone, a whole range of economic distortions will emerge. 

In addition, when all things are considered a broad-based land tax under the current conditions have the impact of increasing <a href="/guides/top-10-hidden-costs-of-buying-a-house-or-apartment-in-2021">Council rates </a>(it would be levied on a rather similar basis). Raising $9 billion per annum from a broad-based land tax could have the impact of almost doubling local rates.

Other questions also emerge such as, should homeowners that have already paid stamp duty still be liable for new broad-based land tax? If they are liable, then they are being double-taxed – if they are not, the imposition of the new tax may have a lock-in effect and reduce potential revenue collections.

The ACT has started a program to replace stamp duty with a broad-based land tax. The ACT has no private ownership of land and has a 99-year leasehold. The Government is largely responsible for land release and its population is about the size of the Northern Beaches of Sydney. Sure, lessons should be learned but differences should be acknowledged.

By far the scariest proposals are betterment taxes and value capture. This has been the topic du jour of the Sydney Morning Herald (SMH). Many Government agencies are enticed by the prospect of capturing the uplift created by a pen stroke without taking any risk. The SMH reported that the Government could <a href="https://www.smh.com.au/national/nsw/value-capture-adored-by-academics-and-despised-by-developers-its-time-may-have-finally-come-20200604-p54zch">capture 75% of the value uplift.</a> Such methods of taxation are lauded as international best practice. What they fail to mention, is the contention surrounding the drawing of tax increment financing boundaries and the community division it creates in the United States. They also fail to mention the small contributions to the <a href="https://www.crossrail.co.uk/">CrossRail project</a> from value capture as it also included reimbursements for value decrement. Admittedly, value capture did work rather well in Hong Kong with the development of the <a href="http://www.mtr.com.hk/en/customer/tourist/index.php">Mass Transit Railway (MTR)</a> but that was for a discrete and continuous piece of infrastructure where value could be clearly demonstrated.

You don’t replace one <a href="/expert-insights/buying/what-do-we-want-stamp-duty-changes-when-do-we-want-them-now">distortionary tax </a>(stamp duty) with another distortionary tax. There are pros and cons of all proposals. But the trick will be in the design. A broad-based land tax appears the best way to go but it should be levied on the improved capital value of land.  This will incorporate elements of all the taxes discussed and will tax the marginal improvement in value throughout the lifecycle of the development. There is far more work needed by policymakers before we accept the removal of stamp duty as a Trojan Horse.

Beware of Politicians Bearing Gifts – Let’s Start the Stamp Duty Discussion

If you’re a first home buyer at the moment, then you will have noticed the Governments, Federal and State, seem to just want to <a href="/expert-insights/buying/home-building-grant-to-benefit-affordable-areas-and-first-timers">throw money at you </a>to try and help you get into that first home.  You’ve got to love that.  Let’s have a brief look at what the offerings are and how they can assist.

There are essentially four different offers available:

<ol>
<li>First Home Buyer Duty Exemption or Concession</li>
	<li>First Home Owner Grant (FHOG)</li>
	<li>First Home Loan Deposit Scheme</li>
	<li>Homebuilder </li>
</ol>
Please note that I’m looking at this from a Victorian perspective, so things may be different in other states.

The first three apply only to first home buyers, while the fourth is applicable to anyone that meets the criteria.

The <a href="https://www.sro.vic.gov.au/fhbduty">First Home Buyer Duty Exemption or Concession</a> relates to the purchase of either a new or existing property as a first home to owner occupy and live in.  If you qualify for this and the property you purchase has a value of $600,000 or less (technically the ‘<a href="https://www.sro.vic.gov.au/dutiable-value#:~:text=Dutiable%20value%20is%20the%20price,market%20value%20of%20the%20property.">Dutiable Value</a>’ to be $600,000 or less) then you will receive the first home buyer duty exemption, or if the value is between $600,001 to $750,000 you will receive the first home buyer duty concession.  This relates to the stamp duty normally charged on the purchase transaction.  In the case of the exemption, you don’t pay any stamp duty, while in the case of the concession, you pay a reduced rate of the stamp duty.  

The <a href="http://www.firsthome.gov.au/">First Home Buyer Grant </a>is applicable only to new homes.  That is if you are building your own home, or are purchasing a home that is being offered for sale for the first time, as well as <a href="/new-apartments">off the plan </a>purchases.  In this instance, in Victoria, you can receive $10,000 or, if the property is in regional Victoria, $20,000.  The property involved, however, has to be valued at $750,000 or less.

The <a href="https://www.nhfic.gov.au/what-we-do/fhlds/">First Home Loan Deposit Scheme</a> is a little different in that its aimed to reduce the amount of funds contribution required by home loan applicants in order to pass the Bank's credit criteria to obtain the loan. How this works is that the Government pays the Lenders Mortgage Insurance (LMI) premium normally associated with borrowing over 80% of the properties value.  There are still certain criteria applicants must meet, property value again being one of them, but this time it is based on postcode, and the criteria now include your level of income as well.  Not all lenders are participating in this scheme either but if it works for you then you can save several thousand dollars on the LMI premium.  

<a href="https://treasury.gov.au/coronavirus/homebuilder">Homebuilder</a> is the latest offering from the Federal Government to help the construction industry during the current COVID-19 situation.  This sees a grant of $25,000 available to any eligible applicants ( not restricted to first home buyers ) to go towards either construction of a new home, including off the plan purchasers, or for a significant renovation of an existing home.  Again there are certain criteria applicants must meet, and for now, at least it appears to only be a short term offer.  Any build contract must be signed before the end of the year and construction must commence within three months of the date of the contract. 

In the case of the first three, all the eligibility criteria are determined prior to <a href="/guides">settlement</a> and so the applicable grant amounts can be factored into the equation so that the loan amount applied for is for the correct amount, however, the Homebuilder scheme is proving a bit more problematic in its current form for the Banks.  Only because final eligibility is determined based on if the construction starts within three months of the contract being signed.  Which means that at the time of loan application, we can’t be certain that the $25,000 will actually be received.  This requires that the initial loan applications will need to be assessed for the full amount. 

In addition, you may still be eligible for the FHOG if you or your spouse/partner purchased a property on or after the 1st of July 2000 and have not lived there as your home.

Additionally, to receive the FHOG at least one applicant must:

<ul>
<li>Must occupy the home as their principal place of residence (PPR) for at least 12 months, commencing within 12 months of settlement or completion of construction.</li>
	<li>Be aged 18 or over (discretionary).</li>
	<li>Be an Australian citizen or permanent resident.</li>
	<li>In the case of the purchase of a new home - as at the date on which the applicant/s become entitled to possession of the home under the contract, which generally occurs on the date of settlement.</li>
	<li>And finally, in the case of entering into a comprehensive building contract - as at the date on which the building is ready for occupation as a place of residence, which generally occurs when construction of the home is finished.</li>
</ul>
On a final note, trying to make sense of it all can be a little daunting so it is always a good idea to have an in-depth discussion with your lender or broker to make sure you fit the <a href="/expert-insights/buying/the-time-has-come-for-first-home-owners-to-join-the-property-ladder">eligibility criteria for some, or all of these offers </a>so you can take advantage of them while they are still available.

Negotiations for strategically placed properties are much tougher than they were with more buyers competing over a low volume of listings.

During the peak of the <a href="/expert-insights/buying/how-will-the-coronavirus-impact-australia-s-property-market">coronavirus pandemic</a>, we remained active in middle-ring locations that offer houses around the $400,000 to $500,000 mark, and mostly had the pick of the crop. Now, listings are still constrained, but the number of active buyers has surged two- to three-fold compared to March and April. In fact, we have seen up to 30 groups going through just one open home because of the lack of stock with <a href="/guides/how-to-buy-a-house-in-2021-a-guide-for-first-time-home-buyers">first home buyers </a>and owner-occupiers as the most common buyer type. 

This state of play is reflected in the latest data and analysis by the Real Estate Institute of Queensland (REIQ). The <a href="https://www.reiq.com/whitepapers/queensland-market-monitor/">REIQ’s Queensland Market Monitor </a>(QMM), released on Friday, found that the Sunshine State property market was in fine shape during the first three months of the year. According to the QMM, Brisbane’s median house price increased 0.7% over the March quarter and had strengthened by 1.5% over the year ending in March as well. Greater Brisbane’s market – including the Logan, Moreton Bay, Ipswich, and Redlands regions – was also performing well, posting median house price growth of 1% over the year as well. Temporary pause 
Local experts interviewed for the analysis say the Brisbane market, as well as all other major markets, took a breather in April as peak virus uncertainty hit the state. However, by May, green shoots of confidence and improved consumer sentiment had started to appear. This market resurgence continued into June, which is what we are currently witnessing on the ground in Brisbane.

It seems that owner-occupiers and first home buyers with the means to purchase are attempting to do so. First-time buyers, in particular, are active in those suburbs that still have affordable <a href="/guides/how-to-invest-in-property-in-2020-the-ultimate-guide">investment-grade </a>housing.

A few months ago, when asked by the media how the Brisbane market was faring, I said properties were achieving their listing prices but there wasn’t the fight from buyers to push prices much higher. Fast forward a few months, though, and that situation has started to change, mostly because of the continued reduced stock levels.

<a href="https://www.corelogic.com.au/research/monthly-indices">CoreLogic’s Home Value Index</a> found that median house values in Brisbane stayed stable in June and had increased by 1.9% since the start of the year – a result superior to Melbourne over the same period.

But I wouldn’t say it’s a seller’s market by any stretch.

That’s because, while there are definitely more buyers out there, most of them don’t seem to have any sense of urgency. Mostly, because they believe there will be a significant property price slump come September when the <a href="https://www.ato.gov.au/general/jobkeeper-payment/">JobKeeper</a> payments are wound back as well as mortgage repayment pauses.

Long-term focus 
Personally and professionally, I don’t believe the Brisbane market will experience any major impact from the ending of these initiatives.

Lenders will not want a flood of mortgagee sales for starters, so they will work with customers experiencing financial distress to prevent such a thing happening by extending repayment holidays or reductions.

That said, it is almost a moot point because savvy property buyers and investors always purchase when <a href="/news/debunking-the-bad-market-myth">conditions</a> are right for them, including when there are market opportunities. They also understand that to create property wealth, they need to hold their investment properties for the long-term, so it is irrelevant to them what may or may not happen in September.

With interest rates so low, and with a reduced volume of buyers compared to the average currently in the market, there has never been a better time to secure a holding in Brisbane in my opinion.

Not only does the sunshine state capital offer affordable house prices, but rental yields are also usually much higher than in southern states.

Thus, I’m picking that interstate migration into Queensland will start to soar once borders are reopened as more people opt to <a href="/guides/covid-19-how-to-adapt-to-working-from-home">work from home</a> from one of the most beautiful places in the world.

Looking ahead, the ABS predicts that average life expectancy will be 92 for males and 95 for females by 2050. Since the mid-1960s, the household has also reduced from 3.4 to 2.4 persons. This 40% decrease is because Australians are choosing to remain single for longer, marrying, partnering and having children later in life, and unfortunately, divorce and separation continues to rise. For example, <a href="https://www.abs.gov.au/websitedbs/censushome.nsf/home/historicaldata?opendocument">ABS statistics from 1986 to 2006 r</a>evealed that one parent households rose by 120% and single households were up 80%.  

Population growth 

Australia has one of the <a href="/news/new-housing-development-aims-to-cater-to-significant-population-growth-anticipated-for-geelong">highest population growth rates</a> in the developed world. This is mostly due to our high immigration rate. 

And while there is a temporary hold on migration, once the borders are open this growth is set to continue as Australia continues to prove it is one of the safest and best places to live in the world. The ABS predicts that Australia’s population to rise to between 36.8 million and 48.3 million in 2061, reaching as high as 70 million by 2101.

Consider this simplified forecasting - Australia will have 16.5 million more people by 2061 and, based on the average household size of 2.4 persons, we’re looking at around 156,000 extra dwellings each year, on top of the existing national housing shortage of 250,000!

Is now a good time to buy property? 

History has repeatedly shown that property is very resilient to economic shocks as well as continues to hold its value and grow irrespective of <a href="/expert-insights/buying/covid-19-and-the-pathway-forward-for-property">unemployment levels</a> and negative economic growth. The after-effects of COVID-19 will be no different. 

In fact, current market conditions create a rare window of opportunity to secure <a href="/developments">good-quality properties </a>before the combined impact of continued share market volatility, historically low-interest rates and Australian dollar. In addition, massive government stimulus tips confidence and growing demand back into the property market including high-quality properties in scarce locations continue to rise in value. Rising above the heritage-listed Eliza Tinsley building, the development reflects a broader shift toward adaptive reuse in the city, where historical assets are retained and reinterpreted as part of new residential development.

Designed by <a href="https://www.urban.com.au/architects/rothelowman">Rothelowman</a>, <a href="https://www.apartments.com.au/new-apartments/640-bourke-street-melbourne-640-bourke-street-melbourne-vic-3000">640 Bourke Street</a> incorporates the Eliza Tinsley building as its foundation, housing a grand gallery and lobby space that serve as both a functional and symbolic centrepiece. The heritage façade informs the tower’s design, creating a connection between Melbourne’s past and its contemporary skyline.

"It's a significant asset and wants to be celebrated and experienced by all residents every single time they go in and out of the building," Rothelowman Principal Stuart Marsland said.

Above this historic base, the 68-storey tower will deliver just over 600 residences, a notable reduction from earlier schemes, reflecting a deliberate move toward larger-format apartments and a stronger owner-occupier focus.

Unlike traditional CBD developments that prioritised investor stock, 640 Bourke Street has been repositioned to respond to changing buyer expectations.

"The discussion was all around making 640 Bourke Street the best residence to live in, to be much more focused on the people in the building rather than people looking at the building," Marsland explained.&nbsp;

This shift is evident in the development’s interiors, which emphasise practical luxury with spacious layouts, high ceilings, and floor-to-ceiling windows framing sweeping views of Melbourne and Port Phillip Bay.&nbsp;

“What it's meant for 640 Bourke is we've actually reduced the number of apartments. We've increased the overall size of the apartments. We don't have any studios in here, and what that does for a project is it elevates it," Lauren Sheldon, Far East Consortium’s Director of Sales and Marketing, said.&nbsp;

Rothelowman Associate Jun Chang added, "We were given the opportunity to be more generous. The apartments became bigger and squarer than any other apartments which had been designed in the CBD before that."&nbsp;

Amenities spanning more than 3,000 sqm across multiple levels further reinforce this focus on resident experience. These include a pool, gym, co-working areas, and a range of hospitality-inspired spaces such as a whisky lounge, library, and private dining rooms, many drawing reference from traditional bathhouses and Melbourne’s laneway culture.

"We wanted to make both the pool and the gym area to be absolutely destinational, and when you traverse across to these spaces, there is a gentle familiarity to the beautiful notions of the hammams and the Roman baths, a gentle nod to history," Chang noted.

At street level, the project contributes to the ongoing transformation of the western CBD, with upgrades to Langs Lane and the introduction of retail, hospitality, and gallery spaces designed to activate the precinct and strengthen its connection to the surrounding city fabric.

Heritage-led design anchors Far East Consortium’s 640 Bourke St, Melbourne

<a href="https://www.apartments.com.au/developers/mayd-group">MAYD Group</a> has set a new residential price record in Queensland with the $30 million sale of the penthouse at its <a href="https://www.apartments.com.au/new-apartments/one-burleigh-88-the-esplanade-burleigh-heads-qld-4220">ONE Burleigh</a> development in Burleigh Heads.

The sale equates to around $37,500 per sqm.

The two-level, 800 sqm penthouse, featuring five bedrooms, five bathrooms, five car spaces, and a private infinity pool overlooking the Pacific Ocean, was acquired by a Gold Coast-based entrepreneur, highlighting continued demand for ultra-premium beachfront product.

Selling agent Freddie Tehle of PRD Burleigh Heads said the result reflects tightening supply of high-quality, large-format apartments in Burleigh.

“There’s very limited opportunity to secure this level of scale and absolute beachfront position in <a href="https://www.apartments.com.au/developments/burleigh-heads-qld-4220">Burleigh Heads</a>,” Tehle said.

“Buyers are increasingly seeking apartments that genuinely replace a standalone home, and this penthouse delivers that with its size, privacy, and direct ocean frontage.”

The sale comes as construction progresses on ONE Burleigh, a boutique development of 17 full-floor residences at 88 The Esplanade, scheduled for completion in early 2027.

Interior designer Sici Design said the approach was to reflect the project’s coastal setting through both materiality and spatial planning.

The project occupies a southern Esplanade site with uninterrupted beachfront frontage, an increasingly rare offering in Burleigh Heads, free from the Norfolk Pines that line much of the coastline and often limit direct ocean outlook.

Mould said the design intent was to balance that outlook with a sense of retreat.

MAYD Group sets Queensland record with $30 million penthouse sale at ONE Burleigh in Burleigh Heads

Apartment developers in the Gold Coast are finding new, creative ways to differentiate themselves from competing projects, as new supply starts to flow through up and down the Coast.

Developer BIG Projects brought in the renowned Sydney-based design studio YSG Studio to craft the interiors for The Frederick, BIG Projects' new Mermaid Beach project and YSG Studio's first move into the multi-residential development space.

It was a strategic move for BIG Projects to bring in a Sydney eye to the development.

“Our role is to give our design partners the space and freedom to explore,” says Matt Barrett, Director of BIG Projects.

“We wanted YSG Studio to capture the essence of Nobby’s, to design a building that embraces life, light and connection, while creating a genuine sense of place.”

There are only 39 apartments in The Frederick, including a striking beach house, just 100 metres from the booming Nobby Beach precinct.&nbsp;

Yasmine Ghoniem, Director of YSG Studio, says their vision&nbsp;for The Frederick "reinvents coastal living."

A standout feature of The Frederick is its rooftop terrace, an uncommon inclusion for a boutique, low-rise building, where amenity is typically concentrated at ground level.

Positioned to capture panoramic views from the hinterland to the ocean, the rooftop has been designed as a series of intimate zones. It includes a pool, sauna, sun decks, workspaces and dedicated entertaining areas.

“The rooftop was conceived as a collection of spaces where residents can unwind and connect, an extension of the Nobby’s lifestyle,” Barrett says.

Architecture for the project was led by Plus Studio, with landscape design by LDG Landscape Architecture.

SRQ Projects Director Nick Clydsdale, who is handling sales at The Frederick, says the majority of enquiry is coming from South East QLD and Victorian buyers who have been actively searching between Broadbeach and Mermaid Beach for some time.

"They’ve reviewed a number of projects, however this one has stood out for its unique detailing and compelling design,"&nbsp;Clydsdale says.

Site demolition is slated for this month, with construction commencing soon after. BIG Projects is targeting a late 2027 completion.

Sydney’s YSG Studio makes Gold Coast multi-residential debut with BIG Projects at The Frederick

Melbourne-based property developer ALTA Property has this week achieved planning approval for the adaptive re-use of a former commercial tower into a $200 million, 169-apartment project at 10 Queens Road, one of the last developable sites along the Albert Park Lake-fronting boulevard.&nbsp;

Set within one of Melbourne’s most sought-after precincts and designed by <a href="https://www.apartments.com.au/architects/fraser-partners-0">Fraser and Partners</a>, the illustrious building will offer unparalleled views across Albert Park Lake, Port Phillip Bay and Melbourne CBD.&nbsp;

The mix of 1, 2 and 3-bedroom residences will be complemented by a ground-floor amenity featuring private dining, a lounge bar, gym and wellness spaces, co-working, outdoor communal gardens, and retail.&nbsp;

The 17-storey building is a masterclass in adaptive re-use, with the existing commercial building’s façade, shell and internal structure to be retained, before high-end residences are built from the ground up in a newly built Albert Park facing addition to the building.&nbsp;

Sitting atop the building will be two 320+sqm penthouses with private rooftop terraces, which are expected to be priced between $9 - $11 million.&nbsp;

Architecturally, the building will feature a curved, geometric façade that celebrates and elevates the existing structure, with warm, muted tones which were selected to extend the materiality of the existing building rather than contrast it.&nbsp;

Interiors will bring together three metre high ceilings with waffle concrete in some spaces, natural timber, granite and Australian materials, culminating in crafted, generous and considered spaces that are defined by authenticity.&nbsp;

The adaptive re-use means that the Queens Road project will be a sustainability led, high-quality finished product, with a 62% saving in carbon emissions by re-using the existing structure rather than knocking it down and rebuilding.&nbsp;

ALTA Property was launched by Nigel Givoni in 2023, bringing over 25 years of experience in multi level residential delivery.&nbsp;

Melbourne’s property market growth is currently led by apartments. According to RPM VIC Apartments &amp; Townhomes Market Report (April 2026), units are outpacing houses, especially in the middle ring suburbs where median prices hit $757,500 – a four-year high that represents 2.9 percent growth quarter-on-quarter.&nbsp;
